Following the recess, City Attorney John Wallace reviewed for the Board
the functions and role of the Board of Adjustment and also the Appearance
of Fairness Doctrine.
V-10-77 ' EDNA ANDERSON - Variance of 5' from required 60' lot width on two lots
at-117 - 9th Ave S. (RS-6)
Mrs. Block indicated this variance was in conjunction with a subdivision
approved in 1969. It had been approved subject to granting of a variance
for a lot width requirement on the two lots. There are two existing
houses which are quite old on the lots. Each lot is 6,600 sq. ft., 600
sq. ft. over the minimum requirement, so this is not a rezone. Mrs.
Block reviewed the criteria for a variance and noted that the two
existing houses were built prior to adoption of the City Subdivision Code.
She found the criteria to be met and recommended approval. The public
portion of the hearing was then opened.
Chet Bennett of 843 Bell St. represented Mrs. Anderson. Her daughter
was also present to answer any questions. Mr. Bennett said the subdivision
was approved in 1969 and Mrs. Anderson thought that was all that was
necessary. She sold the third lot involved in the subdivision and now
desired to sell one of the remaining two lots. When Mr. Bennett looked
into it he found it had not been followed through for the variance. He
said they only wanted to make this conform to what it should have been.
The public portion of the hearing was then closed.
Mr. Roy said he is well acquainted with the property and that he could
not see anything harmful or detrimental in this. MRS. -STOLE MOVED SECONDED

Mr. Hovde asked to be excused from this hearing as he is a personal
friend of the applicant. He left the rostrum but did not leave the
Council Chambers. Mrs. Block displayed the site plan and also showed
slides of the area. She said the applicant wanted to place a garage
at the top of a slope, and the consideration was topography, rather than
size or space of lot. She said it would not amount to a rezone and the
grade was very steep (16%) with a relatively level section just west of
the street. She said strict enforcement of the Code would not allow a
driveway grade of more than 1410. She said the height
restriction on the accessory buildings is 15' which should not interfere
with the views from across the street where the houses are on the uphill
side. firs. Block felt that granting of this variance would be compatible
with intent of the Code, and she recommended approval. The public portion
of the hearing was then opened.
Robert Boyd of 1231 Vista Way said his concern was not with the house
but he inquired about height restrictions and how the height of the house
is determined. City Attorney John Wallace explained that the current
Code requires that it be determined by the average of the four building
corners. The public portion of the hearing was then closed.
Mr. Roy stated that he thought this was as good a way to use the property
as is possible. Mrs. Stole indicated she thought it could have been
designed without going into the setback but, under the circumstances,
it was probably acceptable. Mr. Roy added that this is a very difficult
lot and lie has had experience building on such a grade. Ike said a steeper
driveway than is needed is a hazard and from the safety standpoint the
