Analysis: 1. Location. The subject site is located at 123 P Ave. S, within the Downtown Business (BD2) zone. The site is designated as Downtown Mixed Commercial in the Edmonds Comprehensive Plan and is also located within the Downtown/Waterfront Activity Center. The proposal is subject to the general criteria found in the sign code (ECDC 20.60) and the design guidelines within the Comprehensive Plan. 2. Sign type. The proposed wall -mounted and window signs are permitted sign types in the Downtown area, and the proposed monument sign is a conditionally permitted sign type if consistent with the standards of ECDC 20.60.020(M). It was found that all applicable standards of ECDC 20.60.020(M) related to the proposed monument sign have been met, as the sign is not over six feet in height. The site is permitted to have a total of three signs, excluding window signs. The two proposed wall - mounted signs and one proposed monument sign will account for a total of three signs, which is consistent with the maximum number of signs permitted for the site. 3. Size. Pursuant to ECDC 20.60.030(A), the maximum allowed sign area for the wall -mounted signs is one square foot per lineal foot of attached wall. Sign A is proposed to be 13.6 square feet, and the attached wall is indicated on the plans as being 68 feet in length. Sign B is proposed to be 13.6 square feet, and the attached wall is indicated on the plans as being 75'-51/2" in length. Thus, both proposed wall -mounted signs will comply with the maximum allowed area for each sign. Pursuant to Page 1 of 2 0 File No. BLD20100734 Union Bank - Sign Permit Application 123 Yd Ave. S ECDC 20.60.045(B), the maximum allowed area of freestanding signs in the BD2 zone for a single tenant is 32 square feet. The plans indicate that the sign face of Sign C is slightly less than 7' by 4'- 7" (thee frame of approximately 1" in width should not be included in the area calculations). Thus, the proposed area of Sign C is just under 32 square feet, which complies with the maximum allowed area for this sign. The maximum allowed total sign area for sites within the BD2 zone is one square foot per lineal foot of wall containing the main public entrance. The,plans from the original building permit for the existing building (BLD19840627) indicate that the southern fagade is 75'-51/2" in length, which yields a maximum total allowed sign area of 75.45 square feet. The length of this fagade was also verified and is indicated on the plans submitted by the applicant for the subject application. The total proposed sign area (Signs A, B, and C) is 59.2 square feet. Pursuant to ECDC 20.60.025(A)(3), window signs meeting the requirements of ECDC 20.60.035 do riot count against the total permanent sign area permitted. 4. Color. For all proposed signs, the logo is red and the letters of "Union Bank" are blue. The background of Sign C is white. The lettering for the window signs is white. It has been determined that these are acceptable colors for this site. 5. Height and Setbacks. Pursuant to ECDC 20.60.030(B), the maximum allowed height of wall - mounted signs within the BD2 zone is 14 feet or the height of the face of the building on which the sign is located (see additional restriction regarding height of internally illuminated signs below). Both proposed wall signs will be under 14 feet in height and are also under the height of the building fagade on which they are located. Pursuant to ECDC 20.60.045(D), the maximum allowed height of freestanding signs within the BD2 zone is 14 feet. The proposed monument sign is 6 feet in height, which complies with this requirement. The BD2 zone does not have a minimum required street setback. Thus, the proposed monument sign is not required to be set back from the property line, so long as its location is not determined to be a sight distance hazard by the Engineering Division. 6. Illumination. Internal illumination is conditionally permitted in the downtown area if consistent with the standards of ECDC 20.60.020(M). As such, internally illuminated signs in the downtown area must be mounted on the wall of the building and may only light the letters. Additionally, internally illuminated signs within the downtown area may not be higher than 14 feet: Thus, the two wall - mounted signs are permitted to be internally illuminated as proposed, but the monument sign is not permitted to be internally illuminated. The applicant submitted revised plans indicating external illumination of the monument sign, which is an allowed type of illumination in the downtown area. 7. Landscaping. Pursuant to ECDC 20.60.045(G), the proposed freestanding sign must have a landscaped area twice the size of the sign area at the base of the sign. The applicant submitted a landscape plan prepared by Pacific Landscape Inc. on January 21, 2011. This plan indicates a landscaped area of 150 square feet adjacent to the base of the sign meeting the requirement of ECDC 20.60.045(G). Decision: Based on the facts and conclusions of this report, staff finds that the design review for this .project (File No. BLD20100734) is APPROVED. No Comment .e 0 0 � Lyle Olmsted, identified earlier, wished to support the application by McDonald's. % He stated the original Dairy Queen was located at the intersection of Edmonds Way and Paradise Lane. He said he is aware of the problems that were outlined by Mr. Jaquish concerning traffic traveling by.the store without adequate signage. They had the same problem. In saying the golden arches do represent McDonald's, Mr. Olmsted agreed. He also stated he felt it was unfair to advise McDonald's they were legal during annexation and to tell them now that they are not. Mr. Olmsted emphasized that the City is either in the business of attracting businesses or the City is in the business of chasing them away. Mr. Pederson closed the hearing since no one wished to make any further comments. Mr. Herman said he did not.understand why the City would say the signs were alright and after annexation say they were not. Mr. Hintz suggested that it was not obvious at the time and that the City may have felt there was a five year amortization period. Mr. Herman asked if the business now had five years to conform. Mr. Tanaka explained that under the Code, in Section 17.40.040, "they can apply within six months following date of annexation to the Hearing Examiner for a specific amorti- zation period." Therefore, they have to comply, but within 6 months can apply for a time period to amortize the value of the sign over the loss they will suffer when they have to take it down. The Hearing Examiner may specify the time limit, he said, the Code imposes no Upper limit. Pat Nuxoll, manager of the McDonald's, said they were annexed 6 months ago and were told there was a sign problem approximately 6 weeks after annexation. She said, if they had known there was a problem with the signs, they would not have annexed. Mr. Jaquish stated McDonald's was one of the major factors in keeping the annexa- tion going. The annexation -is done by property value and must have a certain percen- tage of signatures based on property value. If McDonald's had not supported the UJ annexation, it would not have gone through. Ms. Nuxoll said there were 35 homes and the school, and the school could not be counted as part of the property. So the 35 homes did not equal McDonald's in value. LL Therefore, the 35 homeowners talked McDonald's into supporting the annexation. Natalie Shippen, previously identified, asked if any amortization period had expired, that is, the period in which one could ask for amortization. UJ Mr. Tanaka explained the Code specifies 6 months, and McDonald's said it had been about 6 months, so the period is either over or just about over, depending upon the exact date of the annexation ordinance. Ms. Shippen said the applicant should pur- sue that course. She said the City has the right to expect that ultimately all signs will comply, but when they comply does not matter, as long as there is some fixed period when the sign has served its value and needs to be changed. The amortization period provides individual treatment by the Hearing Examiner, she added, based on the worth and life left of the sign. She said there is discussion now ongoing concerning the Hwy 99 sign code and in relation to that the whole istion of how sign problems are solved, whether through grandfather, amortization, etc. If this is done on 99, there is no excuse for not doing it for other businesses that have sign problems. In response to questions from the Board, Mr. Tanaka said he did not know if the 6 months had expired, but from what Ms. Nuxoll said the time period was over. If that is true, they would appear to be outside the limit of this section. The appli- cant may make application to the Hearing Examiner and at that time the staff would look up the date and let them know whether they are within the time allowed, he said.. Mr, Tanaka added that it is the responsibility of the owner of a property to discover that there is a problem, the City does not have the responsibility: the ordinances are available for everyone to read, MR. (BC) ARCHITECTURAL DESIGN BOARD Page 11 - January 4, 1984 Mr. Finke reported the applicant is asking for approval of site plan, elevations, landscaping, and signs for the above location. The site is located on the oblique corner on the east side of 3rd Avenue S., where it intersects James Street. It is approximately 145 feet deep, with 235 feet of frontage along 3rd Avenue S. The site is just over 28,000 square feet. The existing Rainier Bank parking lot abuts the north property line. There is one single-family dwelling to the south of the site and south of that is the Quintana Roo restaurant. The rear property line is approximately 105 feet long and abuts a 16-foot wide public alley. The site slopes gently east to west and is occupied by three wood frame homes, two of which are presently occupied. Vehicular and pedestrian access to the site will be from 3rd Avenue S. There is a sight distance problem on 3rd Avenue S., which should be mitigated by requiring a right turn only from both bank exits. The Engineering requirements, which Mr. Finke will discuss later, say specifically that the drive-in exit should be a right turn but, apparently are open to either right or left turns from the other exit. Thirty-one spaces are provided for off-street parking. Twenty-six spaces are required for the main floor bank area. Five parking spaces appear adequate for the basement storage area, providing it does not have office space. The main floor of the building is a little over 5,000 square feet. Basement storage area is close to 4900 square feet. The height of the building is 23' 6". It will have I-," by 6" bevel cedar siding, color beige, with forest green wood trim. A smooth stucco facia is cream color, with forest green trim. Aluminum sash windows, forest green. The sign and logo area at the northwest corner of the building is to be lit at night by a spot hidden on the lower roof surface. Antique -style light fixtures are planned to be attached to the west face of the building on each side of the entry. Antique -style pole light fixture near the entry on the south side of the building. There are also pole lights, polyquad 20, mercury, metal halide 6 high pressure sodium lights, at two locations marked on site plan by an x with a circle around it. The trash dumpster is located by the alley at the southeast corner of the site. The dumpster must be completely enclosed. No electrical meter location is indiated. Mechanical equipment will be located on the north side of the building. This will be screened from view. Landscaping is shown on the plan before the Board. There are a number of different signs, some of which the Board is concerned with and others which are not counted as part of the sign area. The bank name "Edmonds National Bank" is proposed in three locations: on the west elevation, the sign would be 10 inch by 20 feet, almost 17 square feet, the height is less than 12'6". Signs over entries on west and south sides of the building, 6" by 8', the two would total 8 square feet, with a height less than 12'6". A sign and logo are proposed on the north elevation, 53�' by 13.7' totaling 75 square feet with a height of about 20 feet which is above the code requirements. There are also drive- thru signs, exit signs and lane signs which would not be counted as part of the sign area. Comparing the proposed and permitted sign area and height, the maximum area by Code is 100 square feet for all signs; the proposed is 100 square feet. The maximum height by Code is 14 feet, all signs but the one on the north elevation are under 14 feet, but that one is about 20 feet. The Engineering requirements say this site layout as submitted appears acceptable. A right turn only will be allowed leaving the site from the drive-thru exit. As ppro osed the plan requires three curbcuts on 3rd Avenue S. Per Section 18.80.060 (C)(4� only two are allowed. Engineering would not object to the plan as submitted, but it would require a variance from the Hearing Examiner to have 3 curb cuts. Also, all unused curbcuts must be replaced and all damaged curb/gutter/sidewalk adjacent to the property must be replaced. A development plan must be submitted and approved, and the appropriate bonds posted prior to issuance of any permits. The staff finds the subject development is consistent with the Comprehensive Plan and other adopted City policies except for the proposed sign on the north elevation of the building. In regard to the Zoning Ordinance, the subject development meets the require- ments of the Zoning Ordinance, except again for this proposed sign on the north eleva- tion of the building. The subject development appear to satisfy the criteria and purposes of Chapter 20.10 of the City of Edmonds Community Development Code. Michael Medina, from Commercial Design Associates in Lynnwood, representing Edmonds National Bank, Corporation. Mr. Medina passed around a colored rendering of the project for the Board's information. He said one of the original goals of the project was to bring the building close to 3rd Avenue so it would be a pedestrian oriented building and to reduce the scale. This was accomplished with a 12 foot 6 inch facia along 3rd Avenue, continuing around the building to tie it together. He said all the signs on the building are under the 14 foot height limit except for the sign on the north side. He pointed out that the area chosen for the sign is about the only place on the north elevation where a sign could be placed. Commercial Design Associates made a suggestion to the Planning Department to place a freestanding pole sign at the height limit, but decided the building was strong enough to stand by itself and did not want to put any thing in the way of the building. Therefore, decided to go with a front lit sign on the face of the building facing north to be easily read from Main Street, and from 3rd Avenue S.; and the Planning Department, including Mary Lou Block and Bruce Finke, agreed We are asking that you approve that sign at that elevation as well as the conceptual ARCHITECTURAL DESIGN BOARD Page 12 - January 4, 1984 • landscape plan. We have placed the objectionable functions of the building at the back of the site, the drive-thru, mechanical equipment, and the dumpster. We have separated the drive-thru entry from the main parking facility to reduce the chance that any accidents will occur there. We have no problem with a right -turn only at the drive-thru exit. Mr. Hintz asked Mr. Medina to repeat the rationale for a 20 foot sign on the north side of the property. Mr. Medina passed around a photo of the north side of the property. He said a lower sign on the 12 foot facia would be blocked from view by a row of existing trees on the south edge of the Rainier bank property. Mr. LaFon asked if there would be a need for a cash machine sign. Mr. Medina said there would not be a cash machine installed for several years, since this a new bank. When one is installed, Mr. Medina said the Corporation would at that time apply to the ADB for approval. Mr. Parsons pointed out that landscape plan was very conceptual and asked if the intention was to return at a later time with a specific plan. Mr. Medina said they were seeking final approval on the site, elevations and sign plan and preliminary approval on the landscape plan. Mr. Parsons commented that the lawn area was good, because of the pedestrian approach that has been taken. He encouraged the addition of one or two more trees along 3rd Avenue to break it up. The dumpster could also stand a little more screening on the south and east sides. Mr. Pederson closed the hearing since no one else wished to speak. MR. HERMAN MOVED, SECONDED BY MR. ADB-96-83 NEW FREESTANDING SIGN BRIAN ZETTERBERG, D.D.S.) - Review of new freestanding sign for dental off ica at 547 Main St. C Mr. Finke reported that this application was before the Board at their last meeting, and they had asked the applicant to come back with additional information to show the proposed sign in relation to the building. The maximum area by Code of all signs is 24 square feet; proposed is 17.5 square feet. The maximum height by Code is 14 feet; proposed height of the freestanding sign is 3' 10". The site has a large lawn area where the sign would be located. The staff finds the proposal is not consistent with the policy in Section 15.15.030 (B)(2)(b) of the Edmonds Community Development Code, which states for the downtown that signs should be "perpendicular or flat to buildings." Section 20.60.040 says that "freestanding signs are discouraged in BC, BN, and CW zones. Freestanding signs will be approved only if the applicant can demonstrate to the Architectural Design Board that no reasonable alternative exists to satisfy the identification needs of the business." The proposed sign meets the area and height requirements of the BC zone for freestanding signs. The proposal appears to satisfy the criteria and pur- poses of Chapter 20.10 of the City of Edmonds Community Development Code. Mr. Finke pointed out the Board has a number of sketches before them showing the sign and its relationship to other elements. Gerald Eilert, representing Brian Zetterberg, expressed his hope that the location being requested is clearly defined for the Board. He said it was deemed necessary in this situation, since there are two businesses and buildings in the area, to have the sign back from the street and parallel to the building. He explained the sign is low and unobstrusive, but is the main identification for Dr. Zetterberg. At present there is no identification at all. Mr. Eilert believes the sign fits the area in design and that the nature of the sign and materials are also aesthetically pleasing. Natalie Shippen, 1022 Euclid, Edmonds, wished to support the sign on the basis of equity. She read from the minutes of the previous meeting regarding a unified sign for the property and the Board's request for additional information. She pointed out the relationship of this sign to the one she spoke to earlier, Harbor Square Associates when she asked if the relationship of signs to the buildings was not a necessity. She stated that the Board was very exacting in dealing with this application, but she did not always find them so exact in dealing with different situations and did not feel it was fair to the people who had to live with their decisions. Mr. Eilert also passed around pictures of the building to assist the Board in seeing the relationship of the sign to the building. Mr. Hintz asked for clarification of whether the allowable signage for both buildings would be used by Dr. Zetterberg's sign. Item 18.80.060 C.4, in the Edmond's zoning code limits the number of curb - cuts to two for any one ownership on one street. The Edmonds National Bank proposal includes three curb -cuts along Third Avenue. 2. The 30' wide curb -cut for parking access can be reduced to 24 feet, in- creasing its distance from the drive -up entry by six feet. 3. The drive -up exit curb -cut has restricted visibility around the oblique corner, and may have to be a right turn only type of exit. 4. It is possible to eliminate one curb -cut by placing the drive -through entry inside the parking area rather than on the street, but this would eliminate two parking stalls on a site where parking will be at a pre- mium. 5. Given the low speed limit on Third Avenue the lack of traffic on James Street, and the fact that two of the proposed curb -cuts are one-way only, the actual impact on traffic may be minimal. 6. It was mentioned that there exist presently three curb -cuts along the street frontage on which Commercial Design Associates, Inc. is proposing three curb -cuts. 7. After reviewing the proposal in more detail, the City will advise Commercial Design Associates, Inc. prior to Tuesday, December 19, about whether or not they will waive the two curb -cut limit for this particular project. Commercial Design Associates, Inc. is proceeding with the project based on the above statements being correct.
