Comprehensive Plan The Comprehensive Policy Plan map designates the subject property as Commercial/Business, as are; all the adjoining properties. - The proposed variance does appear to conflict with the purposes of the Comprehensive Plan found in Chapter 15.15.030 (B) (2) (b) . 4. Zoning Ordinance The subject property and the surrounding properties are zoned BC. The required variance must not, result in a special ' privilege being granted to the Applicant;. C. The variance must be consistent with the Comprehensive Policy Plan Map of the City, of Edmonds; D. The variance must be consistent with the purposes of the zone district in which the property is`locatede E. The variance must not be significantly: detrimental .to the public health, safety or welfare, nor 'injurious to the property or improvements in the vicinity of the, same zone; and, F. The variance must be the minimum necessary,to allow the same rights enjoyed by other properties in the same zone. 5. There is an existing sign located on the building on the west end. It is the intent of the 'Applicant to put an identical sign on the northeast corner of the building which is the subject of this variance. (Staff report.) n. The Applicant submitted that they desire to put a wall sign on site instead of a pole sign because a wall signwould enhance the location of the building. However, the Applicant desires to put the sign at approximately the 25-foot level of the new structure. The 'City of Edmonds submitted that the variance as requested by the Applicant does not appear to be the minimum necessary to allow the owner the rights enjoyed by other properties.n the vicinity with the same zoning. In particular, they sub- 7} tC mitted that.a different sign could be.,designed and could 'be placed at a lower point on the building.This would provide" an opportunity for an exposure to Main`Street which is the'. busiest street in the City of Edmonds. (Bowman testimony.) : 8. Although .a lower sign could be located' on a lower point of the building, which would still require a -variance, the City submi'tted.that this would have less of an 'impact than.the sign as proposed by the Applicant. (Bowman testimony.) 9. The Applicant testified to be a small bank that is in compe- tition with other larger banks in the vicinity. As a result, according to the Applicant, exposure is critical for the operation of the bank. The proposed sign as submitted would conform to the sign now located on the west side of the pro- perty, and would provide an identity to the bank. (Braun testimony and Starr testimony.) 10. The Applicant submitted that the sign as proposed was designed to ensure visibility for the pedestrian. The pedestrian traffic that occurs on Main Street will be able to see the sign as proposed by the Applicant. (Braun testimony.) 11. The spokesman for the Planning Department,.submitted that with the sign located in "the lower corner of the building, visi- bility is still available to pedestrians off` Main Street. (Bowman testimony.) 12. The Comprehensive Policy Plan Map of the City of Edmonds - designates the -subject property as Commercial Business. The requested variance for the sign does not appear to be in conflict with the Comprehensive Plan.. (Staff report.) 13. The requested variance does not appear to pose any signifi- cant impact to the public, nor to nearby private properties or improvements. (Staff report.) CONCLUSIONS 1. The application is for the approval of a variance to allow an attached sign to exceed the permitted 14-foot maximum height limit by an additional 11 feet 6 inches on a build- ing located at 123 3rd Avenue South, Edmonds, Washington.. 2. In order for a variance to be granted within the City, of Edmonds for an attached sign to exceed the height limit of 14 feet, the criteria of Section 20.85.010.of the'ECDC.must be satisfied. This is'not 'the minimum variance in -that the sign could be dowered on the subject property and -still provide pedestrian traffic with the. °identif,ication of the location of the Applicant's building. 8: The Planning Department of the City of Edmonds has` recommended ' denial of the requested variance. This recommendation was' opposed by the Applicant. DECISION Based upon the preceding Findings of Fact and,Conclusions;, the testimony and evidence submitted at the; public hearing; and, upon the impressions of the Hearing Examiner at a site view, the requested.' variance for an attached sign on property located at 123 3rd Avenue South, Edmonds, Washington, is denied: f¢. As noted in the Conclusions, the application satisfies all the criteria of Section 20.85.010 of the ECDC except for the last cxiterion,which requires that the proposed variance be the mini- mum necessary to allow the owner the rights enjoyed by other pro. perties in the vicinity with the same zoning. As proven in the public hearing, the Applicant would be able to place a sign on the building at a lower point than that as proposed. This will result in a redesign of the sign that would be different from the sign on the west•side of the building. Although a variance would be needed because the redesigned sign would have to be placed at a point that would exceed the maximum height of 14 feet for attached signs, it would still allow the Applicant all the rights enjoyed by other property owners in the vicinity. The Applicant may resubmit a redesigned sign consistentrwith the Findings and Decision of this case. The redesigned sign may be submitted under the file number V-24-85 in this matter.and the Applicant will not be required to pay an additional variance fee. On October 17, 1985, the Hearing Examiner, of the City of Edmonds denied a request of the Applicant for a variance from the .Edmonds Community Development Code (ECDC) height standards for s signs. The maximum height allowed for a sign.is 14 feet. The Applicant requested a variance for a sign to exceed the 14 feet by 11 feet. The sign would be erected on -a bank located at 123 3rd Avenue South, Edmonds, Washington. The request was r denied, but the Applicant was given the opportunity to submit a revised variance request. As part of the denial, the Hearing Examiner of the City of Edmonds waived the application fee for a revised application. (Bowman testimony and Staff report.) 2. The Applicant submitted a revised variance application requesting a`variance in order to erect an attached sign tothebuilding located at 123 3rd Avenue South, Edmonds, Washington. In order to erect the sign, the Applicant sought a variance from'the maximum height limit of 14 feet`and requested that the height,, limit be exceeded by an additional 6 feet. (Bowman testimony.) 3. A proposed sign is to be located on the Edmonds National Bank- P at 123 3rd Avenue South, Edmonds, Washington, and is proposed t to be located on the northeast portion of the building. (Staff report and Exhibit 5.) 4. The proposed sign will consist of one set of individual channel constructed letters with illumination. The words "Edmonds National Bank" will be on three separate lines. The sign will consist of letters that will be 18 inches in height. The total height of the three words will be approximately six feet. (Exhibit 3.) 5. The proposed sign will be attached to the building and is con- sidered an attached sign. Section 20.60.020(D)(2) requires ° that all attached signs shall not exceed 14.feet in height. It is from this section of the ECDC that the Applicant seeks a variance. (Bowman testimony and ECDC.) 6. Immediately north of the subject property is the Rainier Bank; The Rainier Bank has a parking lot located on. the south side of the bank. There is a grade separation between the Rainier. Bank parking lot and the subject- property. If the Rainier �- Bank parking tot is used by vehicles for parking they obscure the lower half of the north side of the .Edmonds Bank buildi:n.g o.' If the 'parking lot is not .used, the lower half of -the Edmonds t=:' Bank building can be seen. (Bowman testimony.) t 8. In addition to the location of the Rainier .Bank parking lot, the Rainier Bank also has shrubbery growing on their property,' As this shrubbery increases in size, the lower portion Of the north side of the Edmonds Bank building will be further ob'-' scured. (Johnston' testimony.) p �. 9. There is a grade separation between the Rainier Bank parking lot and the subject property. This grade separation.together with the obstruction from vehicles using the parking lot, and the shrubbery create a visual barrier for the pedestrian or the travelling public ;to see a sign that would be locate' on the north side of the Edmonds Bank building,if constructed within the 14-foot height requirement. Thus, for the Edmonds' National Bank to have an effective sign, they must place it on the upper portion of the north wall of their building. (Johnston testimony.) 10. The property is zoned BC (Community Business).(Bowman ;. testimony and Staff report.) 11. The Comprehensive Policy Plan Map of the City of Edmonds desig.= nates the subject property as Commercial/Busin'ess. The Planning Department of the City of Edmonds submitted that the requested. variance is consistent with the Corciprehensive= Plan: (Staff report.) 13. A spokesman for the Applicant submitted that the sign ;satisfies the square footage requirements for attached signs within he City ;of Edmonds.(Johnston testimony'.) =y 14. A°witness (Hertrich) submitted that the requested variance.' does not conform with the downtown concept of the Comprehen- sive Plan as set forth in Section `15. 5.030 of the ECDC'in' that the sign is not a small or low-level sign. ('Hertrich, testimony.) 15. Witness Hertrich submitted that other properties in the vicinity have low-level signs that are pedestrian oriented. According , to the witness, the Applicant would be able to have an .attached sign on the building and still be within the 14-foot height, requirement. (Hertrich testimony.) 16. A witness (Tupper) objected to the Hearing Examiner waiving `f the variance'fee for the resubmittal of the application. Accord- °` ing to the witness, the Hearing Examiner's jurisdictional'au-.' thority is limited to final decisions and to waive the.fee for a resubmittal of an application is in excess of his.juris- diction. (Tupper testimony.) 17. The Planning Department of the.City of Edmonds recommended approval of the variance. The Planning.Department submitted: The revised sign location and design is a much better.pro- posal. The sign is attractive and is located in such a manner that is not obstructed from view by the property to the north. Staff supports the variance request. (Staff report. ) CONCLUSIONS 1. The application is for the approval of a variance to allow an attached sign to exceed the maximum height limit of 14 feet on property located at 123 3rd Avenue South, Edmonds,_ Washington.
