The State's comments on this Determination of Non -Significance are as follows: The proposed development site is located within the Edmonds city limits. It is, therefore, the city's responsibility to ensure that the adjacent highway (SR 524) has adequate right-of-way, and that any access to the highway concurs with standard design specifications. In addition, the city is responsible for making sure that the traffic which will be §enerated by this development will have no significant impact on the area's transportation network and that any anticipated significant impacts are adequately mitigated. We encourage the provision of concrete curb, gutter and sidewalk along the SR 524 frontage to ensure safety of pedestrians, bicyclists and motorists. (Staff report.) 10. The Planning Department of the City of Edmonds has recommended that the permit not be transferable. (Staff report.) 11. As part of the application, the Applicant submitted four plans and building elevations. According to the plan submitted by the Applicant, no views will be impacted as a result of this construction and the allowance of a conditional use permit. (Lewis testimony.) 12. The Planning Department' of the City of Edmonds has recommended approval of the conditional use permit subject to the conditions as set forth in the Staff report. (Exhibit 1.) CONCLUSIONS 1. The application is for the approval of a conditional use permit to allow grading of approximately 800 cubic yards of earth at 126 Third Avenue South, Edmonds, Washington. 2. It is the intent of the Applicant to demolish an existing structure on the subject property and to replace it with an office building. In order to accomplish this, grading must occur. More than 500 cubic yards of earth material will be involved and thus the Applicant is required to obtain a conditional use permit per the provisions of ECDC 18.40.030. 3. The requested conditional use permit has been reviewed in light of the criteria of ECDC 20.05.010. With conditions the application satisfy these criteria. 4. The subject property is zoned BC. The requested conditional use permit is consistent with the purposes of the BC zone as set forth in ECDC 16.40.000 and 16.50.000. It is consistent in that it will reserve areas for offices, which offer goods or services to the community, and will result in convenient development patterns within the City. 5. The conditional use permit request is consistent with the Com- prehensive Plan designation of Commercial Business as set forth in ECDC 15.20.010 et seq. The proposed conditional use permit is not detrimental to other properties or improvements in the area. 7. The conditional use perimit should not be transferable. DECISION Based upon the preceding Findings of Fact.and Conclusions; the testimony and evidence submitted at the public hearing; and, upon the impressions of the Hearing Examiner at a site view, it is hereby ordered that the requested conditional use permit for the grading of approximately 800 cubic yards of earth material at 126 Third Avenue South, Edmonds, Washington,lis granted subject to the following conditions: i 1. All excavation and grading shall comply with the provisions of Chapter 70 of the Uniform Building Code. 2. The Applicant shall su�mit an erosion control plan for review and approval by the City Engineer prior to the issuance of a grading permit. 3. The Applicant shall obtain a grading permit from the Edmonds Building Department and shall comply with ditions of permit approval. 4. The Applicant shall syybmit a truck route plan to the City Engineer for approval prior to removal of excavated material. 5. The Applicant shall be responsible for keeping all streets clean and free of debris. Should the City have to clean any dirt and debris caused by the Applicant's activities, the Applicant shall reimburse the City. 6. All grading work shall be done during normal working hours of the City of Edmonds. Normal working hours are 8 a.m. to 5 p.m., Monday through Friday. 7. The Applicant shall be,responsible for providing verification of the total amount of excavated material prior to finalization of the grading permit. The City shall determine what shall constitute "proper verification of the total amount of excavated material." 8.
