STORM DRAIN EASEMENT
(Over Parcel C for Benefit of Parcel B)
For and in consideration of Ten Dollars ($10) and other good and
valuable consideration, receipt of which is hereby acknowledged by
Grantor, Elizabeth M. Case, a widow, as her separate estate regarding
Parcel C, hereby conveys and quit claims to Grantees, Michael L. and
Barbara McNaughton, hereinafter referred to as Grantees, their
successors and assigns, of the property hereinafter described as Parcel
B, a perpetual easement ("the Easement") for an existing storm drainage
line, under, over, through, and across the property described herein as
Parcel C;
SUBJECT TO THE FOLLOWING:
1. RIGHT TO ENTER.
Grantees shall have the right at reasonable times to enter
onto the Easement for the purpose of locating, constructing, conducting
reasonably necessary inspections, maintenance, repair, improvement,
and/or replacement of the storm drain line.
2. COST.
The cost of such locating, construction, inspection,
maintenance, repair, improvement, and/or replacement shall be borne
entirely by Grantees, their successors and assigns. Such costs shall
include the replacement and restoration of any grass, plant, shrubbery,
tree, or improvement which is disturbed or altered during such
location, construction, inspection, maintenance, repair, improvement,
or replacement and such cost shall include restoration of the premises
of Grantors to the condition immediately prior thereto.
3. BENEFITS AND BURDENS.
Such Easement shall be an easement appurtenant and be for the
benefit of Parcel B and shall be a burden upon Parcel C.
4. LEGAL DESCRIPTION.
PARCEL B:
That portion of Government Lot 4, Section 13, Township 27
North, Range 3 East, W.M., in Snohomish County, Washington
described as follows:
Beginning at the South quarter corner of said Section 13;
THENCE North 0009' West along the East line of Government
Lot 4 a distanc8 of 138.6 feet;
THENCE North 7; 48' West a distance of 629 feet;
THENCE South 0 29' East 84.3 feet;
THENCE North 71 48' West a distance of 200 feet to the True
Point of Beginning;
THENCE continuip North 71°48' West 200 feet;
THENCE South 18 12' West at right angles, 64 feet;
THENCE South 71°47' East 200 feet;
THENCE North 18°12' East 64 feet to the True Point of
Beginning.
PARCEL C:
That portion of Government Lot 4, Section 13, Township 27
North, Range 3 East, W.M., in Snohomish County, Washington

The Easement shall be located under, over, through,

across the northerly ten (10) feet of Parcel B and within the westerly
ten (10) feet of Parcel B and/or the easterly ten (10) feet of Parcel
C, the exact location of which is to be determined by the engineers at
the time of planning and construction; the Easement shall continue
along the southerly ten (10) feet of Parcel C to a point approximately
165 feet or more westerly of the easterly line of Parcel C and then
shall extend perpendicular to that point on the southerly line of
Parcel C northerly in which a perforated drain tile or pipe of no
greater than eight (8) inch diameter shall be installed in a trench of
approximately twenty (20) feet or more in length. The exact location
with the Easement of the line and dispersal field shall be determined
after installation and approval, and a drawing shall be attached to
this document and this document and the drawing shall be recorded or
re -recorded with the Snohomish County Auditor. All measurements herein
shall be measured at right angles to the line from which the
measurement is made.

STORM DRAIN EASEMENT
(Over Parcel for Benefit of Parcel B)
For and in consideration of Ten Dollars ($10) and other good and
valuable consideration, receipt of which is hereby acknowledged by
Grantor, Elizabeth M. Case, a widow, as her separate estate regarding
Parcel C, hereby conveys and quit claims to Grantees, Michael L. and
Barbara McNaughton, hereinafter referred to as Grantees, their
successors and assigns, of the property hereinafter described as Parcel
B, a perpetual easement ("the Easement") for an existing storm drainage
line, under, over, through, and across the property described herein as
Parcel C;
SUBJECT TO THE FOLLOWING:
1. RIGHT TO ENTER.
Grantees shall have the right at reasonable times to enter
onto the Easement for the purpose of locating, constructing, conducting
reasonably necessary inspections, maintenance, repair, improvement,
and/or replacement of the storm drain line.
2. COST.
The cost of such locating, construction, inspection,
maintenance, repair, improvement, and/or replacement shall be borne
entirely by Grantees, their successors and assigns. Such costs shall
include the replacement and restoration of any grass, plant, shrubbery,
tree, or improvement which is disturbed or altered during such
location, construction, inspection, maintenance, repair, improvement,
or replacement and such cost shall include restoration of the premises
of Grantors to the condition immediately prior thereto.
3. BENEFITS AND BURDENS.
Such Easement shall be an easement appurtenant and be for the
benefit of Parcel B and shall be a burden upon Parcel C.
4. LEGAL DESCRIPTION.
PARCEL B:
That portion of Government Lot 4, Section 13, Township 27
North, Range 3 East, W.M., in Snohomish County, Washington
described as follows:
Beginning at tpe South quarter corner of said Section 13;
THENCE North 0 09' West along the East line of Government
Lot 4 a distancs of 138.6 feet;
THENCE North 7� 48' West a distance of 629 feet;
THENCE South 0 29' East 84.3 feet;
THENCE North 71 48' West a distance of 200 feet to the True
Point of Beginning;

the True Point gf Beginning;
THENCE South 18 12'00" West, a distance of 64.00 feet;
THENCE North 71°47'00" West to an intersection with the
Easterly margin of the Burlington Northern Railway Company's
right-of-way;
THENCE Northeasterly6 along said Easterly margin, to a point
which bears North 71 48'00" West from the True Point of
Beginning;
THENCE South 71 48'00" East to the True Point of Beginning.
5. LOCATION OF EASEMENT.
The Easement shall be located under, over, through, and
across the northerly ten (10) feet of Parcel B and within the westerly
ten (10) feet of Parcel B and/or the easterly ten (10) feet of Parcel
C, the exact location of which is to be determined by the engineers at
the time of planning and construction; the Easement shall continue
along the southerly ten (10) feet of Parcel C to a point approximately
165 feet or more westerly of the easterly line of Parcel C and then
shall extend perpendicular to that point on the southerly line of
Parcel C northerly in which a perforated drain tile or pipe of no
greater than eight (8) inch diameter shall be installed in a trench of
approximately twenty (20) feet or more in length. The exact location
with the Easement of the line and dispersal field shall be determined
after installation and approval, and a drawing shall be attached to
this document and this document and the drawing shall be recorded or
re -recorded with the Snohomish County Auditor. All measurements herein
shall be measured at right angles to the line from which the
measurement is made.
