In that letter, it was noted that a permit would be required to do any branch cutting given the proximity of the work to Northstream Creek. That determination still stands since the applicable regulations and requirements regarding tree cutting and critical areas have not changed since that time. The critical areas code considers trimming and similar tree work to be an 'alteration' as defined in ECDC 23.40.320: "Alteration" means any human -induced action which changes the existing condition of a critical area or its buffer. Alterations include, but are not limited to: grading; filling; dredging; draining; channelizing; cutting, pruning, limbing or topping, clearing, relocating or removing vegetation; applying herbicides or pesticides or any hazardous or toxic substance; discharging pollutants; paving, construction, application of gravel; modifying for surface water management purposes; or any other human activity that changes the existing landforms, vegetation, hydrology, wildlife or wildlife habitat value of critical areas. Performing any tree work in the critical area without obtaining the required approval first may result in steep fines in accordance with ECDC 23.40.240 and ECDC 18.45. I understand your concern regarding the tree branches that are overhanging your property. You indicated that you want to remove the branches, at the property line, as they overhang your rear yard Because Northstream Creek is located within 25 feet of the trees, you will need to obtain a clearing permit to do the branch cutting. I am enclosing the permit application documents for your information and use. You will need to have an arborist review the proposed cutting to make written recommendations to minimize the impact on.the trees.
