The Critical Areas Checklist contained on this form is
to be filled out by any person preparing a
Development Permit Application for the City of
Edmonds prior to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable City staff to
determine whether any potential Critical Areas are, or
may be, present on the subject property. The
information needed to complete the Checklist should
be easily available from observations of the site or
data available at City Hall (Critical Areas inventories,
maps, or soil surveys).
An applicant, or his/her representative, must fill out
the checklist, sign and date it, and submit it to the
City. The City will review the checklist, make a
precursory site visit, and make a determination of the
subsequent steps necessary to complete a development
permit application.

During review and inspection of the subject site, it was determined that the site appears to
contain and/or is adjacent to a Class 2A Stream with salmonoid (North Stream), pursuant to
Chapter 20.15B of the Edmonds Community Development Code (ECDC). The property is
developed with a single-family residence and a detached garage.
Based on the above findings, a Critical Areas Study is required for further development of the
site to determine and delineate the boundaries of the critical area, its buffers and setbacks. At
time of development, the applicant shall submit a survey, prepared by a Licensed Land Surveyor,
delineating the top of the stream and its buffers. The buffer for a Class 2A Stream is 25 feet,
with an additional 15 foot building setback.
Because this stream flows into Puget Sound, any development on the subject site requires
additional review and approval by the Washington State Department of Fish and Wildlife. Any
development proposal within or adjacent to the stream requires SEPA review by the State, in
addition to review by the City, for permit applications.
If the property owner wishes to apply for a specific development on the site, they may
submit their proposal to the Planning Division for review. If staff finds that the proposed
development permit will not adversely impact a Critical Area or its buffers, a conditional
waiver may be issued on a project by project basis.

The State Environmental Policy Act (SEPA), chapter 43.21C RCW, requires all governmental agencies to consider the
environmental impacts of a proposal before making decisions. An environmental impact statement (EIS) must be prepared for all
proposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide
information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it
can be done) and to help the agency decide whether an EIS is required.
Instructions for Applicants:

checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer

I ran the 1439 OVD average street setback situation with the other planners and we have concluded the following:
• It is obvious from the memos and building permit history that a survey was used to determine the 11.75 foot street
setback;
• Because our files lack the approved survey, the Planning Division would prefer any new applications be accompanied
by a survey to justify the setback reduction. The applicant can try to track down the survey by contacting the former
owner or surrounding property owners to obtain the name of the firm who probably still has it on record.
• Because the application would not further reduce the average street setback, Plarlping would not require a new survey
and apply the original 11.75 foot average setback for the addition (shown to beeet from the property line).

SUBJECT: Haskell Building Permit, # 900526
On July 23, 1990, the Planning Division received a revised setback
average, measured and drawn by a licensed surveyor as directed. The
calculations on this survey indicate an average front setback of 13.57
feet from the street property line of Olympic View Drive, and an
average front setback of 11.75 feet from the street property line of
Euclid Ave. A site plan was submitted on July 24, 1990 which showed
the setbacks as indicated on the aforementioned survey. I have
initialed these plans to indicate approval -;f the Planning Division.

Request for a "Conditional Waiver"
Dear Ms. Galloway,
Regarding our conversation yesterday about the Determination regarding Critical Areas Checklist #99-56,
We request a conditional waiver on the recommended "study required" decision based on the following
information.
• Site location: 1439 Olympic View Drive, does not have a Class 2A stream running throueh
the property but rather the stream is on neighboring property
• The majority of the remodel/addition being presented for a building permit will be built along
the Euclid Avenue side of the property in no way threatening the stream.
• There will be a one room addition facing the neighboring property, however, this addition will
be much further away than the 25 foot setback that is required.
We feel that our project will in no way threaten the Class 2A stream and will adhere to any buffer and
setback requirements for this area.
Thank you for your time. I will be happy to meet with the Planning Department to explain our position.
Please contact me if there are any further questions and I will be calling to check on the status of this
"waiver request".
