Graf, Building Official 0-16, Waterfront Building @ 144 Railroad Avenue Jeff McNaughton of Butterfield Design has made a verbal request to remove the two existing exterior stairs located on the east side of the Waterfront building. As you may recall these were the additional exit stairs added in 1984 to accommodate the restaurant banquet room occupant load increase. I checked the original approved plans and found that the exiting scheme was approved under the UBC 3302c Exception which states "where exit enclosures are provided as the required means of egress and are interconnected by a corridor conforming to the requirements of 3304(g), exit separations may be measured in a direct line of travel within the exit corridor. Enclosure walls shall not be less than 30 feet apart at any point in a direct line of measurement." Please refer to the attached copy of the original approved second floor plan. 1. The exit enclosures are one hour construction and placed more than 30 feet apart; 2. The direct line of travel within the corridor is 65 feet on one side and 86 feet on the other (94 feet required); 3. The corridors are noted to be one hour fire resistive construction with protected openings Based on this it appears the exception was instituted and the exiting approved (even though the direct line of travel was 8 feet short of exactly one-half the diagonal). The new proposal is to create executive office suites (4 or 5 plan attached) on the third floor and to have a corridor system very similar to the second floor. Based on the exiting exception and the proposed use (occupant load 127 calculated by architect) it appears that both east exterior stairs may be removed. If you concur I will be sending a memo to the architect with the following conditions: 1. Verify stair enclosures are one hour fire resistive construction and all openings are protected or fire rated for one hour, i.e., doors. 2. The proposed corridor must conform to one hour fire resistive construction with protected openings. 3. The path of travel within the corridor must be a total of one half the diagonal of the building which according to the original approved plans is 94 feet. 4. Caution on creating individual office spaces that exceed 30 occupants which will require a second exit (spaced one half the diagonal of the suite) into the rated corridor. Mr. Albers asked the members if they received and reviewed the information sent on the revisions to the Fire Code. Those members present stated they had and suggested that the item be on next meeting's agenda. AGENDA BA-3-82 Alternate method of fireproofing for structural steel in parking area on first level of building at 144 Railroad Avenue. Mr. Albers read the letter from Kirk Black of Pantley's,'Inc. requesting an alternate method of fireproofing the steel columns, beams, and girders in the covered parking area. Mr. Reeves asked Mr. Whiteley if the building would still stand up if fireproofing of the trusses was omitted as requested. Mr. Whiteley responded that the building might if the main columns and frames were fireproofed but the trusses would buckle and the floors will come down. Mr. Reeves stated that a sprinkler system is not required in this building per the Uniform Building Code. A sprinkler system allows for area increases and increase in the number of stories allowed but it is not a substitution for occupancy separation. The situation at the above building is a parking garage and commercial habital space above it and the code requires a 1-hour occupancy separation, and the sprinklers in this case -are not a substitution. Mr. Albers asked if the board could make a recommendation on this item without the applicant present. Mr. Reeves stated that the City Attorney advised that the board could, the applicant is not required to show at the meeting. The board asked what the floor area is in the building and Mr. Reeves stated that the first floor has 4,900 sq. ft. of occupied space and the rest is parking, the second floor has 12,580 sq. ft. of occupied space and the.third floor has 11,166 occupied space and extra decking. The restaurant comprises of about 7,000 sq. ft. on the third floor. The basic allowable for Type V-1-hour construction is 14,000 sq. ft. plus area increases are allowed for distance from property lines and in this case there is a street on one side and water on the other. They meet the allowable area and are not required to have sprinkler system. Mr. Reeves stated that it is the applicant'sidea that if the columns and main members where fireproofed, the sprinkler system would allow for the secondary members to be unprotected. BOARD OF APPEALS MINUTES March 15, 1982 Page 2 Mr. McComas stated that the building is to be Type V-1-hour construction and if you don't apply anything to the steel it is not 1-hour construction. The original plan for the parking area was to have a drop ceiling which would be 1-hour rated. Then the plan was changed to spray all the steel members. Mr. McComas said he was satisfied that the spraying would give the 1-hour cover to everything that was sprayed but now they do not want to do either of the plans and he felt this alternate proposal should be denied and they should be forced to spray all the structural members or apply sheetrock. Mr. Albers stated that he could see their problem with spraying the trusses that it would affect the sprinkler system, but if the sprinkler heads were lowered below the trusses then he couldn't see any problem with spraying the trusses. It was the board's opinion that the area in question should be satisfactorily sprayed or sheetrocked. MR. TRENT MOVED, SECONDED BY MR. ALBERS TO DENY THE -REQUEST SINCE IT DOES NOT MEET THE 1-HOUR FIRE RATING. ALL STRUCTURAL MEMBERS SHOULD BE EITHER SPRAYED, SHEETROCKED OR SOME OTHER FIREPROOFING METHOD. MOTION CARRIED. NAUGHTEN MAYOR It is indeed unfortunate that you cancelled for the second time our meeting relating to life safety code violations in your building at 144 Railroad Avenue. You have, however, been verbally informed of the problems. To confirm our August 14, 1984 conversation, the first floor parking garage is required to have a 1 hour fire resistive occupancy separation from the offices, shops, and restaurant (UBC 104 d). All openings in such separations shall be protected by fire assemblies having a 1 hour fire protective rating (UBC 503 c). The existing aluminum and glass "store front" door does not comply. Required fireproofing of structural members in the garage is deteriorating and must be maintained to insure 1 hour fire resistive integrity (UBC 104 d). Tenants on the first floor continue to prop open their entry doors, which are to remain closed to protect the fire resistivity of the cooridor, which is a part of the re-. quired exit for those on the floors above (UBC 104, 3305). You continue to use the south portion of the third floor as a banquet facility without minimum exiting as required by UBC 33. By letter dated July 18, 1984, you were told that this use must cease immediately until proper exiting is provided. To make up the difference would require the addition of more fireproofing to the structural steel and the installation of a 3 hour fire door assembly. One hour construction was provided but there is no fire door at all between the parking garage and the 1st floor corridor serving exit 7#1 from the restaurant. This is a great hazard to the restaurant occupants. Section 3303 and 3318 of the UBC require that the A-2.1 restaurant have a main exit capable of accomodating 1/2 the total occupant load. Thus, the existing exits for the building would limit th.e total number on the third floor to 300. This is the limit stated on Mr. Pantley's Certificate of Occupancy, yet he has posted a load limit sign of 377 and states that he has 400 or more people at times on the third floor. Other code violations exist also. Restaurant exit #2 dumps into the parking garage. Plans called for a walkway (never installed), but the code would require a fire resistive corridor to the public way. The first floor lease space appeared originally to be designed for offices but was changed to retail use. The tenants use the fire resistive exit corridor as a mall and prop open the fire doors. If these doors must be open, they should be on smoke detector actuated automatic closure devices. The City Attorney feels that the City has a great liability exposure in this matter. Mr. Reeves stated that a sprinkler system is not required in this building per the Uniform Building Code. A sprinkler system allows for area increases, -and increase in the number of stories allowed but i't is not a substitution for occupancy separation. The situation at the above building is a parking garage and commercial habital. space above it and the code requires a 1-hour occupancy separation, and the sprinklers in this case are not a substitution. Mr. Albers asked if the board could make a recommendation on this item without the applicant present. Mr. Reeves stated that the City Attorney advised that the board could, the applicant is. not required to show at the meeting. The board asked what the floor area is in the building and Mr. Reeves stated that the first floor has 4,900 sq. ft. of occupied space and the rest is parking, the second floor has 12,580 sq. ft. of.occupied space and the third floor has 11,166 occupied space and extra decking. The restaurant comprises of about 7,000 sq. ft. on the third floor. The basic allowable for Type V-1-hour construction is 14,000 sq. ft..plus area increases are allowed for distance from property lines and in this case there is a street on one side and water on the other. They meet the allowable area and are not required to have sprinkler system. Attached to that letter is a memo from Hal Reeves indicating your request for an opinion regarding the liability of the City and the Building Official. This liability would be defined as our liability for a failure to address noted building code violations. The State of Washington has joined the national trend of abrogating sovereign immunity and has done so both by case law and statute. Chapter 4.96 RCW. This abrogation of sovereign immunity is applicable to tortious actions of the City. As a general premise the negligent performance of a governmental or discretionary police power duty enacted for the public at large imposes no liability on the part of a municipality runni.ng to individual members of the public. This general rule was ^dis- cussed and a specific exception created in the leading Washington case of Campbell v. Bellevue, 85 Wn.2d 1, 530 P.2d 234 (1975). This Washington state supreme court decision is instructive not only for the general law that it lays down but its application of that -law to a set of facts very similar -to that which we are discussing. In the Campbell case the Bellevue building inspector was summoned to examine an electrical defect. He inspected the situation, noted the violation of the electri- cal code and took certain actions. When he had finished he assured the occupants of the home that the situation had been corrected. It had not, resulting in the death by electricution of an individual. The City of Bellevue was held to be liable. The Campbell exception basically discusses a situation in which the building inspector was alerted to and knew of a defect ,Mr. Peter Hahn November 12, 1984 Page 2 in violation of the City's ordinances. Despite that knowledge the inspector failed to comply with provisions of the code which require that he sever or disconnect the lighting system until it was brought into compliance with the electrical code require- ments. Such requirements were held by the court to be . . not only designed for the protection of the general public, but more particularly for the benefit of those persons or class of persons residing within the ambit of the danger involved, a category into which the plaintiff and his neighbors readily fall. Accordingly, we find municipal liability." Ibid, page 13. As you can see, the exception created by the Campbell case to the City's general freedom from liability for the negligent performance of governmental acts fits your factual situation very closely. In this case the City has determined that the restaurant is currently in violation of occupancy load require- ments. It is my understanding from the information provided that the correct occupancy load for the third floor is 300 persons. The City knows and Mr. Pantley admits that he has a posted occupancy limit sign of 377 individuals and has fre- quently 400 people or more on that floor. It is my assumption that problems involving occupancy loading and the fire exits from buildings would fall into the Campbell cases category of a situation which involves "extreme danger". The requirements also are not designed for the protection of the general public but rather of specific restaurant patrons who would be relying upon the occupancy figures and the fire exits situated in the building. Another recent decision of the Supreme Court involving the City of Seattle established a right to recover against the City under circumstances almost identical to your case. In Halvorson v. Dahl, 89 Wn.2d 673, 574 P.2d 1190 (en bonc, 1978), the Wash gton Supreme Court reviewed a case in which a hotel burned killing several individuals. According to the court the city had been aware of code violations existing at the hotel for at least six years. The City was aware of the violation and had from time to time embarked upon programs of enforcement of the building, housing and safety codes, but had never followed through to force the owners of the hotel to bring the structure into compliance. The court found that the special duty discussed in the Campbell case existed with respect to the housing code of Seattle and that therefore occupants of the hotel could claim the special relationship required by Campbell in order to press suit. This case is almost identical to your own, and it is my belief therefore that the City will be liable for any injuries or deaths which would occur in the event of a fire at the restaurant. Mr. Peter Hahn November 12, 1984 Page 3 Based upon the information available to me and my reading of the Campbell and Seattle cases it is my belief that the City risks liability for the death or injury to any individual brought about because of a fire at the Regency Building. The information supplied indicates that the situation before us fits into the Campbell exception making the City liable for a failure to enforce the specific provisions of the fire code relating to the exits and the occupancy. I would differentiate.the other issues raised by Mr. Reeves's letter which seem of a more technical nature which the City might well be able to compromise. Again, the general rule is that the City has discretion in the enforcement of its police power and is not required to pursue each and every violation, but may attempt to make reasonable decisions regarding the exercise of that power. In the situation involving the loading and exiting, I recommend that you take whatever enforcement action is necessary to correct that situation. If the City for whatever reason chooses not to do so, it must be done with the awareness that there is a high probability that the City would be held liable in the event of a death or injury to any person due to fire. I am aware Mr. Pantley points to other occupancy loading problems which exist at other restaurants within Edmonds and which have gone uncorrected. If that is the case the Fire Marshal and the Building Official should move to ascertain whether such violations exist and to address them as well. In this case however, the City's own files indicate clear knowledge of violations. Because of the.duty and liability imposed by the Campbell exception, this situation should be addressed immediately. Attached to that letter is a memo from Hal Reeves indicating your request for an opinion regarding the liability of the City and the Building Official. This liability would be defined as our liability for a failure to address noted building code violations. The State of Washington has joined the national trend of abrogating sovereign immunity and has done so both by case law and statute. Chapter 4.96 RCW. This abrogation of sovereign immunity is applicable to tortious actions of the City. As a general premise the negligent performance of a governmental or discretionary police power duty enacted for the public at :large imposes no liability on the part of a municipality running to individual members of the public. This general rule was dis- cussed and a specific exception created in the leading Washington case of Campbell v. Bellevue, 85 Wn.2d 1, 530 P.2d 234 (1975). This Washington state supreme court decision is instructive not only for the general law that it lays down but its application of that -law to a set of facts very similar.to that which we are discussing. In the Campbell case the Bellevue building inspector was summoned to examine an electrical defect. He inspected the situation, noted the violation of the electri- cal code and took certain actions. When he had finished he assured the occupants of the home that the situation had been corrected. It had not, resulting in the death by electricution of an individual. The City of Bellevue was held to be liable. The Campbell exception basically discusses a situation in which the building inspector was alerted to and knew of a defect t c' ,Mr. Peter Hahn November 12, 1984 Page 2 in violation of the City's ordinances. Despite that knowledge the inspector failed to comply with provisions of the code which require that he sever or disconnect the lighting system until it was brought into compliance with the electrical code require- ments. Such requirements were held by the court to be . . not only designed for the protection of the general public, but more particularly for the benefit of those persons or class of persons residing within the ambit of the danger involved, a category into which the plaintiff and his neighbors readily fall. Accordingly, we find municipal liability." Ibid, page 13. As you can see, the exception created by the Campbell case to the City's general freedom from liability for the negligent performance of governmental acts fits your factual situation very closely. In this case the City has determined that the restaurant is currently in violation of occupancy load require- ments. It is my understanding from the information provided that the correct occupancy load for the third floor is 300 persons. The City knows and Mr. Pantley admits that he has a posted occupancy limit sign of 377 individuals and has fre- quently 400 people or more on that floor. It is my assumption that problems involving occupancy loading and the fire exits from buildings would fall into the Campbell cases category of a situation which involves "extreme danger". The requirements also are not designed for the protection of the general public but rather of specific restaurant patrons who would be relying upon the occupancy figures and the fire exits situated in the building. Another recent decision of the Supreme Court involving the City of Seattle established a right to recover against the City under circumstances almost identical to your case. In Halvorson v. Dahl, 89 Wn.2d 673, 574 P.2d 1190 (en bonc, 1978), the Washington Supreme Court reviewed a case in which a hotel burned killing several individuals. According to the court the city had been aware of code violations existing at the hotel for at least six years. The City was aware of the violation and had from time to time embarked upon programs of enforcement of the building, housing and safety codes, but had never followed through to force the owners of the hotel to bring the structure into compliance. The court found that the special duty discussed in the Campbell case existed with respect to the housing code of Seattle and that therefore occupants of the hotel could claim the special relationship required by Campbell in order to press suit. This case is almost identical to your own, and it is my belief therefore that the City will be liable for any injuries or deaths which would occur in the event of a fire at the restaurant. Mr. Peter Hahn November 12, 1984 Page 3 Based upon the information available to me and my reading of the Campbell and Seattle cases it is my belief that the City risks liability for the death or injury to any individual brought about because of a fire at the Regency Building. The information supplied indicates that the situation before us fits into the Campbell exception making the City liable for a failure to enforce the specific provisions of the fire code relating to the exits and the occupancy. I would differentiate. the other issues raised by Mr. Reeves's letter which seem of a more technical nature which the City might well be able to compromise. Again, the general rule is that the City has discretion in the enforcement of its police power and is not required to pursue each and every violation, but may attempt to make reasonable decisions regarding the exercise of that power. In the situation involving the loading and exiting, I recommend that you take whatever enforcement action is necessary to correct that situation. If the City for whatever reason chooses not to do so, it must be done with the awareness that there is a high probability that the City would be held liable in the event of a death or injury to any person due to fire. I am aware Mr. Pantley points to other occupancy loading problems which exist at other restaurants within Edmonds and which have gone uncorrected. If that is the case the Fire Marshal and the Building Official should move to ascertain whether such violations exist and to address them as well. In this case however, the City's own files indicate clear knowledge of violations. Because of the duty and liability imposed by the Campbell exception, this situation should be addressed immediately. Scott S der WSS:jt LE October 24, 1984 MEMO TO: Mayor Naughten FROM: Harold Reeves Building Official SUBJECT: UPDATE ON THE REGENCY BUILDING SAFETY PROBLEMS Despite our efforts to obtain compliance with the City's life safety codes, Mr. Pantley continues to operate the Regency Building at 144 Railroad Avenue with occupancy and exiting code violations which threaten the safety of the public. The following is my analysis of the current situation. The plans were submitted and approved for one hour fire resistive. construction between the parking garage (B-1 occupancy) and the restaurant (A-2.1 occupancy). However, I am in receipt of a recent opinion by the International Conference of Building Officials which holds that the required separation should be 3 hour instead of one hour. To make up the difference would require the addition of more fireproofing to the structural steel and the installation of a 3 hour fire door assembly. One hour construction was provided but there is no fire door at all between the parking garage and the 1st floor corridor serving exit Tl from the restaurant. This is a great hazard to the restaurant occupants. Section 3303 and 3318 of the UBC require that th.e A-2.1 restaurant have a main exit capable of accomodating 1/2 the total occupant load. Thus, the existing exits for the building would limit the total number on the third floor to 300. This is the limit stated on Mr. Pantley's Certificate of Occupancy, yet he has posted a load limit sign of 377 and states that he has 400 or more people at times on the third floor. Other code violations exist also. Restaurant exit #2 dumps into the parking garage. Plans called for a walkway (never installed), but the code would require a fire resistive corridor to the public way. The first floor lease space appeared originally to be designed for offices but was changed to retail use. The tenants use the fire resistive exit corridor as a mall and prop open the fire doors. If these doors must be open, they should be on smoke detector actuated automatic closure devices. The City Attorney feels that the City has a great liability exposure in this matter. It is my recommendation that efforts be coordinated through the attorney's office to secure compliance with the code as soon as possible. HR/cr CITY OF E D M O N D S LARRY S. You have, however, been verbally informed of the problems. To confirm our August 14, 1984 conversation, the first floor parking garage is required to have a 1 hour fire.resistive occupancy separation from the offices, shops, and restaurant (UBC 104 d). All openings in such separations shall be protected by fire assemblies having a 1 hour fire protective rating (UBC 503 c). The existing aluminum and glass "store front" door does not comply. Required fireproofing of structural members in the garage is deteriorating and must be maintained to insure 1 hour fire resistive integrity (UBC 104 d). Tenants on the first floor continue to prop open their entry doors, which are to remain closed to protect the fire resistivity of the cooridor, which is a part of the re- quired exit for those on the floors above (UBC 104, 3305). You continue to use the south portion of the third floor as a banquet facility without minimum exiting as required by UBC 33. By letter dated July 1.8, 1984, you were told that this use must cease immediately until proper exiting is provided. The combination of these code violations is creating a serious threat to the safety and welfare of the occupants of your building. We have been, and continue to be, receptive to meeting with you. How- ever, please understand that the City has an obligation.to our citizens to insure conformance to State mandated fire and building codes, and this will require a firm committment on your part. We are asking for your full cooperation in resolving this matter, to avoid legal proceedings. Please contact the Building Division within three (3) days of this letter. AGENDA BA-3-82 Alternate method of fireproofing for structural steel in parking area on first level of building at 144 Railroad Avenue. Mr. Albers read the letter from Kirk Black of Pantley's, Inc. requesting an alternate method of fireproofing the steel columns, beams, and girders in the covered parking area. Mr. Reeves asked Mr. Whiteley if the building would still stand up if fireproofing of the trusses was omitted as requested. Mr. Whiteley responded that the building might if the main columns and frames were fireproofed but the trusses would buckle and the floors will come down. Mr. Reeves stated that a sprinkler system is not required in this building per the Uniform Building Code. A sprinkler system allows for area increases and increase in the number of stories allowed but it is not a substitution for occupancy separation. The situation at the above building is a parking garage and commercial habital space above it and the code requires a 1-hour occupancy separation, and the sprinklers in this case are not a substitution. Mr. Albers asked if the board could make a recommendation on this item without the applicant present. Mr. Reeves stated that the City Attorney advised that the board could, the applicant is not required to show at the meeting. The board asked what the floor area is in the building and Mr. Reeves stated that the first floor has 4,900 sq. ft. of occupied space and the rest is parking, the second .floor has 12,580 sq. ft. of occupied space and the third floor has 11,166 occupied space and extra decking. The restaurant comprises of about 7,000 sq. ft. on the third floor. The basic allowable for Type V-1-hour construction is 14,000 sq. ft. plus area increases are allowed for distance from property lines and in this case there is a street on one side and water on the other. They meet the allowable area and are not required to have sprinkler system. Mr. Reeves stated that it is the applicant'sidea that if the columns and main members where fireproofed, the sprinkler system would allow for the secondary members to be unprotected. BOARD OF APPEALS MINUTES March 15, 1982 Page 2 Mr. McComas stated that the building is to be Type V-1-hour construction and if you don't apply anything to the steel it is not 1-hour construction. The original plan for the parking area was to have a drop ceiling which would be 1-hour rated. Then the plan was changed to spray all the steel members. Mr. McComas said he was satisfied that the spraying would give the 1-hour cover to everything that was sprayed but now they do not want to do either of the plans and he felt this alternate proposal should be denied and they should be forced to spray all the structural members or apply sheetrock. Mr. Albers stated that he could see their problem with spraying the trusses that it would affect the sprinkler system, but if the sprinkler heads were lowered below the trusses then he couldn't see any problem with spraying .the trusses. It was the board's opinion that the area in question should be satisfactorily sprayed or sheetrocked. MR. TRENT MOVED, SECONDED BY MR. ALBERS TO DENY THE REQUEST SINCE IT DOES NOT MEET THE 1-HOUR FIRE RATING. ALL STRUCTURAL MEMBERS SHOULD BE EITHER SPRAYED, SHEETROCKED OR SOME OTHER FIREPROOFING METHOD. MOTION CARRIED.
