We are both aware of the fact that the bar area of the usiness has an occupancy limit of 169. At approximately 2320 hours, we made two body ants, which resulted in counts of approximately 185. We went down the elevator and food by the elevator at the lobby area, and counted approximately 20 more people. enter e elevator and 'go up to the bar. It should be noted that people left and arrived, and he gross addition was approximately 20'. At 2349 hours, OFFICER W. LEE and I went back p to the bar area, and conducted a very systematic count of the patrons inside. This ount showed there to be approximately 215 people inside the business. Prior to tering I checked the handheld counter that is used by the door person to count people 3.s they enter, and noticed that it listed 142 on the display window. e advised the manager of Fish House Charlie's, BRICE, that the count was over the legal cupancy number. ' • ' 7 I:Y 1� ray •1 1 Please review the attached synopsis of contacts the police department has had during the first nine months of 1993, in connection with Fishhouse Charlie's Lounge. As you can see, there have been an inordinate number of incidents arising out of this establisbment, even though they have not all occurred on the premises. This actually indicates a greater problem than one might expect if considering only those incidents occurring on the premises. The fact that these events have spilled over into the surrounding neighborhood only compounds things. One of the major areas of concern is the apparent overservice, as reflected by the number and nature of contacts. Drunk drivers, public urination, fights, disturbances, and liquor law violations of varying types are routine fare on any given weekend. Of the 39 incidents recounted in this list, two of them occurred on Wednesday, two on Thursday, and the other 35 between Friday and Sunday. Clearly things heat up as the week ends, the liquor flows, and the music creates more interaction among patrons and between patrons and "security" personnel (bouncers) . Particularly in light of the fact thp': n^..have had off -duty officers working at this place in uniform since July, these are very discouraging statistics. There was an incident recently (September 18) in which these officers were attempting to break up a fight and. were themselves assaulted. One of the combatants actually attempted to gain control of an officers weapon. Another problem associated with this.business has been the continued overcrowding, which of course adds to the problematic nature of the situation. There have been meetings between police and fire officials and the management of the business in an attempt to gain compliance with set occupancy limits. To the management's credit, their enforcement of those occupancy limits has decreased the number of problems encountered. Fishhouse Page Two Additionally, access to the lounge is highly restricted. The only means of getting in or out of the place is via the sole elevator, which has a comfortable capacity of about six. When you put 10-15 intoxicated persons of both sexes into that space, problems occur. Further, it is difficult to respond to emergent situations when either (a) the elevator is at the top and the officers are at the bottom, or (b) officers are greeted at the bottom and delayed by "security staff." I know of at least one instance where liquor board enforcement personnel were so delayed, apparently intentionally. tie management has told officers that "there only seem to be problems when the police are here." That statement is a bit self-serving, since we are generally there in response to a.call for assistance, generally from someone other than the management or "security" personnel- -The question I need answered is this: In light of the ongoing nature of these problems, and the apparent inability, or unwillingness, of the management to effectively deal with'them, are there grounds for denial of the pending application for renewal of Fishhouse Qnarlie's cabaret license? That license has expired and the business has applied for a renewal. If no grounds exist for such denial, is it feasible that we approve the renewal with specific requirements, i.e., maintain occupancy limits, limited complaints, etc., including a stipulation that failure to adhere to these requirements may result in revocation of the license? I will appreciate your views and recammendations on this as soon as possible, so that we may proceed as appropriate. Thank you for your attention to this matter. Officers also arrested two other subjects for obstructing in the same case. 3/13/93 93-1005 oDsis: Officers came upon a disturbance involving at least 20 people, in the parking lot of FHC. There were a number of fights involved in the disturbance. Some of the people involved were bouncers from FHC_ One subject required medical attention. Due to the number of conflicting accounts as to what had happened, no charges were filed 3/13/93 93-1003 Synopsis: Officers were dispatched to a disturbance at FHC. Two subjects had gotten into an altercation. One had been involved in several fights in the past at FHC. He had to be restrained outside of FHC, by the doorman. Subject assaulted the doorman, and was arrested for assault. 3/28/93 93-1243 Synopsis: A subject was asked to1eave by the employees of FHC. He refused and was detained by the bouncers, for the police. He then became violent and assaulted the bouncers, and was subsequently taken to jail by the police. 4/10 3 93-1478 Synopsis" Officers were dispatched to a disturbance at FHC. Apparently a fight had broken out near the restrooms. The suspect was gone upon police arrival. Two males were verbally accosting two females. Victim and a friend tried to get the suspects to leave the females alone, and one suspect struck the victim_ All had been at FHC just prior to the assault. The officers then came upon a fight in the lower lobby area. The officers tried to break up the fight, and during their efforts to break the fight up, both officers were assaulted. One suspect attempted to grab one officers gun during the fight. A total of three subjects were arrested from this event. Officers were approached by several patrons in the lounge who told the officers that they had missed " a hell of a fight" They stated to the officers that the fight involved up to 12 people. The manager tried to downplay the incident, and also mentioned that the tight involving the officers on 9/18/93, was blown out of proportion - SUMMARY: Out of the listed case reports; the following is a breakdown on the calls officers either witnessed or responded to at Fish House Charlie's. Assaults: Assaults with an arrestl 16. Assaults with out an arrest/ 7 Obstructing a Police Officer. 6 Disorderly Conduct: 5 Criminal Trespass: 4 Resisting Arrest: 2 Liquor Law Violations: 10 Misc. This does not include those cases were the subjects involved either left, or did not cooperate with a police investigation. The total case reports taken during this time period is 41. This total sho"I both dispatched calls to FHC, and those incidents that were on viewed by the Officers. These figures do not include any related case reports and arrest that may have occurred adjacent to Fish House Charlies, but may have been related to incidents that had started there. During seven of these incidents, off duty officers were working at FHC . Officers work there on Friday and Saturday nights from 2200 to 0200, with two officers there at a time. David mentioned that the City has been pursuing another tavern owner on the same basis. That fact and the well documented problems at the location should answer any questions about selective prosecution. David also indicates that the owners of the building would like something done about Fish House Charlies because�,of- the amount of damage which occurs on a regular basis to their building. David and I recommend the following procedure: 1:„......: After .each inspection; you would provide an inspection: report to me. 2. I would write up any complaints required and forward them to David for processing. The Uniform Fire Code is not regularly cited in municipal court, David does not have a copy of it and our office regularly deals with those issues. 3. David would handle the actual prosecutions under the terms of his agreement with the City. While we recognize that there is some sensitivity regarding Fish House Charlies, there is a clear problem there that requires correction. The most straightforward way is to begin dealing with the occupancy problems with the owner/operator while continuing to prosecute individual patrons who break other laws. In that way we can begin to address both the issue of overcrowding and the conduct of .the business .by prosecution of unruly patrons. HALL MAYOR At your request the City has reviewed the occupant load calculations for the lounge, dance floor, bar and northwest seating area for the subject restaurant. Occupant load is determined by the Uniform Building Code and is based on -the use of space, fixed seating, and by.width and number of exits from the rooms in question. On file in the Building Division is a City letter which previously established the occupant load at 168 (copy enclosed). The floor plan you provided for review is virtually identical to the approved seating plan on file with the City; it is therefore determined that the total occupant load of 168 is accurate. For your information the total load for the south side dining area is 212. As required by the Uniform Building Code an occupant load sign shall be installed above the bar entry in a conspicuous space indicating that the maximum occupant load of 168. I CONTACTED THE ON -DUTY POLICE SERGEANT AND ADVISED HIM OF THE OVERCROWDED LOUNGE. WE HAVE HAD THIS DISCUSSION BEFORE AND I BELIEVE THAT YOU NEED TO MAKE SURE THAT YOU STAY WITHIN THE OCCUPANCY RATING. THIS WOULD REDUCE THE POSSIBILITY OF HAVING SOMEONE OVERSERVED AND NOT SEEING THEM, REDUCE THE POSSIBILITY OF A FIGHT AND MAKE IT POSSIBLE FOR PATRONS TO EXIT SAFELY IF NECESSARY. Section 3303 and 3318 of the UBC require that the A-2.1 restaurant have a main -exit capable of accomodating 1/2 the total occupant load. Th.us, the existing exits for the building would limit th.e total number on the third floor to 300. This is the limit stated on Mr. Pantley's Certificate of Occupancy, yet he has posted a load limit sign of 377 and states that he has 400 or more people at times on the third floor. Other code violations exist also. Restaurant exit T2 dumps into the parking garage. Plans called for a walkway (never installed), but the code would require a fire resistive corridor to the public way. The first floor lease space appeared originally to be designed for offices but was changed to retail use. The tenants use the fire resistive exit corridor as a mall and prop open the fire doors. If these doors must be open, they should be on smoke detector actuated automatic closure devices. The City Attorney feels that the City has a great liability exposure in this matter. Clearence House 2. Pindler and Pindler, Number 2213, Grospoint 3. Bayberry Handprints Design - Lana #5 4. Zumsteg, Inc., Tehiti Chintz browns #C95212-1 5. Kirk - Brummel Associates, S/R Boca Chica on MGP-6005 6. Kirk - Brummel Associates, Yards Woodworks on Ottoman/Natural As you can see by the enclosed letter dated December 22, 1981, you were advised of this requirement and you were required to provide the documentation prior to its installation. Then again by letter dated February 22, 1982 you were required by Item 6 to provide the documentation prior to final approval. I have received information on a total of 10 fabrics that were installed in your restaurant. Of the ten only four (4) have the information that is acceptable to the fire and build- ing departments. The six that do not comply with our require- ments make reference to California Bureau of Home Furnishings Technical Bulletin #117. I have been in contact with the California State Fire Marshal and he has advised me that this technical bulletin pertains strictly to residential fabrics - not commercial installations.
