IN THE MATTER OF THE APPLICATION OF ANNE MILLER FOR APPROVAL
OF CONDITIONAL USE PERMIT FOR HOME DAY CARE
DECISION. The permit application is granted, subject to the
conditions listed below.
INTRODUCTION
Anne Miller, 1450 Olympic View Drive, Edmonds, WA and hereafter
referred to as the applicant, has requested a conditional use permit
for the purpose of operating a home day cae facility out of her
residence at 1450 Olympic View Drive, Edmonds, WA,
PARTIES OF RECORD

After due consideration of the evidence presented by the Applicant;
evidence elicited at the public hearing; and as a result of personal
inspection of the subject property and the surrounding area by the
Assistant City Planner, the following Findings of Fact and Conclusions
constitute the basis of the decision of the Assistant City Planner.
FINDINGS OF FACT
1. The Applicant has requested a Conditional Use Permit to allow her
to operate a home day care facility out of her residence,at 1450
Olympic View Drive, Edmonds.
2. The subject property is zoned RS-12, as established by the Edmonds
Community Development Code (ECDC).
3. The Comprehensive Policy Plan Map designates the subject property
as Low Density Residential.
4. The subject property is developed with a single family residence
with access off Olympic View Drive.

5. The following are the review criteria for home day care
facilities, as outlined in Chapter 20.19 of the ECDC:
A. State Lincensing - The Applicant must obtain and comply with
all State licensing requirements.
B. Outdoor Play Times - Outdoor play times shall not be
scheduled before 9:00 p.m. or after 8:00 p.m. Care shall be
taken to minimize noise impacts on adjacent residences.
C. Fenced Play Area - A completely fenced play area is
required. No play area shall be allowed in the street
setback.
D. Parkin - Two on -street or off-street parking spaces must be
provided. Off-street parking spaces must be reasonably
accessible to the applicant's residence and available for
public use under city ordinance.
6. The Applicant testified that she intends to care for up to four
children, including her own two children.
7. The Applicant testified that she has obtained a state license for
a home day care facility to care for up to six children.
8. The Applicant that she intends to operate the day care from early
morning to late afternoon (7:00 a.m. to 7:00 p.m.)
9. The outdoor play area is a fenced yard on the side and rear of the
residence. Outdoor play times will be between 9 a.m. and 6 p.m.
10. Adequate parking is available in the driveway and shoulder of the
street.

CONCLUSIONS
1. The application is for the approval of a conditional use permit
for a home day care facility at 1450 Olympic View Drive, Edmonds.
2. The subject property is zoned RS-12 and is designated as Low
Density Residential on the Comprehensive Policy Plan Map.
3. The Applicant has obtained obtained her state license to care for
six full-time children.
4. The proposed use appears to be consistent with the Comprehensive
Plan.
5. Home day care is an allowed use in the RS-12 zone with the grant
of a conditional use permit.

6. The proposed day care, as conditioned, does not appear to pose any
significant impact to the public or nearby private property or
improvement.
7. The proposed day care complies with the review criteria of Chapter
20.19 of the ECDC, as outlined in the Findings of Fact.
DECISION
Using the above findings and conclusions as the basis for the decision
of the Assistant City Planner, the application_ for a Conditional Use
Permit for a home day care at 1450 Olympic View Drive is granted,
subject to the following conditions:
1. The Applicant is to comply with all State licensing requirements
for a home day care facility.
2. The total number of children may not exceed six.
3. The hours operation are to be no earlier than 7:00 a.m. or later
than 7:00 p.m.
4. Outside play times shall be be between 9:00 a.m. and 6:00 p.m.
y 5. The Applicant must obtain a Business License from the City Clerk,
6. Approval of this permit shall be subject to an inspection by the
City Fire Marshal to insure that a smoke detector and fire
extinguisher have been installed.
7. A solid six foot high fence shall be installed or maintained along
the entire rear yard.
This Conditional Use Permit is granted subject to the authority granted
the Planning Staff as outlined in Chapter 20.95.060 of the ECDC.
