Determination: Study Required: During review and inspection of the subject site, it was found that the site appears to contain and/or is adjacent to a number of critical areas, including possible wetland soils and vegetation pursuant to Chapter 20.15B of the Edmonds Community Development Code (ECDC). Based on these findings, prior to submission of any development permit, you will be required satisfy the requirements of ECDC 20.15B by completing the following: Possible Stream/Wetland: My site investigation has shown that the site could possibly contain wetland soils and vegetation that are part of a stream. Based on the above findings, a Critical Areas Study is required to determine the hydrology of the area and to delineate the approximate boundaries of any stream and/or wetland and identify its buffers. The required qualified critical areas consultant needed to perform the study shall be a specialist in wetland biology and/or streams with a minimum of two years' field experience with streams in the Pacific Northwest. All critical areas studies shall be performed as three party agreements with the city selecting the consultant and the property owner or applicant paying the fees. LSA No. 4630 1 1 1 H Site Development Summary Drainage Improvement Design: A new proposed residence is proposed to be constructed on an existing 12,152 sf lot. The existing vacant lot is open grass lawn with surrounding landscaping. Fruitdale Creek runs westerly just north of the site. To mitigate the development of the site, an infiltration system will be installed to control the drainage runoff from the impervious surfaces. All on -site impervious surfaces are proposed to be collected and routed to the on -site infiltration system. A 6" overflow pipe will provide a discharge outlet if the infiltration system reaches capacity (to prevent flooding). Listed below is a summary of the infiltration trench design. Infiltration Trench Design: The on -site infiltration trench is to be constructed per the City of Edmonds' standard practices. The length of the trench is dependant upon the measured infiltration rate of the native soils and the collection area conveyed to the individual trench. SCS soil survey designates the area soils as an Alderwood-Urban land complex (#5- type C) soil. SCS defines the Alderwood- Urban land complex as a mixture of multiple types of soils, including Alderwood, Everett and Norms soils. General soil characteristic can vary greatly Aue to the variation of multiple pockets of soil types (see attached description). Two test pits, in the area of the proposed infiltration trench were explored on -site. The soils found in the pits was medium sand. Thus, confirming the SCS description of an Everett (#18- type A) soil. Two test pit percolation trials were completed on the soil to determine the on -site percolation rate (see attached calculations). Using the City's design criteria (currently the 1990 King County manual, section 4.5), a required trench length was computed. A length of 50 feet of 4 feet deep, 4 feet wide trench was determined to fully infiltrate the 100-year design storm (P,00). See attached calculations. LSA No. 4630 A _' 1 1 1 u it H Grading and Erosion Control: This project will require grading to raze the existing house and construct the proposed single family resident development. Standard erosion control measures are proposed to be used during construction. The primary erosion and sediment control BMP during construction will be proper soil stabilization methods. Exposed soils shall be stabilized by application --of effective bmp's that protect the soil from the erosive forces of raindrops, flowing water, and wind. Applicable practices include, but not limited to, temporary and permanent seeding, sodding, mulching, plastic covering, erosion control fabrics, matting, soil application of polyacrylamide (pam) , the early application of gravel base on areas to be paved, and dust control. The contractor shall select a soil stabilization method best suited for the particular situation. Stock piles must be stabilized and protected with sediment trapping measures. In addition, site containment of exposed soils shall be sustained by using silt fence barriers along the down -slope boundaries of the site's disturbance areas. See the site development plan for details. Estimated grading calculations: Minimal project grading is expected due to the relatively flat site. The following grading quantity estimations were calculated using a computer modeling program within the AutoCAD computer drawing. The calculations are approximate. The quantities listed are for the permitting process only and should not be considered precise amounts for bidding purposes. With proper installation, maintenance and inspections of the proposed construction the project should have minimal impact to the surrounding environment. To meet the City's criteria the proposed trench width will need to be increased from 4 feet to 4.25 feet. The following sizing calculations replace the original sizing calculations included in the original Engineering Report dated April 2Id, 2004. Initial basin excavation should be conducted to within I - foot of the final elevation of the basin floor. Any accumulation of silt in the infiltration facility must be removed before putting it in service. After construction is completed, prevent sediment from entering the infiltration facility by first conveying the runoff water through an appropriate pretreatment system such as a pre -settling basin, wet pond, or sand filter. ' • Infiltration facilities should generally not be used as temporary sediment traps during construction. If an infiltration facility is to be used as a sediment trap, it must not be excavated to final grade until after the upgradient drainage area has been stabilized. • Traffic Control - Relatively light -tracked equipment is recommended for this operation to avoid compaction of the basin floor. The use of draglines and trackhoes should be considered for constructing infiltration basins. The infiltration area should be flagged or marked to ' keep heavy equipment away. Maintenance Criteria Provision should be made for regular and perpetual maintenance of the infiltration basin/trench, with adequate access. Maintenance should be ' conducted when water remains in the basin or trench for more than 24 hours. An Operation and Maintenance Plan, approved by the local jurisdiction, should ensure maintaining the desired infiltration rate. Debris/sediment accumulation- Removal of accumulated debris/sediment in the basin/trench should be conducted every 6 months or as needed to prevent clogging, or when water remains in the pond for greater than 24 hours at or less than design storm conditions. Seepage Analysis and Control - Determine whether there would be any adverse effects caused by seepage zones on nearby building foundations, basements, roads, parking lots or sloping sites. For more detailed information on maintenance, see Volume V, Section 4.6 — Maintenance Standards for Drainage Facilities. Verification of Performance During the first 1-2 years of operation verification testing (specified in SSC-7) is strongly recommended, along with a maintenance program that results in achieving expected performance levels. Areas are irregular in shape and are 100 to 1,000 acres in size. The native vegetation is mainly conifers. Elevation is 50 to 550 feet. The average annual precipitation is about 40 inches, the average annual air temperature is about 50 degrees F, and the average frost -free season is 170 to 190 days. This unit is about 60 percent Alderwood gravelly sandy loam and about 25 percent Urban land. The components of this unit are so intricately intermingled that it was not practical to map them separately at the scale used. Included in the unit are small areas of McKenna and Norma soils and Terric Medisaprists in depressional areas and drainageways on plains. Also included are small areas of soils that are very shallow over a hardpan; small areas of Everett, Indianola, and Ragnar soils on terraces and outwash plains; and soils that have a stony and bouldery surface layer. Included areas make up about 15 percent of the total acreage. The Alderwood soil is moderately deep over a hardpan and is moderately well drained. It formed in glacial till. Typically, the surface layer is very dark grayish brown gravelly sandy loam about 7 inches thick. The upper part of the subsoil is dark yellowish brown and dark brown very gravelly sandy loam about 23 inches thick. The lower part is olive brown very gravelly sandyloam about 5 inches thick. A weakly cemented hardpan is at a depth of about 35 inches. Depth to the hardpan ranges from 20 to 40 inches. Permeability of the Alderwood soil is moderately rapid above the hardpan and very slow through it. Available water capacity is low. Effective rooting depth is 20 to 40 inches. Runoff is slow, and the hazard of water erosion is slight. A seasonal perched water table is at a depth of 18 to 36 inches from January to March. ' Urban land is areas that are covered by streets, buildings, parking lots, and other structures that obscure or alter the soils so that identification is not possible. ' The Alderwood soil in this unit is used mainly for parks, building sites, lawns, gardens, and woodland. The main limitations of the Alderwood soil for homesites and septic tank absorption fields are the depth to the hardpan and the seasonal perched water table. Onsite waste disposal systems often fail or do ' not function properly during periods of high rainfall. Drainage is needed if buildings with basements and crawl spaces are constructed. Topsoil need to be stockpiled during site preparation and subsequently used to cover the exposed material. Additions of fertilizer and peat are desirable prior 1 to seeding grass for lawns. Any nonconforming sign shall be brought into immediate compliance with the code in the event that: 1. An act prohibited by the provisions of subsection A of this section occurs; 2. The building to which the noncon- forming sign or signs is appurtenant is remod- eled or receives an addition equal to 25 percent of the building's value prior to the addition or remodeling; 3. A change in the use of the building to which the sign is appurtenant or the land upon which the sign is located occurs; or 4. An application for the erection of a new sign or signs is made by the owner or les- see of the business premises to which the sign is appurtenant. C. None of the foregoing provisions relat- ing to permitted maintenance, name change or preservation of the sign under paragraph A of this section shall be construed so as to permit the continuation or preservation of any non- conforming off -premises sign. A nonconforming lot is one which met applicable zoning ordinance stan- dards as to size, width, depth and other dimen- sional regulations at the date on which it was created but which, due to the passage of a zon- ing ordinance, the amendment thereof or the annexation of property to the city, no longer conforms to the current provisions of the zon- ing ordinance. A lot which was not legally cre- ated in accordance with the laws of the local governmental entity in which it was located at the date of the creation is an illegal lot and will not be recognized for development. B. Continuation. A nonconforming lot may be developed for any use allowed by the zon- ing district in which it is located, even though such lot does not meet the size, width, depth and other dimensional requirements of the dis- trict, so as long as all other applicable site use and development standards are met or a vari- ance from such site use or development stan- dards has been obtained. In order to be developed a nonconforming lot must meet minimum lot size standards established by the provisions of this code, subject to the provi- sions of subsection D of this section. C. Combination. If, since the date on which it became nonconforming due to its failure to meet minimum lot size or width criteria, an undeveloped nonconforming lot has been in the same ownership as a contiguous lot or lots, the nonconforming lot is and shall be deemed to have been combined with such contiguous lot or lots to the extent necessary to create a conforming lot and thereafter may only be used in accordance with the,provisions of the Edmonds Community Development Code, except as specifically provided in subsection D of this section. D. Exception for Single -Family Dwelling Units. An applicant may build one single-fam- ily dwelling unit on a lot or parcel regardless of the size of the lot or parcel if, but only if, one of the following exceptions applies: 1. In an RS zone, such nonconforming lot may be sold or otherwise developed as any other nonconforming lot pursuant to the fol- lowing conditions and standards: -a. The lot area of the nonconforming lot is not less than the minimum lot area spec- ified in the table below for the zoning district in which the subject property is located, and b. Community facilities, public utili- ties and roads required to serve the noncon- forming lot are available concurrently with the proposed development, and . c. Existing housing stock will not be destroyed in order to create a new buildable lot, and d. The proposed development of the lot is generally consistent with the character of the surrounding neighborhood. The existing vacant lot is open grass lawn with surrounding landscaping. Fruitdale Creek runs westerly just north of the site. To mitigate the development of the site, an infiltration system will be installed to control the drainage runoff from the impervious surfaces. All on -site impervious surfaces are ' proposed to be collected and routed to the on -site infiltration system. A 6" overflow pipe will provide a discharge outlet if the infiltration system reaches capacity (to prevent flooding). Listed below is a summary of the infiltration trench design. . Infiltration Trench Design: ' The on -site infiltration trench is to be constructed per the City of Edmonds' standard practices. The length of the trench is dependant upon the measured infiltration rate of the native soils and the collection area conveyed to the individual trench. I SCS soil survey designates the area soils as an Alderwood-Urban land complex (#5- type C) soil. SCS defines the Alderwood- Urban land complex as a mixture of multiple types of soils, including Alderwood, Everett and Norms soils. General soil characteristic can vary greatly due to the variation of multiple pockets of soil types (see attached description). Two test pits, in the area of the proposed infiltration trench were explored on -site. The soils found in the pits was medium sand. Thus, confirming the SCS description of an Everett (#18- type A) soil. Two test pit percolation trials were completed on the soil to determine the on -site percolation rate (see attached calculations). Using the City's design criteria (currently the 1990 King County manual, section 4.5), a required trench length was computed. A length of 50 feet of 4 feet deep, 4 feet wide trench was determined to fully infiltrate the 100-year design storm (P,00). See attached calculations. Standard erosion control measures are proposed to be used during construction. The primary erosion and sediment control BMP during construction will be proper soil stabilization methods. Exposed soils shall be stabilized by application of effective bmp's that protect the soil from the erosive forces of raindrops, flowing water, and wind. Applicable practices include, but not limited to, temporary and permanent seeding, sodding, mulching, plastic covering, erosion control fabrics, matting, soil application of ' polyacrylamide (pam) , the early application of gravel base on areas to be paved, and dust control. The contractor shall select a soil stabilization method best suited for the particular situation. Stock piles must be stabilized and protected with sediment trapping measures. In addition, site containment of exposed soils shall be sustained by using silt fence barriers along the down -slope boundaries of the site's disturbance areas. See the site development plan for details. 1 n Estimated grading calculations: Minimal project grading is expected due to the relatively flat site. The following grading quantity estimations were calculated using a computer modeling program within the AutoCAD computer drawing. The calculations are approximate. Initial basin excavation should be conducted to within 1- foot of the final elevation of the basin floor. Any accumulation of silt in the infiltration facility must be removed before putting it in service. After construction is completed, prevent sediment from entering the infiltration facility by first conveying the runoff water through an appropriate pretreatment system such as a pre -settling basin, wet pond, or sand filter. • Infiltration facilities should generally not be used as temporary ' sediment traps during construction. If an infiltration facility is to be used as a sediment trap, it must not be excavated to final grade until after the upgradient drainage area has been stabilized. • Traffic Control - Relatively light -tracked equipment is recommended for this operation to avoid compaction of the basin floor. Areas are irregular in shape and are 100 to 1,000 acres in size. The native vegetation is mainly conifers. Elevation is 50 to 550 feet. The -average annual precipitation is about 40 inches, the average annual air temperature is about 50 degrees F, and the average frost -free season is 170 to 190 days. t This unit is about 60 percent Alderwood gravelly sandy loam and about 25 percent Urban land. The components of this unit are so intricately intermingled that it was not practical to map them separately at the scale used. 1 Included in the unit are small areas of McKenna and Norma soils and Terric Medisaprists in depressional areas and drainageways on plains. Also included are small areas of soils that are very shallow over a hardpan; small areas of Everett, Indianola, and Ragnar soils on terraces and outwash plains; and soils that have a stony and bouldery surface layer. Included areas make up about 15 percent of the total acreage. The Alderwood soil is moderately deep over a hardpan and is moderately well drained. It formed in glacial till. Typically, the surface layer is very dark grayish brown gravelly sandy loam about 7 inches thick. A weakly cemented hardpan is at a depth of about 35 inches. Depth to the hardpan ranges from 20 to 40 inches. Permeability of the Alderwood soil is moderately rapid above the hardpan and very slow through it. ' Available water capacity is low. Effective rooting depth is 20 to 40 inches. Runoff is slow, and the hazard of water erosion is slight. A seasonal perched water table is at a depth of 18 to 36 inches from January to March. ' Urban land is areas that are covered by streets, buildings, parking lots, and other structures that obscure or alter the soils so that identification is not possible. The Alderwood soil in this unit is used mainly for parks, building sites, lawns, gardens, and woodland. The main limitations of the Alderwood soil for homesites and septic tank absorption fields are the depth ' to the hardpan and the seasonal perched water table. Onsite waste disposal systems often fail or do not function properly during periods of high rainfall. Drainage is needed if buildings with basements and crawl spaces are constructed. Mr. Helleren: Wetland Resources, Inc. conducted a wetland reconnaissance on the approximate 0.73-acre site (Parcel B) located at 1551 10th Place N. in the city of Edmonds, Washington. Wetland conditions were evaluated using the Washington State. Department of Ecology Wetlands Identification and Delineation Manual March 1997, as required by the City.of Edmonds. The subject property is irregularly shaped with access from the east via 10Lh Pt N. The site is undeveloped; surrounded by single-family residences, and is comprised entirely of maintained lawn with a subtle west aspect. A Category 3 stream flows. across the northeastern corner of this property and off -site to the northwest. This stream is shown as a Type 5 water on the Snohomish County Water Types Classification maps, and is not mapped as containing fish on the Snohomish County bull trout or Chinook distribution maps. Given the extent of alteration, the stream does not appear to be suitable habitat for fish. The stream flows from east to west through a series of m.an-made ponds and often landscaped stream channel.. This series of ponds do not.contain .wetlands, but comprise the ordinary high water mark of the Category.3 stream. Category 3 streams in the City of Edmonds typically receive 10-foot. protective buffers. As portions of the Category. 3 stream, these ponds shall receive 10-foot buffers. No wetlands are located on the subject property. Parcel B is comprised of maintained lawn represented by colonial bentgrass (Agrostis tenuis, Fac), common dandelion (Taraxocum officinale, FaclJ), and unidentified mosses. Soils display Munsell colors ranging from dark brown to dark yellowish brown (10 YR 3/3 to 10 YR 4/4) with textures of sandy loam, from 0 to 18 inches below the surface. [Ord. 3327 § 1, 2000; Ord. 3 1, 2000]. 11.40.030 Nonconforming lots. A. Definition. A nonconforming lot is one which met applicable zoning ordinance stan- dards as to size, width, depth and other dimen- sional regulations at the date on which it was. created but which, due to the passage of a zon ing ordinance, the amendment thereof or the annexation of property to the city, no longer conforms to the current provisions of the zon- ing ordinance. A lot which was not legally cre- ated in accordance with the laws of the local governmental entity in which it was located at the date of the creation is an illegal lot and will not be recognized for development. . B. Continuation. A nonconforming lot may be developed for any use allowed by the zon- ing district in which it is located, even though such lot does not meet the size, width, depth and other dimensional requirements of the dis- trict, so as long as all other applicable site use and development standards are met or a vari- ance from such site use or development stan- dards . has been obtained. In order to be developed a nonconforming lot must meet minimum lot size standards established by the provisions of this code, subject to the provi- sions of subsection D of this section. r C. Combination. If, since the date on which it became nonconforming due to its failure to meet minimum lot size or width criteria, an undeveloped nonconforming lot has been in the same ownership as a contiguous lot or lots, the nonconforming lot is and shall be deemed to have been combined with such contiguous lot or lots to the extent necessary to create a conforming lot and. thereafter may only be used in accordance with the,provisions of the Edmonds Community Development Code, except as specifically provided in subsection D of this section. D. Exception for Single -Family Dwelling Units. An applicant may build one single-fam- ily dwelling unit on a lot or parcel regardless of the size of the lot or parcel if, but only if, one of the following exceptions applies: 1. In an RS zone, such nonconforming lot may be sold or otherwise developed as any other nonconforming lot pursuant to the fol- lowing conditions and standards: -a. The lot area of the nonconforming lot is not less than the minimum lot area spec- ified in the table below for the zoning district in which the subject property is located, and b. Community facilities, public utili- ties and roads required to serve the noncon- forming lot are available concurrently with the proposed development, and c. Existing housing stock will not be destroyed in order to create a new buildable lot, and d. The proposed development of the lot is generally consistent with the character of the surrounding neighborhood. An applicant applies for necessary permits to construct the unit within five years to the date the lot or parcel is annexed into the city and the lot or parcel was lawfully created under provisions of Snohomish County subdi- vision and zoning laws as well as the laws of the state of Way shington; or • (Reviwd5/01) 17-10.4 Attachment 7 Edmonds Community oelopment Code 17.40.040 r: 3. An applicant may remodel or rebuild one residence on a nonconforming lot without regard to the 50 percent destruction require- ment of ECDC 17.40.020(F) if a fully com- pleted building permit is permitted within one year of the destruction of the residence and all other development requirements of this code are complied with; or 4. The lot lines defining the lot or parcel were recorded in the Snohomish County recorder's office prior to December 31, 1972, and the lot or parcel has not at any time been simultaneously owned by the owner of a con- tiguous lot or parcel which fronts on the same access right-of-way subsequent to December 31, 1972, and the lot or parcel has access to an access right-of-way which meets the minimum requirements established by this code; or 5. - The owner oEa lot . which was law- fully created under he Snohomish County subdivision and zonin aws and which was annexed to the city of E onds on or after December 16, 1958, may file fully completed building permit applicati . or a development lot in accordance wi the provisions of this chapter and develop th lot if a fully completed building application to velop said lot waste filed with the city on or be a the date. estab-:; lished by Ordinance No. 30 . Nonconforming signs are injurious to the health, safety and welfare and destructive of the aesthetic and environmental living condi- tions which this zoning ordinance is intended to preserve and enhance. Nonconforming signs shall be brought into compliance with the provisions of. Chapter 20.60 ECDC under the following terms and conditions: A. No nonconforming sign shall be expanded, extended, rebuilt, reconstructed or altered in any way, except as otherwise pro- vided in ECDC 17.40.050; provided, however that the following acts are specifically permit- ted and shall not in and of themselves require conformance with the provisions of Chapter 20.60 ECDC: 1. Normal maintenance of the sign; 2. A change in the name of the business designated on the sign; or 3. Any action necessary to preserve the public safety in the event of damage to the sign brought about by an accident or an act of God. B. Any nonconforming sign shall . be brought into immediate compliance with the code in the event that: 1. An act prohibited by the provisions of subsection A of this section occurs; 2. The building to which the noncon- forming sign or signs is appurtenant is remod- eled or receives an addition equal to 25 percent of the building's value prior to the addition or remodeling; 3. A change in the use of the building to which the sign is appurtenant or the land upon which the sign is located occurs; or 4. An application for the erection of a new sign or signs is made by the owner or les- see of the business premises to which the sign is appurtenant. C. None of the foregoing provisions relat- ing to permitted maintenance, name change or preservation of the sign under paragraph A of this section shall be construed so as to permit. the continuation or preservation of any non- conforming off -premises sign. It is hereby determined that pursuant to Chapter 17.40 of the Edmonds Community Development Code the property identified above contains a nonconforming (check only one of the following): USE BUILDING Description of legal nonconforming lot: LOT X SIGN A surveyor representing the owners of 1551 10"' Place North made an inquiry to the City to determine whether the property at 1551 loth Place North, could be considered two legal lots (Attachment 2). The property consists of two parcels. One parcel, described above as parcel "B", is developed with a single-family residence. The other parcel, described above as parcel "A", is vacant and appears to be substandard according to the development standards of the RS-12 zone where it is located. (See Attachment 6) The surveyor was able to provide information in the form of deeds that describe the two parcels and show the transfer of ownership to separate parties (Attachments 3, 4, and 5) as well as an old survey map that shows the two parcels (Attachment 6). The two parcels as described above were sold as separate parcels to two separate parties in 1956. At this point, the property was within unincorporated Snohomish County. In Snohomish County, prior to 1972, a formal subdivision process was not required to create a new legal lot. The deeds and survey indicate that the lots were legally created and, when annexed to the City of Edmonds in 1958, became nonconforming lots based on size according to ECDC 17.40.030.A (Nonconforming lots) (Attachment 7). The lots are now in ownership by the same person and are thus considered to be combined according to ECDC 17.40.030 (Nonconforming lots — combination). According to this section, the lots are deemed to be combined and thereafter may only be used in accordance with the provisions of the Development Code unless that property qualifies for an exemption that would allow it to be considered a separate building lot. Section 17.40.030.D (See Attachment 7) provides specific exceptions that, if apply, can be used to build one single-family dwelling unit on a nonconforming lot or parcel regardless of size. Staff has determined that the first exception provided in Section 17.40.030.D.1 (Exception for Single Family Dwelling Units) can be applied to the nonconforming vacant lot. The key element of this exception is that the lot must meet the minimum area requirement provided in this section. In this case the minimum area is 8,400 square feet. The survey map (Attachment 8) shows that the vacant lot parcel "A" meets the exception because it is 11,375 square feet. An address of 1541 loth Place North, has been assigned to this vacant lot. Therefore, the determination of the Planning Division is that lots "A" and "B", as described above, are not required to be combined and are considered separate buildable lots. This determination was made based on the information provided above and with the documentation that is listed as attachments 1 through 8 as listed below. This determination is made with tOnderstanding that the status of the parcel be altered by amendments to the Edmonds Community Development Code (ECDC) adopted subsequent to the issuance of the determination and provided that the City shall not be liable for damages for its action to amend the ECDC affecting this determination. This determination shall be null and void if any activity, action, or omission as listed in ECDC Chapter 17.40 occurs which would terminate the nonconforming status. This includes, but is not limited to, alteration to the nonconforming use, building, lot or sign not in accordance with the requirements of the Edmonds Community Development Code, including required approvals and permits.
