The area where the new construction is to take place is an area which contains fill material. The fill material consists of sand dredged out of Puget Sound for the mid -marina expansion project, which took place around January of 1985. We have information which suggests that the fill may contain toxic material. This method should be incorporated in the proposed design if at all possible. 2) Oil water separator facilities are only beneficial if maintained regularly. The separator on:the south parking lot at Harbor Square does not appear to.have been maintained for some time. Assurances (legally binding) would have to be made, demonstrating that the proposed and existing systems are maintained. The separator sizing calculations are needed for proper design and review of the system as well. The attached guidelines from the Department of Ecology Storm Water Management Manual are for your use in establishing the sizing and maintenance of such a facility. 3) Existing topography in the outlet area of the marsh is needed for analysis. High water marks of record should be noted or flood event analysis should be performed. 4) A minimum 0.5% slope could be maintained throughout the storm drain system to achieve better drainage for the site. As you are aware, the existing Harbor Square complex discharges its stormwater runoff without detention to the marsh located south of Dayton Avenue and west of SR 104. The runoff from the existing site passes through a structure which is intended as an oil/water separator. Runoff from the planned expansion will be collected in a new storm drainage system that will be independent of the existing system; therefore, no additional burden will be placed on the existing drainage system or oil/water separator. The new system will have its own oil/water separator to treat runoff from the parking area. It was sized to be consistent with the latest criteria for oil/water separation; namely a 15- minute detention time for the 10-year flow. Flows in excess of the 10-year flow will bypass the oil/water separator to avoid overloading. Runoff from the proposed buildings and landscape areas will not flow through the oil/water separator. A copy of the proposed drainage plan and the associated calculations have been previously submitted to the City for review of the Grading and Drainage Plan. A copy of the plan is enclosed with this request for your convenience. The drainage system and oil/water separator that are proposed have been sized to accommodate runoff from the parking areas in the proposed expansion as well as anticipated parking for future expansion, as indicated on the plan. The present expansion that is proposed is approximately 1.55 acres in size. Of this amount, approximately 0.58 acres will be buildings, 0.36 acres will be outdoor sports/tennis courts, 0.24 acres will be parking, and 0.37 acres will be landscaping/lawns. Future expansion was presumed to be a total of approximately 0.74 acres of which 0.32 acres will be buildings, 0.30 acres will be parking, and 0.12 acres will be landscaping/lawns. • • ETp ERICH 0. Runoff from the expansion area will discharge to the marsh located south and west of the site. The size of the marsh is estimated to be approximately 65 acres in size. The entire drainage basin tributary to the marsh has been estimated to be in excess of 230 acres, not including the marsh itself. Therefore, the impervious area of the expansion site represents less than 1 percent of the entire drainage basin and less than 3 percent of the marsh area where natural detention is already occurring. The outlet of the marsh discharges directly to Puget Sound through an outfall, so no other downstream conveyance systems will be affected by runoff from the proposed site. The waiver for on -site detention is requested on the basis of the following: 1. The runoff from the proposed site will have negligible effect on the peak flows leaving the marsh. 2. The site represents less than 1% of the entire drainage basin and less than 3% of the marsh area. 3. Natural detention is already occurring in the marsh at this time. 4. Pretreatment of runoff from planned pavement areas will be accomplished by means of an oil/water separator. If additional information is required for review of this request, please feel free to call. Soil sample study for Marina Excavation After due consideration of the evidence presented by the Applicant, and evidence elicited during the public hearing, the following Findings of Fact and Conclusions constitute the basis of the decision of the Hearing Examiner. FINDINGS OF FACTS 1. The Applicant operates an athletic club at 160 W. Dayton, Edmonds, Washington. It is the intent of the Applicant to expand the facility with construction of new indoor and outdoor tennis courts, a multi -purpose recreation court and associated parking. In order to do so, the Applicant must excavate approximately 7,000 cubic yards of earth material. 2. The Edmonds Community Development Code (ECDC) 18.40.030 requires a conditional use permit for the excavation and grading of any project consisting of more than 500 cubic yards of earth material. The Applicant seeks a conditional use permit because the proposed project exceeds the minimum permitted amount. 3. In order for a conditional use permit to be granted within the City of Edmonds, the criteria of ECDC 20.05.010 must be satisfied. Those criteria include: 00 HEARING EXANMOR DECISION RE: CUG-92-40 8/92 Page 3 A. The proposed use must be consistent with the Comprehensive Plan of the City of Edmonds. B. The proposed use and its location must be consistent with the purposes of the zoning ordinances and the purposes of the zone district in which the use is to be locatd, and the proposed use meet all apllixable requirements of the zoning ordinance. C. The proposed use, as conditionally approved, must not be significantly detrimental to the public health, safety and welfare, and to nearby private properties or improvements unless the use is a public necessity. D. The Hearing Examiner must determine if the proposed use is transferable. ( ECDC ) 4. The subject property is approximately 115,870 square feet or 2.66 acres. The land for the improvements is currently undeveloped. 5. Attached hereto and incorporated as part of these Findings is a copy of the proposed site plan of the Applicant. As depicted on the site plan, the new construction will occur in the southern portion of the Applicant's property. 6. The subject property is zoned General Commercial 2 (CG-2). It has a land use plan designation of industrial as set forth in the Edmonds Comprehensive Plan. 7. The subject property is flat. On site is fill that was placed from other excavations that have occurred in the Edmonds waterfront area. All of the fill material that has been placed on site has been tested and have been determined to be clean. 8. The properties to the north, east and west are zoned CG-2 and are developed with multi -use commercial and industrial uses. The proposal of the Applicant would be consistent and complementary to these uses. The property to the south is identified as the Union Oil Marsh and is zoned open space. 9. Pursuant to the State Environmental Policy Act (SEPA) the City of Edmonds was designated the lead agency. On July 14, 1992, the City issued a mitigated determination of nonsignificance. The City indicated that an appeal of the MDNS was filed but the appeal was withdrawn on August.19, 1992. The MDNS as issued applies to the proposal. 00 *0 HEARING EXAMINER DECISION R& CUO-92-40 8192 Page 4 10. The property to the south includes wetlands. The City, as part of the SEPA review, is requiring the Applicant to provide an erosion and sedimentation control plan that will protect the wetlands from erosion resulting from the development of the site. Also, the Applicant must secure hydraulic project approval permits from the Department of Wildlife for all direct discharge into the wetlands. 11. The City, and the Washington State Department of Wildlife, have required the Applicant as part of the SEPA approval to prepare a mitigated proposal which addresses the limitations on hours and seasons of construction operation and the type of equipment used in construction with the excavation, site preparation and construction of the proposed development. This plan may include the complete inventory of the wildlife if no other documents are available. The Applicant has indicated that other documents are available which the inventory of wildlife. 12. The Applicant submitted a report which evaluated the soil material to be moved from the site. This report was submitted on August 16, 1992 and will be reviewed by the City. It will also be submitted to the Department of Ecology. The City indicated that no excavation or activity will occur until the City Engineering Department and the Department of Ecology have approved the plan. 13. As part of the record of the conditional use permit the City submitted several letters. These letters which question environmental uses in the area and the impact of the proposed project to the adjacent environments were addressed in the SEPA review. 14. The City submitted that the proposal complies with the lot and dimension regulations for CG-2 lots. 15. The proposal is consistent with the purposes of the CG-2 zoning designation. It provides a complimentary use of commercial activity in the CG zone that will be beneficial to the commerical development of the City of Edmonds. 16. The requested conditional use permit will not be detrimental to other properties in the area. 17. The Applicant did not know the exact routes for the trucks for the removal of the dirt on site. However, he indicated that State Route 104 would be used as the main source of egress from the site. 18. At the public hearing a witness (Connie Hill) submitted that she represents the business community around Harbor Square. She 010 HEARING EXANUNM DECISION R& CUO-92-40 8/92 Page 5 requested that all truck routes and construction vehicles ingress and egress the site on the easterly section of the subject property and that the trucks and vehicles do not traverse the commercial area of Harbor Square. CONCLUSIONS 1. The application is for the approval of a conditional use permit for the excavation of 7,000 cubic yards of earth material in conjunction with the improvements at the Harbor Square Athletic Club at 160 W. Dayton, Edmonds, Washington. 2. A conditional use permit is required pursuant to the provisions of ECDC 218.40.030. 3. The Hearings Examiner of the City of Edmonds has jurisdictional authority to hold a hearing based on the authority granted to him in ECDC 20.100.010. 4. The criteria for review of a conditional use permits are set forth in,ECDC 20.05.010. With conditions as imposed herein these criteria are satisfied. 5. The proposed conditional use permit is consistent with the purposes of the CG-2 zoning as set forth in ECDC 16.60.005. It will reserve areas with fewest restrictions for development of the site. Further, it will reserve an area for outdoor activities and will provide improvements for parking to be used in conjunction with the commercial development. 6. The requested conditional use permit is consistent with the purposes of the Comprehensive Plan and the industrial designation. It satisfies the provisions of ECDC 15.20.20 in that it is compatible with the character of the City of Edmonds and provides small scale, service -related industries, such as the athletic facility as proposed. 7. The proposal is consistent with the goals and policies of the City of Edmonds. Further, it is not detrimental to other properties in the vicinity. 8. The conditional use permit should be transferable. DECISIONS Based upon the preceding Findings of Facts and Conclusions, the testimony and evidence submitted at the public hearing, and upon the impressions of the Hearings Examiner at a site view, it is J HEARING EXANMffR DECISION RE: CUG-9240 8/92 Page 6 hereby ordered that the conditional use permit for excavation of approximately 7,000 cubic yards of earth material in conjunction with the construction of new indoor and outdoor tennis courts, a multi -purpose recreation court and associated parking for the Harbor Square Athletic Club at the vacant parcel south of 160th W. Dayton, Edmonds, Washington is granted subject to the following conditions: 1. This application is subject to the applicable requirements contained in the Edmonds Community Development Code. It is the responsibility of the Applicant to ensure compliance with the various provisions contained in these ordinances. Attachments 16 through 19 are provided to familiarize the Applicant with some of the additional development regulations. These attachments do not include all of the additional regulations. 2. All excavations and, grading shall comply with Chapter 70 of the Uniform Building Code (U.B.C.), 1988 Edition. 3. The Applicant shall obtain a grading permit from the Building Department and comply with all conditions of permit approval. 4. Prior to the issuance of a grading permit, the Applicant shall: a. Submit an erosion control plan for review and approval by the City Engineer prior to the issuance of the grading permit. b. Submit a truck route plan to the City Engineer for approval prior to removal of any excavated material, or import of any material. C. Have the site plan approved by the City Engineer prior to any site work. 5. The Applicant shall be responsible for keeping all streets clean and free of debris at all times. 6. All grading/fill work shall be done during normal working hours of the City of Edmonds (8:00 a.m. to 5:00 p.m., Mondays through Fridays). 7. If deemed necessary by the City Engineer, the Appicant shall provide traffic control during the removal of site excavation material, and/or the placement of fill material. 9. The permit should be transferable. CUG-92-40 I have had the opportunity to visit the site, review the environmental checklist, site exploration information from a study prepared by Associated Earth Sciences (December 1989) and the "Harbor Square Site Assessment" prepared by Landau Associates for the Port of Edmonds (prepared 1/2/92). A copy of which are filed in the official file for this permit (File No. CUG-92-40). Based on my review of all available information and adopted policies of the City, I recommend that a Mitigated Determination of Nonsignificance be issued. ISSUES: The subject is located immediately north of and adjacent to the Union Oil Marsh/Wildlife Habitat area. The proposed grading activity will be located within approximately 50-feet of the Union Oil Marsh/Wildlife Habitat and will involve heavy equipment during the excavation. The Union Oil Marsh/Wildlife Habitat contains a very fragile environment which could be impacted by the proposed grading activity. Specifically of concern is the potential impact to nesting wildlife. The operation of heavy equipment during mating season or rearing season could adversely affect the wildlife. Grading could cause increased sedimentation in the Union Oil Marsh. The completed project could adversely affect water quality released to the marsh. The fill material which currently exists on the site was placed there when the Port of Edmonds excavated/dredged beach material for the construction of the expanded marina in Page 1 of 3 92-4oENn-i3-92.SEPA • approximately 1985. At the time of excavation, questions were raised regarding the suitability of the material for disposal, as portions of the Edmonds waterfront in the area of the excavation had been used in the past for commercial/industrial activity. Furthermore, these same questions and concerns have been raised again with this project. In order to address these concerns an evaluation of the present fill material which the applicant/proponent proposes to remove from the subject property would be an appropriate measure to determine if the material contains any hazardous material which requires special handling. CONCLUSIONS: Based on my review of all information and adopted policies of the City, I am recommending that the proposal be changed or clarified to include the following mitigating measures so that a MDNS can be issued. Recommended Mitigation Measures: 1. Prior to the issuance of a grading permit for the actual work on the site, the applicant shall: a. In consultation with, and with the approval of the Washington State Department of Wildlife, prepare a mitigation proposal which addresses limitations on hours and seasons of operation, and type of equipment used in conjunction with the excavation, site preparation, and construction of the proposed development. This plan may include the complete inventory of the wildlife, if no present documents exists which would allow for the adequate development of the required mitigation plan. b. Submit an erosion and sedimentation control plan for Engineering Division approval. Provide 200-feet of biofiltration swale (or maximum practical) for water quality treatment prior to discharge into adjacent wetlands. Design swale per King County or Department of Equality standards. Obtain Hydraulics Project Approval permit from the Department of Wildlife for direct discharge to the wetlands. C. Submit a report prepared by a qualified professional which evaluates the soil material to be removed. This report should identify any hazardous substance(s) which are present on the site, and recommendations for the proper disposal of the hazardous substance(s). This report shall be submitted to the Department of Ecology and the City of Edmonds for evaluation. This report shall also contain an evaluation and recommendations regarding the potential impacts to the adjoining Union Oil Marsh which may result from the removal of contaminated soils, if they are found to be present on the subject property. These recommendations are based on adopted policies of the City as found in the Edmonds Community Development Code, Title 15. Specific policies and regulations in the Edmonds Community Development Code which support the proposed mitigation measures are: 1. ECDC Section 15.15.000.C.3.a (ENVIRONMENT - Soils and Tol2og=hy - Erosion Control) on page 13, states as a goal that; "Temporary measures shall be taken to reduce erosion during construction." 2. ECDC Section 15.15.000.C.3.b (ENVIRONMENT - Soils and Topography - Erosion Control) on page 13, states as a goal that; "Natural vegetation should be preserved wherever possible to reduce erosion......." ECDC Section 15.15.010.A (ENVIRONMENT - Water Resources and Drainage Management - General) on pages 13 and 14, states "The environmental amenity of the City of Edmonds is greatly enhanced by numerous year round stream and the location of the City on the Puget Sound....... Urban runoff causes significant decreases in water quality because of the quantity of pollutants in the runoff water........ " 4. ECDC Section 15.15.010.B (ENVIRONMENT - Water Resources and Drainage Mana eg ment - Goal) on pages 14 and 15, states "......In the management of storm drainage and urban runoff, the City should utilize the natural drainage system where it is possible to do so without significantly altering the natural drainage ways, in accordance with the following policies......... " 5. ECDC Section 15.15.020.A (ENVIRONMENT - Vegetation and Wildlife - General) on pages 15 and 16, states "As Edmonds has urbanized, the natural vegetation has become increasingly scarce. The city's woodlands, marshes and other areas containing natural vegetation provide an important resource which should be preserved." 6. ECDC Section 15.15.020.B (ENVIRONMENT - Vegetation and Wildlife - General) on page 16, states as a goal of the City: "The City should ensure that its woodlands, marshes and other areas containing natural vegetation are preserved, in accordance with the following policies:......" 7. ECDC Section 15.15.020.0 (ENVIRONMENT - Vegetation and Wildlife - General) on pages 16 and 17, states as a goal of the City: "The city should promote and increase public awareness and pride in its wildlife heritage. Special emphasis should be directed toward preserving the natural habitats (woodlands, marshes, streams and beaches) of the city's wildlife in accordance with the following policies:......" That study was the basis of the flood insurance rate map revision made on February 19, 1986. The building elevation for the athletic club was set over one foot above the 100-year floodplain elevation established by Reid, Middleton and approved by FEMA. FOR THE CITY OF EDMONDS PREPARED BY: REID, MIDDLETON & ASSOCIATES, INC. 121 5TH AVENUE NORTH, SUITE 200 EDMONDS, WASHINGTON PURPOSE: In 1983 the Federal Emergency Management Agency (FEMA) published the flood insurance rate map for the city of Edmonds area which established the study area as a Zone A flood hazard area. Concerns were subsequently raised by both local officials and private property owners within the study area. This study is as a result of that concern. The purpose of this study is to establish a well defined 100-.year base flood elevation for the uplands adjoining the shoreline area and the Union Oil Marsh. The study area is a portion of Sections 23 and 26, Township 27 North, Range 3 East, W.M., bordered by Dayton Street on the North, S.R. 104 on the East, Pine Street on the South and Puget Sound on the West. The study area encompasses a fresh water estuary and marsh called the Union Oil Marsh. Tidal flows are kept from entering the marsh by a tide gate which is on the 48" outfall from the marsh. The tide gate is located southeast of the dry storage area of the Edmonds Marina. Since no tidal records are kept in Edmonds, the September 15, 1983 FEMA Flood Insurance Study Report and previous studies established the Edmonds 100-year flood tide elevation by using the Seattle based tidal records. The 100-year flood tide for Seattle has been established at elevation 8.3 N.G.V.D. (1). The highest recorded tide in Seattle was 8.55 which occurred in February 1909, December 1967 and December 1977. Due to the sinusoidal nature of tides, N.O.A.H has established tabular tidal difference between different locations in Washington State. The published tidal difference between Seattle and Edmonds is a -0.36 feet (2). The result of this difference lowers the record 8.55 flood tide recorded in Seattle to 8.19 feet N.G.V.D. for Edmonds. The FEMA report has established a 1.5 foot runup factor for exposed reaches in Snohomish County to take into account wind and wave action. Since no detailed wave runup analysis has been performed for the study area, we have chosen to use the 1.5 foot average wave runup factor suggested by the previous studies for the exposed reaches of Northern Puget Sound. Therefore, the exposed reaches within the study area will have a 100-year flood tide elevation of 9.69 feet N.G.V.D.(15.58 feet M.L.L.W.). For sheltered reaches the 1.5 foot runup factor will not he used and the resulting 100-.year flood tide elevation would be 8.19 foot N.G.V.D. (14.08 M.L.L.W.). To determine the effect of these tidal elevations, a topographic survey of the study area was performed. The elevations from this survey have been plotted on the attached study map. As shown on the map, the elevations of the bulkhead and adjoining uplands are above the 9.69 flood tide elevation except for two areas. The first is the mid -marina area between the breakwater. This area will remain exposed, only for a short time though, for construction of the Edmonds mid -marina expansion will modify the breakwater opening protecting this area from wind and wave action. The second area for potental inundation is a narrow corridor north of the marina breakwater at the public beach stairway access. Because the stairway is narrow and the bulkhead is at 9.7 feet, the risk of floodina will be minimized. It is possible that this bulkhead could be breached for the two hours at peak high tide, however. If this occurred, the expanse and volume of the upland area would limit the spread of water to only a small portion of the properties west of the railroad tracks. Since tidal action has been determined to have no effect on the uplands east of the railroad tracks, the second concern of flooding by storm water inundation was analysed. A 100-year 24 hour rain storm was calculated and manipulated so the peak volume requirement occurred at the same time as the 100-year flood tide. The result was a constriction of the discharge capacity of the marsh outfall for a period of approximately three hours. To determine the effect on the uplands.surrounding the marsh, we utilized the Edmonds aerial topographic and comprehensive drainage plan maps together with our current topographic survey and development plans of the study area to determine the volume of the westerly portion of the Union Oil Marsh, which is protected from development. The analysis revealed that the period of peak volume demand was during the last three hours of the event with the maximum capacity of 41.53 ac.f t. required within the marsh. Assuming the tide has closed the gate preventing discharge an additional 4.74 ac. ft. of capacity would be consumed. For this analysis a 10% reduction in capacity was used to simulate the natural condition of the marsh which is dominated by cattails. The computed volume of the marsh at elevation 5.0 N.G.V.D.(10.89 M.L.L.W.) is 9.44 ac. ft. At elevation 8.0 N.G.V.D. (13.89 M.L.L.W.), the volume equals 83.58 ac. ft. With the peak volume demand being 41.53 ac. ft. plus the additional 4.74 ac. ft. of inflow detained by tidal constriction, we have calculated the maximum elevation of the marsh at 6.38 N.G.V.D. (12.27 M.L.L.W.). The last senario considered in this study is what affect a failure of the 48" tide gate would have on the marsh level. If this should occur and go unnoticed until a 100-year tide and 100-year storm event occurred simultaneously, the rate of backflow for the three hour period would not significantly raise the elevation of the marsh. To take this in to account, we recommend that the 100-year flood elevation of the marsh be raised by 0.2 ft. to elevation 6.58 N.G.V.D. (12.47 M.L.L.W.). The impact of the 6.58 N.G.V.D. marsh elevation on the Harbor Square Development is that the storm sewer system, which discharges to the marsh, will be filled to within 0.5 ft. of the -surface thus reducing the discharge capacity of the system. All of the existing buildings on the site have been constructed above elevation 7.9 N.G.V.D. (13.79 M.L.L.W.) therefor the 100 year flood elevation in the marsh is not anticipated to have any effect on the structures. Ic STORMWATER RUNOFF CALCULATIONS FOR 100-YEAR FLOOD ELEVATION OF UNION OIL MARSH Drainage basin area = 510 acres Note: SR-104 drainage is collected into a separate storm drainage system and bypassed around the marsh. Time to concentration = 6000/2(60) + 10 min. = 60 min. Using the Everett Rainfall intensity curve i = 1.07 in. hr. Runoff coefficient for study area = 0.45 Omax = 0.45 (1.07) 510 = 245.56 c.f.s. for short duration high intensity storms. For 100 vear 24 isopluvial 3.0 inches of rain would fall in a 24 hr. period equalling 0.125 in/hr. Q = 0.45(0.124)510 = 28.69 c.f.s. 1. Analysize both conditions with standard discharge from marsh. 2. Analysize the restriction caused by tidal action on 48" tide gate. If discharge is stopped for peak detention period rate of inflow = 2.37 ac. ft./hr. Time of NO flow 2 hours therefore detained volume increased by 4.74 ac. ft. Restricted flow is 30 min. on either side of peak tidal fluctuation decrease allowable discharge from to one quarter of design flow. REFERENCES 1. Dear Ms. Block: The following observations were made by me during a high tide of 12.4 M.L.L.W. at 12:01 p.m. with high winds from the northwest, estimated at 30 knots. Wave overtopping of the bulkhead adjactent the Senior Center on Railroad Avenue was observed and photographed. Due to the existing grading behind the sea wall, west of the Senior Center, accummulated sea water, from the splash of the waves hitting the bulkhead, had flooded the circular paved area northwest of the building, the center building adjacent to the bulkhead and the parking lot. We also observed that once the sea water had exceeded the capacity of the holding area a sheet of water flowed east through the Senior Center parking lot to gutter on Railroad Avenue and then southerly in the gutter to Dayton Street. At the intersection of Admiralty Way and Dayton Street the accummulated waters from the inundation area at the City Park south of the Ebb Tide Condominium joined and crossed over Dayton Street and continued southerly between the Railroad tracks on the east and the Port of Edmonds property on the west to the outfall of Union Oil Marsh. Another area where splash and spray overtopping was observed was along the public beach at the foot of Dayton Street. The parking lot north and west of the intersection of Dayton Street and Admiralty Way was flooded as well as the three single family residences west of the parking lot. The waters from the overtopping at the Senior Center were also contributing to the inundation of the Ebb Tide parking lot. Our field observations indicated that the wave splash overtopping in the area of the Senior Center was greater than other areas of the waterfront due to the direction of the wind which gave the waves a reach of approximatly 10.3 miles and no structures west of the bulkhead to dampen the waves. It is my opinion that on the above date these two northerly areas were not receiving the brunt of this storm due to (1) the ferry dock acting as a wave break for the boat sales parking lot and the reminants of the old dock, north the Sunset Beach, acting on the waves and dampening them sufficiently so that wave runnup was not as severe. For further clarification, I have indicated the areas affected by today's event on the enclosed map. At 3:00 P.M. this afternoon I again went down to the waterfront area and observed the condition of the effected area finding that approximatly 4.O feet of sand had been removed from the beach in front of the Senior Center. We intend to continue to observe any extreme storm and high tide events in the coming weeks to further our analysis of the flood plain area along the waterfront, and for the purpose of showing accurate flood plain boundaries along the water front area to FEMA.
