On November 15, 1978, the first variance request on this short plat +
was made under Edmonds File No. V-90-78. Since that time, Mr. Campbell !`
has gone before many hearings on this short plat. F

access easement which Lot l owns cannot be counted in square footage for the I
drainfield nor can it be used in.m asuring lot width. Therefore, the lot width
on tot 1 is 75' based on this principle. Mr. Campbell, therefore, asks for
a variance of 5 feet on Lot width. Using this criteria, the lot width depth i
ration is 0.38 instead of 0.40 as required.

The variance requested on 1 t width on Lot 2 3.87 feet

This is mainly due to the overall narrow nature of the total parcel
and due to the fact that it was of primary concern to maintain 20,000 sq. ft.
or greater due to the previously questioned septic tank requirement.
The proposed location of th new residence on -Lot 2 is set back
j into the hillside so the lot width at that point is 110 feet at the building
1 line. If the lot width depth rati were calculated in this fashion it would
equal 0.46 feet.
Two of the lots are over 20,000 square feet, however, Lot 1 is short
of square footage if the access easement is not included. The existing
septic tank drainfield system on Lot 1 is presently functioning satisfactorily.
The access easement follows an existing old road for the first 100 feet or
so. That was one of the primary reasons for this location. The street or
driveway was designed to minimize filling, grading or further alterations to
existing conditions.

Item 12.10.050 under Design -Criteria Item (B) it states "If a public -
sewer is not located within 800 feet of the proposed subdivision, the following
shall be considered reasonable in lieu of sanitary sewerage system: Where the
zoned lot size is twenty thousand sq. ft. or more and where the soil conditions
have been found satisfactory by the City Engineer and Health Officer, septic
tanks, or.other methods of handling wastes shall be installed in accordance
with the standards and -under the supervision of the City Engineer."
Does the underlying zoning R. S. 12 suddenly change to R. S. 20 if the
applicant's property is further than 800 feet from sewers?
The total square footage of the 3 lots exceeds 60,000 square feet.
However, after deeding 10 feet to the City for right-of-way, not enough
square footage is available.'
Both Lots 2 and 3 can meet City of Edmonds and Snohomish County on -
site sewerage disposal requirements. These designs are primarily a function
of topography and percolation rate.
The lot arrangement has little bearing in this case on the location of
the proposed houses and drainfield systems.
If the lot lines were changed the systems would be virtually in the
same location as proposed at the present time.

Dear Board Members:
Since October 16, 1978 I have been processing a short plat of some property in.
the.`North Meadowdale area. This property is approximately 800'.East of the
top of the adjacent hillside. The ground is sandy loam of superior perk
qualities and is heavily wooded; this property is not in any slide area.
Three city agencies have agreed that this project should be allowed ,to proceed: t,

Edmonds Engineering Department --- in minutes of City Council hearing on land
evelopment in the Meadowdale area (Feb. 27, 1979): "He (Fred Herzberg, City
Engineer) felt, however, that because Mr. Campbell was so far into them (pro-
jects) he should be excluded from the moratorium."
- also, memo to John LaTourelle from Fred Herzberg dated May 7, 1979:
"Engineering Division does not oppose a lot size less than 20,000 sq.ft."
Edmonds City Council ---.Resolution No. 428, of Feb. 27, 1979 Section 1:
No City Department or official shall issue, approve or process an
application for any building permit, planned residential develop-
ment, subdivision or short subdivision which has been filed with
the City on or after February 27, 1979.
Building permits were applied for on December 15, 1978 and December 28, 1978,,
respectively, and it was my project that the Council intended to exclude as
there were no other applications pending.
Edmonds Planning Commission --- minutes of March 14, 1979: approved appeal
for subdivision. "Since the applicant's subdivision application was made
prior to imposition of the building moratorium, Mr. Herzberg said it would
be exempt, and he recommended approval of the appeal."
All variance requests are minor and reasonable and not without precedent,
(eg. Goodrick Residence, 2 lot short subdivision in Meadowdale area with
approved septic system on less than 20,000 sq.ft. lot area.) The 20,000 sq.ft.
lot size for septic system is unique to the City of Edmonds; King and Snohomish

system installation.

The regular meeting of the Edmonds Board of Adjustment was called to order by
Chairman Alice Stole.at 7:35 p.m. in the Council Chambers of the Edmonds Civic
Center.

Chairman Stole welcomed the audience and explained the functions of the Board,
the procedure -for handling of the hearings, and -the method of appealing decisions
of the Board.
APPROVAL OF MINUTES
Minutes of the December.20, 1978 meeting had been distributed. .11R. HATZENBUHLER
MOVED, SECONDED BY MR. BYRD TO APPROVE THE MINUTES OF DECEMBER 20, 1978. MOTION
CARRIED.
CORRESPONDENCE
Mrs. Luster called attention to a flyer which had been sent out in the packets
regarding a course being offered -at the Edmonds Community College on "Board and
Staff Relations." She said several Staff members would be attending and she
encouraged attendance by any Board members who could work it into their schedules.
Mrs. Luster welcomed Mrs. Stole as the new Chairman of the Board of Adjustment.
Due to the resignation of Al Bailey, Mrs. Stole who had been Vice Chairman became
the Chairman, and Mrs. Luster suggested election of a new Vice Chairman. The Board
decided to delay that until next month when a new member would come onto the Board.
Mrs. Luster announced that V-7-79 would be continued to next month's meeting and
V-3-79 which had been posted but not shown on the agenda also would be continued
to next month's meeting. She explained the circumstances of both. MR HATZENBUHLER

This item had been continued from last month so the Board members could
view the site. The applicant wished to build a deck not to exceed 30"
in height, to within 5' of the side property line. The deck would
extend along the existing line of the home and be on the same level
as the master bedroom. A railing was -not required for the deck and none
was intended. Mrs. Luster recommended approval of this application because
it would allow the applicant to build a deck, not to exceed 30" in
height, along the existing lines of the house; the setbacks were
established in this area, as was apparent by the houses on either side
(all being nonconforming); and the proposed deck would not obstruct
views or create a safety probleri in the area. The public portion of
the hearing was reopened.

The regular meeting of the Edmonds Board of Adjustment was called to order by Chairman
Alice Stole at 7:35 p.m. in the Council Chambers of the Edmonds Civic Center.

Chairman Stole welcomed the audience and explained the functions of the Board, the
procedure for handling of the hearings, and the method of appealing decisions of the
Board.
APPROVAL OF MINUTES
Minutes of the April 18, 1979 meeting had been distributed. MR. LERAAS MOVED, SECONDED
BY MR. HATZENBUHLER, TO APPROVE THE MINUTES OF APRIL 18, 1979. MOTION CARRIED.

V-749 WILGIAM CAMPBELL Variance to.,allow.on-site sewage disposal on a lotrless,
than 0,000 sq. ft., from lot width, and from lot width/length ratio, at

Ms. Luster stated this application was in conjunction with a 3-lot subdivision
and would not result in a rezone. The lot width requirement in this -.zone is
801, the lot width/depth ratio is .40, and the square footage required for
an on -site septic .system is 20,000 sq. ft. Ms. Luster showed slides of
the site, noting that it has sloping terrain and numerous trees. Lot 1 of
the subdivision has an existing home with the septic system in question
which is functioning in good order. Lot 1 also has an access easement
which reduces the lot area to 14,196 sq. ft., which is adequate for the lot
size but not for the septic system. If the access road, which is part of
the legal description for Lot 1, were included in the computation, the lot
area would be 19,387 sq. ft. The Engineering Division felt the road could
be included for the overall drainage system for the site. Excluding the
access road, the lot width of Lot 1 is 75', so a 5' variance was requested.
The lot width/depth ratio would be .38 instead of the required 40 and a
variance was requested for that. On Lot 2 a width variance of 3.87was
requested and a width/depth ratio variance of 08. The Planning Staff felt
these were minimum variance requests. Ms. Luster noted that there was
adequate area on both Lots 1 and 2 for suitable building sites and for open
space. Lot 3 met all requirements. She noted that this subdivision is in
the Meadowdale moratorium area but building permits were not an issue
j before this Board. She said the perc tests were acceptable on all the
lots. She recommended approval of the application because the reduction in
�. lot area for Lot 1 was for an existing septic system which is in good
working order; the reductions in lot width and lot width/length for Lots 1
and 2 were minimal and would not decrease the open space or building areas;
i and none of the requests would be detrimental to the public health, safety,
j or welfare of the area. The public portion of the hearing was opened.
Gene Greenway, attorney for the applicant, said in other cities the area
required for a septic system is only 12,000 sq. ft. and it was his under-
standing that the City of Edmonds engineering staff is reviewing the 20,000
sq. ft. requirement. He said the total lot area would be enough for four

with Reid, Middleton 6 Associates, asked to clarify the lot width for Lot
1, but City Attorney John Wallace advised that the intent of the Code is
not to include any access easements in figures for any lot dimension. The
public portion of the hearing was then closed. Mr. Hatzenbuhler felt the
requests were reasonable and would result in best use of the land. Mr. Roy
felt the application reasonable also, as long as the perc was all Mrs. Medina noted that the lots had right.

some portions of two lots were wider than the requirements and some were
less, but since the square footage of each was 20,000 sq. ft. the interest
of retaining open space was certainly met. MR. BYRD THEN MOVED, SECONDED
BY.MR. LERAAS, TO APPROVE V-7-79 ON THE BASIS THAT THE VARIANCE REQUESTS
APPEARED TO BE MINIMAL AND REASONABLE, THAT THE VARIANCES WERE REQUIRED TO
MAKE THE BEST SUBDIVISION USE OF THE LAND, AND IT APPEARED THAT THERE WOULD
BE NO HEALTH HAZARD OR OTHER DETRIMENT TO THE PUBLIC. THE MOTION CARRIED.
CU-18-79 ALDEN BOWES - Conditional Use/Home Occupation Permit for office for drawing
in ustria real estate brokerage agreements at 1031 12th Ave. N. (RS-12)
Ms. Luster said this application had been scheduled to be reviewed before
the Staff but was continued to be heard before the Board because of neighborhood
Opposition. The applicant works in an office in his basement and no customers
go to his home. There are no signs on his home or vehicle. There is no
outside storage of equipment and no other employees. Ms. Luster recommended
approval because all of the Home Occupation Permit criteria were met. The
public portion of the hearing was opened.
The applicant said some of the neighbors in his block felt he would create
a traffic problem and set a precedent for other businesses. He said no one
goes to his home except twice a year when he is audited. He conducts his
business by telephone. Robert Boyd of 1231 Vista Way said the neighbors
feared that if this application were approved other permits may be granted
in their area and they felt their neighborhood was special and should
retain the strict residential character. He said they did not want to have
any businesses started there in Emerald Hills and they had no assurances
that there would not be signs, vehicles,.or traffic from this business.
Doris Hovik of 626 12th Ave. N. said that from what she understood there
.would not be anything different from what the applicant had done in the

public portion of the hearing was closed. Ms. Luster noted that the neighbors
were concerned with home occupations in the Emerald Hills area but home
occupations are permitted in their home owners' association agreement. The
public hearing was then reopened as others wished to speak. Vialetta Dodge
(no address given) said she has a real estate broker living across from her
and a contractor, and if they did not work from their homes neither should
the applicant. She said she had lived there ten years and wanted to keep
this neighborhood residential. Jim Phelps spoke to Ms. Luster's statement
regarding the Emerald Hills home owners' association and said this was not
in Emerald Hills. The public hearing was closed again. Mr. Hatzenbuhler
explained that there are certain criteria for home occupations and if any
of these are violated the permit can be revoked. Mr. Roy added that the
ordinance is written for all of the City and home occupations cannot be
denied just because the location is in a better neighborhood. Mr. Leraas
said this application appeared to fall within the established criteria for
home occupations and he felt the applicant should be given the opportunity
to work within these guidelines. Mrs. Derleth said the Code is specific
and if the neighbors feel it is being violated they have the right to
appeal. She cautioned them, however, that they should have specific evidence
of any violation. She felt this application met the criteria for a Conditional
Use Permit. MR. HATZENBUHLER MOVED, SECONDED BY MR. ROY, TO APPROVE CU-18-79
BECAUSE IT MET THE CONDITIONAL USE PERMIT CRITERIA AND WOULD NOT BE DETRIMENTAL
TO THE NEIGHBORHOOD. THE MOTION CARRIED.
