A recent State law on radon, effective 7/1/92, affects your newly built residence at
15818 68 Ave. ., monds. The law requires that local jurisdictions provide free
radon monitors o owners to determine if radon gases are present on their site. Radon
is a natural radioactive gas in the ground. It comes from the decay or breakdown of
uranium, a radioactive element in rocks and soil. Radon has no odor, color or taste.

information on the hazards of radon. The enclosed radon kit explains the process for
setting up the monitor and the testing process. The results are confidential and the
testing is free.

The undersigned grantor, HOFTO HOMES, INC., a Washington corporation,
hereafter referred to as "HOFTO," hereby grants to the PUBLIC and to the CITY
OF EDMONDS, WASHINGTON, a tree protection easement in consideration of
review, approval, and as a condition of approval of C_ty_of-Edmonds=_Setback

RECITALS
1. HOFTO owns certain real estate in the City of Edmonds, the subject of
this matter, which street address is 15818 68th Ave. W., Edmonds, WA, and
which is legally described as follows:
Lot 2, CITY OF EDMONDS SHORT PLAT NO. S-13-90, Recorded
under Recording No. 9008090410, being a portion of Tract
37, PLAT OF MEADOWDALE BEACH, According to the Plat
thereof recorded in Volume 5 of Plats, Page 38, Records of
Snohomish County, Washington.
Situate in the County of Snohomish, State of Washington.
GRANT OF TREE PROTECTION EASEMENT AND TERMS
1. Grant. In order to preserve the physical and aesthetic character of the
City of Edmonds, and specifically, this neighborhood, through the prevention
of indiscriminate removal or destruction of native trees, in specific areas
within the above -referenced property, an easement is granted to the City of
Edmonds and its citizens within the two (2) parcel areas (approximately shown
on the attached exhibit "A," which is not to scale, but is for illustrative
purposes only) which are legally described as follows:
PARCEL AREA A: (WESTERLY TREE PROTECTION AREA):
The westerly 90 feet of Lot 2, CITY OF EDMONDS SHORT PLAT
NO. S-13-90, recorded under Recording No. 9008090410,
being a portion of Tract 37, Plat of Meadowdale Beach,
according to the plat thereof recorded in Volume 5 of
Plats, page 38, records of Snohomish County, Washington.

Lot 2, a distance of 60.00 feet; thence N 51018' 25" E, a
distance of 73.04 feet to an intersection with the east
line of said Lot 2 at a point 45.00 feet northerly of the
southeast corner thereof; thence S 3048'04" E, along the
east line of said Lot 2, a distance of 45.00 feet to the
point of beginning.
2. Conditions. Except as provided herein, the owners of the property, shall
preserve and maintain the existing trees and shall not cut, prune, remove,
log, destroy by the use of herbicides or otherwise disturb the trees within
the easement areas, except that dead, dying or diseased trees may be removed
which are a direct threat to the safety of any adjacent home, home on the
subject site itself, or public or private right of way or when necessary to
protect the remaining trees from disease. Such designated areas may be
allowed to naturally reseed themselves unless replanting is necessary to
preserve slope stability, preserve a watershed and water quality, prevent
erosion or when native trees are destroyed or damaged by fire or other
natural catastrophe. In such cases, replanting shall be undertaken at the
cost of the owner with appropriate native trees in a size and configuration
determined in accordance with Architectural Design Board standards.
Replantings shall be maintained and replaced until the damaged area has been
restored. No herbicide, pesticide or other chemical shall be used in the
easement areas, except as may be necessary to address insect or rodent
infestation in accordance with law or administrative action.
3. Tree and Caliper. For the purposes of this document, "Tree," shall mean
any living woody plant characterized by one main stem or trunk and many
branches and having a caliper of six inches or greater, or a multi -stemmed
trunk system with a definitely formed crown. "Caliper," shall mean the
diameter of any tree trunk as measured at a height of four (4) feet above the
ground on the upslope side of the tree. These definitions shall apply to the
trees located in the two (2) easement areas as of the time of the signing of
this document. A "tree" shall also include, trees replanted under this
document, which have a caliper less than six inches in diameter.
4. Replantings. To the extent reasonably possible, replantings of trees,
required under this document shall be of the same species, however, the exact
species is not a significant issue and may be determined by the staff of the
Edmonds Planning Department.
5. Procedure for Removal and/or Replanting of Trees. In the event the
landowner wishes to remove trees pursuant to this document, replant, or act
otherwise regarding this tree protection easement, the owner shall make
application for a clearing permit (or as the City of Edmonds, Planning
Division Staff, requires) under the Edmonds Community Development Code
Chapter 18.45, and such Chapter 18.45 shall apply, to the extent consistent
with this tree protection easement. Action. on such property shall take place
only after the City of Edmonds, Architectural Design Board approval, the
extent or significance of which as shall be determined by the City of Edmonds

TO BACKFILLING UTILITIES.
4, EXISTING`UNDERGROUND FACILITIES HAVE BEEN SHOWN ON THESE DRAWINGS FOR THE
PURPOSE OF ASSISTING THE CONTRACTOR IN LOCATING SAID FACILITIES IN THE FIELD. THE
CONTRACTOR SHALL BE RESPONSIBLE FOR CHECKING ACTUAL LOCATIONS IN THE FIELD AND
CHECKING WITH APPROPRIATE AGENCIES THAT MAY HAVE UNDERGROUND FACILITIES WITHIN
THE PROJECT LIMITS. THE CONTRACTOR SHALL BE SOLELY RESPONSIBLE FOR ANY DAMAGE
TO UNDERGROUND FACILITIES RESULTING FROM HIS OPERATIONS.
