In response to a recent localized slide, City officials conducted a site inspection today and
observed slide damage to have occurred all on private property within Tract A and your Lot 5 of
the Plat of Lorian Woods. It is unclear whether the slide initiated from your property or farther
uphill in Tract A but debris are evident on your property on Lot 5.
Since you may be unaware of these conditions, the City recommends that you have your
professional Geotechnical Engineer make a site inspection for an independent assessment of your
property to provide recommendations about any possible site restoration that may be advisable
for you to undertake to protect your property. If your geotechnical engineer requires restoration,
slope mitigation or improvements, an approved permit from the City is required in advance since
all work must comply with City Ordinance #3632 which regulates the Earth Subsidence
Landslide Hazard Area in north Edmonds (note this is a newly adopted ordinance effective
4/2/07).

1. We lived in Edmonds for 23 years and would never have left except that we needed to care for
ancient parents who moved to Florida. Then one of our children got so ill that he is tied to the medical
system here and we cannot come back to live in Edmonds. He will be in Florida for the rest of his life,
and we must stay with him. We heard from Brian Isaacson, Bill Derry and Steve Chung that they had
met with you and we are sure they brought up most of these ideas, but we wanted to add our two cents
to the meeting, and make a specific request with reference to our lot. This is what we would have said
had we been able to attend. This letter is only from us and not from our Lorian Woods neighbors.
2. We are property owners of Lot #5 at Lorian Woods and the immediate down slope neighbors of the
Sequoia Ridge subdivision. We are requesting a review of the present situation created by the
occurrence of numerous slides originating from Sequoia Ridge subdivision properties and extending
into the common area of the Lorian Woods Planned Residential development. We believe the review
needs to lead to the adoption of a plan to stabilize the west -facing slope below Sequoia Ridge. The
scope of what we believe needs to be done is outlined below. There is urgency to accomplish as much
of a proposed plan as possible in the Spring -Summer season of 2006. The steps necessary are far
beyond the scope of a single homeowner or lot owner and are beyond the scope of the Lorian Woods
Homeowners Association as well. We believe there is an urgent need for the City of Edmonds to take
the lead to call the Lorian Woods Homeowners, and the homeowners of the Sequoia Ridge
development together to develop long-term solutions to the problems mentioned in succeeding
paragraphs.
3. Adamant opposition to the proposal for a four -lot subdivision on the prominent hog -back ridge east
of Lorian Woods property was expressed in our correspondence and testimony in 1999, a copy of
which is attached. We pointed out that reshaping of the cliff top and removal of some 15-20 ancient
conifers anchoring the cliff would greatly increase the slide hazard and impinge on the Lorian Woods
property. The City approved the Sequoia Ridge development largely as submitted, notwithstanding
the many cautionary warnings and request for indemnification in our correspondence, and opposition
from your own technical staff. Subsequent events have confirmed the occurrence of the dire events
emphasized in our testimony. We believe the time for corrective action has arrived.
4. It is not our purpose or intent at this point to go back in time and rehash the past, and this letter is in
no way a "stalking horse" for legal action. We firmly believe that with goodwill and perserverence we
can work through these issues together. It is our wish, that Sequoia Ridge homeowners and the City of
Edmonds join with Lot Woods Homeowners to take res onsi� for the problems which have

ensued, and take action now to secure the value and safety of our property. In the late 1980s and early
1990s the City formed an L.I.D. to construct sanitary sewers, storm sewers and an interceptor drain
system to reduce landslide hazards and provide a basis under which many additional properties could
be developed with reasonable security. The L.I.D. made it possible for the plan to develop the Lorian
Woods Planned Residential Development to be approved. The interceptor drain system was planned,
engineered, built and maintained by the City. Following the Sequoia Ridge development, numerous
slides have caused the City to abandon plans to reconstruct the interceptor system on Lorian Woods
property, and have made the sale of unbuilt lots of the Lorian development markedly problematic. At
least one home (Bosch) in the Sequoia development is markedly impacted with two slides which have
moved the edge of the cliff to within a few feet of the Bosch home. We believe the City and all
affected City departments have a vested interest in participating in formulating and participating in a
plan to stabilize the hillside, mitigate risk and permit safe development on unbuilt properties. A
comprehensive plan can be a win for all property owners and the City as well. Our Sequoia neighbors
would also win with greater assurance of preservation of their homes, the value of those homes, and
assurance of personal safety.
5. We assume that the banks holding the mortgage on the property of Jim Bosch are as eager as we
are to see this planning take place; that would make the banks into winners as well. Mr. Bosch owes a
great deal of money on his home, and professes to not have the resources to pay for the repair of the
cliff face or for the bolstering of the cliff against further slides. He has listed the house for sale since
June 2003, but unfortunately the property cannot sell in its present condition at fair market value. As
you can imagine, the banks in question do not want to take back in receivership a property that is so
severely threatened. We assume that the banks will join us in urging the formulation of an action by
all parties.
6. We assume also that the other property owners above us understand that having frequent and
ongoing slide events below their homes is not just an unsightly nuisance, but that it is indeed a hazard
of the first order. At the very least, these slides can lead to such severe degradation of the properties
as to make obtaining insurance difficult or impossible. Certainly, as in the Bosch case, such slides can
make their properties unmarketable. Beyond the insurance and property value issues we assume that
property owners above us do not want their homes to be "red flagged" as hazardous, nor do they wish
to see large portions of their yards or the structures themselves slide down the hill. There is a
possibility that such slides will cause irreparable damage to structures or injury to occupants of
structures either above or below the hill, or to workers or visitors on the lots below or in the common
area of the Lorian development. Without adequate mitigation, and with the historical perspective of
previous letters and testimony, responsibility for mitigation of risk devolves on all stakeholders
including the City.
7. We believe a complete plan will include d—❑ removal of the most hazardous trees which are at
risk for failing, triggering slides and threatening workmen or visitors on the property; a—❑ removal
of an appropriate part of the debris from previous slides; a—❑ controlling and channeling of water
from numerous identified seeps to be collected in the existing north and south storm drain systems;
a ❑ replanting arborist-recommended deeply -rooting replacement plants and trees with high water
dispersion properties to replace removed trees and to supply cover in slide -exposed surfaces; d—❑
stabilization of the scarp below the Bosch home and similar revetment below the Thorsen and
Johnson properties; and a—❑ continued maintenance of water channelization and collection systems.
Finalization of a plan, and assignment of responsibility for these separate activities seems to us to be
the job, which needs to be done now.
8. As our contribution toward potential solutions we have already joined with other homeowners at
Lorian Woods to retain a qualified arborist who has completed an inventory of all trees of significant
size on unbuilt Lorian lots and in the Lorian common area. All significant water seeps on the hillside
have also been located. Our arborist is ready to certify a list of the trees whose removal he believes is
urgent. The Lorian Woods Homeowners Association is prepared to request a permit from the city to
cut those trees that make it hazardous for work and maintenance crews to access the drainage system
that is already in place and which is not now being maintained.
9. Our question is pretty simple. We are attempting to market our lot and assume that any new owners
will be eager to assist you to stabilize the hill. Can you help us to assure potential buyers that our lot

Lot 3. Slide debris may have pushed onto or near your Lot 5 in Lorian Woods.
Accompanying City officials was a representative of Landau Associates, the City's professional
geotechnical consultant. Landau Associates conducted a site reconnaissance and subsequently
prepared a report (copy enclosed) that describes the observed slide. The purpose of this letter
and the attached copy of the Landau Associates report is to notify you and other private. property
Owners in the area, of the current situation as we know it, so that you may take whatever action
you deem appropriate.
Since you may be unaware of these conditions, the City recommends that you have your

This letter provides a summary of our observations, assessment, and recommendations related to
a landslide observed on the northwest side of the Bosch residence at 16116 72nd Avenue West (also
known as Lot 3 of the Sequoia Ridge Plat). in Edmonds, Washington. The purpose of our services was to
observe the site conditions and to provide recommendations to the City of Edmonds (City) Building
Official related .to our assessment of site conditions and the potential for an imminent hazard to
City -owned facilities, the. general public, or the private property residents related to the landslide. Our
services. wererequested by.Don Fiene, Assistant City Engineer, on February 14, 2005 and confirmed by
Task Order No. 05-01 under Landau Associates' On -Call and Emergency / Disaster Response
Geotechnical Engineering Agreement with the City of Edmonds.
BACKGROUND
Don Fiene, Assistant City Engineer, Ann Bullis, Assistant Building Official, and Dennis Stettler
of Landau Associates observed the above -described landslide on the afternoon of February 1.4, 2005. The
landslide was observed from 73rd Place West below the slide and from the top in the yard of the Bosch
residence at 16116 72nd Avenue West. Mr. Bosch spoke to us during our site visit and provided
background information. Our observations were limited to brief visual observations and no
measurements were taken and no attempts were.made.to closely examine the slope or slide debris, other
than what. could.be..re.adily seen: by standing at the top of the slope.
We understand that the landslide occurred on Saturday, February 12, 2005. Periods of heavy rain
occurred, sporadically on. that day, but otherwise the period preceding the landslide was a period of
:relatively drier than normal winter precipitation.

The landslide occurred at the top of a steep, northwest -facing slope immediately west of the
northwest corner of the Bosch residence. The location of the landslide corresponded to the location of
ground cracking observed by Landau Associates and City personnel on September 16, 2003 and
documented in a Landau Associates letter to the City dated September 25, 2003. The previously observed
ground cracking was noted when Landau.Associates and City personnel observed a landslide on the same
slope that occurred about 200 ft north of the current landslide location.
Following the observation of ground cracking in 2003, sections of heavy tarp were reportedly
placed over the ground by Mr. Bosch and secured in place by driven steel rebar. At the time of our
observation on February 14, 2005, the heavy plastic tarps were still in place, but the ground beneath the
tarps at the location of the previous ground cracking had failed and slid downslope.
The landslide formed a steep slope with a headscarp located about 5 to 6. ft from a porch of the
Bosch residence. The headscarp was estimated to be approximately 8 to 10 ft from the northwest corner
of the house.
Soil observed in the upper 3 to 5 ft of the headscarp area appeared to be similar to fill. Mr. Bosch
indicated that his recollection of this area prior to the house construction as compared to the present
topography suggests that some fill may have been placed in this area. According to a letter dated October
31, 2003, Cornerstone Geotechnical, Inc. (a geotechnical consultant retained by Mr. Bosch in 2003) also
interpreted the near -surface soil in this area to be fill. Below this fill layer, a soil that appeared to be very
dense, gray, fine sand that formed a smooth surface was exposed in some areas of the landslide scarp.
This exposed, gray soil appears to be sand of glacial origin that is typically found along the bluff in this
area. The sand is typically underlain by fine-grained silt and clay along the slope and groundwater
seepage typically emerges on the slope near the contact of the sand and the low -permeability silt and clay
below it.
The upper portion of the slide formed a steep scarp area, which flattened to a slight "bench" about
20 ft below the top of the scarp. Soil exposed in the upper portion of the slope appeared to be relatively
dry. At the slight "bench," seepage and wet zones were observed with seepage flowing downslope
through the recent slide debris and ultimately emerging as surface water drainage that was intercepted by
catch basins along the edge of 73`d Place West. We suspect that the seepage zone corresponds to the
location of the silt and clay layer that is present along the. Meadowdale Bluff. Slide debris had been
deposited or flowed into the area at and below the "bench" and was mixed with the trees and undergrowth
on the lower portions of the slope.

ASSESSMENT
The location of the recent landslide appears to be consistent with the location of ground cracking
we observed in 2003. The ground cracking was an early indication of slope movement and failure at this
location. The heavy tarp protecting this area from rainfall infiltration was probably effective for a period
of time, but ultimately the steep slope with ground cracks was going to fail. The landslide that occurred
at this location is relatively consistent with other landslides that have occurred along this slope at various
locations. The top of this steep slope or bluff forms the headscarp of the much larger Meadowdale
landslide complex.
The bluff in the Meadowdale area is a known landslide hazard zone. The observed landslide is
consistent with other naturally occurring landslides along the Meadowdale Bluff. Springs and- seepage
emerge from this slope above the Lorian Woods subdivision and the slopes above these springs are
subject to repeated landsliding and slope movement as the landslide headscarp continues to progress back.
If fill had been placed at the top of the slope as a part of the house construction, that condition could
reduce the stability of the slope. However, even without fill at the top of the slope, the steep slope in this
area is subject to landsliding.
The observed landslide was likely caused by natural groundwater seepage zones that are present
in the steep portions of the bluff. The seepage zones and the observed landslide are located well above a
City interceptor drainage system. The purpose of the City drainage system is to capture some of the
localized surface water and water emerging from springs that would otherwise infiltrate into the ground
below the drainage system. Implementation of the drainage system and other drainage improvements in
the Meadowdale area is thought to contribute to the overall stability improvements of the Meadowdale
landslide complex located downslope from the location of the interceptor drainage system. The
interceptor drain system is at and below about elevation 180 ft on the slope east of 73`d Place West. In
comparison, the top of the bluff on the Bosch property at the location of the subject landslide is near
elevation 255 ft, about 75 ft above the highest point of the interceptor drain system. The interceptor
drainage systems . do not reduce the groundwater levels in .the slopes above the systems or reduce the
seepage from these areas. Accordingly, it is our opinion that the observed landslide was not caused by or
related to the City's interceptor drainage system..
The landslide has encroached into the yard adjacent to the northwest corner of the residence and
left very little room between the top of slope and the house. Left alone, we would expect that this
oversteepened landslide scarp would continue to fail and progress back so that it would eventually
encroach into the northwest corner of the residence. Landsliding along this slope (and Puget Sound bluff
slopes in general) typically produce landslide scarps that extend back from several feet up to 10 ft or so
back from the top crest of the slope during each landslide event. The time period for the slope to

encroach back to the house is very difficult to estimate, but could conceivably occur over a number of
months to many years.
RECOMMENDATIONS
We recommend that the owners of the house retain a geotechnical consultant to evaluate the slope
condition in detail, assess the present and future risk, and develop specific recommendations to protect the
house and limit the potential for additional landslides to damage the house.
We offer the following comments and assessment to address the City's questions on whether the
landslide and present condition pose an imminent hazard to City -owned facilities, the general public, or
the occupants of the Bosch residence and downslope residences. This assessment is based on a cursory
observation of the site conditions and our experience with similar landslide conditions, and not on a
detailed evaluation of the site conditions. Our limited assessment for the purpose of assessing imminent
risk should not be construed as a replacement for a detailed geotechnical evaluation and recommendations
developed by a geotechnical consultant retained by the property owner to address the longer -term risk
posed by the landslide hazard.
The landslide occurred on private property and extended into adjacent private. property.
Therefore, the general public traveling on public rights -of -way would not be affected by this landslide.
From the readily available vantage points below and above the landslide, it was not possible to determine
if the landslide debris extended far enough downslope to impact the City's interceptor drainage system
number 1-A. Surface water carrying silt and fine sand was observed emerging onto the pavement surface
at 73rd Place West and may require maintenance activities to better collect this surface water at the
roadway location and to maintain clean and functioning storm water catch basins. It does not appear that
the landslide threatens any other City -owned facilities.
The oversteepened landslide scarp could continue to progress back until it eventually encroaches
on the house foundation. The time period for this to occur is difficult to predict. We have not examined
the building plans, but we understand that the house itself is supported on deep piles. The porch,
however, may only be supported on spread footings. The pile foundations provide some protection to the
structure and, therefore, provide improved life safety as compared to a structure supported solely on
shallow foundations. However, additional slope movement or landsliding in the future could progress
back to the house foundation and damage the pile foundation, ultimately damaging or endangering the
house. We expect that landsliding of the scale typically observed on the bluffs in this area (typically
extending back from the top of the slope a distance on the order of several to 10 ft for each landslide
event) could damage the pile foundation. However, a landslide of this magnitude would be unlikely to
pose an immediate life safety issue for occupants of the residence.

The debris from this landslide extends into an undeveloped lot within the Lorian Woods
subdivision. The owner of this property should be advised of this condition. Mudslides and landslide
debris from the bluff above can impact any development on the property below and any future
development plans should consider and address this issue.

the evaluation of public safety concerns related to the Bosch property landslide. Within the limitations of

Department was transcribed and forwarded to me for response.
Please note that the City has not initiated any form of eminent domain or condemnation
proceedings with respect to your property. The notice which you received was sent by the
Building Department in order to advise of a condition that exists with respect to the lot which
you own in Edmonds. It did not suggest that the lot which you own is worthless or unbuildable.
The condition is a matter which you should review with a geotechnical expert. The City has
found that with proper geotechnical planning, lots in the Meadowdale landslide and earth
subsidence hazard area can be the site of residential construction. —That construction needs to.be
thoughtfully undertaken with the advice of a geotechnical expert due to the underlying
characteristics of the landslide mass. You or your geotechnical expert should consult the City's
records in that regard as well as conduct an independent evaluation of the property.
Secondly, Snohomish County, not the City of Edmonds, administers the State's property tax
assessment program. The assessment which you have been given can be the subject of an appeal
and you should retain counsel to help you with it. The issues which you raise are ones which
could be considered in the assessment of the value of the unimproved lot which you own.
The information with which you have been provided by the City was intended to advise you of a
condition that impacts your property. It does not trigger any restriction regarding construction

The following is a response to the Order To Corect Violation issued to my
company for work done at Lorian Woods Plat east of Lot 5.
My company performed no illegal tree cutting without a permit as required
by the City of Edmonds. Our job was to simplU prune the trees on the above
mentioned site, and no trees were removed not was their any land cleared.
A call was made to the City of Edmonds to ask if a permit was needed for
pruning of trees and the response was that no permit was needed as long as they
were not being cut down.

The purpose of this letter is to inform you as the property owner of Lot 5 in Lorian Woods, a plat
within the City of Edmonds, that a slide has occurred on the embankment located directly to the
east of your property. Although the east lot line of your property cannot be determined the City
believes that debris and landslide material have reached portions of your property.
Enclosed please find the City's geotechnical engineering report on the landslide. The City is
requiring corrective action for the plat of Sequoia Ridge located to the east of your lot as well as
individual corrective action on a single family project under development within Sequoia Ridge.
If you desire any other public information or submittals that the City may receive in the future
concerning this matter please advise us in writing.
On a related matter, as you may know, City Public Works crews inspect the City storm drainage
system on the slope between the Plats of Lorian Woods and Sequoia Ridge every Friday. On
Friday December 14t', crews reported that maple trees have been topped midway up the slope.
In addition the tree debris from the toppings was not removed and is blocking the hillside
maintenance paths and City crews are now unable to access and maintain the drainage system.
The City desires your knowledge and assistance with regard to this tree topping since the topped
trees in question clearly benefit the views of the Plat of Sequoia Ridge. Please inform the City at
your earliest convenience if you have any information regarding this tree topping.

Phis letter summarizes our observations and recommendations related to the landslide. that
occurred on a steep slope, east of 73`d Place West, south of North Meadowdale Road, near the Lorian
Woods and Sequoia Ridge Plats. At the request of the City of Edmonds, Deborah Ladd of Landau
Associates visited the site on December 17, 2001 with City of Edmonds personnel (including Dave
Gebert, Jeannine Gras~ Don Fiene, and Noel Miller). The purpose of our visit was to assess site
conditions and identify any imminent hazard to the residents or general public.
BACKGROUND AND OBSERVATIONS
We understand that the landslide occurred sometime on Sunday, December 16, 2001. The
landslide was reported by the resident at 16109 73rd Place West. At the time of our visit, we could
observe parts of the slide from the 73rd Place West roadway (below the base of the slide) and from the top
of the slope (from a location behind 16118 72nd Avenue West). The landslide occurred during a period of
very intense rainfall on December 16, 2001 and rainfall for the water year beginning in Octolxx 2001 has
been considerably above normal.
The landslide has mudflow characteristics, with a width estimated to be about 20 ft at the top of
the slope.. The slide extends from the top of the slope (west of 72"d Ave. West) to near the bottom of the
slope, east of 73'j Place West The landslide appears to largely involve the surficial layer of soil on the
steep bluff face along with small trees and other surficial vegetation.. The mudflow and vegetative
material is currently resting.on the flatter parts of the slope about 100 ft east of the 73'd Place West
roadway. The landslide did not extend to the public roadway and did not impact any residences. Silty

water, interpreted to be from seepage and springs in the landslide area, was flowing into several small
drainages at the time of our visit.
, I During our visit we also observed conditions near the top of the slide, near a residential
construction site (the Bosch site, located immediately north of 16118 72"d Avenue West). During our
visit we noted that soil excavated from the residence foundations had been placed in stockpiles at the edge
of the bluff near the slide area. The stockpiles were estimated to be about 6 to 10 ft high and had been
sparsely covered with straw. We observed that the erosion control fencing along the west side of the
construction site had been torn in the area of the slide and was partially failing in other areas. We also
observed some very loose soil immediately north of the slide area that could potentially fail in the near
future.
PUBLIC RISK
It is our opinion that the existing landslide does not pose any imminent risk to the nearby
residences or to the general public. The residence closest to the base of the slide (16109 73`d Place West)
is located about 100 ft south and over 50 ft west of the base of the slide path. The residence closest to the
top of the slide (16118 72' Avenue West) is located over 50 ft from the top edge of the slide. The slide
path does not extend to the public roadway at 73`d Place West.
RECOMM)ENpATIONS
The construction practices at the Bosch site are not in accordance with practices for landslide
prone areas. We recommend that the soil stockpiles located near the edge of the bluff be moved or
removed immediately. The soil stockpiles should not be placed any closer than 30 ft from the slope edge
on any part of the site. Furthermore, we recommend that soil stockpiles be covered with plastic sheeting,
and all site drainage be directed away from slopes on the site. We also recommend that the site erosion
control measures be reinspected and repaired where needed. In particular, the silt fencing that was
destroyed by the slide should be replaced and excessive accumulations of silt and soil behind silt fences
should be removed.
During the time of our visit, the existing bluff edge showed evidence of potential future
movement in the area immediately to the north of the existing slide as evidenced by soil cracks and very
loose and soft soil. This loose / soft soil north of the existing landslide is at high risk for future failure.
We recommend that extreme caution be used in this area when working at the top of the bluff or on the
slope below the bluff. The risk of failure is expected to be highest during and following periods of high
intensity precipitation. Accordingly, we recommend that the City advise the owners of nearby residences
at 16118 72od Avenue West and the Bosch residence to consult their own geotechnical engineers for

advice about the long-term stability of the slope on their property and the risk and repercussions of slope
movement.

Subject: Request for Permission to cut trees
Lot No. 6, Lorian Woods PRD
Dear Sir/Madam:
I am writing this letter on behalf'of Mr. & Mrs. Chun & Ui-Chon Park to request
your permission to cut four Alder trees posing danger to damage their house
located at Lot No. 6 of Lorian Woods PRD. The trees are located on the
adjacent Lot No.�-. The map of the Lorian Woods PRD is attached herewith.
The Lot NoS is vacant and is currently on the market for sale. When someone
builds house on the lot, the trees will have to be cut off eventually; however,
because of the imminent threat posed by those trees, Mr. & Mrs. Park want to
cut the trees at their expenses as soon as possible. The subject has been
discussed at the April Lorian Woods Home Owners Association meeting and all
those attended approved the tree cutting.
Mr. & Mrs. Park have consulted with an arborist concerning the nature of the
trees and potential threat to fall by wind storms toward their house. The life of
Alder trees is known to be about 60 years and the arborist estimated the trees to
be about 50 years old. The trees are leaning toward Mr. & Mrs. Park's house
on Lot No. 6 and there exist potential to be uprooted by severe windstorm.
I have looked at the situation with respect to soil erosion and possibility of
causing slide as a result of cutting those trees. It is my professional opinion
that the cutting of those trees would not necessarily aggravate the slide potential.
