I have contacted the Building Official and the Fire Marshall and all have concurred that your address of 16105 N. Meadowdale Road should be changed to 16115 N. Meadowdale Road. This is consistent with the surrounding addresses and new addresses assigned to the newly created short -plat building lots. With the neccessity of addressing the Falk short -plat, the City is taking the opportunity to correct, or more correctly bring into line, incorrect addressing in the area. Ot Public worft; Your letter addressed to the City Council Members has been referred to one for answer regarding the City of Edmonds' utility charge, which you refer to as the sewer service charge. My apolo- gies for not answering sooner, but you refer to a King County South Park case, which we tried to inquiry into. As of yet, we have not identified the matter. The same matter was brought to our attention regarding the City of Seattle, which at that time was on the losing side of a similar action. Since at the moment we are unable to get the details on the South Park matter, we will for convenience and illustration compare the City of Edmonds to the Seattle'case. The situation is quite different between the City of Edmonds and the City of Seattle, and in all probability different again from King County. The C ity of Edmonds has had a combined water/ sewer system since 1953 when the water and sewer system were combine(). At that time the action was necessitated in order to finance construc- tion of certain significant sewer mains and the sewerage treatment plant, and other sewer betterments, because the city was so ordered to do under either federal or state order due to pollution of Puget Sound. As you are, no doubt, aware the Lynnwood sewer treatment plant capacity is under critical review at the present time, and Brown's Bay is threatened with pollution which is adjacant to the Meadowdale area. As you probably also know, many years ago the City of Edmonds purchased some of the capacity of the Lynnwood sewer treatment plant, but the plant apparently cannot handle the flow currently coming from Lynnwood, irrespective of the rights of the City of Edmonds in the capacity of the plant. Were it not for the foresightedness of the City of Edmonds, the situation currently would be much worse than it is. nd the Meadowdale area would be the area most directly affected. All property owners in Edmonds, whether directly connected to the Edmonds sewerage system or not, receive substantial benefits i Gordon W. Rosier January 24, 1980 Page Two in a cleaner Puget Sound, overall water table, storm drainage run-off, etc. Seattle, and perhaps King County, made no distinction between properties that were connected and unconnected in its rate'. structure'.:'-" Seattle (and perhaps King County) charged a sewer charge based on water usage, whether or not the particular property were connected to the sewers. Although I do not pretend to have read the entire court file in Seattle, as referenced above I did look at what seemed the more pertinent documents at the time. I note that the plaintiffs in the Seattle case emphasize the dis- tinction just referenced in which Seattle charged a sewer charge based on water usage, whether or not the particular property were connected to the sewers. On page 3 of their legal brief to the court, it was, stated: "Plaintiffs thus have been required to pay charges equal to those paid by City residents whose property is connect to the sewer system and who use compar- able amounts of water, irrespective of the fact that plaintiffs do not discharge any water or liquid waste into the city's sewage collection or treatment facilities. " This is not the case in the City of Edmonds. In Edmonds there is no sewer service charge as such (although there originally was), but instead there is a utility charge at $2 per month for those not connect- ed to sewers, and $3. 50 per month for those connected to sewers (City Code Section 6. 20.030). Therefore, the City rate structure recognizes that all property owners in the City are benefited by the basic sewerage system, such as the sew#,age treatment plant, ex- tended outfalls, basic main system, etc., but that those directly connected to the sewerage system receive greater benefits, and, hence, are charged 75 percent more. The existing system is actually available to the Meadowdale area of the City 'of Edmonds. It is more a matter of Meadowdale re- sidents being unwilling to pay the admittedly high cost of forming the necessary local improvement district to install the final system with- in that' area. All other areas of the City have been sewered by lo- i 0 Gordon W. Rosier January 24, 19'80 Page Three cal improvement district assessments paid for by the property owners. Edmonds has gone on record numerous times, in fact even initiating an LID for the area, that the 'Meadowdale area will be connected anytime the ,property owners are willing to pay for the assessments as have all other areas of the City. The primary trunk system was built and designed for this specific purpose. It was my understanding that the court did not invalidate the entire Seattle sewer service charge, even though it had not been segregated between con- nected and unconnected users. At the time of my inquiry, the court order establishing the class, granting motion for partial summary judgment, and judgment, stated in part on page 3: "Defendants may not lawfully impose upon and collect from members of the designated [unconnected property owner] class the total sewer service charge which has been and currently is imposed, but can and shall only collect for benefits, general or special, actually re- ceived by members of the designated class." (Empha- s is added.) At that time the court had not ruled on what proportion the Seattle sewer service charge represented benefits received. At the moment I do not know the final outcome of the Seattle case. As pointed out above, however, the City of Edmonds has a combined "utility charge", rather than a "sewer service charge", and already makes a distinction in its rate structure for property owners that are not directly connected to the sanitary sewerage system. In your letter you state Meadowdale residents are organizing to file a class action against the City. As you are aware, such liti- gation can be very expensive. The amount in controversy will not really be .a significantly large figure. I should think efforts and money would be better spent on trying to solve the sewerage situation, rather than legal attacks on the utility charges that are used in part to mitigate against, an unhappy circumstance. I am sure you are aware that the City staff is again studying the problem. Residents of the area have complained several times to the Public Works Department advising the fee is illegal. We cannot participate nor take advantage of sewer service. A recent case in King County (South Park) involving the exact same cir- cumstances produced a favorable decision for the residents. The sewer fee money was refunded to!the residents and the county ordered to stop collecting the sewer fee because the residents did not have sewers. Some residents of Meadowdale (including myself) are organizing to file a class action suit against the City of Edmonds inorder to recover the fees collected by the city, and to stop further sewer fees from being collected until such time as the residents are actually connected to sewers. I would strongly recommend the Council review the sewer fee, refund monies monies we feel have been illegally collected and discontinue collecting the sewer fee until we have sewers. Edmonds, Washington 98020 Dear .Mrs. Phillips: AUG 2 9 1978 Executive Offices Your letter of July 31 to the City of Edmonds has been re- ferred to me for answer regarding the City of Edmonds' utility charge which you refer to as the sewer' service charge. My apologies for not answering sooner, but you refer to the Seattle case of Mahoney v. the City of Seattle, which necessitated my inquiring into that matter. The situation is quite different between the- City of Seattle and the City of Edmonds. The City of Edmonds has a combined water/sewer system since 1953 when the water and sewer system were combined. At that time the action .was necessitated in order to finance construction of certain significant sewer mains and the sewerage treatment plant, and other sewerage betterments, because the city was so ordered to do under either federal or state order due to pollution of Puget Sound. It is my understanding that Seattle operates its sewerage sys- tem in connection with Metro. All property owners, whether directly connected to the Ed- monds sewerage sy_stem or not receive substantial benefits in a cleaner Puget Sound, overall water table, storm drainage run off, etc. Seattle made no distinction between properties that were con- nected and unconnected in its rate structure. Seattle charged a sewer charge based on water usage, whether or not the particular property were connected to the sewers. Although I do not pretend to have read the entire court file in Seattle, I have looked at what seems the more pertinent documents. I note that the plaintiffs (John Mahoney and others) in the Seattle case emphasized this distinction. On page 3 of their legal Mrs. Don Phillips August 2.8, 1978 Page Two brief to the court it is stated: "Plaintiffs thus have been required to pay charges equal to those paid by City residents whose property is connected to the sewer system and who use com- parable amounts of water, irrespective of the fact that plaintiffs do not discharge any water or liquid waste into the city's sewage collection or treatment facilities." This is not the case in the City of Edmonds. . In Edmonds there is no sewer service charge as such (although there originally was), but instead there is a utility charge at $2 per month for those not connected to sewers, and $3.50 per month for those connected to sewers (City Code Section .6. 20. 030). Therefore, the City rate structure recognizes that all property owners in the City are bene- fited by the basic sewerage system, such as the sewerage treat- ment plant, extended outfalls, basic main system, etc., but that those directly connected to the sewerage system receive greater benefits, and, hence, are charged 75 percent more. The existing system is -actually available to the Meadowdale area of the City of Edmonds. It is simply a matter of Meadowdale residents being unwilling to pay the' admittedly high cost of forming the necessary local • improvement . district to install the final . system within that area. All other areas of the City have been sewered by local improvement district assessments paid for by the property owners. Edmonds has gone on record numerous times, in fact even initiating an LID for the area, that the Meadowdale area will be connected anytime the property owners are willing to pay for . the assessments as have all other areas of the City. The primary. trunk system was built and designed for this specific purpose. It . may have escaped your notice that the court did not invalidate the entire Seattle sewer service charge even though it had not been segregated between connected and unconnected users. The court order establishing the class, granting motion for partial summary. judgment, 'and judgment, states in part'on page 3:. Mrs. Don Phillips August 28, 1978 Page Three "Defendants may not lawfully impose upon and collect from members of the designated class [unconnected property owners] the total sewer service charge which has been and currently is imposed, but can and shall only collect for benefits, general or special, actually received by members of the designated class." . (Emphasis added.) The court still has not ruled on what. proportion the Seattle sewer service charge represents benefits received. As pointed out above, however, the .City of Edmonds has a combined "utility charge", rather . than a "sewer service charge", and already makes a distinction in its rate structure for property owners that are not directly connected to the sanitary sewerage sys- tem. I note in your letter that you have declined to pay the $2 , portion of your bill attributable to the utility charge. I trust you will reconsider and on your next bill pay any arrearage. There are significant outstanding utility bonds for which the covenants in the bonds require the City to enforce its current rates. State law also requires the same, and provides for enforcement by the city either filing a lien against the property, or turning off the water to the . premises, or both. We would much prefer not to take either one of these actions, and trust that you will keep. your account current. If you have any questions, . please do not hesitate to make further inquiry. In 1970, Ordinance #1465 was passed by the City Council. This ordinance redesignated the "Sewer Service" charge as the utility charge.. These charges develop revenue to provide for such things as sanitary sewage collection, treatment, disposal and outfall, together with storm and surface water collection and disposal. Also, in 1977 the City Council passed Ordinance #1898 which increased water and utility rates. AN ORDINANCE ESTABLISHING DEFINITIONS AND CLASSIFICATIONS OF USERS OF WATER AND SIWVER SERVICES IN THE CITY OF EDMONDS; ESTABLISHING AND FIXING WATER RATES; AND ESTABLISHING SEWER SERVICE CHARGES ACCORDING TO CLASSIFICATION OR USE, WHEREAS, because of annexations and rapidly. expanding facilities and increas- ing population of the City of Edmonds, the present water service charges are in some instances inadequate to cover the cost of water service provided to homes in the City of Edmonds,. and WHEREAS, it is necessary to increase the water service charges to cover the said increased costs and expenses, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS DOES ORDAIN, as follows: Section 1. Definitions. a. Dwelling Unit shall mean a building or portion thereof providing complete housekeeping facilities for' one family. b. Single Family. Residence shall mean a detached building containing one dwelling unit only. c. Duplex shall mean a building, .occupying a lot, containing two dwelling units. d. Apartment houses and other multiple units (except hotels, tourtist courts, trailer parks and motels) shall mean a building or buildings used for and containing three or more dwelling units occupied on a weekly or monthly basis. Units rented on a weekly or monthly basis shall not be deemed to be tourist courts or motels. e. Hotels shall mean any place with individual rooms rented on a daily or weekly basis. f. Tourist courts and motels shall mean detached, multiple units, occupied and paid for on a daily basis. g. Office buildings shall include all types of professional and business offices, including but not limited to architects, engineers, lawyers, doctors, dentists, real estate offices, etc. h. Commercial and retail buildings shall mean all types of retail and com- mercial business establishments other than office buildings and other than industrial or manufacturing, and each such business shall be con- sidered as a separate unit even though two or more may be in the same building. i. In the event there shall be more than one type of operation in the same building, i, e. , a professional office, a retail store, a restaurant, or an apartment, then in that case each separate category or type shall pay at the rate fixed under that particular category or type. 06 Section 2. Establishing and Fixing. Water Rates. . The monthly rates for water supplied through meters, within the corporate limits of the City of Edmonds, are hereby fixed as follows: a. First 700 cu. ft. or less - - - $2. 25 b. Next 700 cu. ft. , (per 100 cu . ft.) - - ..25 c. Next 2, 500 cu. ft., (per 100 cu. ft.) - - .20 d. All over 3, 900 cu. ft., (per 100 cu. ft.) - .17 Monthly minimum charges, for other. than 3/4" meters, within the corporate limits of the City of Edmonds, are hereby fixed as follows: a. 1" meters - - - - - - $3. 20 per mo. b. Over 1" and up to 2" meters - - - 6. 50 per mo. c. All over 2" meters - - - - - $10. 00 per mo. The monthly rates for water supplied through meters, outside the corporate limits of the City of Edmonds, are hereby fixed as follows: a. First .700 cu. ft. or less 7 - - - $3. 65 b. Next 700 cu. ft. , (per 100 cu. ft.) - .25 c. Next 2, 500 cu. ft. , (per 100 cu. ft.) - - .20 d. All over 3, 900 cu. ft., (per 100 cu. ft.) - .17 Monthly minimum charges, for other than 3/4" ne ters, outside the corporate limits of the City of Edmonds, are hereby fixed as.follows: a. 1" meters - - - - - - $ 4. 60 per mo. b.. Over 1" and up to 2" meters - - - 7, 90 per mo. c. Allover 21' meters - - - - - 10. 00 per mo. New meter installation charges are hereby f ixed as follows: a. 3/4" inside City limits - - - - $100.00 b. 3/4" outside City limits - - - - 125.00 C. 1" inside City limits - - - - - 125.00 d. 1" outside City limits - - - - 1.40. 00 e. All over 1" to be charged for at total actual cost of job Cost of street restoration (all surfaced streets) to be added to any meter installation chage where applicable. Section 3. Establishing sewer service charges according to classification or use. .The sewer service charges hereinafter set forth shall be added to and made a part of monthly rates for water supplied through the meters as hereinbefore set forth, such sewer service charge to be based on types of use and established ac- cording to L.he following scneauie: a. By addi- tional office is meant an office operated separate and apart from other offices in the same building. h. Laundries and Laundromats - - $5. 00, or 1/3 of the water bill, whichever is greater k. Hospitals or Nursing Homes - - $5. 00 per month 1. Churches, Fraternal and Service Organizations - - - $1. 40 per. month These rates do not apply to industries or manufacturing concerns which have industrial wzdes and these, with any other activities not covered in this ordi- nance, will be dealt with on a special basis and have special rates set for the particular business by the Water Committee. Section 4. Should any section, clause or provision of this ordinance be de- clared by the Courts to be invalid, the same shall not affect the validity of the Ordi- nance as a whole or any part thereof, other than the part so declared to be invalid.
