REVIEW PROCESS: Variance; Hearing Examiner conducts public hearing and makes final decision. MAJOR ISSUES: a) Compliance with Edmonds Community. Development Code (ECDC) Section 16.20.030 (SINGLE FAMILY RESIDENTIAL - Site Development Standards). b) Compliance with Edmonds Community Development Code (ECDC) Chapter 20.85 (VARIANCES). SUMMARY OF RECOMMENDATION AND DECISION: Staff Recommendation: Approve with conditions Hearing Examiner Decision: Approve with conditions PUBLIC HEARING: After reviewing the official file which included the Planning Division Staff Advisory Report; and after visiting the site, the Hearing Examiner conducted a public hearing on the application. The hearing on the Young application was opened at 9:20 a.m., April 18, 1996, in the Plaza Room, Edmonds Library, Edmonds, Washington, and closed at 9:30 a.m. Participants at the public hearing and the exhibits offered and entered are listed in this report. A verbatim recording of the hearing is available in the Planning Division. • Incorporated August 11, 1890 • Sister Cities International — Hekinan, Japan 1. Site Development and Zoning: a) Facts: (1) Size: The subject property is approximately 7,236 square feet in area. Lot dimensions are 60.30-feet by 120-feet. The proposed addition would be located near the southwest side of the property approximately 21-feet 6-inches from the nearest property line (see Exhibit A, Attachment 4 and Photographs, Exhibit Q. (2) Zoning% The zoning of the subject property is Single -Family Residential (RS-20). (3) Terrain and Vegetation: The subject property slopes downward from the east properly line to the west property line, with all open areas fully landscaped (see Exhibit A, Attachment 4). 2. Neighboring Development and Zoning: a) Facts: (1) North: Developed with detached single family residences, and zoned RS-20. (2) South: Developed with detached single family residences, and zoned RS-20. (3) East: Developed with detached single family residences, and zoned RS-20. (4) West: Presently undeveloped, and zoned RS-20. a) Facts: (1) The fundamental site development standards in a RS-20 zone are set forth in Chapter 16.20.030. (2) Minimum street setback in the RS-20 zone is 25-feet. b) Conclusion: Except for the requested side setback variance, the applicant is proposing to build a structure which conforms to the RS-20 development standards for locating structures on a lot. 2. Compliance with requirement for a variance ECDC Chapter 20.15B.180.A, states an applicant may request a variance from the standards of this Chapter pursuant to the procedures set forth in ECDC Chapter 20.85 (Variances). Chapter 20.85 of the ECDC sets forth the mechanism whereby a provision of the Code may be varied on a case -by -case basis if the application of the provision would result in an unusual and unreasonable hardship (see Exhibit A, Attachment 2). a) Facts: (1) ECDC Section 20.85.010 establishes the decisional criteria with which a variance request must comply in order to be granted by the Hearing Examiner. These criteria include: a special circumstance must exist; no special privilege is granted; the proposal is consistent with the Comprehensive Plan and the Zoning Code; the proposal will not be detrimental and is the minimum necessary. (2) Variances may be used to modify bulk standards. They may not be used to modify use or procedural requirements. (3) The home was constructed in 1905 and has previously been used as a school and store. The home was constructed prior to the adoption of the zoning code (see Exhibit A, Attachment 2). b) Conclusions: (1) Special Circumstances Special Circumstances include the size, shape, topography, location or surroundings of the property and public necessity for public structures. Hearing Examiner Decision Case No.: V-96-13 Page 4 In this case, the applicant wants to construct an addition on the south side of the home. The lot size is approximately 7,236-square feet and substandard for the RS- 20 zoning district. The home was constructed in 1905 prior to the adoption of the ECDC. Most of the applicants residence is located in the setback area and the proposed location of the roof is the only area adjacent to the buildable area of the site (see Exhibit A, Attachment 2). Therefore in order to access the buildable portion of the lot the applicant must encroach upon the setback area in order to connect the addition to the residence. Special Circumstances exist with regard to lot size and the residence predating the adoption of the ECDC. (2) Special Privilege It does not appear that any special privilege will be demonstrated in granting this variance in that other properties in the same zone with similar circumstances would also qualify for a variance (see Exhibit A, Attachment 2). (3) Zoning Code and the Comprehensive Plan Approval of the proposed variance would allow for the continued development of the site in a manner consistent with the intent of the Zoning Code and the Comprehensive Plan designation of the site (see Exhibit A, Attachment 2). (4) Not detrimental Approval of the variance would not be detrimental to the public health, safety or welfare (see Exhibit A, Attachment 2). (5) Minimum Required The request is the minimum necessary for accommodation of the addition in that the applicant is making every effort to locate the addition in the buildable portion of the lot (see Exhibit A, Attachments 2 and 4). C. 'Technical Committee 1. Review by City Departments a) Fact: No continents were submitted by other departments. D. Comprehensive Plan (ECDC) 1. a. Fact: The subject property is designated as "Single Family Large Lot". b. Conclusion% The proposed development is consistent with the existing Comprehensive Plan Land Use designation for the site. 2. a. Facts: The Comprehensive Plan, Residential Development section, identifies goals and policies which relate to "Residential Development" in the City. Specific goals and policies are discussed in detail below. Hearing Examiner Decision Case No.: V-96-13 Page s (1) Section B states as a goal of the City that: "High quality residential development which is appropriate to the diverse lifestyle of Edmonds residents should be maintained and promoted...." b. Conclusion: The proposed development is consistent with the above adopted goals and policies of the City for the development of residential property in the City. IL DECISION Based upon the foregoing findings and conclusions, the application for a variance is approved, subject to the following conditions. 1. This variance is to allow the proposal in the location identified on the proposed site plan (see Exhibit A, Attachment 4). Any other structures, additions or remodels would have to conform with the typical setbacks or height requirements for the zone or obtain another variance. 2. This application is subject to the applicable requirements contained in the Edmonds Community Development Code. It is the responsibility of the applicant to ensure compliance with the various provisions contained in these ordinances. 3. The applicant must obtain a building permit prior to construction. 4. The permit should be transferable. ATTACHMENT 1 �SIGNATURE OF APPLICANT/ OWNER/ AGENT 1�� File No. V-96-13 Variance Description: We are requesting a variance of 4'-6" to the existing 25 foot south setback of the subject property that would allow the removal of a 48" inch by 16 foot triangular portion of the`existing roof, the connection of a roof overhang to the existing ridge, and enclosure of the east gable end wall located within the setback. The current planning ordinances allows a roof of overhang of 30 inches into a set back area. The subject existing roof area is located under such an overhang located in a setback area. Because of the overlapping overhang, the existing roof is not visible, and is useless. (See Eave Separation Detail 1/3) The section of the roof protrudes into the living area rendering it practically unusable. To accommodate the roof currently, is structurally complex, and creates potential short and long term maintenance problems We are requesting permission to remove the portion of the existing roof, enclose a gable end, and connect the overhang to the existing ridge by filling in the 1-1/2" separation show on Eave Separation Detain 1/3. This work will not increase the visual non conformity of the structure, nor will it impact view. It will facilitate allow a ,. more sound structural construction detail and avoid potential maintenance problems. Community development code does not allow the non -conformity an existing structure to be increased. It is our belief that this proposed work is consistent with the intent of the code because the visual and practical non -conformity will not be increased, nor will the use of the space be changed. The hearing on the Herman/Van Horne application was opened at 9:24 a.m., March 7, 1996, in the Plaza Room, Edmonds Library, Edmonds, Washington, and closed at 9:45 a.m. Participants at the public hearing and the exhibits offered and entered are listed in this report. A verbatim recording of the hearing is available in the Planning Division. HEARING COMMENTS: The following is a summary of the comments offered at the public hearing. From the City: Kirk Vinish, Project Planner, reviewed the Planning Division Advisory Report which recommended approval of the request for a conditional use permit, with conditions. From the Applicant: Gind Herman and -Lisa Van Horne, Applicants, said: • They concurred with the staff report. • The house where the daycare is proposed to be located has been used as an office building for several years. • Children at the day care will only be outside twice a day and no more than 10 children will be outside at any one time. • One staff member lives in the neighborhood and will either walk or ride a bike to work. • Ages of the children in the daycare will be from 6 weeks to 7 years. From the Neighborhood: Marilyn Nielson, Neighbor, said: • There is a great deal of traffic on Maplewood and she didn't think the street will lend itself to additional traffic; • The daycare will create additional noise in the neighborhood; and • Parking on -site is not adequate for a daycare. Robert Nielsen, neighbor, said: • He agreed with his wife; which is a very awkward intersection; • Due to the design of the parking lot only one car can enter or exit at one time; o The tendency will be to park on the street which is a narrow street, with no room for street parking; and • Pedestrian safety is a real concern as Maplewood has no sidewalks and drivers who use Maplewood don't obey speed limits, Robert Haynes, Neighbor, said: • If the day care is approved, there could be 23 additional cars on Maplewood between 7:00 a.m. and 9:00 a.m. to drop children off and the 23 cars will be back in the afternoon to pick children up; and • People now drive up to 40 mph on Maplewood and a dangerous situation could arise with people turning into the daycare parking lot. Response from the Applicants: Lisa Van Horne said: • Most of the time there are multiple children per family so if there are 30 children in the day care there will be less than 30 families; • Parents generally spend approximately S minutes at the daycare when they drop their children off and they spend approximately 10 minutes at the daycare when they pick the children up. • Traffic speeds are also a concern to them. Gind Herman said: • Not all of the children attend every day or all day, so there will not always be the same number of children at the daycare. Response from the City: Kirk Vinish said: • The ultimate number of children which will be allowed at the day care could be determined by the amount of off-street parking which is available; • The City will monitor the parking issue; Hearing Examiner Decision Case No. CU-96-14 Page 4 • The Engineering Department reviewed the application and did not see a problem with the intersection and the location of the driveway to the parking lot; • The parking issue will be addressed as part of the building permit review process; and e An additional condition should be added which states the applicant will need to comply with the parking requirements. Conclusion: The applicant and the City have satisfied the requirements of SEPA. C. EDMONDS COMMUNITY DEVELOPMENT CODE (ECDC) COMPLIANCE 1. Compliance with ECDC Section 16.30.010 (Multiple Residential) a) .Fact: Daycare Centers are a primary use in multiple residential zones if a Conditional Use Permit is granted, per ECDC 16.80.030.2. b) Conclusion: A Conditional Use Permit is required to allow a daycare center. 2. Compliance with Code (ECDC) Chapter 20.05 (CONDMONAL USE PERMITS) a) Facts: ECDC Section 20.05 contains the review and approval criteria for conditional use permits. According to the aforementioned code section, "No conditional use permit may be approved unless all the findings in this section can be made." The findings are as follows: 1)omprehgnsive Plan - That the proposed use is compatible with the Comprehensive Plan. 2) Zoning Ordinance - That the proposed use, and its location, is consistent with the purposes of the Zoning Ordinance and the purpose of the zone district in which the use is to be located, and that the proposed use will meet all the applicable requirements of the Zoning Ordinance. 3) Not Detrimental - That the use, as approved or conditionally approved, will not be significantly detrimental to the public health, safety and welfare, and to nearby private property or improvements unless the use is a public necessity. 4) Transferability - The Hearing Examiner shall determine whether the conditional use permit shall run with the land or shall be personal. b. Conclusions: 1) Comprehensive Plan: The City of Edmonds Comprehensive Plan has several policies pertaining to daycare centers. Policy B.5 states, "Protect residential areas from incompatible land uses through the careful control of other types of development and expansion based upon the following principles: B.S.a. Residential privacy is a fundamental protection to be upheld by local government. B.S.b. Traffic not directly accessing residences in a neighborhood must be discouraged." There is no specific discussion of daycare facilities in the Comprehensive Plan. C Hearing Examiner Decision Case No. CU-96-14 Page 6 2) Zoning _fiance: The RM-2.4 zone allows Daycare Centers, provided the use is approved through the Conditional Use Permit process. Therefore, the proposed development is consistent with the zoning designation for the subject property. 3) Not Detrimental: The property is separated on two sides by streets, thereby reducing the amount of noise received off site. The outdoor area is fenced and should afford neighbors as much privacy as can reasonably be expected. Traffic outside of the neighborhood should be minimized by locating the facility on a 196th Street which is a major arterial (see Exhibit A, Attachment 2). Therefore, the proposed development will not be detrimental to public safety. 4) Transferability: The proposed development will be permanent, therefore the permit should run with the land 5) The conditional use permit for a Daycare Center should be approved because it is consistent with the decisional criteria for a Conditional Use Permit. C. (1) Facts: (a) The subject property is subject to review under ECDC Chapter 20.15.B (Interim Critical Areas) as part of the application process. (b) The applicant has submitted a Critical Areas Checklist, and the City issued a Waiver from the requirement to prepare , a Critical Areas Study. (2) Conclusion: The applicant has complied with ECDC Chapter 20.15.8. 3. Comprehensive Plan (ECDC) a. : The subject property and adjacent properties are designated as "Public". b. Conclusion: The proposed use is consistent with the Comprehensive Plan designation. D. TECHNICAL COMMITTEE 1. The proposed Conditional Use Permit has been reviewed and evaluated by other Departments/Divisions of the City. a) The Fire Department has commented that an inspection is required (see Exhibit A, Attachment 5). b) The Engineering Division has commented that during the building permit review the Engineering Division will review all applicable requirements (see Exhibit A, Attachment 6). Conclusion: The applicant and the City have satisfied the requirements of SEPA. C. Edmonds Community Development Code (ECIDC) Compliance 1. Compliance with ECiDC Section 16.30.010 (Multiple Residential) a) FW: Daycare Centers are a primary use in multiple residential zones if a Conditional Use Permit is granted, per ECDC 16.80.030.2. b) Conclusion: A Conditional Use Permit is required to allow a daycare center. several policies pertaining to daycare centers. Policy B.5 states, "Protect residential areas from incompatible land uses through the careful control of other types of development and expansion based upon the following principles: B.S.a. Residential privacy is a fundamental protection to be upheld by local government. B.S.b. Traffic not directly accessing residences in a neighborhood must be discouraged. " There is no specific discussion of daycare facilities in the Comprehensive Plan. (2) Zoning Ordinance: The RM-2.4 zone allows Daycare Centers, provided the use is approved through the Conditional Use Permit process. Therefore, the proposed development is consistent with the zoning designation for the subject property. (3) Not Detrimental: The property is separated on two sides by streets, thereby reducing the amount of noise received off site. The outdoor area is fenced and should afford neighbors as much privacy as can reasonably be expected. Traffic outside of the neighborhood should be minimized by locating the facility on a 196th Street which is a major arterial (see Attachment 2). Therefore, the proposed development will not be detrimental to public safety. (4)-Trarnsferability: The proposed development will be permanent, therefore the permit should run with the land. (5) The conditional use permit for a Daycare Center should be approved because it is consistent with the decisional criteria for a Conditional Use Permit. III. RECONSIDERATIONS AND APPEALS The following is a summary of the deadlines and procedures for filing reconsiderations and appeals. Any person wishing to file or respond to a recommendation or appeal should contact the Planning Department for further procedural information. A. Request for Reconsideration Section 20.100.010.0 allows for the Hearing Examiner to reconsider his decision or recommendation if a written request is filed within ten (10) working days of the date of the initial decision by any person who attends the public hearing and signs the attendance register and/or presents testimony or by any person holding an ownership interest in a tract of land which is the subject of such decision or recommendation. The reconsideration request must cite specific references to the findings and/or the criteria contained in the ordinances governing the type of application being reviewed. B. Appeals Section 20.105.020.A & B describe how appeals of a Hearing Examiner decision or recommendation shall be made. The appeal shall be made in writing, and shall include the decision being appealed along with the name of the project and the date of the decision, the name of the individual or group appealing the decision, their interest in the matter, and reasons why the appellant believes the decision to be wrong. The daycare will be licensed for 25-30 children for the above acid% Bess. Our hours of business are Monday through Friday lam to 6pm. The facility is closed on weekends. Currently, there are 15 children attending the daycare center with variable schedules. We have some part -tune and some full -dune attendees. There are children who attend half days • two days a week, full days for 2-3 days a week and full time attendees. As the center increases in the number of children , the variable schedule will still adhere as not all 2530 children will be present all and every day. During the winter months the children attending the facility spend approximately 90°l0 of their time indoors. In the summer months they are inside approximately S00f0 of the time and 50% outdoors. The daycare currently has a staff of 1 part time and 2 full-time employees. The members of the staff work on a flexible schedule which provides coverage for the 11 hours of daily operation at the center. The first care provider arrives at lam and leaves at 2pm. The second arrives at 9am and stays until the 6pm closing. The third staff member arrives at 2pm and departs between 5-5:30pm. The 3 parking stalls located on the east side of the parking lot will be used for employee parking. One staff member lives close enough to the center to wails or ride a bike so in her case no parking is weeded. This arrangement will allow for 6 parking spaces for drop off in the morning and 7 parking spaces for pickup in the evening. As the number of children increase in the daycare, we will modify the staff' schedule as follows: First Starting 7MM Shift End 2PM Second Starting 8AM Shill End 4PM. This arrangement will allow for 6 parking spaces for drop off in the mom Iing and 7 parking spaces for pickup in the evening.
