REVIEW PROCESS: Conditional Use Permit; Environmental Review; Hearing Examiner conducts public hearing and makes final decision. MAJOR ISSUES: a. Compliance with Edmonds Community Development Code (ECDC) Section 16.20.010 (SINGLE FAMILY RESIDENTIAL - USES) b. Compliance with Edmonds Community Development Code (ECDC) Chapter 20.05 (CONvTATIONAL USE PERMITS) 4 Compliance with City of Edmonds Comprehensive Plan SUMMARY OF RECOMMENDATION AND DECISION: Staff Recommendation: Approve with conditions Hearing Examiner Decision: Approve with conditions PUBLIC HEARING: After reviewing the official file which included the Planning Division Staff Advisory Report; and after visiting the site, the Hearing Examiner conducted a public hearing on the application. ,The hearing on the application was opened at 9:03 a.m.,.November 6, 1997, in the Plaza Room, Edmonds Library, Edmonds. W"-:::iigton, and closed at 9:11 a.m. Participants at the public hearing and 0- r--,J,i1bits offered and entered are listed in this report. Hearing Examiner Decision Case No. CUH-97-105 Page 2 HEARING COMMENTS; The following is a summary of the comments offered at the public hearing. From the City: Meg Gruwell, Planner, reviewed the staff report and recommended approval with, conditions. From the Applicant: Phillip Lehn, Applicant, said he had nothing to add to the staff report and said the conditions are consistent with the code. However, he asked for clarification regarding the number of trips he would be allowed each day. He would like the number to be applied so that he could average 10 trips per day. From the Community: No one from the general public spoke at the hearing. FINDINGS OF FACT AND CONCLUSIONS A. Site DescAption 1. Site Development, Neighboring Development, And Zoning: a) Facts: (1) Size: The subject property is an odd -shaped flag lot with 1.19 acres (see Exhibit A, Attachments 1'& 3). An approved short subdivision application S 95-163 when recorded will divide this lot and an adjacent lot into four lots, with the lot that this house will remain on being a thin, mostly rectangular lot. (2) Land Use: The property is currently developed with a single-family residence and a detached garage. , (3) Zoning The zoning of the subject property is Single -Family Residential (RS- 12) (see Exhibit A, Attachment 1). (4) Terrain and Vegetation: The subject property slopes steeply down to the west, and is landscaped near the house with, shrubs, trees and ground covers. Portions of the lot have had improvements for the short subdivision (primarily the access road) and have been'hydroseeded where the ground was.disturbed. a Hearing Examiner Decision Case No CUH-97-105 Page 3 2. Surrounding Development.and Zoning: a) Facts: (1) The lots to the north, east, and south are all currently zoned Single Family Residential (RS-12) and are developed with single family homes (see Exhibit A, Attachment 1). (2) The lot to the west is zoned Single Family Residential (RS-20) and is developed with single family homes (see Exhibit A, Attachment 1). B. Edmonds Community Development Code (ECDC) Compliance 1. ECDC Section 16.20.010 (SINGLE-FAMILY RESIDENTIAL - USES) a) Facts: (1) "HomeOccupation," subject to the requirements of Chapter 20.20, is apermitted secondary use in the RS-12 zone, per ECDC 16.20.010. (2) A single-family dwelling unit is a permitted primary use, given in ECDC 16.20.010. b) Conclusion: Compliance. with Chapter 20.20 is required to. allow the,establishment of a home occupation in a single family zone If a Conditional Use Permit is'granted, the use will be consistent with the Edmonds Community Development Code Section 16.20.010. 2. ECDC Chapter 20.20 (HOME OCCUPATIONS) 0 a) Facts: (1) ECDC Section 20.20 contains two ways to allow Home Occupations., The first through administrative approval, which allows home occupations as a permitted To qualify for administrative approval, the home occupation may not have persons visiting the subject property. Hearing Examiner Decision Case No.`CUH-97-105 Page 4 • Will not include storage, display of goods, building materials.andlor the operation of building machinery, commercial vehicles or other tools, unless it LU meets the following criteria: M eI • Is wholly enclosed within a structure or building, • Does not emit noise, odor or heat, and • Does not create glare or emit light from the site in violation of the performance criteria; • Does not create a condition which injures or endangers the comfort, or health or safety threats of persons on abutting properties or streets; and e Will not generate traffic from outside of the neighborhood nor excessive neighborhood traffic or necessitate excessive parking beyond that normally associated with a residential use; and all performance criteria established ECDC 17.60.010 are met. Any permit granted to such a home occupation be immediately voidable upon proof of any visit to the site by any client, patient or customer in excess of the standard established through the conditional permit process, and proof of one such occurrence shall be sufficient to void permit in any proceeding under ECDC 20.100.040 relating to review approved permits. (3) The applicant has addressed these criteria in Exhibit A, Attachment 4, summarized below: • The applicant states that given the small and quiet nature of the occupation, existence would be Iargely unnoticed. • No temporary or permanent keeping of animals would be associated with home occupation. • The applicant states that a small assortment of building materials and equip may be stored and displayed, but they would be enclosed within a building would not emit noise, odor or heat, nor create glare or emit light from the site violation of the city's performance criteria. • The applicant declares that the home occupation would not create a condition which injures or endangers the comfort, or pose health or safety three' persons on abutting properties or streets. • The applicant anticipates that because he has no employees, plans to meet most, consultants at their offices, and anticipates only having one or two additional I Q (4) The Institute of Transportation Engineers book Trip Generation gives an average trip generation rate per single-family, detached dwelling unit of 9.55 trips per weekday, with a range of rates between 4.31 and 21.85 trips. (5) The maximum number of parking spaces required would presumably be one space required for a single-family residence and three spaces for the three other owner/officers. However, since the meetings are only to be at least once a year, then one additional parking space would probably be adequate. The site plan submitted shows two areas for guest parking, in addition to the parking provided in the garage. (6) Access to this neighborhood is either by 164th Street SW off of North Meadowdale Road, or from Meadowdale Beach Road via 74th Place W. and private easements. Both of these approaches are steep, with corners that are difficult to maneuver and often hard to see around. (7) No comment letters have been received. b) Conclusions: (1) See Section.B.4 of this report for a discussion on how this proposal addresses the Conditional Use Permit criteria for the City of Edmonds. (2) If traffic is kept at a minimal level, the home occupation would seem to be quite innocuous and will not harm the character of the surrounding neighborhood. (3) No animals will be kept in association with the home occupation. (4) The home occupation will include some storage and display of building materials and equipment, but they will be wholly enclosed within a building and will not have any of the negative emissions listed in the criteria. (5) Excessive traffic on the steep roads which provide the only access to this neighborhood would create conditions which could pose safety threats to persons on abutting properties or streets. The applicant anticipates that total trips will be reduced as a result of being granted a home occupation permit instead of commuting to a distant office, which will reduce the safety threat. (6) The applicant does not address where the traffic is coming from. He states that the traffic will not exceed that which is normally associated with a residential use. The home occupation should also not require more parking than that associated with a residential use. So long as the use does not generate more traffic than that associated with a residential use, it should be compatible with the neighborhood. The parking provided appears to be adequate for the use. The use appears to meet all the performance criteria established by ECDC 17.60.010. 3. Compliance with Code (ECDC) Chapter 20.05 (CONDITIONAL USE PERMITS) a) Facts: (1) ECDC Section 20.05 contains the review and approval criteria for Conditional Use Permits. According to the aforementioned code section, "No Conditional Use Permit may be approved unless all the findings in this section can be made." The findings are as follows: • Comprehensive Plan - The proposed use is compatible with the Comprehensive Plan. • Zoning Ordinance - That the proposed use, and its location, is consistent with the purposes of the Zoning Ordinance and the purpose of the zone district in which the use is to be located, and the proposed use will meet all the applicable requirements of the Zoning Ordinance. • Not Detrimental - That the use, as approved or conditionally approved, will not be significantly detrimental to the public health, safety and welfare, and to nearby private property or improvements unless the use is a public necessity. • Transferability - The Hearing Examiner shall determine whether the conditional use permit shall run with the land or shall be personal. (2) The Comprehensive Plan designates this area for single-family residential use. (3) The Edmonds Community Development Code allows for "Home Occupations' in a single family zone if a Conditional Use Permit is approved. If the proposed Conditional Use Permit is approved, the "Home Occupation" will be consistent with the Zoning Ordinance. (4) This area has very difficult roads providing access to the neighborhood, so any additional traffic in addition to what a residential use would generate, would be detrimental to public safety. However, as proposed, the home occupation would not be detrimental to the public health, safety and welfare. O Hearing Examiner Decision Case No. CUH-97-105 Page 7 b) Conclusions. - (I } See Section C. I, of this report for a discussion on consistency with the Comprehensive Plan for the City of Edmonds. (2) See Section B. 1-6 of this report for a discussion on consistency with the criteria given in the Zoning Code of the City of Edmonds. (3) If the traffic is maintained at or below a level normally associated with a residential use, the use would not be detrimental to the neighborhood. 4: Compliance with ECDC. Chapter 20.15A (Environmental Review) a) Facts: (1) A conditional use permit for an accessory dwelling unit is not categorically exempt from SEPA review. (2) The applicant submitted an environmental checklist, and the proposal received a Determination of Nonsignificance. This determination was not appealed and the deadline for appeals ended on October 3, 1997. b) Conclusion: The applicant and the City have complied with the requirements of ECDC 20.15A. 5. Compliance with ECDC Chapter 20.1513 (Critical Areas) a) Facts: (1) The applicant submitted a Critical Areas Checklist (CA-94-102) and received a Determination as required prior to the issuance of any permit. (2) The Critical Areas Determination required a topographic survey to delineate the steep slope hazard areas, and further required a 50-foot buffer with an additional 15-foot building setback from the top and toe of the slope (see Exhibit A, Attachment 5). A topographic survey was prepared as part of a short plat (File S- 95-163). Land Use rc i a) Fact: The City of Edmonds Comprehensive Plan has few goals and policies stated in al the Land Use Element, under Residential Development which relate to the subject proposal. U3 iM 0 C (1) The Comprehensive Plan designates the subjectproperty "Single Family." w b) Conclusion. The proposed use is located in a Single Family area on the U. Comprehensive Plan and is therefore consistent with the Land Use designation of the T v Comprehensive Plan for its location. 2. Residential Development a) Facts: (1) The City of Edmonds Comprehensive Plan Residential Development Policy B.5. states "Protect residential areas from incompatible land uses through the careful control of other types of development and expansion based upon the following principles: (a) Residential privacy is a fundamental protection to be upheld by local government. (b) Traffic not directly accessing residences in a neighborhood must be discouraged. (c) Stable property values must not be threatened by view, traffic or land use encroachments. (d) Private property must be protected from adverse environmental impacts of development including noise, drainage, traffic, slides, etc." b) Conclusion: The proposed use will not impact residential privacy, will not promote through traffic, will not impact views, will not increase noise or drainage, and is generally consistent with the Land Use designation of the Comprehensive Plan for its location. D. Technical Committee 1. Limit the average total daily traffic to and from the house to the average number of trips per day listed in the ITE Trip Generation book, which is an average of ten (10) trips per day. 2. Retain on the site a guest parking space of 8.5 feet by 16.5 feet in addition to the parking space provided for the single-farniiy residential use. 3. The home occupation shall not include storage, display of goods, building materials and/or the operation of building machinery, commercial vehicles or other tools, unless they are wholly enclosed within a structure or building, do not emit noise, odor or heat, and do not create glare or emit light from the site in violation of the city's performance criteria. 4. This application is subject to the applicable requirements contained in the Edmonds Community Development Code (ECDC). It is the responsibility of the applicant to ensure compliance with the various provisions contained in these ordinances. 5. The permit shall not be transferable to any other property owners. Ron McConnell a Hearing Examiner RECONSIDERATIONS AND AP'PFA LS The following is a summary of the deadlines and procedures for filing reconsideration's and appeals. Any person wishing to file or respond to a recommendation or appeal should O contact the Planning Department for further procedural information. REQUEST FOR RECONSIDERATION Section 20.100.010.G allows for the Hearing Examiner to reconsider his decision or recommendation if a written request is filed within ten (10) working days of the date of the initial decision by any person who attends the public hearing and signs the attendance register and/or presents testimony or by any person holding an ownership interest in a tract of land Hearing Examiner Decision Case No. CUH-97-105 Page 10 which is the subject of such decision or recommendation. The reconsideration request must cite specific references to the findings and/or the criteria contained in the ordinances governing the type of application being reviewed, APPEALS Section 20.105.020.A & B describe how appeals of a Hearing Examiner decision or recommendation shall be made. The appeal shall be made in writing, and shall include the decision being appealed along with the name of the project and the date of the decision, the name of the individual or group appealing the decision, their interest in the matter, and reasons why the appellant believes the decision to be wrong. The appeal must be filed with l the.Community Development Director within ten (10) working days after the date of the decision being appealed. LAPSE OF APPROVAL Section 20.05.020.0 states 'Unless the owner obtains a building permit, or if no building is required, substantially commences the use allowed within one year from the date of approval, the conditional use permit shall expire and be null and void, unless the owner files an application for an extension of the time before the expiration date.' NOTICE TO COUNT' ASSESSOR The property owner may as a result of the decision rendered by the Hearing Examiner request a change in the valuation of the property by the Snohomish County Assessors Office. STATEMENT During the past five years, my private practice as an architect (Phillip Lehn Architect, formerly located at 524 Main Street in Edmonds) has been principally, engaged with projects originated by Green Tara Incorporated (GTI), a land and building design and development company dedicated to benefiting the natural environment (please see the enclosed statement of purpose). Because the small scale of the practice makes it unnecessary to hire employees, and because I normally try to minimize costs by meeting most consultants at their offices, very little additional traffic would be generated by my home occupation. While I hope to serve one or two additional residential or small commercial clients each year, and host corporate meetings with GTI's three other owner / officers at least once a year, the more likely result of the permit would be to reduce traffic on the street by the much larger number of trips I would otherwise need to make each day commuting to a more remote business location. The following responds specifically to each criteria listed in Section H.A: a. The home occupation will not harm the character of the neighborhood. - Given the small and quiet nature of the occupation, its existence would be largely unnoticed. b. Because the small scale of the practice makes it unnecessary to hire employees, and because I normally try to minimize costs by meeting most consultants at their offices, very little additional traffic, would be generated by my home occupation. While 1 hope to serve one or two additional residential or small commercial clients each year, and host corporate meetings with GTrs three other owner / officers at least once a year, the more likely result of the permit would be to reduce traffic on the street by the much larger number of trips I would'otherwise need to make each day commuting to a more remote business location. The following- responds specifically to each criteria listed in Section H-A: a. The home occupation will not harm the character of the neighborhood. ' Given the small and quiet nature of the occupation, its existence would be largely unnoticed b. No temporary or permanent keeping of animals would be associated with the home ; occupation. c.
