Per your request, the City is hereby informing you that the construction of the storm
improvement system at 1631175'1' Place West is complete.
The following is provided in response to your letter of September 30, 2009:
The storznwater diversion that I believe you are referring to (the above ground piping) was a
diversion put in place by Mr. Pearson to allow for the construction of the storm system
improvements per the approved plans. The diversion was temporary and the above ground
piping has been removed as the storm system construction is now complete.
Exhibits B & C to the Storzrzwater Agreement and Covenant are not construction drawings. A
separate civil plan was submitted by Pearson for the storm system at 16311 75th Place West. The
design was completed by a fain hired by Mr. Pearson and the plans were approved by the City.
The engineer of record as noted on the plans is Todd W. Perbik, P.E. of Perbix Bylconen.
Review of the proposed system was completed by City staff Don F. Fiene, P.E. and Lyle
Chrisman.
As previously communicated and provided for in the recorded covenant, the Pearsons, their
successors and assignees agree to maintain, repair or reconstruct the storm system in perpetuity
in order to convey stonnwater to the catch basin owned by the City (shown on Exhibit D of the
agreement).
City Public Works Department staff perforins regular maintenance inspections of the City's
storm system adjacent to Pearson's private storznwater system. Maintenance inspections are
typically performed on a weekly basis which is normally sufficient to deterinine that Pearson's
system is not causing an impact to your property.
Land use action bulletins were not required by City Code for the work performed by Mr. Pearson
and therefore, a sign was never posted at the site.

No permits were required for the construction of the storm improvements and therefore
inspections performed did not follow the typical permit process. Mr. Pearson was given
authority to construct the storm improvements through the agreement between the City and Mr.
Pearson, which was recorded against the property on September 19, 2001. In addition, the City
approved plans for the storm system design on November 20, 2001.
