The agreement states the City had a storm improvement design completed by a consultant and had anticipated construction of said improvements during the 2001 construction season. You had proposed storm improvements that were more aesthetically pleasing and compatible with the landscaping of the property. The parties agreed to cooperate and the Stormwater Improvement Agreement was recorded against your property on September 19, 2001. The agreement states you will "diligently pursue" construction, reconstruction, completion and maintenance of the improvements. The City has been monitoring the storm drainage improvements on your property since 2001. h1 March of 2002 the storm water flowing through the area of the proposed ponds was re-routed in order to dry out the soils in the area. This diversion remains in place today. The first phase of the liner was formed in September of 2002, and the lower pond was formed and ready for plaster in October of 2006. Additional rebar has been placed since that time, but no additional plaster work has been performed. The private storm water improvements designed and agreed upon in 2001 needs to be completed. The City requires confirmation from you that you will complete these improvements prior to the 2009 wet weather season, which typically begins around October 1St. Please submit a progress schedule to the City by July 2, 2009, outlining the remaining construction elements and a date by which each phase will be completed. Again, the entire project shall be completed by October 1, 2009. Failure to provide the required confirmation or to diligently pursue these improvements may result in an enforcement action by the city or referral of this matter to the city attorney for appropriate legal action. In a letter dated June 16, '2009, ofty engineer, Robert S. As a neighbor I was never notified of storm improvement. Tile C;Ibj never posted any land use action bulletins, to solicit public input. I believe the city chose a more expensive and structurally inferior, hlgh maIntenamle, way to transi5ort storm water in an area the city deems high risk W land movement. The ciflas own temporary diversion is more typical and afar less expensive way to control mtorrn water. This temporary diversion is less likely to fail in this sensifivo area. In the diversion permanent? Was the original plan to divert the creek into the storm water drain? How does the current diversion differ from the storm water design the city was: preparers to install? (Why was lhq change made?) Aesthetically pleasing to whom? The storm system structure is not at all visible from any roadway or public, sidewalk, arohitecturally pleasing yes, totally hidden from the public, far hewer suited f©r public viewing on stable fooling in a park, school or beach.
