Number: 5131 000 094 00 Determination #: CA-03-91 Owner: WLFB Investments LLC CRITICAL AREAS DETERMINATION: STUDY REQUIRED (CA-03 91) During review and inspection of the subject site, it was found that the site may contain or be adjacent to a Steep Slope Hazard Area, pursuant to Edmonds Community Development Code (ECDC) 20.15B.060A3c. A Critical Areas Study will be required to delineate the boundaries of the critical area, buffers, and setbacks. STUDY REQUIREMENT — STEEP SLOPE HAZARD AREA Prior to submission of any development permit, you will be required satisfy the requirements of the Critical Areas Chapter 20.156 by completing the following Steep Slope Hazard Area Delineation Requirements: 1. A topographic survey must be prepared by a Licensed Land Surveyor to delineate any Steep Slope Hazard Areas. A steep slope hazard area is defined by ECDC 20.1513.060 as ground that rises at an inclination of 40% or greater within at least 20 feet of elevation change. In order to delineate a steep slope hazard area, it is necessary to locate the top and toe of the slope. The inclination of the slope is established by averaging the inclination over at least 20 feet of vertical relief. A 50 foot wide buffer plus a 15-foot building setback will be required from both the top and the toe of the steep slope hazard area. Refer to ECDC 20.1513.080C and 20.15B.110A. 2. In order to complete the Study Requirement, a map must be submitted to the Planning Division for review and approval. DEVELOPMENT PROPOSALS ON A SITE WITH STEEP SLOPE HAZARD AREAS Development is restricted within the Steep Slope Hazard Area, its buffer, and/or building setback. If development must occur within these areas, the applicant may pursue certain processes provided in the Critical Areas Chapter of the Edmonds Community Development Code. The applicable process depends on the specific development proposal and site but may include one of the following: Buffer Reduction. For development proposals within 65-feet (50-foot buffer plus 15-foot building setback), but no closer than 25 feet (10-foot buffer plus a 15-foot building setback) from the top or toe of the slope, the 50-foot buffer requirement may be reduced to 10 feet if a study is completed by a licensed geologist or geotechnical engineer. The study must clearly demonstrate that the proposed buffer alteration will have no adverse impact upon the site, the public, or any private party. Essentially, development could be allowed as close as 25 feet fro m om the top or toe of the slope. The 15-foot building setback always applies no matter how much the buffer is reduced. Refer to ECDC 20.15B.110A. Steep Slope Exemption, Critical Areas Variance, or Reasonable Use Exception. Development proposals closer than 25 feet from the top or toe of the slope may be allowed through the approval of a steep slope exception, critical areas variance, and/or a reasonable use exception. These Land Use Permits that must be obtained through the Planning Division. Refer to ECDC 20.1513.110D2, 20.1513170A, and 20.1513.040C. PROJECT SPECIFIC CONDITIONAL WAIVERS If the property owner wishes to apply for a specific development permit which they feel would not impact the Critical Areas located on the site, they may submit their proposal, to the Planning Department for review. If the Planning Department finds that the proposed development permit will not adversely impact a Critical Area or its buffers, a conditional waiver may be issued on a project by project basis. EXEMPT DEVELOPMENT PROPOSALS Certain development proposals may be exempt from Critical Areas Requirements. Refer to ECDC 20.156.040. If you need additional information, please contact a Planner. We therefore were using a design rate, for the repair, of the existing system of 0.7 gal/sq.ft/day which is the approximate percolation rate through a mature drainfield system. This rate is far less than what would normally be allowed if regular percolation rates were used. 2) The original drainfield was found within the banks of the creek and was seeping into the creek. It is our opinion that the original condition was totally unacceptable and was presenting a potential health hazard to the adjacent property owners who had been complaining of the odor for some time. We therefore designed a repair which would be in confor- mance with the state guidelines which allows a minimum of 75 feet should there be no adverse effect from the reduction of setbacks. You will also note that our design also included the installation of an interceptor to intercept adjacent ground water which at the time of our investigation was ;totally saturating the existing and proposed drainfield site. Snohomish County Health Department regulations allow installation of drainfields in slopes up to and including 30% if the setback between lines is increased to 10' in our design submittal. Our survey crew indicated that the slope from the old fence easterly for 75' + was originally 22% then the slope increased to 40% + to the road and house. 3) You will note that we have added the above mentioned data to our original drawing. At the time of our inspection we were not aware that the drain - field permit had not been issued, therefore not finding our client at home or the contractor at the site, we left a sheet, as a substitute permit signa- ture card which is normally at the site, to advise the contractor that a correction was necessary to the septic tank. Normally no construction is done without a permit and we had no indication that the permit had not been issued. b. After a drainfi.eld is installed, we are called out to inspect it and state that it is acceptable and can be backfilled. c. After our inspection, we called your office to advise you that the system was installed and was ready for inspection. If you have any questions regarding the as -built, please contact me. HARRISON MAYOR The application"for the subject disposal system is not approved and is returned herewith. There are a number of problems regarding the design and the procedures you are follow- ing. Prior to approval, we will need the following: 1. Perc rates are needed for design of absorption fields.. A minimum of two perc tests are required in accordance with Public Health Service Manual. 2. Demonstration that the reduction from a 100-foot set- back to a 70-foot setback from surface water will not adversely effect the water auality. Note that the Soil Conservation Service considers slopes in excess of 15 percent to constitute a, severe limitation for septic tank absorption fields. 3. The slope of the ground surface at various locations in the area of the absorption trench. 4. Method of maintaining adequate clearance between ground water or impermeable layer and the bottom of the trenches. 5. Rationale for allowing construction and backfilling (see copy of note found at site) prior to approval and inspections of design and installations. 4l Reid, Middleton &Associates, Inc.
