V-70-79 WALTER PAYNE - Variance to allow swimming pool to project into required front yard setback at 900 Walnut St. (RS-6) The application was for a 7' front yard setback variance. This is a corner lot so it has two front yard setbacks. The applicant wished to build a swimming pool which would intrude into the setback. There already is an existing 6' fence around the yard. Mr. Pearson said if a swimming pool was to be constructed on the property, this was the only place it could be done because to -move it back would require excavation into a retaining wall. He said it would not be an over -sized pool and would not cause any sight' impairment. He recommended approval. The public portion of the hearing was opened. Walter Payne said his wife has had polio and her doctor recommends a pool for therapeutic exercise. He said they have a 60' lot and want to move the setback from the east to the west because they have a terrain problem. The pool will be 15'x 35'. He provided photographs to illustrate the terrain problem and said in order to maintain a reasonable walkway around the pool they felt they should move it to the west. He said it would not create a noise problem and the neighbors to the south have a large setback and the Paynes' home is lower than theirs. He had advised the neighbors of his plans. V-72-79 BILL LeCLAIRE - Variance from required driveway slope at 16719 74th P1. Wi.` Mr. Pearson said the normal driveway slope maximum is 14%, which most people sould consider to be a steep driveway. However, the Director of Public Works can approve up to a 20% grade with the concurrent approval of the Police and Fire Chiefs. In this case, the Public Works' recommendation was that the Board take no action until the applicant hires an engineer to show he cannot put in a 14% sloped driveway as he said he would in his building permit application. They felt he may be able to curve the road going up, or he may be able to purchase the right to use the easement he used to build the house. Mr. Pearson said that, according to Public Works, the applicant was advised that 14110 was maximum, and he apparently had a plan which met that requirement. Access onto 74th P1. W. at this location is hazardous due to sight distances and slope of roadway. Mr. Pearson noted that the lot next to this has a similar situation and they might work out some kind of shared driveway that would meet the grade requirement. Bill LeClaire said there is only a 31' frontage to his lot, and his permit was issued to him after approval of a site plan prepared by Kegel b Associates, with a 18% drive. He said that was drawn from a City topographic survey of the area. The lot has a twofold slope to it, to the east and to the north, where the switchback was to take place so switching back does not decrease the slope. He said there also is subsurface water in -the area and they incurred extra grading because of the water table. He had the City engineers out at the time of excavation. He said they are required to install a retention system, and they propose a coarse finish on the driveway to give good traction. Further, the last part of the driveway is not so steep, and they could trim back some of the trees to make visibility better, but there is a nice grove of alder trees and if the switchback were put in they would have to be eliminated. He said he had done his best. Bill Johnson of 720 Maple said the building permit did say maximum 20%. He said he believed. Mr. LeClaire was not trying to get by with something, and he has worked with the Engineering Division and it was they who suggested he ask for a variance. Mrs. LeClaire said they are a small business and they have put everything into this project. She said they had tried for an easement on the lot above but it was refused. They had offered to pay for it but the owner would not give it. She said they had spent $10,000 on the driveway alone and that her husband had really tried to find a solution. She said there is a second driveway adjacent to it which results in a swath 50' wide and 8' deep into the hillside. She noted that there is a constant stream there also. She.said she did not see how this could be anything but a big drainage problem, and the site is in the moratorium area. These two items were combined as they were essentially the same, with a modification added to V-86-79. The plan had been modified at the recommenda- tion of the Engineering Division in order to provide maximum safety for the homeowners as well as the traffic on 74th P1. W. and to minimize cuts to the slope. Slides of the site were shown. Mr. LeClaire had joined with his neighbors, Mr. and Mrs. Johnson, and devised a road plan with a joint driveway which was acceptable to the City in respect to width and slope requirements. Theredesign used the Johnsons' lot for area to curve the road and reduce the slope, and it provides a flat area near the public road to lessen the hazard at the road. The Planning Staff recommended approval, subject to meeting requirements of the Public Works Department and planting disturbed areas with native vegetation by June 1, 19B0, the planting plan to be approved by both Planning and Public Works by March 1, 1980. Slides of the site were shown. Mr. Bowman noted that the variance request was for a 12' shared driveway with turnouts and a 22% maximum slope. The Board examined the plans for the new proposal. The public portion of the hearing then was opened. Bill LeClaire said he had hired Group 4 Engineers of Lynnwood to resolve this problem and had worked with City Engineer Jim Adams. He said the Group 4 surveyors found the driveway to be a 23.5% slope, and the upper portion would remain in that area, but the bottom portion will be less. The first turn coming down the hill will have a substantial berm to eliminate the possibility of a runaway car. The turnout will allow one car to pull aside for another. Mr. LeClaire stated the water running between the two lots was existing prior to either the Johnsons or he purchasing the property and small amounts had channeled into it from surface and subsurface draining. He said the Planning Division had indicated they would like to see some native landscaping installed and he had planned that anyway. He said one of the driveways will be pushed back in and landscaped to grow back with vegetation and there will be one snaked driveway between the two lots. The Engineering Division had indicated to him that the steepness of the area and their not wanting to create any more impermeable surfaces than necessary made.this a good case for a variance. Bill Johnson said he had been working with the City on this because Mr. LeClaire was now in Auburn. He said Group 4 had developed the plans and met with the City Engineer to develop the final plan. He said these plans had'been submitted to the Engineering and Planning Departments at least three weeks ago. The Board had not received the current plans but he assured them they had been submitted to the City. He explained the alternatives which had been considered and the problems involved. He said with the alternative selected they had not been able to get the entire steepness below 20%, but the bottom is 14% and gradually goes to 22.9%, and there is spring activity and an embankment which prevent a second switchback being used. There is a turnout wherever visibility is restricted on the driveway so one car can pull aside. He said they had asked for the width variance to minimize water runoff and he described the configuration of the driveway to direct water runoff to a catch basin and culvert. He added that the City Traffic Engineer had submitted this plan to the Fire and Police Departments. The public portion of the hearing was closed. (City Attorney Wayne Tanaka arrived at this time, 8:10 p.m.) Mr. Hatzenbuhler observed that this appeared to be the best solution for the problem and appeared to be satisfactory to the Engineering Department. Mr. Bowman reviewed the variance criteria, noting that the existing house and attached garage were built under earlier zoning requirements and 11 other lots in the area can use a 5' side yard setback. Special conditions did not result from actions of the applicant. It appeared that the addition could be designed to meet the setbacks, but the yard and view would be less. It was not felt that this would block views or visibility for cars on the street. It appeared to be a minimum variance unless a two-story design were used, which would be inconsistent with surrounding development. �. Mr. Bowman said an adjacent property owner had contacted the Planning Division and asked that he visit the site again and view the proposal from his home with respect to obstruction of view. Mr. Bowman found it would encroach into the view from his home as it now exists. Mr. Bowman revised the recommendation made by Assistant City Planner Richard Pearson who had recommended approval. After viewing the situation from the neighbor's home Mr. Bowman recommended allowing the variance to increase the improvement in the garage area on the south side as it would not be injurious to the adjacent property owner, -but he recommended that the variance to allow encroachment into the setback on the north side be denied as it would be injurious to the adjacent property owner. He felt there was a possibility for a redesign. The public portion of the hearing was opened. Don Westlin, architect for the applicant, said they had entertained the idea of a second story addition as they could have gone to 25' in height over the westerly 35' of the building without encroaching into any setback, but they thought one story was more in keeping with the surrounding neighborhood and that a two-story configuration would have a greater impact on more people. He said they were requesting a 16' extension to the north and the height of the ridge of the addition will be 1 1/2' less than the existing height, and as it goes to the north it slopes east and west, so the visual encroachment appears only at the ridge. He noted that when originally built these houses were allowed to go 5' from the street and this one is 10' Harold A. Anderson of 1004 Sprague said this proposal would take away his view of, the water which he bought when he bought his house, and he would fight it to the end. George Turner of 1010 Edmonds St. said a lot of his view had been taken away in the past by growing trees but they had paid for view and l wanted to keep it. Buford Stalker of 958 Sprague, immediately .south of the subject property, said Mr. Curtis had indicated to him that there would be f. a 2' increase in elevation of the roofline simply because the architect had said that was the only way to fit the new addition to the existing house, and he objected to any increase in elevation of the roof. He said a building permit had been issued for a two-story house on Edmonds St. which blocks his view of the mountains and he had bought and paid for that 25 years ago, and the City is permitting trees to grow in the right-of-way west of his i. home and that is blocking his view, and he wanted to maintain whatever view they had. Chuck Olson of 1000 Edmonds St. said his view will not be impaired but everyone in the area is sensitive to view, and these people had allowed the neighbors above them to cut some of their trees to get a better view. He said there should be some way to try to satisfy everyone. B. K. Bennett of 951 Sprague said he had no objection to Mr. Curtis' building as long as he did not block anyone's view, but he objected to the building of the garage all the way out to the face of the existing house as when he comes ` out of his driveway it will block his view.
