(HCI) under contract with the City of Lynnwood will be expanding the Sewage Treatment Plant located at the West end of Brown's Point Road. The site, owned by Lynnwood, adjoins properties within the City of Edmonds. During construction, 4000 to 7,600'cubic yards of surplus dirt will be generated. The purpose of this request, is to obtain permission to place this excess dirt as fill on two lots that are adjacent to the plant site. The property owners have given their consent. The proposed fill site is the bottom of a very steep and deep gully. The drainage stream in the bottom of the gully enters a culvert at the plant site property line and runs underground 700 feet to the Sound. The gully bottom will also be filled to the property line during construction. The effect of this permit will be to extend the culvert and the fill about 300 feet farther up the gully. The gully is so steep and deep and so heavily treed, that it is doubtful that any of the adjacent resident will even be aware of the change. The upper end of the gully has already been partially filled to permit development of residential lots. The North side of the gully is in very unstable ground. There has been considerable difficulty over the years maintaining Brown's Point Road. The placement of fill in the gully will tend to help stabilize that area. The surplus dirt will have to be placed somewhere. Use of the adjacent properties will save filling other sites and eliminate up to 2,000 dump truck trips on the city and county streets. J }' FINDINGS OF FACT 1. The Applicant has requested approval of a Conditional Use permit for the purpose of placing up to 7,600 cubic yards of fill and installa- tion of a drainage culvert at 16905 Talbot Road and 7700 Bertola Road, Edmonds, Washington. 2. The placement of the fill is on a site which consists of two separate properties at the bottom of a very deep gully. The owners of the properties have expressed approval of the granting of the Conditional Use permit. 3. The placement of the fill is part of a construction project in which the City of Lynnwood is improving their Sewage Treatment Plant. The Sewage Treatment Plant is to be located west of the fill site and the fill material will come from the treatment plant site. 4. Access to the site will be by a narrow road from 76th Avenue West. 1 5. The proposed fill site is at the bottom of a steep and deep gully. There is a drainage stream that is at the bottom of the gully. The stream enters a culvert at the existing plant site property line and runs underground for 700 feet to where it drains into Puget Sound. If the requested Conditional Use permit is granted the culvert will be extended about 300 feet up the gully. 6. The gully is the most logical place for the placement of the fill. If the permit is not granted the Applicant will be required to conduct 2,000 dump truck trips through the City in order to dispose of the fill. 7. In order for a Conditional Use permit to be granted within the City of Edmonds the following must occur: A. The proposed use must be consistent with the Comprehensive Plan of the City of Edmonds; B. The proposed use must be consistent with the zoning ordinances of the City; C. The proposed use must not be detrimental to the public health, safety or welfare, nor to nearby property or improvements; and, D. A determination of transferability must be made by the Hearing Examiner of the City of Edmonds. 8. The subject property is zoned RS-12. With proper conditions the placement of the: fill will not be in conflict with this zoning designation. 9. The surrounding properties have a Comprehensive Plan of low density residential. The placement of the fill will not be inconsistent with the Comprehensive Plan. ■ a 1 Findings and Decision of the Hearing Examiner of the City of Edmonds Re: CU-56-82 Page 3 �1 10. The surrounding properties will not be affected by the placement of the fill. Because the fill is to be placed in a deep gully the adjacent residences will most likely be unaware of the placement. 11. Part of the contract that the Applicant has with the City of Lynnwood is to shore an access road, identified as Brown's Point Road. The placement of the fill will buttress the entire hill and cause more stability for this road. 12. The culvert will be sloped to the west. Because of this slope there appears that there will be little or no problem with silt build up in the area. 13. A resident of lot 2 questioned the Applicant about the potential backup of water as a result of the placement of the fill. The Applicant sub- mitted that the fill would not create any dam effect and would not cause problems for the resident on lot 2 in any way. 14. The Planning Department of the City of Edmonds recommended approval of the Conditional Use permit subject to the following conditions: A. A designed headwall and profile of pipe are required with building permit. The pipe is to be 24". B. An inspection is required prior to covering the pipe. The Applicant should coordinate this with the Engineering Depart- ment to set the time. C. The fill should be hydro -seeded upon completion of the project. 15. The Applicant testified to be in support of the recommendation of the City. CONCLUSIONS 1. The application is for the approval of a Conditional Use permit for the purpose of placing up to 7,600 cubic yards of fill and installation of drainage culvert at 16905 Talbot Road and 7700 Bertola Road, Edmonds, Washington. 2. The subject property is zoned RS-12 and has a Comprehensive Plan designation of low density residential. The proposed project is consistent with this zoning designation and the Comprehensive Plan designation. 3. The proposed Conditional Use permit will be consistent with the surrounding properties and will not adversely affect any of the neighboring properties nor the health, safety or welfare of the general public. 4. The Conditional Use permit should not be transferable. 5. The criteria as set forth in Chapter 20.05 of the Edmonds Community r Findings and Decision of the Hearing Examiner of the City of Edmonds Re: CU-56-82 1 Page 4 Development Code have been met. 6.
