The treatment plant is located on a small site entirely within the City of Edmonds. 1 Land available for the treatment plant is very limited, and all level ground there will be occupied by new construction and the access road. LEGAL DESCRIPTION: See Exhibit 3 IV. STAFF FINDINGS AND CONCLUSIONS: A Description of the Subject Property and Surrounding Area The subject property contains approximately 25,600 square feet of area. It is undeveloped and is covered with a mixture of Alder trees and brush. The topography on the site is relatively level. It is the Applicant's intent to use the subject property as a temporary location for construction offices while the Lynnwood Sewage Treatment Plant is being remodeled and expanded. The proposal would include fencing the entire site with a six foot high fence. Surrounding development is single family residential. There are large undeveloped areas immediately to the south and east. B. Official Street Map Proposed R/W Existing R/W West - 76th Avenue West 60' 50' No dedication of right-of-way is required. C. Comprehensive Plan The Comprehensive Policy Plan map designates the subject property as low density residential. As conditioned, the proposed use will not be in conflict with the Comprehensive Plan. Zoning Ordinance The subject property and surrounding area are zoned RS-12. Further to the east is RS-20 zoning. Temporary uses, such as the subject proposal, are allowed. per Chapter 17.70.010 of the Community Development Code. In this instance, the site would be used for a period of approximately eighteen months while improvements to the Lynnwood Sewage Treatment Plant are being constructed. As a temporary use, with a Conditional Use permit, the proposal would be consistent with the Zoning Ordinance for the RS-12 zone. E. Not Detrimental As conditioned, the proposed use should not have a significant detrimental impact on nearby private property or improvements nor to the public health, safety or welfare. F. Transferability If approved, the permit should be personal to the Applicant. IV. STAFF RECOMMENDATION:. It is the recommendation of the staff that CU-54-82 be approved subject to the following conditions: 1. The proposed circular drive should be a one-way loop to minimize access points onto 76th Avenue West. 2. The fence should be six foot in height, set back at least fifteen feet from the road. 3. Temporary blacktop, twenty-five feet back from 76th Avenue West, will be required for each driveway entrance. 4. Culvert beneath access road should be sized to 12". 5. Temporary erosion/sedimentation plan is required. 6. Every attempt should be made to preserve the natural vegetation along the perimeter of the property. Some trimming may need to take place along 76th Avenue West to insure proper sight distance. 7. Zoning Ordinance The subject property and surrounding area are zoned RS-12. Further to the east is RS-20 zoning. Temporary uses, such as the subject proposal, are allowed per Chapter 17.70.010 of the Community Development Code. In this instance, the site would be used for a period of approximately eighteen months while improvements to the Lynnwood Sewage Treatment Plant are being constructed. As a temporary use, with a Conditional Use permit, the proposal would be consistent with the Zoning Ordinance for the RS-12 zone. E. Not Detrimental As conditioned, the proposed use should not have a significant detrimental impact on nearby private property or improvements nor to the public health, safety or welfare. <t F. The subject property is located on the east side of 76th Avenue West and is adjacent to 171st Street South. 5. The subject property is approximately 25,600 square feet. Also, the the far easterly side of property is vacant except for one house on the site. 6. The property is level. There is vegetation on the site with Alder and Fir trees. ' 7. There is a small pathway through the middle of the site. 91 It is the proposal of the Applicant to fence the site with a six-foot fence. With the fence as proposed the site would be screened. The Applicant desires to construct a circular driveway within the site. The reason for this is to provide access to the site and to the office which will be located within the circular driveway. The Applicant has a contract for the improvements to the Lynnwood Sewage Treatment Plant. The contract will extend for 500 days or approximately 1-1/2 years. In order for a Conditional Use permit to be granted in the City of Edmonds the Applicant must meet the criteria as set forth in Section 20.05.010 of the Community Development Code. Another witness was concerned about the disruption of parking in the vicinity as the result of the construction. The Applicant stated that they would not utilize off-street parking and would make every attempt to see that all their suppliers and workmen did not disrupt the parking in front of the house belonging to the witness. CONCLUSIONS 1. The application is for the approval of a Conditional Use permit for the purpose of constructing a temporary office at property located at 17035 76th Avenue West, Edmonds, Washington, and more particularly described as set forth on Exhibit 3. 2. The purpose of the request is to construct a temporary construction Ii office during the expansion and remodelling of the City of Lynnwood's j! Sewage Treatment Plant. 3. In order for a temporary office to be constructed in an RS-12 zone, Section 17.70.010 of the Community Development Code requires a Conditional Use permit be obtained. 4. With conditions the criteria for the granting of a Conditional Use permit as set forth in Chapter 20.05 of the Edmonds Community Develop- ment Code are satisfied. 3. 5. With conditions the requested Conditional Use permit for the construc- tion of a temporary office building on the subject property would not be detrimental to the area and would be consistent with the zoning classification. 6. With conditions the proposed Conditional Use permit for the construction of a temporary office will be compatible with the Comprehensive Policy Plan of the City of Edmonds and a low density residential zoning designation. 7. The proposed Conditional Use permit will not be detrimental to the 1 public health, safety or welfare, or to nearby improvements or property. y(, 8. With the proposed fence and the setbacks as required the temporary construction office will not be aesthetically detrimental to the area. 4, 9. With proper drainage and placement of culverts there should be no storm drainage problems on the site. 10. The Applicant has a contract for the expansion of the Sewage Treatment Plant that exceeds one year. Because the Community Development Code standards allow for a Conditional Use permit for only one year, the Applicant should be allowed an extension upon request for an,addi- tional one year. 11. The Planning Department of the City of Edmonds recommended approval of the Conditional Use permit subject to the conditions listed in Finding #14. :F Findings and Decis..;n of the Hearing Examiner of the City of Edmonds Re: CU-54-82 Page 5 DECISION Using the above findings and conclusions as the basis of the decision, the Hearing Examiner of the City of Edmonds hereby grants a Conditional Use permit to the Applicant for the purpose of constructing a temporary office at pro- perty located at approximately 17035 76th Avenue West, Edmonds, Washington, and more particularly described as set forth in Exhibit 3. This Conditional Use permit is granted subject to the following conditions: 1. The proposed circular driveway on the site should be a one-way loop to minimize access points onto 76th Avenue West. In addition, gates are to be provided at the entrance and exit points of the one-way loop. 2. A fence should be erected around the perimeter of the site. The fence should be at least six feet in height and set back at least fifteen from 76th Avenue West. 3. The Applicant is required to provide temporary blacktop on the one-way loop from the entrance and exit points off 76th Avenue West. Further, the Applicant is to make every attempt to keep gravel from the site off 76th Avenue West. 4. Culverts are to be placed beneath access road. These culverts are to be sized to 12 inches. 'S. A temporary erosion and sedimentation control plan is required prior to the issuance of any building permits. 6. The Applicant is to make attempts to preserve the natural vegetation along the perimeter of the property. Some trimming is allowed along 76th Avenue West to ensure proper sight distance. 7. The Applicant shall comply with all performance standards listed in the Edmonds Community Development Code, Chapter.17.60. 8. The Conditional Use permit will be valid for one year.
