The City's Comprehensive Storm Sewer Plan indicates the future use of the storm sewer. Please supply this office with a document to be executed in which the City would be held harmless should it become necessary to remove the boat cover for maintenance of said storm sewer. Larson Director of Public Works STREET FILE WATER TURN OFF COMPLAINT - 17127 SEALAWNDRIVE On June 1, 1978, the water was turned off at approximately 173rd Street SW and 76th Avenue West due to a contractor cutting in a new main line valve which necessitated shutting off the main. According to our as -built maps, a valve at 171st and 76th and at Braemar Drive and 76th should have isolated the shut down area. All of the home owners in the area were notified of the water shut down and the approximate length of time. However, the shutting off of the valve on 171st shut down the water on 171st, Sealawn Drive and Talbot Road. At 10:45 a.m. on June 1, Jack Mitchell received a telephone call from Dr. Cooper of 17127 Sealawn Drive, Edmonds. Dr. Cooper was very upset because the water had been turned off without notification. Jack apologized to Dr. Cooper and told him that we could get the water back on in about ten to fifteen minutes and if there was any damage done, he could file a claim with the City Clerk. Dr. Cooper was cussing Jack over the telephone and told him that he was an irresponsible person and didn't know anything about the water system.. Jack told him that if he didn't stop cussing he would hang up the telephone and his reply was that he was not cussing and that if Jack hung up he would go to the Mayor. COOPER and 7,wi-d r COOPER, his wife, hereafter referred to as "Owners", are the Owners of certain real property in the City of Edmonds, legally described below, and, WHEREAS, the City of Edmonds, Washington, hereafter referred to as "City", presently has.a twelve (12) inch storm sewer line constructed on the Owners' property, and WHEREAS, the Owners desire to grant to the City a permanent easement as set forth below, now, therefore, IN CONSIDERATION OF MUTUAL BENEFITS, THE PARTIES AGREE AS FOLLOWS: 1. Owners hereby grant to the City a permanent easement for the installation, operation and maintenance of storm sewers, over, across, through and below the real property, legally described on Exhibit A, attached hereto and incorporated by this reference as if set forth in full. 2. The City shall have the right to remove trees, bushes, undergrowth and all other obstructions interfering with the location, construction and/or maintenance of said storm sewer lines. 3. Owners shall have the right to construct a boat cover over a portion of the permanent easement herein granted. Provided, however, that.the City shall have the right, in its sole discretion, to require owners to remove, relocate and/or alter said boat cover if necessary for the I construction, operation and/or maintenance of said storm sewer. Owners hereby releases and agree to indemnify, defend and hold harmless the City, its employees and agents from any and all claims for damages of whatever nature, arising from.the relocation, removal or alteration of said boat cover. 4. Ave, N., Executive Officcs Edmonds,, Wa. 98020 Dear Mayor Harrison: This letter is written to demand some immediate action on a surface drainage problem which is seriously damaging our property by the erosive action of storm water. Storm drainage off the hill east of 76th. Ave. W. at the 174th. level is flowing over the roadway, through the development known as Talbot Glen, and then flooding our property and causing the described damage. We have traced the source of the water with the developer of Talbot Glen., Mr. Patrick MacKay,, since originally it appeared the run-off had its source on his property. This proved not to be the case. This problem has never occurred in the fifteen years of residence at this location, so that we.can faibly assume that the development permitted on the hill East of 76th. Ave. W. has had some serious impact on water drainage in the area which could not have been proper- ly planned. Some immediate rectification of this problem is required before more serious damage to our property occurs,:'.aIid,_,this letter' --gives notice that we intendto hold the City responsible for any further damage incurred as a result of'this situation.
