Our records indicate you are the owners of the subject property. We have received a
complaint that the shrubs along the front of your property are making it difficult to see on
coming traffic on 76' Avenue West. City staff has investigated the matter and
determined the shrubs in question do, in fact, create a sight distance hazard.
In order to reduce the hazard and improve safety for you and others, please trim your
shrubs to a height of 3 V2' for a distance of 20 feet from your driveway. Your cooperation
in bringing the shrubs into compliance is appreciated. The Street Maintenance workers
will be instructed to remove vegetation if you are not able to complete the necessary
trimming by July 26, 1999.

Dear Mr. Jess:
I have reviewed your account and will allow a credit for the current billing and the same
for the next billing period in accordance with our City policy. The policy states that the
customer will be billed at the retail rate based upon the average water consumption for the
same period during the previous year. In addition, the excess water lost from the leak will
be billed to customer at the City's wholesale rate with a 15% surcharge added for
administrative cost. Only one leakcredit will be granted in any three year period.

Concrete slab or foundation will not be warranted for cracks, separation, etc., or in the presence of hydro undermining, ground settling, storage of extra heavy machin
ery or equipment, unless it has been submitted to a soil analysis or structural design reinforcing steel.
Any salvageable material realized during demolition becomes the property of said contractor.
Any dumping fees or hauling away of discarded material, not included in contract price unless otherwise specified.
All changes in the above contract must be in writing and signed by both parties hereto. The owner agrees to carry fire and all necessary insurance.
The company agrees that all workers are fully covered by Workmen's Compensation Insurance. All surplus materials remain the property of the company.

SUBJECT: STORM DRAINAGE DAMAGE CLAIMS AT 17414 76TH AVE. W./
AND 7629 175TH *S.W.
Summary of Events
Heavy rains occurred in the early a.m. on February 16, 1981.
In response to drainage calls at 17414 76th Ave. W. and other
neighboring residences; the drainage ditch,on the east side of
76th Ave. W. had become plugged at two driveway culverts to the
north of 175th St. S.W. and water flowed across 76th Ave. W.
into the above driveway access. Recent sanitary and storm sewer
construction to the east in a new subdivision developme ' nt had
left the surface soil in unstable condition and had developed
erosion which caused stoppage in the 76th Ave. W. drainage ditch -
line. Since this occurrance the construction area has been
iTproved with rock channelization into the drainage system iftlets
and culverts. Also the Engineering Division issued work orders
to install roadside drainage berms on the west side of 76th Ave. W.
fronting the affected residences to channel any overflow drainage
down the right-of-way to a cross -culvert and open drainage stream
bed. This work was completed on March 25, 1981 by the Street
Division.

BACKGROUND REGARDING CONSTRUCTION IN SUBDIVISION. S-47-79
Construction through the subject subdivision (for Dennis Hania)
involved a sanitary sewer and a storm drain. Action-oti , both lines
was initiated as a result of requirements for the subdivision.
The sanitary sewer was installed using the L.I.D. process by petition.
A property owner initiating the L.I.D. was Mr. Hania. The contract
for the L.I.D., designed by R.M.A. and administered by the City,
was awarded to B & M Contractors, Inc. Considerable difficulty was
encountered in a portion of the project. Unstable organic material
required removal and the contractor brought in new fill, largely
sand, to provide a passable base. Same of this material later was
washed aw'ay by runoff where'it clogged ditchesas previously described.

The first large storm occurred when the storm drain had not yet
installed. The ditches filled with sand and damage was done to
several properties*. By mutual agreement, B & M agreed to clean
repair damage on privalte properties. The City cleaned roadside
or '/

and
ditches.
Just prior to completion of- the clean-upt-Tork- a second lar-e storm
occurred. At this time the storm drain had been installed through
the subdivision by Mr. Hania per the plan prepared by R.M.A. and
approved by the City. The inlet end of the storm drain became
covered with material eroded by the storm. The erosion is believed
to have been aggreVated by the freshly disturbed soils due to the
sanitary sewer installation.
The second storm, having plugged the storm drain inlet, again washed
sand into ditches and caused damage to private property. The damage
from the second storm is the cause of the current claims.
After the second'storm, additional measures have been taken by the
City to improve the channel above the storm drain inlet and to provide
an improve� inlet. Other work, also as previously described, has also
been accomplished.

Damage as a result of improper storm sewer-and heavy rains
on February 16, 1981 resulted in -a deposit,of mud in our
driveway at a depth of between 3 and 4 inches, I to 2 inches
in about 1/3 of out double car garage area, 3 to 4 inches on
about 1/2 of a graveled parking area to the south side o ' f our
house. The garden on the east side of the house and the lawn
and garden on the south side both had bark and soil washed
away and mud deposited in substantial amounts. The south
side yard ended up with sticks, rocks, straw etc. on it.
This same thing has happened to us three times, prio I r incidences
of lesser degree. The first time we cleaned up the entire
mess, the second time the City of E . dmonds partically had it
cleaned up when the third occurance happened. -At this point
all has been cleaned up again by ourselves with the exception
of a complete removal of and replacement of the gravel in the
parking area just south of the house.
About 10 yards of crushed gravel and 8 yards of beauty bark
will be needed to restore the damaged areas back to normal.
Also I should mention that we consider our time worth some-
thing. We have received a verbal bid from C. R. Harnden,
Landscaper, for the third occurance in the amount of $658.00
of which doe's not include twenty some, hours of,our time cleaning
up prior messes.
Conclusion is that we as long time property owners feel we
should not be responsible for the time and expense involved
because of either the City of Edmonds or the Building Con-
tractor's responsibility t-o provid, ' e adequate drainage.
Please consider our bid of $658.00 to you as just and fair.

SUBJECT: STORM DRAINAGE DAMAGE''CLAIMS AT 17414 76TH AVE. W.
AND 7629 175TH S.W.
Summary of Events
Heavy rains occurred in the early a.m. on February 16, 1981.
In response to drainage calls at 17414 76th Ave. W. and other
neighboring residences, the drainage ditch on the east side of
76th Ave. W. had become plugged at two driveway culverts to the
north of 175th St. S.W. and water flowed across 76th Ave. W.
into the above driveway access. Recent sanitary and storm sewer
construction to the east in a new subdivision development had
left the surface soil in unstable condition and had developed
erosion which caused stoppage in the 76th Ave. W. drainage ditch -
line. Since this occurrance the construction area has been
improved with rock channelization into the drainage system inlets
and culverts. Also the Engineering Division issued work orders
to install roadside drainage berms on the west side of 76th Ave. W.
fronting the affected residences to channel any overflow drainage
down the right-of-way to a cross -culvert and open drainage stream
bed. This work was completed on March 25, 1981 by the Street
Division.

BACKGROUND REGARDING -CONSTRUCTION IN SUBDIVISION, S-47-79
Construction through the subject subdivision (for Dennis Hania)
involved a sanitary sewer and a storm drain. Action on both lines
was initiated as a result of requirements for the subdivision.
The sanitary sewer was installed using the L.I.D. process by petition.
A property owner initiating the L.I.D. was Mr. Hania. The contract
for the L.I.D., designed by R.M,A. and administered by the City,
was awarded to B & M Contractors, Inc. Considerable difficulty was
encountered in a portion of the project. Unstable organ . ic material
'ired removal and the.contractor brought in new fill, largely
requ
sand, to provide a passable base. Same of ' this material later was
washed away by runoff where it clogged ditches as previously described.
The first large storm occurred when the storm drain had not yet been
installed. The ditches filled with sand and damage was done to
several properties. By mutual.agreement, B & M agreed to clean and
repair damage on private properties. The City cleaned roadside ditches.
Just prior to completion of the clean-up work, a second large storm
occurred. At this time the storm drain had.been installed through
the subdivision by Mr. Hania per the plan prepared by R.M.A. and
approved by the City. The inlet end of the storm drain became
covered with material eroded,by the storm. The erosion is believed
to have been aggrevated by the freshly disturbed soils due to the
sanitary sewer installation,
The second storm, having plugged the storm drain inlet, again washed
sand into ditches and caused damage to private property. The damage
from the second storm is the cause of the current claims.
After the second storm, additional measures have been taken by the
City to improve'the channel above the storm drain inlet and to provide
an improved inlet. Other work, also as previously described, has also
been accomplished.
