In accor ar.111:11:1 wit hort plat approval, a stormwater detention system was required to be installed in accordance with the preliminary drainage report. See Item 10, Engineering Requirements for Plats and Subdivisions, File No. S-98-71. That detention improvement was required to have been completed prior to recording of plat. The improvement was not and has not been constructed, the plat has been recorded and the lots have been sold. At this point, Mr. and Mrs. Grant have applied for a building permit with respect to Lot 1. 1 am writing to clarify the City's position regarding this matter, to outline the tools available to the City to resolve the situation and to suggest that you move promptly toward a commons -sense solution to the problems. Among the materials provided me by my client is a copy of an agreement between the Warners and Grants regarding the required engineering and utility improvements. Nethercot Eric Grant and Michelle Trudeau-Grant August 4, 2000 Page 2 please understand that privity under the contract, that is the obligations and rights of the original plat approval, are those of the applicants, Ms. Warner and Mr. Nethercot. The City will therefore look to the original subdivider to install the improvement. The agreement between the parties is a private matter and on behalf of the City, I urge you to resolve your differences and install the improvements at your earliest opportunity. The City has a number of remedies at its disposal. First, pursuant to ECDC 20.75.180 and RCW 58.17.210, no building permit will issue with respect to either Lot I or 2, until such time as the detention system is installed. The City also has the ability under the State Building Code to red - tag the existing structure, ordering the home on Lot 2 vacated. At this point, the City has not taken that step. You should be aware that that is one of the tools available at the City's discretion to try and bring about resolution of the problem. The City can sue for specific enforcement in Superior Court and bring a civil enforcement action. In order to provide the parties an opportunity to resolve your dispute regarding who is to install the system before the City commences its enforcement action, the parties have until August 15 to submit a work plan for installation of the detention system, including evidence that you have entered into a contract with a contractor, supported by a performance bond. If these actions are not taken by the close of business on August 15 and submitted In writing to the Building Official of the City of Edmonds, Jeannine Graf, I will commence the following actions: 1. An action for specific performance under the terms of subdivision approval in Superior Court; and 2. A civil enforcement action under the provisions of ECDC 20.110.040. Please note that civil damages of up to $250 per day may be assessed. Notice of Violation is attached hereto as Exhibit A. Again, the purpose of my letter is to urge you to resolve your dispute and install the detention system before the fall rains begin. I previously cited the provisions of RCW 58.17.210 which provides that building, septic and other development pen -nits will not be issued for land divided in violation of the subdivision chapter and the regulations and conditions imposed thereunder. Please note that the section provides in part: All purchasers' or transferees' property shall comply with the provisions of this chapter and each purchaser or transferee may recover his damages from any person, firm, corporation or agent selling or transferring land in violation of this chapter or local regulations adopted pursuant thereto, including any amount reasonably spent as a result of inability to obtain a development (WSS443696. Again and finally, the purpose of this letter is to encourage the parties to work cooperatively to resolve their problem. If you cannot do so or are unable to reach agreement, I will be forced to commence judicial proceedings. In my experience the cost of such proceedings on all parties will significantly outweigh the cost of installing the detention system regardless of who ends up paying for it. For that reason, I would urge you to meet promptly and to resolve your differences. I wanted to notify you of the provisions of City Code to be sure that you have the ability to fully exercise your rights under the Code. My letter notes the provisions of City ordinance and state law which prohibit the issuance of development permits when a subdivision is in violation of City Code provisions. In fairness, you should be aware that both City ordinance and state statute permit you to apply to the City if you reasonably believe that issuance of your building permit will not affect the public interest. ECDC 20.75.180 Violation -Permits reads in full: 20.75.180 Violation -Permits No building permit, septic tank permit or other development permit shall be issued for any lot, tract or parcel of land divided in violation of this Chapter unless the applicant for such a permit has applied to the Hearing Examiner and attained a ruling from the Hearing Examiner that the public interest will not be adversely affected thereby; provided, however, that prohibition contained in this section shall not apply to an innocent purchaser for value without notice. While I wanted to be sure you are aware of these provisions, please also be aware that I would oppose such waiver for several reasons. First, you executed an agreement with the seller, which, while it may or may not be legally binding to transfer the construction of the detention system, it certainly gave you notice that work was required and takes you from the status of a bona fide innocent purchaser. I sincerely hope that you and the developer will be able to work this matter out. As I have discussed on the phone with you, the City's options are unfortunately punitive and not designed to foster cooperation.
