RE: GEOTECHNICAL ENGINEERING SERVICES SOIL MOVEMENT AT 17624 TALBOT ROAD EDMONDS, WASHINGTON Dear Mr. Walker: February 14, 1997 ENGNVi:'1_._1:-1P1 This letter summarizes our observations and recommendations related to soil movement observed on the steep, west facing bluff at 17624 Talbot Road. At the request of the City of Edmonds, a representative of Landau Associates visited the site on February 7,1997 with City of Edmonds' personnel and representatives of the property owner to observe site conditions and to provide consultation to the City on the situation and potential future action. OBSERVATIONS The property is located along a high, west -facing bluff overlooking Puget Sound. The property is bounded.on the west by the mainline track of the Burlington Northern -Santa Fe (NF-SF) railroad, on the east by Talbot Road, and on the north and south by single-family residences. A residence is located on the property within about 10 to 15 ft of the top of the bluff face. A gravel walkway and a landscaped strip are located between the residence and the . top of the bluff face. According to the Don Fiene of the City, an 8-inch sanitary sewer lateral connecting several homes in the vicinity of the site parallels the top of the bluff face. At the site, the sewer line is located between the residence and the top of the bluff face within the walkway/landscaped area. The face of the bluff is a steep slope that extends down to the railroad right-of-way. BN-SF has constructed a short, cantilevered soldier pile retaining wall along the toe of the slope. The ground surface behind the waU is relatively flat for about 8 to 10 ft, then extends up to the top o . f the slope atan average inclination estimated to be about 1H:1V (horizontal:vertical) or steeper. Slope vegetation consisted of grasses and brush, with an isolated, topped fir located near the middle of the slope. 23107-m),rtl AVE. W. - R0. These walls are apparently cantilevered 'structures constructed of two to three railroad ties supported by 2-inch diameter galvanized pipes driven vertically into the slope. Walls located in the upper portion of the slope are in various states of failure ranging from partial to complete collapse. Those located in the lower portion of the slope did not appear to be failing. At the top of the slope, soil within.the landscaped area was retained by a 2-inch by 10- or 12-inch board also supported by galvanized pipe. Several solid PVC drain pipes were observed behind the failed walls and along the upper portion of the slope, a nd a corrugated HDPE drain pipe extending from the residence was observed to be connected to the PVC p ipes. The function of these pipes is unclear but appears to be for channeling water downslope. At the time of our visit, evidence of soil movement was observed within the landscaped area. A strip of soil near and along the top of the slope (behind the retaining board) was observed to have settled relative to soil further back from the top of the slope. Similar, but more advanced, erosion -related settlement.was observed adjacent to the previously mentioned HDPE drain pipe. With the exception of the failed walls, evidence of slope failure was not observed. According to representatives of the owner, the wall failures have been occurring gradually over the past year or more. However, the soil movement along the top of the slope has occurred since the end of December, 1997. CONCLUSIONS AND RECOMMENDATIONS Based on our observations and comments by the owner's representatives, it appears that progressive failure of the downs . lope retaining structures has resulted in a loss of confinement of soil near the top of the slope. This lack of.confinement, in combination with saturated soil corlditions and downward movement o � f ;nfiltra fed. water, has resulted in soil erodin- from beh;­1 and beneath the fail * ed walls and the landscaped area retaining board and from along the HDPE pipe. The observed soil movement along the top of the slope appears to be the result of the loss of underlying supporting material due to this erosion. * At the time of our visit, the observed soil movement did not appear to pose an immediate threat to the residence or the sewer line. However, ongoing eastward migration of the top of the slope should be expected as long as soil erosion along the top of the slope continues. In addition, oversteepened areas within the slope, including those at or near the top, may fail at some point as part of the natural process of slope equilibration. 2 The rate and magnitude of future erosion, the risk of slope failure, and possible means of limiting erosion and slope failure, would depend on soil and groundwater conditions underlying the site, as well as weather -related conditions. Until those conditions can be evaluated, the slo' pe could be protected from further erosion or infiltration of water by placing plastic sheeting or other slope protection materials over the upper portion of the slope. In addition, water collected by the observed pipes should be routed to beyond the base of the slope . and not allowed to discharge to the slope. We recommend that the property owner retain a geotechnical engineering consultant to further evaluate site soil and groundw . ater conditions and provide specific advise to the property owner. Long-term stabilization measures may include providing structural confinement to the upper portion of the slope and improving surface drainage over the slope to limit saturation of retained soil. Active measures could also include promoting the growth of deeper rooting vegetation to protect surficial soil from erosion. The City, as well as the property owner, should be aware that completely elin-driating erosion processes along the slope may not be practical, and that the sewer line and the residence could ultimately be affected by those processes. CONSTRUCTION OF EARTH STABILIZATION MEASURES. These stabilization measures are not intended and cannot feasibly be designed to provide for permanent stabilization of the slope but rather are intended to address limited, small scale sloughing and earth movement. The Parties acknowledge and understand that in the event of large scale earth subsidence or landslide, the facilities necessary to address such problems would be unreasonably expensive for the Parties to construct. Therefore, the Parties agree to equally split the costs of the design, installation and maintenance of reasonably limited earth stabilization measures. 2.1 Construction. The facilities shall be designed and constructed by CITY forces according to a design mutually agreed to by both parties. The parties shall equally split the cost (materials, labor, equipment) up to a maximum of $10,000. Should this amount be exceeded, both parties'must mutually agree to the additional cost. The existi ng westerly fence shall be reinstalled as close to the present location as possible. Attached hereto as Exhibit A is a copy of a schedule of charges for applicable City employees. The City shall provide at owner's request time sheets supporting its costs in design and construction. 3. INDEMNIFICATION AND HOLD HARMLESS. In addition, nothing therein shall be interpreted as a promise to indemnify or hold harmless either Party from the negligent maintenance of the CITY sanitary sewer line or the residential structures and improvement located upon the OWNERS' property, including but not limited to water lines, irrigation systems, swimming pools, gardening, landscaping, and other similar facilities or the indiscriminate destruction of vegetation. In the event that the CITY'S sanitary sewer line and facilities or the OWNERS' residential structure and attendant facilities should fail, causing a landslide or other damage, loss or injury due to the negligent maintenance of a facility or other negligent act or intential tort of eithe.r, liability shall be assigned as the same shall be determined in accordance with Washington law. 4. EASEMENT. The OWNERS hereby grant to the CITY a temporary construction easement for the purposes of entering onto the subject site, legally described in the attached Exhibit B in order to construct and maintain earth stabilization facilities as determined in accordance with paragraph 2, along with such reasonable right of entry, the right to pile, stack and store dirt and other materials and any other act necessary to construct and reasonably maintain the earth stabilization facilities. These stabilization measures are not intended and cannot feasibly be designed to provide for permanent stabilization of the slope but rather are intended to address limited, small scale sloughing and earth movement. The Parties acknowledge and understand that in the event of large scale earth subsidence or landslide, the facilities necessary to address such problems would be unreasonably expensive for the Parties to construct. Therefore, the Parties agree to equally split the costs of the design, installation and maintenance of reasonably limited earth stabilization measures. 2.1 Construction. The facilities shall be designed and constructed by CITY forces according to a design mutually agreed to by both parties. The parties shall equally split the cost (materials, labor, equipment) up to a maximum of $10,000. Should this amount be exceeded, both parties must mutually agree to the additional cost. The existing westerly fence shall be reinstalled as close to the present location as possible. Attached hereto as Exhibit A is a copy of a schedule of charges for applicable City employees. The City shall provide at owner's request time sheets supporting its costs in design and construction. 3. INDEMNIFICATION AND HOLD HARMLESS. The CITY promises to indemnify and hold harmless the OWNERS and the OWNERS promise to indemnify and hold harmless the CITY, its officers, agents and employees from any and all claims whatsoever relating to the design, installation and maintenance of the earth stabilization facilities and any loss of any kind or nature -3- rising therefrom, provided, however, that nothing herein shall be 4 interpreted to indemnify or hold harmless either Party(ies) from its sole negligence or from the intentional tortious act of either Party. In addition, nothing therein shall be interpreted as a promise to indemnify or hold har.mless either Party from the negligent maintenance of the CITY sanitary sewer line or the residential structures and improvement located upon the OWNERS' property, including but not limited to water lines, irrigation systems, swimming pools, gardening, landscaping, and other similar facilities or the indiscriminate destruction of vegetation. In the event that the CITY'S sanitary sewer line and facilities or the OWNERS' residential structure and attendant facilities should fail, causing a landslide or other damage, loss or injury due to the negligent maintenance of a facility or other negligent act or intential tort of either, liability shall be assigned as the same shall be determined in accordance with Washington law. 4. EASEMENT. The OWNERS hereby grant to the CITY a temporary construction easement for the purposes of entering onto the subject site, legally described in the attached Exhibit B in order to construct and maintain earth stabilization facilities as determined in accordance with paragraph 2, along with such reasonable right of entry, the right to pile, stack and store dirt and other materials and any other act necessary to construct and reasonably maintain the earth stabilization facilities. The temporary construction easement for earth stabilization measures is described on the attached Exhibit C. The temporary easement is granted solely to the CITY for the earth stabilization measures. Japan AGREEMENT REGARDING INSTALLATION OF EARTH STABILIZATION MEASURES WHEREAS, the hereafter described OWNERS -own residential real estate within the City of Edmonds upon which a sanitary sewer easement line owned -and constructed by the City of Edmonds exists within a public utility easement; WHEREAS, the subject tract contains a steep slope which has been subject to sloughing and other forms of earth movement and subsidence in the past, WHEREAS, the City of Edmonds sanitary sewer line is located within this area of sloughing; WHEREAS, the Parties wish to jointly provide for earth stabilization measures which will, at a reasonable cost, provide for some measure of earth stabilization, both Parties realizing and stipulating that due to the inherent character of the soils and the slope, some sloughing or earth movement is an unavoidable consequence of the geologic nature of the slope and its soils; WHEREAS, such sloughing and earth movement has occurred through no fault of either Party and the Parties wish to confirm their intention to mutually provide for earth stabilization measures by waiving any and all claims with respect to the existing condition and move forward to provide for a joint, reasonable resolution of minor earth sloughing problems; NOW THEREFORE, LYLE C. AND GLADYS A. NICHOLS (hereinafter OWNERS) and the CITY OF EDMONDS, WASHINGTON, a municipal corporation (hereinafter CITY) enter into this agreement on the date below written: 1. MUTUAL WAIVER AND RELEASE. In order that this agreement establish and represent the I -I- intention of the Parties to address future sloughing and earth movement problems, the OWNERS and the CITY do hereby mutually waive and release each other and their officers, agents and employees from any and all liability of any kind or nature relating to past earth movement, including but not limited to the design and installation of the existing sanitary sewer facilities, the design and installation of the existing residence and its location upon the lot, removal of native ,vegetation, if any, and the design and installation or failure to install structures or improvements designed for earth stabilization or any other purpose whatsoever on the lot including but not limited to irrigation and drainage lines. In order to further this waiver, each Party hereby promises to indemnify and hold harmless the other and its officers, agents and employees from any claim or loss of any kind or nature arising from or out of the claims of either Party(ies) against the other for any and all loss or damage whatsoever arising from or out of the location, design or construction of the sanitary sewer facilities, earth stabilization measures or the failure to install same, any residential structure or other attendant facility upon the lot including failure to design or install any structure which arose or occurred prior to the date of this release. The aforementioned promises to hold harmless and indemnify and to release shall not be interpreted and shall not extend to the failure of either Party(ies) to properly maintain any existing facility or, except as provided below in paragraph 3, extend to the design, construction or maintenance of any new facility upon the structure. 2. The Parties -.acknowledge and understand that in the event of large scale earth subsidence or landslide, the facilities necessary to address such problems would be unreasonably expensive for the Parties to construct. Therefore, the*Parties agree to equally split the costs of the design, installation and maintenance of reasonably limited earth stabilization measures. 2.1 Construction., The facilities shall be designed and constructed by CITY f orces according to a de sign mutually agreed to by both parties. The parties shall equally split the cost (materials, labor, equipment) up to a maximum of $10,000. Should this amount be exceeded, both parties must mutually agree to the additional cost. INDEMNIFICATION AND HOLD HARMLESS. The construction easement is described on the attached Exhibit C and a permanent utility easement for such earth stabilization measures is described on the attached Exhibit D. The permanent easement is granted for such earth stabilization measures in recognition that they mutually benefit both the CITY and the OWNER. Such easements are granted solely to the CITY and neither the construction easement nor the utility easement for the earth stabilization measures nor any interest therein may be transferred by the CITY to any other Party. He said the Council supported the swap concept, and the Lynnwood Pub lic Works Director also agreed with the concept. He said, however, the matter should be formalized in a binding legal agreement. Mr. Hahn said a formal agreement outlines the swap concept clearly and ties it to the present agreement. He said there are not costs associated with the agreement, and it is a reciprocal swap of capacity. Mr. Hahn said Staff recommends that the Council approve the agreement. When I went over these two items with -Mr. Mills today, he advised that he was only instructed to work on the area in front of the bedroom. Nichols and a proposal from GeoEngineers for your reference. In the letter from Mr. Nichols, he points out that the embankment over the City's sewer in Talbot Park is slipping. I met with Mr. Nichols at his residence on Sept. 27, 1985. The reasons for his concerns were immediately apparent. The Nichols have a chain link fence along their west property line that adjoins the Burlington Northern right of way. Because of the slippage, their fence has deflected considerably. The sewers for the Talbot Park area were installed along the top of - the embankment about 1970. Since then, there has been on -going weathering and consolidation of the bank and the embankment material. ' In the Nichols' yard the movement is easily detected by the alignment of the fence. In the surrounding area we have not yet seen any highly visible features that would indicate land movement. However, it would not be unusual for there to be other land movement in the area. On the same day I notified Public Works of the situation. They 40 ran the television down the sewer line to see if there were any visible breaks or distortions in -the line. The line appears to be intact at the present time. I suggested that a Public Works crew walk the sewer line to see if there were any other areas with visible indications of slipping. They did not feel qualified to evaluate the area and suggested that I reconnoiter the area. On Oct. 14, 1985 Bobby Mills and I walked the railroad tracks and tried to spot areas of sliding. We saw a few areas that may have slipped or settled, but for various reasons we could not define how serious the situation was. Jon Koloski visited the Nichols' residence with me on Sept. 30, 1985. He suggested some remedial measures to address the problems at the Nichols'house. He also suggested that it would not be unusual to see that type of movement anywhere along the face of the bluff. Subsequent to the aforementioned inspection with B.Mills and additional discussions with myself, Jon Koloski submitted the attached proposal. Jerry Hauth Gentlemen: December 5, 1985 Proposal Geotechnical Consultation Sanitary Sewer Alignment Talbot Road Area Edmonds, Washington File No. 138-08 GeoEngine Incorporated Consulting Geotechnical Engineers and Geologists In response to your request, we are pleased to submit this proposal for geotechnical consultation concerning two segments of existing sanitary sewer line in the Talbot Road area of' Edmonds, Washington. The two sewer line segments have a combined length of about 2500 feet and are located between approximately the 17300 Block and 17600 Block along Talbot Road. The area has been inspected in part in the field by the undersigned with Mr. Jerry Hauth of the, City of Edmonds. Mr,. Hauth provided drawings which show the location of the subject sewer lines. The subject sewer Jines are located immediately adjacent to the top of a bluff overlooking the Puget Sound. The bluff is of variable height along the pipe alignment. Burlington Northern Railroad tracks are located at the toe of the bluff adjacent to the shoreline of Puget Sound. The bluff face adjacent to the sewer alignment has experienced ongoing weathering and minor sloughing since long before the sewer lines were con- structed. We understand that the City of Edmonds is concerned that bluff weathering process may have encroached upon the sewer line alignment in places and may encroach more in the future. These encroachments are manifested in minor existing problems such as localized damage to landscaping or the displace- ment of fences. The second phase would include development of specific design recom- mendations for solution to selected specific problems. Our scope of services for the two phases is summarized below. PHASE I: 1. Review design plans and pipeline surveillance data p*rovided by the City of Edmonds. 2. Perform detailed route reconnaissance including observation of the bluff adjacent to the Burlington Northern Railroad tracks as well as the pipeline alignment and adjacent private properties. 3. Perform hand explorations as necessary to evaluate subsurface conditions along the pipeline route. The explorations will be conducted at the locations of specific existing or potential -hazards identified during the route reconnaissance. 4. Perform preliminary engineering analyses as necessary to establish the level of criticality and the priority for remedial action. 5. Prepare a for-mal report which includes a discription of the problem classifications, a map showing the location of identified. existing and potential hazards, and the supporting field, and analytical data. 6. Two to three meetings with City of Edmonds officials including one meeting in the field to describe our observations and recommendations, and one or two additional meetings to prioritize the development of remedial procedures. PHASE II: 1. Perform additional explorations as determined necessary to better perform specific si-te evaluations. The exploration program would be discussed with the City,of Edmonds officials and would be undertaken in accordance with a budget and schedule approved by those officials. Possible laboratory testing would be required at this time. 2. Develop recommendations for specific remedial actions including consideration of drainage, earthwork, support structureso or other options. E City of Edmonds December 6, 1985 Page Three 3. Aid City of Edmonds officials in evaluating the relative cost effectiveness of option solutions. 4. Prepare drawings illustrating design concepts or provide sufficient informati ' on to permit these drawings to be generated by City of Edmonds staff. Where additional engineering or technical services are required which are outside of our expertise (i.e., structural retaining wall design) these services would be described to City of Edmonds officials and. would be undertaken only with City of Edmonds approval. Our consultation will be performed by qualified geotechnical engineers and engineering geologists and under the direct. supervision of the undersigned. We will work from maps and design drawings of the project area to be supplied ,.by the City of Edmonds. We will also obtain recent aerial photography of the - site by purchasing existing photographs from aerial photography contractors. if the City of -Edmonds can provide these photographs, of course that -would be -helpful and a cost savings. We do not expect to contract for a specific flight to obtain the required photographs.. The location of specific features identified in our reconnaissance and other investigation will:be based on the maps provided and standard " tape measure" techniques. We, do not anticipate specific engineering survey. work as a part of our consultation. We will require:.permission to enter private property, and we expect the City to aid us in that process or to obtain said permission for our work. We expect the field portion of Phase I of our consultation will require two to three weeks of intermittent effort depending on the number and complexity of explorations required. This schedule includes one week to observe and record existing and potential hazards and approximately two additional weeks to discuss a subsurface exploration program'with the, City and conduct the explorations as required. The engineering analysis and development of our classification scheme and priority discussion will require two to three additional weeks to complete. We will be prepared to discuss our observations and preliminary verbal recommendations with City, of Edmonds officials within six weeks after we are notified to proceed. We will maintain frequent contact. with City of Edmonds officials throughout the conduct of our Phase I study to assure coordination and expedient information transfer. We expect that Phase II of our consultation will require four to six additional weeks to complete if this work does not overlap Phase I. We anticipate frequent communication with City of Edmonds officials during this phase similar to that of Phase I for the purpose of coordination and informa- tion transfer. We propose to conduct the consultation described herein on a time -and - expenses basis in accordance with the rates described in our Standard Schedule of Charges, a copy of which is attached and is a part of this proposal. Should the terms of your contract of purchase order specifically place greater responsibility on us or require higher limits of coverage, we will attempt to obtain additional coverage to your prescribed limits, the charges for which shall be borne by you. You agree, in any case, that we shall not bear responsibility for general liability or property damage from any cause, including fire and explosion, beyond the limits of coverage in effect for your specific project. CLIENT FURNISHED INFORMATION The Client is responsible to provide GeoEngincers, Inc. 2 description ofthe.property, its location, and the locations of any buried utilities or structures. The Client is responsible for advising GeoEngincers, Inc. of any requirements for entry or work permirs,security clearances, licenses, or any other required permissions. If the property is not owned by the Client, the Client shall obtain righr-of-entry for the purpose of accomplishing our services. GeoEngincers, Inc. will take reasonable precautions to minimize damage to the property and avoid damage or injury to subterranean structures or utilities. It is understood by the Client that in the normal course of exploratory work some surface damage may occur, the restoration of which is not part of this agreement. The Client agrees to hold GeoEngincers, Inc. harmless for any damages to subterranean structures which are not called to GeoEngineers, Inc. attention and correctly shown on the plans furnished. SAMPLE RETENTION Samples will bo.- discarded 30 days after submission of our report unless prior arrangements are made to store or deliver the samples. I even went to the trouble of hav- ing Reid & Middleton engineer in the dry sewer line for the lot in the rear of ' mine at the time they put in my septic tank and dry sewer hook-up line. This cost me an extra $400 for the -engineering cost and extra sewer line. As you know, Lief, they now have this main line of the sewer coming right across my patio, 13 feet from my family room and about 8 feet from my living room and practically running under the corner of my bedroom. This is not where I was told it would be when I applied for my approval from your office and Reid & Middleton. You will also recall that you and some of the people from Reid & Middleton came down and looked over this suggested route, and the people from Reid & Middleton suggested they lay the line on top of my rockery. Now, they told me that if a cast iron pipe was put in, there would be no problem whatsoever. As a matter of fact, we have had an experience where we had a cast iron sewer line running by a window, and the smell was so bad, we finally had to move. The excuse for this was that, while a cast iron pipe does not leak, the gases still escape through very tiny air holes. Also, it was said the matter would be restudied, and you would report back to me. Since we have not heard from your office, I want to go on record as being very., very, very much opposed to running the sewer where they now show it and suggest that you locate it down along the railroad tracks where they originally suggested it be placed--insofar.as related to my property. I understand that you are running some of the line along the tracks, anyway.
