is to cover damage to her property due to a water pressure
fluctuation problem on NoVember 29, 1977. In a follow-up
telephone conversation with Mrs. Faste on December 9, 1977,
she was informed of the City Ordinance requiring customer re-
sponsibility to provide pressure regulator and pressure relief

I see, Okayt I'd like to call your attention to an incident on or about
,November 29# 1977 involving a Mrs. Edith Fastep I believe it is.
A. I don't know the correct pronunciation myself but that's the same name I'm
working withp yes*.
Q. And she had some problem with the water heater. Are you aware of that?
A. Yesp we received a.call on.or about that datep the exact date we didn't
receive a callp I'll retract that, lie received a letter from her stating...
that she had some damage and the.damage was in the action of her-pAacing a
new hot water tank and she also enclosed a copy of the bill for installing
a now hot water tank from Day & Night Plumbingp Invoice #A-11394, to the
amount of $207.11. In the letter she wrote accompanying the copy of the
bill# she requested money from a contingency fund that the City of Edmonds
might have to cover such accidents. We have no contingency fund of any type
like that.
City Ordinance No. 6.16.100 titled Water Shut -Off Safety Valve. I will read
verbatim the Ordinance. "The water may be shut off from the main at a ny time
for the purpose of repair without giving notice and the Water Department will
not be responsible for any consequent damage. Persons having boilers supplied
by direct pressure from.the water main are cautioned against danger of explo-
sion or collapse. Safety valves shall be placed between the boiler 'and the.
meter'at the owner's expense who shall be held responsible' to the City for
all damages to meters caused by hot water." The final sentence in the Ordi-
nance,, "The City shall not.be-responsible for the safety of boilersg tinning
or other apparatus on the premises of any water customer." Now that is in
Ordinance No..4139 Paragraph 15 dated 1929* That is the Ordinance as stated.
Nowq what -that means in a nut shell is that to protect the.owner's property
against damaget they must install a pressure regulator valve. This relieves
the City of responsibility to damage on private property,
And all of the customers are aware of this?

A. The mailers have been mailed out in thevater bill or accompanying the water
bill periodically, about once -a year on the average - sometimes a couple of
years go by when they don't mail one out 'p but, as a matter o , f factl last
let's seep 1977 about - I'm not sure of the exact datep but about In the
middle of the year. the summer monthaq there was one of those mailers mailed
out that accompanied the water bill in veryg very bright red lettering stating
again about -having protection on your own property by installing your own
pressure regulator that will protect the property against any high pressure
damage. That is in case - the reason for the Ordinance is that we have
apparatus on the water mai . ns that control the pressure and once in a while,
those break down-, and when they break downp then it creates a high pressure
problemg and.we kne,4that this high pressure problem had occurred due, -.to the
Fire Department being out there and doing some kind of a fire test or some-6-
thing - a.flow test forinsurane ' e - the reason they were doing Itq apparent.1y,
was to get the rates of flow for the'insurance for the rating of the City, and
when they opened these hydrants, it created a high pressure problem when they
turned those hydrants off real quickty. That surged the pressure up. This
Is a City function, a normal City function.

A. I discussed it with Mrs, Faste. I called her.

A. I can give you - I've.got a letter of record in our'files dated December l5p

A. Wellp just that immediately -upon receipt of her letter, we contacted her'
Immediately and explained the situation to her$ verballyp and then I made
a letter of record of that.
Have you had any other incidents of this nature?
A.. Many.times. Not from this particular person though.
Q. No., What are some. of the normal fluctuations in pressure7
A. Normal fluctuations I n pressure?
Qe Yea*
A. There usually isn't much fluctuation in mos.t of the water mains. The City of
Edmonds Is built 6n a bill and it creates many problems -in that we have to
have what they call pressure reducing stations in the main water mains.
Q. I see.
A. Periodic areas throughout the entire city* These stations.are designed to
maintain a regular or lowered pressure. The waterfront pressure.we cannot
regulate anything down to like aroundp or anything around 80 or 90 lbs. it's
'all around 125 to 130 lbs. all along the waterfront' It is just impossible
to get the water pressure down below thatg so I wouid guess that 99% of the
people living in this area have their own pressure reducing valve. The reason
they do that is, if they didn'tl-they would be replacing little washers in
.their faucets and -replacing hot water tanks at a very high rate compared to
an area that would havepsay, 60 lbs. of pressure.

A* So the City almost has to and one of these pressure reducing valves on the
mains that I'm talking aboutp the main feeder line going down the hillss if
one of those were to, you knowp no piece of equipment is made perfect and
once in a while they will break down. Immediately upon our knowledge that
they are brokeng breaking downy've go right out there and repair it. Somem
times it takes a dayp sometimes.it takes Wo days to get the parts, but
during that time there it high pressure and we do our very best to get it
offas quickly as we can.
Q. Hot; often are the stations maintained?
A. They are maintained.on a regular basis once a year - we maintain them whether
t1ey need It or not. We go through and service them once a year or check them
out. Periodically# they will break down and will not -operate properly and then
the pressure will sometimes go up or down according to however they malfunction.
.We have - I think we have around 15 of them throughout the'Cityg and we've had
problems where these stations have broken down.
Okay. . Well# in your opinion thent there is no liability on. the part of the
City Edmonds for Mrs,. Faste's hot water tank problem, is that correct?
