the past experience has been not to try and retain the water off -site or
on -site due to the time of concentration and lag in individual storms.
There would be no impact to individual downstream owners nor should
property owners in bluff areas be asked to store upstream water and thus
further load or saturate these bluffs.

Enclosed is a partial historical review of proposed development on Tract 37,
Talbot Park.
EXHIBIT A
In January 1967 Reid, Middleton & Associates prepared a short subdivision for
Sproule McGinnes depicting 4 lots.
EXHIBIT B ,
During February of that year a washout occured due to heavy rainfall coming
down this drainage basin. RMA resubmitted a revised short subdivision labeled
Revision "A".
EXHIBIT C
Also, at the time it was apparent in my review that the City would be installing
a storm sewer to alleviate the concern of surface drainage causing future erosion
on this lot. Refer to LeRoy Middleton's letter dated February 13, 1967.
EXHIBIT D
Subsequent to the construction, in 1969 RMA prepared the development plan for
Mount Baker Seaview Estates, a 12 lot plat to the south. This plan shows that the
24" storm line in fact had been installed and that easements for access and
maintenance had been created and granted to the City.

Also, I prepared another grading and drainage plan for Virgil Scott in 1978
upstream of Mr. Linton's site. It depicts the location of the 24" stormline
in question which Leif Larson had approved as City Engineer.

Early in 1983, Mr. Linton contacted our firm to perform a topographic survey
of said Tract 37. Enclosed is a portion of this map which depicts the invert
elevation of the storm manhole on the Burlington Northern right-of-way as being
15.70 MLLW'. high tide generally is considered as being 13.10 feet in this
vicinity. Based upon this fact the outfall pipe will not be inuhdated by the
high tide.
After review of the above facts I trust that you will reconsider my letter of
March 27, 1984. (EXHIBIT G).

Tlie City of Edmonds, in consideration for the granting
of this easement agrees to the following conditions:
1. That there is presently, at the time of execution of
this easement, an easement for storm sewers granted by the above
named Grantors to The City of Edmonds. That The City of Edmonds
hereby grants to the Grantors the right to construct permanent.
improvements over, above and upon the said storm sewer easement
Subject to the following conditions:
a. The Grantors, their heirs or assig ns, so long as
they are in compliance with the then existing zoning and
buil.di.ng codes or other applicable ordinances and regula-
tions of The Cit� of Edmonds, may construct permanent
improvements in the said storm sewer easement area so long
as footings, foundations or any other portion of saicl
permanent improvements shall not be within five (5) feet
in any direction of the storm sewer line as it is desig-
nated to be located in the. easement area according to the
final as -built construction drawings as they appear in the
records of The City of Edmonds.
b. That the Grantors at the time of the granting of
this easement to The City of Edmonds have full knowledge
of the existence of a storm sewer line located on the
subject property as hereinabove referred to. That the
Grantors at the time of the granting of this easement
have indicated their intention to built a permanent improve-
ment in the storm sewer easement area subject to the above
set forth condition and the other conditions set forth
hereinafter. That the Grantors are aware of the attendant
risks involved by reason of locating permanent improvements
in an easement area or over a storm sewer line. The Grantors
agree to hold The City of Edmonds, Washington, harmless from
any and all liability for damages sustained to permanent

improvements placed in the easement area by reason of a
failure of said storm sewer system.
(6) The Grantors agree not to place any permanent
improvement in the storm sewer easement area in such manner
as to interfere with the access by The City of Edmonds,
Washington to any manholes or clean -out pipes which may be
located in the said storm sewer easement area.
2. That all of the provisions and conditions set forth in
this easement shall be binding on the Grantors, their heirs and
assigns, and are to be made a part of the public record.
3. That located in the northwesterly portion of the North
1/2 of Lot 37, Talbot Park, according to the plat thereof, as
recorded in Volume 12 of Plats, page 107, records of Snohomish
County, Washington, there is located a manhole in the above
referred to storm sewer easement area. The City of Edmonds hereby
agrees to raise said manhole to a heighth to be agreed upon by said
City and said Grantors, said heighth not to exceed twenty feet
above its existing elevation and the cost of said construction
shall be borne by The City of Edmonds.
4. That The City of Edmonds, Washington, agrees to restore
to substantially its original condition such improvements as are
disturbed during the construction, maintenance and repair of said
sanitary sewer line by the City.
5. The Grantors, their heirs or assigns, shall not con-
struct any permanent structure over, upon or within the sanitary
sewer easement granted herein.
6. The City agrees to pay the sur, of MO to the Grantors.

their property. A licensed side sewer contractor must be employed to
construct side sewers in the public' right-of-way. I

installation for one year.
c. Commercial establishment requires a minimum of a six inch (6")
side sewer line.
d.. Side sewers may not be installed closer than thirty inches (30")

REFERENCE: Engineering Department letter, dated April
26, 1983,.to Hal Reeves
The owner, Robert Linton, and his Design Engineer, Gary W.
Henderson, met with City Engineer, James E. Adams, and Assistant
City Engineer, Pat Wilson, on May 5, 1983 to discu . ss our concerns
expressbd in the above referenced letter to you.
Gary Henderson stated that he wa s a Soils Engineer, but not a
Structural Engineer,and that he wished -first to address our con-
cerns with the general design considerations as set forth in our
letter of April 26. He discussed his loading and soils assumptions
and felt that his assumptions -would, indeed, yield a 45 PCF equiva-
lent soil fluid pressure. We are still not satisfied with his pas-
sive pressure assumptions', although he is.
The owner stated that he thought the building permit was just a
formality., and he has gone ahead with the installation of the sol-
dier piles and poured the deadman.
Our concerns are still with�the very concept of this wall as pre-
viously stated in our letter of April 26. This was also discussed
with Gary Henderson and the owner. We are also concerned with the
lack of details as marked on the attached check print and have the
following additional questions and comments:
1. How are precast horizontal members to be installed past
the "DYWIDAG" connections? Details on the drawing should
be shown for this.
2. Designer should show design and construction details on
the drawing for the precast horizontal members.and their
connection details at the soldier piles.

3. Weep hole location, size and spacing should be shown on
the drawing.
4. Design calculations shall demonstrate the safety of the
wall for up to seven feet of fill without tie -backs, as
called for in wall design note 9, or the stated fill
height should be modified if it does not figure.
5. It is suggested that earthwork compaction notes 3 and 5
be modified, as marked on the check print attached.
6. The Design Engineer should be required to visit the site
for inspection during construction and -certify, ' in
writing, that construction has been properly done in
accordance with the Designer's plans and details.
We are still concerned about the effect of the under drainage con-
tributing to*the accumulation of runoff water at the base of the
wall and subsequent reduction of passive pressure capacity, since
passive pressure is critical in preventing "kick -out" at the base
of the wall.
Since the owner has already proceeded with construction of the
piles and deadman, and since there is a honest difference of opin-
iQn,between the Designer and this Department, we recommend the
following course:
1. Obtain from the owner the details and further calcula-
tions cited above and shown marked on the attached check
print.
2. Ship plans, details, dalculations, and these letters to a
specially qualified Structural Engineer for an independent
check and comments. (We recommend Skilling, helle,
Christiansen and Robertson, who may also use Dames & Moore,
or Shannon & Wilson, as consultants.)
3. Based on their check and comments, you may decide to issue
a permit for this structure, and we may also reluctantly
agree with you.
However, we still stand on our concerns with the concept of a tie-
back wall over a storm sewer.
These are out recommendations and comments resulting from our
meeting today. The next choice is yours to make.
