Prior to the hearing on November 19, 1997, your agent, Jim Miller, faxed us a letter stating that the application was withdrawn and that you would be at the hearing to confirm that. At the hearing, you stated that you disagreed with the staff decision, but that you had not had adequate time to look into it, so you stated that you preferred to postpone the hearing. The Hearing Examiner asked if you wanted to do it to a specified date, but at that time you did not have a date in mind. As there now exists some confusion in this office whether the application is to be withdrawn or postponed, we would appreciate you responding by December 23, 1997, to tell us which of the following options you would like to pursue: 1. Withdraw the application; or 2. Have a hearing on the variance. In order for you to have a hearing on the variance, you will need you to cover the costs of sending out the new notice. We will also need to know when you anticipate you would want the hearing to be. If you can only tentatively schedule it now, we -could double- check with you three weeks prior to the hearing to make sure that the date was still suitable. M: 4:25-259-4099 Edmonds, WA 98020 Fax: 4,25.259,3230 SUIUECT: NORMAN VARIANCE APPLICATION (V-97-117) Dear Hearing Examiner: On behalf of my client and the applicant for the aforementioned variance applicant, Mr. Jack Norman, I am herewith formally withdrawing this variance application. While it has always been Mr. -Norman's position that his residence was "legal". it was only recently that I have been able to confirm the legal non -conforming building status of the Norman property with a member of the City's planning staff. Messages exchanged with the City Attorney have also suggested the inappropriateness of and lack of necessity for the variance application. Discussions of these facts with Mr. Norman, together with his confirmation that he has not plans for expansion of the existing building, have resulted in Mr. Norman directing me on this date to formally withdraw this variance application. Since the variance application is withdrawn, I will not be attending the public hearing tomorrow. As is customary is such instances, Mr. Normanwill be there to verify his withdrawal. We would,anticipate no further action with the exception of the Hearing Examiner acknowledging the withdrawal and indicating that this terminates your jurisdiction in this matter.
