We only went back as far as the 1981 code. The language that says "Except as otherwise provided, the width of any residential driveway shall not exceed 20 feet exclusive of the radii of the returns." and "The Public Works Director may authorize additional residential driveway widths for three car garages or for access driveways necessary for off-street parking or recreational vehicles." was included in the 1981 code. So, the pertinent language has been in the code at least since 1981, maybe longer. The property at 17922 72 d Avenue West is a comer lot. It has a circular driveway with one driveway approach, approximately 12 feet wide, off 72nd Avenue West and a second driveway approach, approximately 36 feet wide, off 180th Street SW. This driveway approach is the one which you have filed the complaint about. Our code says, in part, that "the width of any residential driveway shall not exceed 20 feet unless authorized by the Public Works Director for off-street parking or recreational vehicle parking." Our Public Works Director, in accordance with our code, has indeed authorized the additional driveway width. Therefore no code violation exists. Section 3. ECDC section 21.55.020 defining Lot Area is hereby amended to read as follows: 21.55.020 LOT AREA Lot Area means the total horizontal area within the boundary lines of a lot. Lot Area shall normal exclude any street rights -of -way and access easements. If additional right-of-way has been required in accordance with the provisions of ECDC 18.80.010, note 4 as the same exists or is hereafter amended, Lot Area shall be calculated to include the additional right-of-way required over and above the standard established by that section. . ECDC section 21.90.130 defining Street Lot Line is hereby amended to read as follows: 21.90.130 STREET LOT LINE Street Lot Line means the line or lines along the edge of a street or access right of way or easement. Where the Official Street Map shows a proposed right of way, the edge of the proposed right of way shall be used as the Street Lot Line. Except as otherwise provided, the width of any residential driveway shall not exceed 20 feet exclusive of the radii of the turns, with such measurement being made parallel with the center line of the street. Driveway approaches shall extend from the edge of the existing street a distance of twenty (20) feet or to the edge of the property line, whichever is greater. Approaches shall be constructed of asphalt concrete pavement or an equivalent approved by the City Engineer. The standard width for commercial and other nonresidential streets shall be thirty (30) feet. At the application of the applicant or the City Engineer, additional width in excess of the established standard may be approved as a staff decision to a maximum width of forth (40) feet. Such decision shall be made only after notice and hearing in accordance with provisions of ECDC 20.95.050. Such application shall be approved only if: (a) it conforms to the provisions of the Comprehensive Plan; (b) is found to be in the public interest when the needs of the applicant are reviewed and balanced in light of the benefits to the general public and the impacts, if any, on the immediate neighborhood; and (c) is consistent with or enhances public safety and will not create a hazard to vehicular, pedestrian or bicycle traffic. Permit Required.. No person shall begin work on the construction, alteration, repair or removal of any driveway or the paving of any parking strip on. any or adjacent to street, alley or other public place in the City, without first obtaining a permit from the Public Works Director. Fees shall be as s*et,forth in Chapter 15.00. B. Location- 1. No driveway shall be so located as to create a hazard to pedestria-ns, bicyclists or motorists,or invite or comp el. illegal or unsafe. traffic movements. 146 18.80.060 2. Unless otherwise approved by the Public Works Director, all drive- ways including the returns shall be confined within lineslperpen- dicular to the curb line and passing through the property corners. 3. No driveway shall be constructed in such a manner as to be a hazard to any existing street lighting standard, utility pole, traffic regulating device, or fire hydrant. The cost of relocating any such street structure when necessary to do so shall be paid by the abutting property owner. The relocation of any street struc- ture shall be allowed only on approval of the person owning the structure involved. 4. on private property every driveway must provide access to parking structures or access specifically designated for parking purposes requiring the entrance of vehicles. C. Size and Number. 1. Except as otherwise.provided, the width of any residential driveway shall not exceed 20 feet exclusive of the radii of the returns. (The measurement being made parallel to the center line of the street.) The maximum width for any com- mercial driveway shall be 30 feet. The Public Works Director may authorize additional residential driveway widths for three car garages or for access driveways necessary for off-street parking or recreational vehicles. 2. The width of * any driveway shall not be less than ten feet, exclusive of the radii of the returns, the measurement being made perpendicular to the center line of the driveway. 3. The total width of all driveways for any one ownership on a street shall not exceed 50% of the frontage of that ownership along the street. Any driveway which has become abandoned or unused through a change of the conditions for which it was originally intended, or which for any other reason has become unnecessary# shall be closed and the owner shall replace any such driveway curb -cut with a standard curb to be constructed according to theCity's general specifications. 4. There shall not be more than two driveways on one street for any one ownership except where a single ownership is developed into more than one unit of operation, each sufficient in itself to meet the requirements of off-street parking and loading as required by the zoning ordinance and where the necessity for separate access to the street is evident.
