Ile alleged that the rockery was loosened due to the vibrations caused by construction equipment working on the installation of a sewer during the summer of 1979. The claim was sent to our insurance carrier. Thev inves- tigated the circumstances and also had an Engineering �onsul- tant, Mr. William L. Shannon, look at the rockery. Both of their opinions, which I support, are that the rockery is in poor shape and needs to be replaced. But, the damage and Dresent condition is due to water from the house gutters and �Oots from trees growing behind the rockery, and not to any possible virbrations caused by the construction.of the sewer. Mr. Larson now claims that the tree belongs to the City. None of the trees appear to be in the public right-of-way. The claims examiner, Mr. Milton Gustafson, notified Mr. Larson that the claim was denied. Since the time of this notifica- tion, Mr. Larson has called the Engineering Division several times demanding that we repair the rockery. Interestingly enough, what you tell us about the engineer's report brings us back to dealing with the City of Edmonds again, since the tree that the engineer refers to as being responsible for the damage, is not on our property. The tree sits at the base of our rockery, on property belonging to the City of Edmonds. The tree in question is an unsightli scrub tree' and it was there at the time we purchased the house. ' We wanted to remove this tree but since it was not on our property we did not - have the right to do so. Ironic, isn't it, that this very tree is what is being blamed - for the damage to our property. Further,, regarding the engineer's "opinion" that the ground vibration could not have contributed to the damage - all we can say is that is exactly that - an opinion. We wonder what the engineer would have to say if he haj been inside our house at the time of the excavation, listening to the sounds of the shaking and rattling and watching the windows vibrate. We wonder what the engineer would have to say about tons of equipment belonging to the contractor being parked on the ground which was not equal to supporting that kind of weight. The simple fact remains that regardless as to who is at fault,, the City (tree) or the contractor (sewer excavation), we have sustained a great deal of damage to our property, none of which was our fault. In addition we must point out that the condition of the rockery and the bank is worsening steadily and we will not run therisk of being held liable when the whole thing ultimately comes down, either injuring some innocent victim, damaging the road below, and possibly taking our house along with it. Aren't contractors required to research the ground they will be excavating before proceeding with their projects? Why haven't we heard from G. R. Severson's insurance carrier? ARNOLD LARSON 18003 HOME VIEW DRIVE EDMONDS, WASHINGTON Gentlemen: CLNIMS In accordance with your request, I visited the Larson resi- dence on March 3rd. During the past few days I have discussed the conditions at the Larson residence with Mr. Larson, Mr. Adams, Edmonds City Engineer, and Mr. Roth of Reid Middleton Consulting Engineers who designed the sewer and observed the construction in 180 St. SW. It is my understanding that a sanitary sewer was installed in 180 St. SW in 1978. The portion'of the sewer north of the Larson residence is located 7 feet south of street centerline and at a depth varying between 7 and 8 feet. Construction operations of excavating, laying the sewer, backfilling, re- paving and clean up took place over a period of approximately six months. Mr. -Roth recalls -.-'that the ground was hard, trench walls were generally self'�supportingjll.and groundwater was "not - encountered. In the Spring of 1979, according to Mr. Larson, bulging and subsidence of the high (15 feet approximately) rockery on Home View Drive, which bounds their residence on the west side, was first observed. I understand that the Larsons claim the bulges in the rockery resulted from vibration by equipment used for construction of the sewer in 180 St. SW. RECENED J U L 8 1980 CNA Insurance Dir. Of Public Works Attn: Milt Gustafson March 6, 1980 Page 2 It is my observation that the high rockery on Home View Drive is bulged and settled severely at the south end and to a lesser extent near the north end. The fence at the top of the rockery, probably built to a straight line, now sags noticeably. It is my -opinion that the rockery in its present condition is unsafe and in danger of collapse. There is a tree at the south end of the rockery which has been severely pruned and has sent out numerous suckers. The tree is situated so that its roots probably grow behind the rockery. Above the rockery is a concrete patio the full width of the resi- dbnce. Water from the downspout at the southwest corner of the house is directed onto this patio and flows toward -a shallow concrete lined gutter along the west edge of the patio. This gutter slopes to the -south and discharges into a pipe the entrance to which appears to be free of obstruction. However, the gutter has separated from the patio and there is a continuous crack throughout its length. Water flowing across the patio would first enter this crack before it would reach the gutter. Also, the gutter is slightly tilted to the west and water flowing in the gutter could easily spill out on the low side. Water enter- ing the crack between the patio and the gutter and water spilling from the gutter will.infiltrate the ground immediately behind the rockery. It is my opinion, based on the information described herein, that the subsidence and bulging of the rockery is.caused primarily by a combination of root growth behind the rockery, which has the effect of wedging rocks outward, and water infiltrating from above. I am of the opinion that the construction of the sewer, including vibration of equipment, is not respo*nsible for the bulging and subsidence of the rockery. Sincerely,, William L. Shannon, P.E.
