Kernen Lien, Associate Planner
Fence in Olympic View Drive right-of-way
Alan Muzzy, property owner, called planning on October 22, 2008 stating that the City of
Lynnwood informed him that the City of Edmonds had recorded a "bad" survey that
resulted in his fence being place in the City of Lynnwood's right-of-way along Olympic
View Drive.
After researching the matter (consulting with Pam Lemcke (Edmonds Engineering) and
Jesse Perrault (Lynnwood)), it does appear that the fence is within Lynnnwood's right-of-
way, but that the survey recorded with S-98-72 is correct. I informed Mr. Muzzy that he
would not have to move the fence now, but in the future, if the fence needed repairing or
replacement it would have to be moved back to the property line (approximately 2 feet).
Mr. Muzzy was not pleased and indicated he would be seeking councel of a landuse
attorney. Mr. Muzzy believes it is the City of Edmonds' fault that the fence is in the
wrong location and he should not be required to move the fence.

Dear Mr. Muzzy:
Thank you for your letter dated February 12, 2005 (received by the City on February 23,
2005) regarding the subject driveway. Upon receipt of your letter, City representatives
visited the site and confirmed that additional requirements will be placed upon the
developer until the City can approve the final construction of the driveway retaining wall.
Be assured, all required permits shall be obtained and all required inspections, including
required special inspections, shall be performed in order for the City to approve the work.

RE: Excavation in the area of private driveway at 18017 69h PL W
Dear Linda:
As we discussed last week in our telephone conversation on the above subject, I had our
inspector visit the site to look at the situation and determine if there was any degradation
of the driveway due to the adjacent construction. Our inspector looked at the site and
reported there was no undermining and the area between the wall and driveway is now
partially backfilled and compacted and the contractor was in the process of installing a
block wall. Although there had been some undermining prior to the wall going in, there
was no evidence of problems. The reason the area hasn't been totally backfilled is
because they are still working on the wall and the contractor has to relocate one of the
water service lines that feeds the house directly to the East of the construction. Based on
field observations, the water service will be located between the block wall and the
driveway. Before the contractor can backfill the water service line, we must inspect it.
According to the inspector, the block wall will not be very high and the contractor will be
required to backfill behind the block wall at a 2:1 slope (2' horizontal for every foot
vertical).
If there is settlement in the driveway as a result of the construction, the contractor will be
required to fix the problem prior to our sign off of the permit
Please note that should settlement occur after we sign off on the building permit, the issue
will be between you and the contractor and or homeowner to resolve.

My wife and I are faced with a situatio that I am confident you can help us resolve. We
recently purchased our home at 18017 S91h Place West in "The Estates at Olympic View"
development in Edmonds. . Uncontroll,,d surface water run-off from the lot to the west of
our home streams across our driveway,. carrying silt and debris to a catch basin that was
installed to handle rainwater run-off from ours and a neighboring driveway.
No effort has been made by the bUilder.(Westar Development) to tie into the existing
surface water drain system located betkeen our lots, or to otherwise mitigate potential
damage to neighboring private propert caused by un controlled run-off.
I am hereby requesting that the certificate of occupancy for the home at 18015 6 91h Place
West be blocked until this situation is tisfactorily resolved by the installation of a
drainage system between our propertiet, tied into the exisdng surface water system.
I am also aware that Westar's concrete �sub-contractor for the same lot broke the exposed
vertical sewer pipe. This was done to drain excess water and uncured concrete that
accumulated during the pouring and fir ishing of the exposed aggregate driveway. The
City of Edmonds in investigating the matter flushed the dirt and concrete debris from the
lines only to find pieces of the broken plastic pipe blocking the lateral line where it ties
into the sewer main. It is imperative th�t both these matters be resolved prior to the
certificate being granted and the new o�vner taking possession.

We recently noticed City CTeWS on site doing camera %urveys of the existing sewer
system throughout the development. During the conven-ation with your crew, it was my
understanding that the camera could not proceed up the line in the vicinity of lot 20
because of the concrete and rock that had entered this line from the construction activilies
by Westa Development on this lot- It Is my understanding that the problem still has not
been Fixed and the remainder of this SeWCT line still needs to be camera surveyed. I have
b card a rumor that lot 20 is scheduled to close Nvit hi n the nex t several days and am
curious as to why the City of Edmonds would grant a cerilifi caic of occupancy to Westar
for this project while having full knowledge of thewsewer problems.
The association is hereby requesting a written response from the City rr-garding the status
of this issue and what actions have or wl li be taken to insure that this pToblern is
remedied immediately.

Dear Mr. Muzzy:
The purpose of this letter is to inform you that in response to a citizen's complaint on a possible slope
failure and dangerous condition to a private driveway located to the north of Lot 17 at 18019 69h Place
West, City officials and City Geotechnical consultants conducted a site inspection on September 13, 2004
and observed over excavation of the building lot in question exposing a near vertical cut slope on the
north side of the property and the sloughing of materials beneath the shared driveway pavement.
Please note that the primary purpose of the investigation was to determine if the cut slope and material
sloughing created an impact to the adjacent driveway. Please refer to the attached Landau Associates
technical memorandum discussing this matter. It is the opinion of the City's geotechnical engineer that
the excavation is overly steep, threatens the adjacent shared driveway and that vehicle traffic should
immediately be limited from access on the southerly 6 feet of the driveway pending a geotechnical
evaluation by the developer's geotechnical engineer. Therefore, pursuant to Uniform Building Code
Section 3307, entitled Excavation and Grading, as Building Official for the City, I have officially ordered
the developer (Westar Development Company, Inc) that the southerly 6 feet of the access driveway shall
be immediately barricaded from vehicle use and access pending further geotechnical investigation.
Furthermore, as a joint property owner of the access driveway you are ordered not to use this portion of
driveway as it may be susceptible to further failure until repaired under the direction and supervision of
the property owner's licensed geotechnical engineer. The City understands that reducing the width of the
driveway is a temporary inconvenience however, the City must take prudent action to safeguard public
safety. The requirements of the Building Official as noted in this letter are appealable within 14 calendar
days to the City Hearing Examiner by filing a formal written appeal and filing fee of $230.00 pursuant to
ECDC 20.105.0 1 OA.
