At your request, we have inspected and evaluated the stability of the Key -tone block walls
constructed on the subject residence site. Presented in this letter report are our findings and
conclusions.
A curvinor Kevstone 'segment concrete block wall (hereinafter referred to as Wall 1) is
constructed to line a toe cut alona the north and west lot lines, and a straight wall (hereinafter
referred to as Wall 2) line the south lot line of the subject residence. Wall 2 is a single -tier wall
linina the, south side of the driveway and garage of the subject residence, and stands at about 4
feet tall. About the middle half of Wall I splits into two tiers, with the lower tier wall stands up
to 3 feet 4 inches tall and the upper tier up to 2 feet 8 inches tall, and the upper tier wall is set
back at 2.0 feet from the lower tier wall. Wall I is within about 15 to 20 feet of the sidewalk to
the west and within about 4 feet of the neiahbor's driveway to the north at its closest point. The
area between Wall I and the sidewalk is now covered with grass sod and shredded bark, and the

area between Wall I and the neighbor's driveway is mostly bare. We understand that the
stabilitv of Wall I is the main concern, and hence the subject of our stability evaluation.

Two typical sections of Wall I are shown on Plate 1. attached hereto. You stated that a
perforated PVC drain pipe is installed along the base in front of the lower tier wall, and that
crushed rock filled trenches are constructed under the base -course of the lower -tier block wall at
to 4 points to hydraulically connect the sand backfill to the drain pipe in front of the wall.-. The
drain pipe is then tightlined to the drain line of the roof drain system. You also informed us that
free -draining sand is used to backfill the block walls, and that the sand backfill is placed in lifts
no more than 12 inches thick with each lift compacted with a vibratory plate compactor to a non -
yielding state. It is our opinion that the block walls constructed as you described should have
adequate drainage control provision.
As presented on our 10/29/04 letter, the original surficial'soil unit at the residence site and its
vicinity is mapped as advance outwash deposits of dense to very -dense, slightly silty. fine to
medium sand with a trace to some gravel. The native undisturbed advance outwash soils are
quite stable. We understand the roadbed of the neichbor*s driveway to the north is constructed
with structural fill placed over the advance outwash deposit. The structural fill was compacted to
at least 95% of the maximum dry density determined by ASTM D1557 (Modified Proctor
method), monitored and certified by Nelson- C ouvrette Associates. It is our opinion that cut
slopes or fill embankments at 2H: IV in such structural fill material or in the compacted sand
backfill of the block walls should be able to maintain stability. The surficial soils on the slope
next to the north neighbor's driveway may have been disturbed by construction traffic. The
disturbed soils should be compacted with a vibratory plate compactor to a non -yielding, state, and
the slope should be seeded and covered with a layer of straw mulch. Shrubs may also be planted
on the slope to provide erosion protection.
With multi -tier walls, the general rule of thumb is that the upper -tier wall should be set back
from the lower -tier wall a horizontal distance at least equal to the height of the lower -tier wall in

order not to exert additional surcharge on the lower -tier wall. This is based on the assumption
that the pressure envelope of the foundation load of the upper -tier wall spreads downward at a
45-dearee an -le. In dense native soils or structural fill. the pressure develop may actually be
spreading downward at a steeper angle, and thus requires less setback of the upper wall. The
Keystone block walls constructed on the subject residence appear to be stable, with no signs of

foundation load does not appear to an adverse impact on the stability of the lower -tier wall of
Wall 1.
Based on our observation of the conditions of the Keystone walls built on the subject residence
site, it is our conclusion that the one -tier portion of the block walls is stable. The two -tiered
portion of the walls appears to be stable without any discernable movement. even though the
upper -tier is not set back far enough from the lower -tier wall according normal rule of practice.

We have reviewed a letter prepared,by Liu & Associates dated -March 2, 2005, a.letter,from the
City of Edmonds.date.d. March 7, 2005, requesting an evaluation of the surcharge influence of traffic on the
adjacent driveway,.and a response letter from Liu & Associates dated. March. 21,.2005. We have also
reviewed a. hand sketch of dimensions and elevations of the existing wall configuration prepared by Lyle
Chrisman of the City of Edmonds to better. understand the overall configuration and heights of the.
existing wall.
Landau Associates concurs with the findings and conclusions of Liu & Associates'
March 21, 2005 letter that addresses the influence of the driveway traffic surcharge and concludes that the
driveway should exert minimal or no surcharge. pressure on the block wall given the most critical section
described in the letter prepared.by Liu & Associates.
However, Landau Associates is concerned about,the. overall configuration of, the, wall. and, in
particular the configuration of the two-,tiered.wall.system,: It is, our opinion that. the upper wall, which is

Limited information has been provided to assess the stability of the two-tier wall.
Liu & Associates states that the wall is a Keystone block wall. Information was not provided to us as to
the block size and no calculations were provided to support the design of the wall in its current
configuration. The approximate block size has been described to us and we have compared this to
technical literature from Keystone Retaining Wall Systems. The block size described is consistent with
the Keystone "Compac" unit blocks. The Keystone technical literature indicates that the recommended
maximum wall height for a modular block wall constructed of the Keystone Compac units is 3 ft, without
soil reinforcement and no surcharges (no slopes, roadways, etc.). The height of the existing wall, whether
in a single wall ortwo�-tierconfiguration, exceeds 3 ft- in some areas and has a -sloping backfill-.— The
Keystone technical literature also cautions. that a two-tier wall can impose higher stresses in the lower
wall when the height of the.lower wall is greater than the horizontal space created by the terrace between
the walls. This configuration is also consistent with the City of Edmonds requirements for spacing
between rockery walls, which in many ways are similar to modular block gravity walls.
Liu & Associates states in their March 2, 2005 letter that "the Keystone block walls constructed
on the subject residence appear to be stable, with no signs of movement, such as tilting, bulging, or
sliding." Liu & Associates also states that the two -tiered wall configuration is not according to the
14non-nal rule of practice." In our opinion, the current absence of signs of imminent failure of the wall do
notprovide the necessary assurance that the wall will perform as intended over the long term. Since the
information currently available to us indicates that the wall system does not appear to comply with the
manufacturer's recommendations regarding wall height and the configuration of tiered walls, we
recommend that the stability of the wall and slope configuration be evaluated with en gineering
calculations to provide appropriate design support for the current configuration, or remedial measures be
taken to -increase the stability of the current wall and. slope system.

Thank you for meeting with City Officials today regarding the driveway retaining wall design and surcharge
issue. In attendance at the meeting was Mr. Dennis Stettler, P.E., the City's geotechnical consultant with
Landau Associates, Inc. and your engineer Mr. Liu, P.E..
Your proposal to the City is to:
Remove the upper retaining wall tier;
Cut into the hillside and rebuild the upper wall a minimum of four feet back from the lower wall --closer
to the driveway. The lower wall height has been measured by Mr. Liu to be approximately 3 feet 5
inches in height. Mr. Liu indicated that the upper wall finished height will not exceed four feet and that
there is sufficient space between the lower wall and the driveway such that the rebuilt upper wall will
not support a driveway surcharge and will not impose a surcharge on the lower wall (in order to avoid
permitting requirements). Mr. Liu recommends structural backfill to be placed behind the upper wall
(i.e., crushed rock) to reduce driveway surcharge affects. Drainage pipe will also be placed behind the
upper wall and be piped to an approved system. You will contact the City when the work is complete.
Once the retaining wallis completed the bond will be released and final occupancy may be granted.
The City re-emphasized that if any portion of the wall exceeds 4 feet in height or supports a surcharge, a
permit is required.
On a related issue, you have decided to re -locate the neighbors' water service line and place it between the
paved portion of the existing driveway and the upper tier of the re -located wall. You will be responsible to
notify the neighbor of temporary water shutoff. It is understood that a portion of the structural backfill placed
against the wall may be replaced with sand due to minimum water service line embedment requirements. You
understand that you are required to contact the City Engineering Technician for inspection, of the relocated
line —before -you backfill.

We have reviewed the letter dated March 2, 2005 from Liu & Associates, which you submitted
to the City on March 4, 2005, concerning the subject retaining wall. The conclusions in the letter
do not satisfy our requirement that the engineer clearly state that the existing wall does not
support a driveway surcharge. In our meeting with you on March 1, 2005, we explained to you
very clearly that the immediate question that must be answered regarding your retaining wall is
whether or not a permit is required. We explained to you that the determining factor as to
whether a permit is required is whether or not the retaining wall supports surcharge from the
adjacent driveway. Our observation, based upon the close proximity of the retaining wall to the
driveway, is that it does support surcharge and that, therefore, a permit is required.
If you wish to pursue a determination that a permit is'not required, you must submit an
evaluation and report from a geotechnical engineer that demonstrates that the retaining wall does
not support a surcharge. Upon receipt of this evaluation and report, we will submit it for peer
review, for which you will be required to pay a peer review fee. The evaluation must include
corresponding calculations and dimensioned drawings for peer review approval; OR, if you
agree that the retaining wall supports a surcharge, then you must submit an application.for a
permit and include all required submittal information (refer to Retaining Wall Perm it Submittal
Requirements) including appropriate fees. Note, peer review will be required.
On Friday, March 4, 2005, you asked the City Engineer if the City would accept a bond for the
retaining wall. This request has been reviewed with the Director and has been determined that a
bond is not appropriate in this situation and, therefore is not an acceptable alternative.
Lastly, I remind you that occupancy prior to final occupancy approval is a violation of the
Building Code and is subject to fines.

Regarding the driveway retaining wall design and surcharge issue, the City"s geotechnical consultant Landau
Associates, Inc. has completed review of Mr. Llu's, P.E., submittal and a copy of their review letter dated March
24, 2005 is enclosed. Please note that Landau concludes that the series of retaining walls were not built in
accordance with the manufacturer's specifications and the upper wall imposes a surcharge on the lower wall in
the two tiered system. It was also noted that the walls are not constructed to City approved design standards.
Because of these issues it is the decision of the City that the entire wall be reconstructed under a building permit.
Please be advised that the new wall shall be designed per manufacturer specifications as well as City design
standards. Engineering calculations shall be provided to justify the design. 'Me City shall utilize Landau
Associates to perform the future design peer review and you are responsible for the peer review fees. Once the
permit is issued the City shall require special inspection and geotechnical evaluation (to be perfon-ned by a state
licensed geotechnical engineer) during the course of reconstruction and work must be completed within 30 days
of permit issuance. Enclosed is a copy of the City's handout for Retaining Walls.
Pursuant to your request, temporary occupancy may be granted while you are progressing with correcting the
driveway retaining wall condition. If temporary occupancy is granted by the City a bond for the reconstruction
of the driveway retaining wall shall be posted in the amount of $10,000.00, (bond form previously provided to
you) prior to temporary occupancy approval.
If you have any questions please feel free to contact Dave Gebert, P.E., City Engineer duning City business
hours. If you and Mr. Liu desire to meet with City Officials or representatives of Landau Associates we can

During the construction of a residence on Westar's property located at 18019 691h PI W (the
'�Property"), Westar encountered a water -line, which serves your property, well within the boundaries of
the Property. At considerable expense, Westar attempted to relocate the water -line in order to satisfy the
ruluirements of the City of Edmonds. -1be City of FAlmonds has imposed additional requirements that
Westar'is unable'to comply with as the water -line was installed unproperly by your contractor.
Ifi addition to the above, your contractor failed to obtain an easement from Westar prior to
placement of the water -fine on the Property; therefore, the reason for this letter. Westar hereby demands
that you bring the water -line up to code (at your expense) and, in conjunction therewith, obtain approval
ftom die City of Edmonds. Additionally, it will be necessary for you to obtain an easement across the
'Property -fbf the water -fine (also at your expense).
Time is of the essence. Ile improper placement of the water -line is delaying the closing of the sale
of the Property. Unless this matter is resolved inimediately, you will be responsible for any and all costs
incurred due to the improper placement of the water -fine and the resulting delay of Westar's closing.
Further, absent immediate resolution, Westar will be left with no alternative other than to disconnect the
water -line, and remove the water -line from the Property. Thank you for your immediate attention to this
matter.

I am contacting you on behalf of Olympic View Crest Homeowners' Association, especially those who
are responsible for the future maintenance and upkeep of the private road under discussion.
Long-term stability of the road remains in question due to improper excavation of the adjacent building
site. In her letter of September 14, 2004, Jeanine Graf included a technical memorandum from Landau
Associates to Dave Gebert expressing several concerns about the stability of the excavated bank and
water line. In response, Ms. Graf ordered Westar Development Company Inc to impose road use
restrictions pursuant to UBC Section 3307 because, as she stated, the driveway "may be susceptible to
further failure until repaired under the direction and supervision of the property owner's licensed
geotechnical engineer." (emphasis added). Per your letter of September 15, 2004 to Ron Trickett,
Homeowners Association President, Westar was ordered to:
• "Obtain the services of a licensed geotechnical engineer to perform a detailed site investigation
and submit a plan that includes temporary and permanent erosion control and slope protection
measures and monitoring."
• "Immediately perform any work deemed emergency by the geotechnical engineer."
• "Report any additional slope sloughing or failures or driveway undermining immediately to the
City Engineer."
Several homeowners observed continued sloughing of the middle and upper portions of the bank
undermining the edge of the roadway. I contacted the City Building Department in late November to
again express my concerns regarding the continued erosion of the slope, requesting an inspection prior to
commencement of work on the retaining wall while the bank was still exposed. During . the week of
December 6, pallets of landscaping blocks were delivered to the site and work on the wall began during
the week of December 13. In my absence, my wife contacted the City again and an inspector was
dispatched to the site. In his letter dated December 17 2004, Mr. Lyle Chrisman wrote that the ". . .
inspector looked at the site and reported there was no undermining and the contractor was in the process
of installing a block wall." Further "according to the inspector, the block wall will not be very high . . ....
At this time, the landscape block wall is complete, with portions reaching 60-inches in height. The
retaining wall is constructed of common garden landscaping blocks. Manufacturers of this type of block
recommend structures not exceed 48-inches in height nor be subject to surcharges from sloped banks and
or roads.
At this time, I am requesting the City provide the following documents to be kept in the records of the
affected property owners and homeowners association.
I . A copy of the final report to the City from the licensed geotechnical engineer as to the efficacy of
the repair to the slope
2. Evidence refuting residents' claims of bank sloughing and undercutting of road edge
3. Evidence that the repair was made under the direction and supervision of a licensed geotechnical
engineer
4. A copy of the approved Engineer's plan and City permit for the construction of a block retaining
wall exceeding 3-feet in height

Dear Linda:
As we discussed last week in our telephone conversation on the above subject, I had our
inspector visit the site to look at the situation and determine if there was any degradation
of the driveway due to the adjacent construction. Our inspector looked at the site and
reported there was no undermining and the area between the wall and driveway is now
partially b.ackfilled and compacted and the contractor was in the process of install'ing a
block wall. Although there had been some undermining prior to the wall going in, there
was no evidence of problems. The reason the area hasn't been totally backfilled is
because they are still working on the wall and the contractor has to relocate one of the
water service lines that feeds the house directly to the East of the construction. Based on
field observations, the water service will be located between the block wall and the
driveway. Before the contractor can backfill the water service line, we must inspect it.
According to the inspector, the block wall will not be very high and the contractor will be
required to backfill behind the block wall at a 2:1 slope (2' horizontal for every foot
vertical).
If there is settlement in the driveway as a result of the construction, the contractor will be
required to fix the problem prior to our sign off of the permit
Please note that should settlement occur after we sign off on the building permit, the issue
will be between you and the contractor and or homeowner to resolve.

The City is in receipt of your letter dated September 20, 2004 that details your actions to date on above
referenced Lot 17 and your work schedule for the next week and one half Your proposal is to forgo
geotechnical evaluation required in the Order to Correct Violation Notice because; you have addressed
City concerns in a timely manner; you have not observed any sloughing of the shared driveway; and
you will restore the shoulder of the shared driveway so that the slope will not exceed a 2:1 slope such
that no additional engineering is needed.
The City remains concerned on the issues outlined in my letter dated September 14, 2004 but will
allow you to proceed with your plan to form the foundation walls and backfill the driveway shoulder
area, provided; that daily monitoring of the site for adequate temporary erosion control measures
continues, that any observed driveway sloughing, movement or failure is immediately reported to the
City Engineer, and that geotechnical evaluation (to be performed by a state licensed geotechnical
engineer) takes place on the compaction of the driveway shoulder area. This required engineering
inspection is not an appealable or negotiable decision by the building official and is required due to the
fact that the fill will support the driveway surcharge and adequate compaction is critical.
The City expects that the foundation walls will be poured by no later than Friday, September 24, 2004
and that the complete backfill of the driveway shoulder area and special geotechnical inspection on
compaction shall be completed by no later than September 29, 2004 (with the report to be filed with
the City by no later than October 1, 2004). If any of these time lines will be exceeded you are required
to inform the City in writing prior to the deadline. Failure to notify the City shall result in the issuance
of Notice of Civil Violation whereby fines of $ 100.00 per day shall be assessed.

We have installed the barricades and erosion control measures outlined in your correction notice
dated September 15, 2004.
' We have met with you engineering inspectors onsite on the 150' and 16fl, and have made minor
field corrections and have received approval for erosion control on the 16".
We received approval from the building department on Friday morning the 101, and poured
footings that afternoon.
We are removing the footing forms today and will deliver wall panels tomorrow the 2 1 " and
begin building the walls and anticipate requesting inspection Friday morning the 20 and hope to pour
them that afternoon. After pouring walls we will need a few days to remove the forms and waterproof the
walls. I anticipate beginning backfill on about the 29h of September.
I believe we have addressed the City's concerns in a timely manner and will be restoring the
shoulder of the adjoining driveway so that the slope will not exceed a 2:1 slope. It does not appear that
there has been any sluffing of the driveway in question. Furthermore the backfill will be restored in such
a manner that I do not see the need for additional engineering.
I hope that this will provide you with a schedule as to what we have planned. I want to assure
you that we are checking our erosion measures daily and will be diligently pursuing completion and
restoration of this site.

The purpose of this letter is to inform you that in response to a citizen's complaint on a
possible slope failure and dangerous condition to a private driveway located to the north of
property you own at 18019 691h Place West, City officials conducted a site inspection on
September 13, 2004 and observed over excavation of your building lot exposing a near
vertical cut slope on the north side of the property and the sloughing of materials beneath
the shared driveway pavement. Accompanying City officials were representatives of
Landau Associates, professional geotechnical consultants for the City who prepared a site
report based on their observations (copy enclosed).
Please note that the primary purpose of the geotechnical site investigation was to determine
if the cut slope and sloughing created an impact to the adjacent driveway. As stated in the
Landau Associates report, it is their opinion that the excavation on your lot exceeds a
2:11-1/V slope is overly steep, and threatens the northerly shared driveway. Landau's
recommendations include that vehicle traffic should be limited from access on the
southerly 6 feet of this shared driveway.
As the owner of the lot under construction and responsible party for this excavation, you
are responsible for slope protection and associated mitigation and/or safeguards in this
matter. Pursuant to Uniform Building Code Section 3307, entitled Excavation and
Grading, as Building Official for the City of Edmonds, I shall require the following:
Immediately install lighted bamicades along the length of the access driveway
reducing the width by six feet. The barricades are to remain in place pending the
outcome of your geotechnical report (explained in detail below). If the report

recommends removal of barricades, concurrence by the City Engineer shall be
required.

The City shall expedite any required permit approvals in this matter to the extent
permissible.
• Any changes to the amount or expansion of sloughing under or near the shared
driveway shall be immediately reported to the City Engineer.
In order to be assured that barricades are immediately installed and a plan is provided by
the established deadline of September 20, 2004, attached is an Order to Correct Violation
Notice, the first step in the City's Civil Penalties process whereby fines may be imposed in
order to gain code compliance. Note, immediate shall mean within 24 hours and all
actions deemed immediate are subject to potential fines if the 24 hour notice is not met.
The requirements of the Building Official as noted in this letter are appealable within 14
calendar days to the City Hearing Examiner by filing a formal written appeal and filing fee
of $230.00 pursuant to ECDC 20.105.010A.

Dear Mr. Gebert:
At your request, Dennis Stettler of Landau Associates and Dave Gebert of the City of Edmonds
observed an excavation fb� a filtire residence at 18019 69h Place W. on the aftemoon of September 13,
2004. The purpose of the visit was to assess potential excavation slope stability concerns that could
impact the adjacent driveway.
OBSERVATIONS i
The excavation conditions were observed from the private driveways bounding the property on
the north and south sides. We did not enter the excavation. At -the time of our visit no construction work
was being conducted and �it was rainJng- Rain had been falling intermittently overnight and during the
daylight hours preceding our site visit. A temporary, moveable wood fence was present along the south
side of the north driveway. The driveway is about 15 ft wide and asphalt paved.
'Me excavation for the basement of the proposed residence extended down into what appeared to
be gray, glacially -consolidated soil. Brown soil that appeared to be topsoil was present between the gray
sod and remnants of a sod line that wm visible around portions of the excavation. Fill appears to be
present in some areas, in particular the upper portions of ffie north side of the =cavation appear to be fill.
The north side of the excavation is near -vertical for the lower approximately 4 to 5 ft, steeply sloping
above the near -vertical slope, then near -vertical again for the upper portion of the slope. The top of the
excavation on the north side comes up to the edge of the pavernent for the driveway that services
residences north and east;of the subject excavation. The soil exposed in the. upper portion of the slope
beneath the pavement appears to be angular quarry spall material that is sloughing into the excavation.
During the brief time of our site visit, portions of the quarry spall material and a small segment of the
near -vertical excavation in the gray soil near the base of the slope were observed to slough into the
excavation.

A plastic waterline was observed in the base of the excavation near the north side and the sides of
the excavation on the cast and wast sides. We understand that this waterline services the residence to the
east and the line was broken during excavation for the basement and bas been temporarily repaired.
Portions of the waterline are suspended in air as the pipeline traverses betweim the excavation sides and
the bottom of the excavation
ExcAvAmN STABlury
The excavation contdris near-verdeat portions and the overall slope inclination appears to be
significantly steeper than a 2H: IV (horizontal : vertical) slope. In our opinion, the excavation is overly
steep and threatens the adjacent drivft2y to the north. Sloughing and failure of material into the
excavation could be expected to continue and could undenniine the south portion of the driveway on the
north side of the excavation. This could present a hazard to vehicles traversing the driveway. In our
opinion, the present si on presents a danger to any vehicle traversing the south side of the 15 ft -Ovide
driveway. At this time, we reconunend that 1he temporary fence or other temporary barricades be moved
so that vehicle traffic is pirevented from access to at least the southerly 6 ft width of the driveway. It will
also be important that the driveway be monitored for signs of cracidng or settlement that could be
war=g signs of movement that could fturther endanger the stability of the thiveway. If such signs are
observed, it may be appropriate to prevent all vehicle traffic on the driveway taitil the adjacent excavation
is backfilled or otherwise-staWlized by shoring.
Worker safety in and around the excavation is the responsibility of the contractor. Howevc,-, we
note that the excavation is steeper than that prescribed by WISHA, and according to WISHA excavation
requirements (WAC 296455), should either be flattened or temporary shorirql, provided.

WATERLM STABiLrry ,
The waterline has bwn tetuporarily repaired, but is presently expo.ied and partially suspended
near the base of the ex cavation. Should sloughing of the excavation side slopes or movernent of
construietion equipment damage and break the waterline, the release of water could potentially result in
erosion of the slopes at: the base of the excavation and furd= reduce tho stability of the temporary
excavation. It would be prMent to protect and relocate this waterline as soon as it is practicable.

engineer to perforin a detailed site investigation and submit a plan by September 20, 2004 that
includes temporary and permanent erosion control measures, necessM slope protection and slope
mitigation measures, temporary or permanent juading and/or shoring improvements for all portions
of the cut that exceed a 2:1 slope, driveway safeguards and/or limited access, and include
provisions for required on site monitoring of the exposed cut slope and condition of driveway, and
3) Any work deemed emergency by the geotechnical engineer shall be immediately installed
(provided no City approvals or discretionary gpprovals are required) and, 4) Report all additional
slope sloughing or failures or driveway undennining immediately to the City Engineer, and, 5) Any
geotechnical work requiring a permit shall be prepared by licensed professionals and submitted
within 10 business days of the geotechnical report.
Correction is Required no later than: 5:00pm _(time) Immediately shall mean
within 24 hours from the date/time of service which is September 15, 2004 at 5:00pm, the
report shall be submitted by September 20, 2004 and any geotechnical work requiring plans
shall be submitted within 10 business days of the geotechnical report.
If correction is not made by the date and time specified in the Order, a Notice of Civil
Violation shall be issued. The Notice of Civil Violation shall assess fines of $100.00 per day, or
portion of a day, during which the violation continues.

The Estates at Olympic View Crest Homeowners Association wishes to "press
several concerns regarding the construction of lot 17. There appears to be several
issues that are not in compliance with erosion control measures and safety standards.
The private road has been undermined due to a 10 — 12 foot deep cut along the edge
of it. There appears to be a loss of the road base. The ply wood safety barrier that
was constructed was.ineffective in that it blew into the lot sometime during the night
of September I &- Larry Seitz was notified the following day, via fax, that this had
occurred. So far, there has been no effort to rectify the problem.
The Association is concerned about the long term stability of the road. We request
that corrective measures be implemented to restore the integrity of the road base. We
also request that a maintenance bond naming the homeowners association as
additional insured be posted by Westar Development for any future maintenance or
repair of the road, should additional settlement or deterioration of the private road
occur along the edge of property line.
Another area of concern is the exposed soil. There appears to be a lack of proper
erosion control in these areas.
Finally, the existing water line that serves the lower lot 18 has already been damaged
during the excavation, leaving the homeowner with soil in the water and a risk of
contamination. The locate wires have been broken and the line is lying on the
ground resulting in the potential for additional damage during subsequent
construction activities. The water line must be adequately supported to preyent any
future damage and needs to be subsequently backfilled with sand or pea gravel
during the backfill process to prevent any future damage to this service. Also, the
locate wires, need to be repaired along the length of this water line. It appears as if

the water line has already been patched in with a new section. We are curious as to

At your request, we have inspected and evaluated the stability of the Keytone block walls
constructed on the subject residence site. Presented in this letter report are our findings and
conclusions.
A curving Keystone segment concrete block wall (hereinafter referred to as Wall 1) is
constructed to line a toe cut along the north and west lot lines, and a straight wall (hereinafter
referred to as Wall 2) line the south lot line of the subject residence. Wall 2 is a single. -tier wall
lining the south side of the driveway and garage of the subject residence, and stands at about 4
feet tall. About the middle half of Wall I splits into two tiers, with the lower tier wall stands up
to 3 feet 4 inches tall and the upper tier up to 2 feet 8 inches tall, and the upper tier wall is set
back at 2.0 feet from the lower tier wall. Wall I is within about 15 to 20 feet of the sidewalk to
the west and within about 4 feet of the neighb6r's driveway to the north at its closest point. The
area between Wall I and the sidewalk is now covered with grass sod and shredded bark, and the
area between Wall I and the neighbor's driveway is mostly bare. We understand that the
stability of Wall I is the main concern, and hence the subject of our stability evaluation.

Two typical sections of Wall I are shown on Plate 1, attached hereto. You stated that a
perforated PVC drain pipe is installed along the base in front of the lower tier wall, and that
crushed rock filled trenches are constructed under the base -course of the lower -tier block wall at
3 to 4 points to hydraulically connect the sand backfill to the drain pipe in front of the wall. The
drain pipe is then tight.lined to the drain line of the roof drain system. You also informed us that
free -draining sand is used to backfill the block walls, and that the sand backfill is placed in lifts
no more than 12 inches thick with each. lift compacted with a vibratory plate compactor to a non-.
yielding state. It is our opinion that the block walls constructed as you described should have
adequate drainage control provision.
As presented on our 10/29/04 letter, the original surficial soil unit at the residence site and its
vicinity is mapped. as advance outwash deposits of dense to very -dense, slightly silty, fine to
medium sand with a trace to some gravel. The native undisturbed advance outwash soils are
quite stable. We understand the roadbed of the neighbor's driveway to the north is constructed
with structural fill placed over the advance outwash deposit. The structural fill was compacted to
at least 95% of the maximum dry density determined by ASTM D1557 (Modified Proctor
method), monitored and certified by Nelson-Couvrette Associates. It is our opinion that cut
slopes or fill embankments at 2H:IV in -such struciural fill materia for in the compacted sand
backfill of the block walls should be able to maintain stability. The.surficial soils on the slope
next to the north neighbor's driveway may have been disturbed by construction traffic. The
disturbed soils should be compacted with a vibratory plate compactor to a non -yielding state, and
the slope should be seeded and covered with a layer of straw mulch. Shrubs may also be planted
on the slope to provide erosion protection.
With multi -tier walls, the general rule of thumb is that the upper -tier wall should be set back
from the lower -tier wall a horizontal distance at least equal to the height of the lower -tier wall in

order not to exert additional surcharge on the lower -tier wall. This is based on the assumption
that the pressure envelope of the foundation load of the upper -tier wall spreads downward at a
45-degree angle. In dense native soils or structural fill, the pressure develop may actually be
spreading downward at a steeper angle, and thus requires less setback of the upper wall. The
Keystone block walls constructed on the subject residence appear to be stable, with no signs of
movement, such as tilting, bulging or sliding. The pressure envelope from the upper -tier
foundation load does not appear to an adverse impact on the stability of the lower -tier wall of
Wall 1.
Based on our observation of the conditions of the Keystone walls built on the subject residence
site, it is our conclusion that the one -tier portion of the block walls is stable. The two -tiered
portion of the walls appears to be stable without any discernable movement, even though the
upper -tier is not set back far enough from the lower -tier wall according normal rule of practice.

At your request, Dennis SteWer of Landau Associates and Dave Gebert of the City of Edmonds
observed an excavation fo ' � a fawre residence at 18019 69' Place W. on the aftemoon of September 13,
2004. The purpose of thp visit was to assess potential excavation slope stability concerns that could
impact the adjacent dtive�ay.
OBSERVATIONS I
The excavation conditions were observed from the private driveways bounding the property on
the north and south sides. We did not enter the excavation. At the time of our visit, no construction work
was being conducted and lt was raining- Rain had been falling intermittenfly overnight and during the
daylight hours preceding our site visit. A temporary, moveable wood fence was present along the south
side of the north driveway. The driveway is about 15 ft wide and asphalt paved -
The excavation for the basement of the proposed residence extendeddown into what appeared to
be gray, glacially-consobdated soil. - Brown soil that appeared to be topsoil was present between the gray
soil and remnants of a sod line that w= visible around portions of the excavation. Fill appears to be
present in some areas, in Rarticular the upper portions of the north side of the -.xcavation appear to be fill.
The north side of the excavation is near -vertical for the lower approximately 4 to 5 ft, steeply sloping
above the near -vertical slope, then near -vertical again for the upper portion of the slope. The top of the
excavation on the north side comes up to the edge of the pavement for the driveway that services
residences north and east!
,of the subject excavation. The soil exposed in the upper portion of the slope
beneath the pavement appears to be angular quarry spall material that is sloughing into the excavation.
During the brief time of our sitz visit, portions of the quarry spall material and a small segment of the
near -vertical excavation in the gray soil near the base of the slope were observed to slough into the
excavation.

A plastic waterline was observed in the base of the excavation near thc north side and the sides of
the excavation on the castl and west sides. We, understand that this waterline services the residence to the
east and the line was br6ken during excavation for the basement and bas been temporarily repaired.
Portions of the waterlm'e am suspended in air as the pipeline traverses betweim the excavation sides and

the bottom of the excavation.
EXCAVATION STABLILM
The excavation contains near -vertical portions and the overall slope inclination appears to be
Significantly steeper than A 2H: 1V (hod=tal : vertical) slope. In our opinion, the excavation is overly
steep and threatens the adjacent driveway to the north. Sloughing and failure of material into the
excavation could be expected to continue and could undermirie the south portion of the driveway on the
north side of the excavation. This could present a hazard to vehicles traversing the driveway. In our
opinion, the present situation presents a danger to any vehicle traversing the south side of the 15 ft wide
driveway. At this time, we reconunend that 1he t=Wmry fence or other tern porary barricades be moved
so that vehicle traffic is prevented from access to at least the southerly 6 ft width of the chiveway, It will
also be important that the driveway be monitored for signs of cracking or settlement that could be
warning signs of movement that could Ruther endanger the stability of the 4hiveway. If such signs are
observed, it my be appro I priate to prevent all vehicle traffic on the driveway iintil the adjacent excavation
is backfilled or otherwise� stabilized by shoring.
Worker safety in and around the excavation is the responsibility of the contractor. Howcvc�.,-., we
note that the excavation i I s steeper dm that prescribed by WISRA, and according to WISHA excavation
requirements (WAC 296 '155), should either be flattened or terMorary shoriq, provided.
WATEMM STABiLriy
The waterlme has been temporarily repaired, but is presently exposed and partially suspended
near the base of the excavation. Should sloughing of the excavation side slopes or movement of
construction equipment �arnage and break the waterline, the release of water could potentially resi3lt M'*
erosion of the slopes at! the base of the excavation and Airther reduce tho stability of the temporary
excavation. It would be prudent to protect and relocate this waterline as soon as it is practicable.

98026. A few weeks ago, the developer -who ownd Lot 17'(address is 18019
69th Pl. W), began construction. '
When I came home from an extended business trip this Friday, there was dirt
in my water. I ran my faucets for about an hour, and it cleared up
somewhat. However, there are still solid particles in the water from all my
pipes and faucets.
I am concerned that during the course of the digging on Lot 17, they have
managed to nick, or otherwise disturb my water line. I would like to see
this fixed before they pour the foundation, and bury the damaged water pipe.
Could you please advise me on what I can do to remediate this situation?
