The Critical Areas Checklist contained on this form is
to be filled out by any person preparing a Development
Permit Application for the City of Edmonds prior to
his/her submittal of a development permit to the City.
The purpose, of the Checklist is to enable City- staff to
determine whether any potential Critical Areas are, or
may be, present on the 'subject property. The
information needed to complete the Checklist should
be easily available from observations of the site or data
available at City Hall (Critical areas inventories, maps,
or soil surveys).
An applicant, or his/or representative, must fill out the
checklist, sign and date it, and submit it to the City.
The City will review the checklist, make a precursory
site visit, and make a determination of the subsequent
steps necessary to complete a development permit
application.
Please submit a vicinity map, along with the signed'
copy of this form to assist City staff in finding and

Dear Mr. Bowman,
The Estates at Olympic View Crest Homeowners Association wishes to express
several concems regarding the construction of lot 17.- There appears to be several
issues that are not in compliance with erosion control measures and safety standards.
The private road has been undermined due to a 10 — 12 foot deep cut along the edge
of it. There appears to be a loss of the road base. The plywood safety barrier that
was constructed was ineffective in that it blew into the lot sometime during the night
of September I O'h. Larry Seitz was notified the following day, via fax, that this had
occurred. So far, there has been no effort to rectify the problem.
The Association is concerned about the long term stability of the road. We request
that corrective measures be implemented to restore the integrity of the road base. We
also request that a maintenance bond naming the homeowners association as
additional insured be posted by WestarDevelopment for any future maintenance or
repair of the road, should additional settlement or deterioration of the private road
occur along the edge of property line.
Another area of concern is the exposed soil, There appears to be a lack of proper
erosion control in these areas.
Finally, the existing water line that serves the lower lot 18 has already been damaged
during the excavation, leaving the homeowner with soil in the water and a risk of
contamination. The locate wires have been broken and the line is lying on the
ground resulting in the potential for additional damage during subsequent
construction activities. The water line must be adequately supported to prevent any
future damage and needs to be subsequently backfilled with sand or pea gravel
during the backfill process to prevent any future damage to this service. Also, the
locate wires need to be repaired adong the length of this water line. It appears as if

the water line has already been patched in with a new section. We are curious as to
if this work meets the City of Edmonds standards.
The Association is asking that you enforce the proper erosion control measure,
construction requirements and safety standards during the construction of this lot
and not to allow work that creates a hazard to the community and or exposes the
community to future liability and replacement costs for the private road -

This is in response to your letter dated September 13, 2004, Denise and Ricardo
Schwedhelm's letter dated September 12, 2004, and Padmaja Vrudhula's e-mail dated
September 12, 2004, all expressing concerns regarding the private development project at
18019 69h Place West.
The City has investigated the concerns expressed in the above correspondence and taken
the following actions:
Issued a Correction Notice to Westar Construction, the builder of the project at
18019 69'h Place West, directing them to do the following:
o Remove the dirt that is covering the water meters.
o Properly and completely cover the stockpiled dirt on the site with plastic
sheeting and anchor the plastic sheeting in place.
o Support and protect the exposed water service line (that serves 18021 69"'
Place West), and repair or replace the water service line per City
standards.
0 Issued an Order to Correct Violation to Westar directing the following actions:
o Immediately install lighted barricades along the access driveway serving
18015, 18017, and 18021 69'h Place West.
o Obtain the services of a licensed geotechnical engineer to perform a
detailed site investigation and submit a plan that includes temporary and
permanent erosion control and slope protection measures and monitoring.
o Immediately perform any work deemed emergency by the geotechnical
engineer.
o Report any additional slope sloughing or failures or driveway undermining
immediately to the City Engineer.

Provided written notice to the property owners of 18015, 18017, and 1802169'
Place West informing them that the City's geotechnical engineer has conducted a
site inspection and determined that the excavation is overly steep and threatens
the driveway serving their properties. It also notified these property owners that
the City Building Official has directed Westar to barricade the access driveway to
prevent vehicles for using the southerly 6 feet of its width and that these property
owners are not to use this southerly 6 foot width of the driveway for vehicles
pending further geotechnical investigation.
We will continue to monitor this situation until all corrective actions have been
completed. If any of your Homeowners' Association members have questions, I would
ask that you please coordinate them through you to avoid duplication and submit them to
me in writing at the above address or by e-mail to me at bowman@ci.edmonds.wa.us. I
will make sure that you get a prompt response.

This is in response to your letter dated September 13, 2004, Denise and Ricardo
Schwedhelm's letter dated September 12, 2004, and Padmaja Vrudhula , 's e-mail dated
September 12, 2004, all expressing concerns regarding the private development project at
18019 69h Place West.
The City has investigated the concerns expressed in the above correspondence and taken
the following actions:
Issued a Correction Notice to Westar Construction, the builder of the project at
18019 69h Place West, directing them to do the following:
o Remove the dirt that is covering the water meters.
o Properly and completely cover the stockpiled dirt on the site with plastic
sheeting and anchor the plastic sheeting in place.
o Support and protect the exposed water service line (that serves 1802169'
Place West), and repair or replace the water service line per City
standards.
Issued an Order to Correct Violation to Westar directing the following actions:
o Immediately install lighted barricades along the access driveway serving
18015, 18017, and 18021 69th Place West.
o Obtain the services of a licensed geotechnical engineer to perform a
detailed site investigation and submit a plan that includes temporary and
permanent erosion control and slope protection measures and monitoring.
o Immediately perform any work deemed emergency by the geotechnical
engineer.
o Report any additional slope sloughing or failures or driveway undermining
immediately to the City Engineer.

Provided written notice to the property owners of 18015, 18017, and 18021 691h
Place West informing them that the City's geotechnical engineer has conducted a
site inspection and determined that the excavation is overly steep and threatens
the driveway serving their properties. It also notified these property owners that
the City Building Official has directed Westar to barricade the access driveway to
prevent vehicles for using the southerly 6 feet of its width and that these property
owners are not to use this southerly 6 foot width of the driveway for vehicles
pending further geotechnical investigation.
We will continue to monitor this situation until all corrective actions have been
completed. If any of your Homeowners' Association members have questions, I would
ask that you please coordinate them through you to avoid duplication and submit them to
me in writing at the above address or by e-mail to me at bowman@ci.edmonds.wa.us. I
will make sure that you get a prompt response.

Your letter contains severaiamportant
First, you were required to obtain a variance because you proposed to construct a structure in the street
setback, not because that structure was potentially to be constructed over a city utility easement. You would
have been required to seek this variance regardless of whether or not a city easement and/or sewer line
existed in the area in which you sought to build your shed.
Secondly, further research reveals that a utility easement was dedicated facing the plat for "all utilities
serving the subject plat ' -... "under and upon the exterior ten feet parallel and adjoining the street frontage of
all lots ... in which to install, lay, construct, renew, operate and maintain underground conduits, cables, pipe
and wires with necessary facilities and other equipment..." This easement was dedicated by the plat of
Olympic Crest Subdivision. Therefore, the first ten feet of your lot abutting the Olympic View -Drive right of
way is already burdened with a blanket utility easement.
The engineering and public works departments are attempting to locate the sewer line with reference to the
easement. Wq will need your,permission to come onto your property to locate the sewer line in
relation . ship[p.. to.the ten foot utility easem' ent. Please let me know your schedule so I can have the
engineering and public works employees schedule a time to do the field study.
When I have received the report of the public works and engineering department regarding exact location of
the* sewer line, I will be in touch with you. I will work with you to resolve this matter. If the sewer line is
located outside of the easement, the City will honor its constitutional and statutory obligations and acquire
any necessary additional area easement from you. It is important, however, to understand that the steps
which you have gone through were necessitated by your request for a variance from the zoning code and
were not required because of the sewer easement or lack of an easement.
