G. TECHNICAL COMMITTEE 1. The application was routed to the Engineering Division, Fire Department, Public Works Department, and Parks and Recreation Department. The following are the comments received: a) Facts: (1) The Fire Department noted "Hydrant needed at end of culdesac. Hydrant on 180th needs to be moved (stays). (Per ECDC 19.75.140)" These comments have been incorporated into the Engineering Division requirements. (2) The Public Works Department has commented "Need a utility plan to review. Public Works request that a watermain be installed from 181s' Place SW/Olympic View Drive to 1801h Street SW/691h Avenue W." (3) The Engineering Division has submitted comments and requirements for the development of the proposed plat (see Exhibit A, Attachment 4). b) Conclusion: The applicant must incorporate the required improvements into the civil engineered site development plan. DECISION Based upon the foregoing findings and conclusions: 1. The proposed height modifications for lots 15,17 and 20 are APPROVED with the following condition: a) Provide landscaping in the right-of-way of 180th Street SW adjacent to proposed lot 20 similar in density and materials to the landscaping proposed around the detention pond for the earlier Planned Residential Development (see Exhibit A, Attachment 13). This landscaping shall be carefully placed so as not to restrict vision of drivers using the intersection. A plan of the landscaping shall be submitted to the Planning Division for review and approval prior to final plat approval. The landscaping must be in place prior to a building permit being approved for construction on Lot 20. 0* 09 R F- C E.7 I V E r) MODIFICATION REQUEST 1999 PERMIT COUNTER Request for modification of building height for lots 15, 17, and 20 We are proposing to construct a 20 lot formal subdivision. The site is a comer lot at the southwest comer of 180'h St SW and Olympic View Drive. The majority of the site is nearly flat, 'With steep slopes in the northwest comer. In our original application to the City, our design took access from Olympic View Drive, where the site is flat. We had almost no problems with access or site design with the access in that location. Unfortunately, Olympic View Drive is in the City of Lynnwood, and Lynnwood refused to grant the right-of-way access permit for Olympic View Drive. Therefore, we have been forced to redesign the site layout with access on 18e St SW. 18& St SW rises from Olympic View drive at a slop of 12%, while the adjacent portion of our site remains flat. Where the northern portion Of OUT site rises to meet 180th Street Southwest the slope is between 25% and 33%. The maximum allowed slope for a street serving more than 4 lots is 12%. Therefore, a great deal of grading will be required to install a roadway off 18(yh St SW. In drafting the proposal we find that several lots adjacent to and east of the proposed new road would require fill material in excess of 15 feet deep. The Community Development Code requires building height to be measured from the elevation of natural grade, with a maximum of 25 feet of height allowed. In the case of the lots to be filled, this would leave a maximum building height of 12 to 13 feet. Obviously this creates problems in siting buildings on those lots. Therefore we are asking for a modification of the allowable building height on lots 15, 17, & 20 Modification for lot 15: Description of Proposal: The road grading will necessitate the raising of the grade elevation of lot 15 as shown on Modification attachment 1. The profile is taken through the center of the lot from the proposed access road to the east property line. The profile indicates a fill depth of 8 feet at the western setback and 0 feet at the eastern setback. This leads to an average elevation increase of 4 feet. Therefore, we are requesting a variance to allow a 29-foot building height as measured from the natural grade, where a 25-foot building would be required for lot 15. Modification for lot 17; Description of Proposal: The road grading will necessitate the raising of the grade elevation of lot 17 as shown on Modification attachment 2. The profile is taken through the center of the lot from the proposed access road to the east property line. The profile indicates a fill depth of 13 feet at the western setback and 3.5 feet at the eastern setback. This leads to an average elevation increase of 8.25 feet. Therefore, we are requesting a variance to allow a 3 )3.25-foot building height as measured from the natural gra de, where a 25-foot building would be required for lot 17. Modification for lot 20; Description of Proposal: The road grading will necessitate the raising of the grade elevation of lot 20 as shown on Modification attachment 3. The profile is taken through the center of the lot from the proposed access road to the east property line. The profile indicates a fill depth of 16.8 feet at the western setback and 3.5 feet at the eastern setback. This leads to an average elevation increase of 10. 15 feet. Therefore, we are requesting a variance to allow a 35.15-foot building height as measured from the natural grade, where a 25-foot building would be required for lot 20. ATTACHMENT 11 00 #6 0 Compliance with criteria for approval: A. Special Circumstances: That, because of special circumstances relating to the property, the strict enforcement of the zoning ordinance would deprive the owner of use rights andprivileges permitted to other properties in the vicinity with the same zoning. The site contains special circumstances due to the steep slope adjacent to 180'h Street Southwest. The majority of the site is flat at approximately the same elevation as Olympic View Drive. 18& St SW rises from Olympic View drive at a slop of approximaltyl2%. Where the northern portion of our site rises to meet 1801h St SW the slope is between 25% and 33%. As stated above, Olympic View Drive is located in the City of Lynnwood, and Lynnwood has refused to grant an access to Olympic View Drive limiting our access to 18& Therefore, there are special circumstances related to the topography and the surrounding uses. B. Special Privilege: 7hat the approval of the variance would not be a grant of special privilege to the property in comparison with the limitations upon other properties in the vicinity with the same zoning. We are requesting a variance to allow the proposed future buildings a height of 25 feet as other buildings in the vicinity would be allowed. We are not asking for this modification to achieve a better view or to gain a sales advantage over our neighbors, but rather, to allow us to achieve a viable building height due to the installation of the proposed road. Ordinarily the Codes of the City of Edmonds require the building height to be measured from natural grade. This is presumably to provide predictability in view blockage, and encourage builders to utilize the natural topography wherever possible. In this case we are forced to change the natural topography to install the road to access our site. By granting this modification request, builders would have a set height limit based on the new topography, just as other houses in the vicinity have had. Therefore, the granting of the proposed modification would not be a grant of special privilege. C. Comprehensive Plan That the approval of the variance will be consistent with the comprehensive plan. The proposal is to build new single family residences that will be compatible with the surrounding uses and buildings. The comprehensive plan calls for single family development in this area. Therefore the proposal is consistent with the Comprehensive Plan. D. Zoning Ordinance 7hai the approval qf the variance will be consistent with the purposes of the zoning.ordinance and the Z017e district in which 1he property is located. The proposal is for new single-family residences in a single-family zone. Our proposal complies with all of the zoning requirements except for the requirement for which we are requesting relief Additionally, the granting of the proposed height variances will not result in taller buildings, but rather buildings that comply with the intent of the zoning ordinance with heights of 25 feet from the finished grade. Therefore the proposal is consistent with the Zoning Ordinance. 00 . so E. Not Detrimental 7hat the variance as approved or conditionally approved will not be significantly detrimental to the public health, safety and wetfare or injurious to the property or improvements it? the vicinity and same zone. The proposed variances will not create houses with more height from the grade, thus no towering houses that dwarf the surroundings will be created. Additionally, there are no views in the area that will be blocked or harmed in any way. Therefore the proposal will not be detrimental to the public health, safety and welfare or injurious to the property or improvements in the vicinity. F. Minimum Variance That the approved variance is the minimum necessary to allow the owner the rights enjoyed by other properties in the vicinity with the same zoning. The proposed road will be installed at a maximum slope of 12% with 14% slope for the driveways. These slopes are proposed as they are the maximum slopes allowed by the City of Edmonds Community Development Code. Therefore, the fill and finished grades proposed cannot be avoided with the road proposed in the present location. We also explored placing the proposed access road in other locations including accessing off Olympic View Drive, and accessing further to the east on 180" St SW in order to avoid the large amount of fill on site. Neither of these access proposals were feasible. We originally designed our plat to access onto Olympic View Drive. Olympic View Drive is within the City of Lynnwood, and Lynnwood has refused in writing our request for access to Olympic View Drive. Therefore, the option of accessing with a nearly flat road is closed to us. We further explored other possible locations for locating the access road on 180' St SW. In other locations we found that if we were able to avoid the large amount of grading for the roadway access, the grading would then be required for individual lot construction, leading to the same problems that we are faced with now. The City has investigated the concerns expressed in the above correspondence and taken the following actions: 0 Issued a Correction Notice to Westar Construction, the builder of the project at 18019 69th Place West, directing them to do the following: • Remove the dirt that is covering the water meters. • Properly and completely cover the stockpiled dirt on the site with plastic sheeting and anchor the plastic sheeting in place. • Support and protect the exposed water service line (that serves 1802169" Place West), and repair or replace the water service line per City standards. * Issued an Order to Correct Violation to Westar directing the following actions: o Immediately install lighted barricades along the access driveway serving 18015, 18017, and 18021 69th Place West. o Obtain the services of a licensed geotechnical engineer to perform a detailed site investigation and submit a plan that includes temporary and permanent erosion control and slope protection measures and monitoring. o Immediately perform any work deemed emergency by the geotechnical engineer. o Report any additional slope sloughing or failures or driveway undermining immediately to the City Engineer. * Incorporated August 11, 1890 * 0 Provided written notice to the property owners of 18015, 18017, and 1802169 'h Place West informing them that the City's geotechnical engineer has conducted a site inspection and determined that the excavation is overly steep and threatens the driveway serving their properties. It also notified these property owners that the City Building Official has directed Westar to barricade the access driveway to prevent vehicles for using the southerly 6 feet of its width and that these property owners are not to use this southerly 6 foot width of the driveway for vehicles pending further geotechnical investigation. We will continue to monitor this situation until all corrective actions have been completed.
