We have attached what the city is requesting us to do —applying for an encroachment permit and to purchase liability insurance for a fence that was taken away maliciously by a neighbor (Tony Shapiro) who illegally trespassed into our property and upon removing the fence which was installed in 2002 per a survey done by Lovell-Sauerland and started storing his personal items on our property. We are currently suing Mr. Shapiro for his actions. This request by the City, for us to apply for an encroachment permit and to purchase liability insurance seems to be an extremely biased treatment towards us —yet again. We applied for this fence permit on 11/22/2010 and we still do not have a resolution. Mr. Shapiro applied for a permit for a far larger construction project, which is still in progress today on July 27, 2010 — he was granted a permit on 8/2/2010 (only 5 days). Furthermore according to our attorney's letter to Mr. Shapiro's attorney (attached) with regards to ou'r lawsuit against Mr. Shapiro, it appears that Mr. Shapiro's sewer line is connected to the city's main sewer line that runs through our property in the City's utility easement. As our attorney, Mr. Adams states in the attached letter, the City owns a utility easement on our property —not Mr. Shapiro. Does the City have permission to extend their utility easement rights to other residents of the City without permission from us? Please see our attorney's letter (attached). Did the City grant permission to Mr. Shapiro to enter our property without our permission? In summary, we need to understand where we stand regarding our fence permit. Number: 27041800202000 Determination: Study Required Determination #: CRA-2010-0040 Applicant: Elena Shippen Owner: Elena Shippen BACKGROUND During review and inspection of the subject site, it was found that the site contains and/or is adjacent to critical areas, including Geologically Hazardous Areas, pursuant to Chapters 23.40 and 23.80 of the Edmonds Community Development Code (ECDC). The subject parcel is fairly level. However, there is a short, steep slope immediately to the north which slopes down to Olympic View Drive. According to the City's LIDAR data, the grades near the northern edge of the parcel range from 15% to greater than 75%, which qualifies the slope as both an erosion hazard area and a landslide hazard area. This report applies to the entire subject parcel. Depending on the location and type of project proposed relative to the identified critical areas, additional studies may be required. ALLOWED ACTIVITIES AND EXEMPT DEVELOPMENT PROPOSALS Certain activities are allowed in or near critical area buffers as specified in ECDC 23.40.220. Similarly, certain development proposals may be exempt from Critical Areas Requirements (ECDC 23.40.230). If you have any questions about whether your proposed development qualifies as an allowed or exempt activity, please contact a Planner for more information. GENERAL CRITICAL AREA STUDY REQUIREMENTS Critical Areas Reports identify, classify, and delineate any areas on or adjacent to the subject property that may qualify as critical areas. They also assess these areas and identify any potential impacts resulting from your specific development proposal. If a specific development proposal results in an alteration to a critical area, the critical areas report will also contain a mitigation plan. You have the option of completing the portion of the study that classifies and delineates the critical areas and waiting until you have a specific development proposal to complete the study. DEVELOPMENT PROPOSALS ASSOCIATED WITH EROSION HAZARD AREAS Development within an Erosion' Hazard Area must meet additional criteria. • For erosion hazard areas with suitable slope stability, the only critical area study needed is an erosion and sediment control plan prepared in compliance with the requirements set forth in Chapter 18.30 ECDC as part of the construction documents. This option is- at the director's discretion, per Edmonds Community Development Code section 20.80.050.G. • In areas where the slope, stability is not suitable, projects within Erosion Hazard Areas will require a report by a licensed Geotechnical Engineer or other qualified professional. Note that it is important for the report to be prepared by a qualified professional as defined in the ordinance. • Report requirements are given in ECDC 23.80.050, and more generally in ECDC 23.40.090. D. • Development standards are given in ECDC 23.80.060 and 23.80.070. , STUDY REQUIREMENT — LANDSLIDE HAZARD AREA It appears that this property contains or is adjacent to a Landslide Hazard Area. • A Landslide Hazard Area is any area with a slope of forty percent (40%) or steeper and with a vertical relief of ten (10) or more feet (except areas composed of consolidated bedrock). • Landslide Hazard Areas are further defined and illustrated in ECDC 23.80.020.6. • In addition to the general requirements for Critical Areas reports referenced above, specific Critical Area report requirements for Landslide Hazard Areas are provided in ECDC 23.80.050. DEVELOPMENT PROPOSALS ASSOCIATED WITH LANDSLIDE HAZARD AREAS Development is restricted within a Landslide Hazard Area and its buffer. • Projects that will intrude into these areas will require a report by a licensed Geotechnical Engineer. • The criteria that are applied depend on the amount that the buffer is reduced. • The buffer can be reduced to a minimum of ten (10) feet (with an additional 15' building setback per ECDC 23.40.280) if a report is prepared that meets the standards listed in ECDC 23.80.050. The alteration must also meet the requirements listed in ECDC 23.80.060. 2 • In addition, proposals to reduce the buffer to less than ten (10) feet must comply with the design standards listed in ECDC 23.80.070.A.3. File No. S-9-65, Marie D. Brandt This was a request for a four -lot subdivision on Olympic View Drive, to be served by an extension of Sunset Way. Affidavit of Poster in file. Mr. Leroy Middleton was present to represent Mrs. Brandt. It was proposed by the applicant that the 20' wide extension of Sunset Way, now a private road leading to Olympic View. Drive and shown on the subdivision sketch in red, be dedicated to the City, along with an additional 20' bordering the proposed Lots A, B, C, and D. This would then extend the 40' r/w of Sunset Way an additional 258 feet, with the remainder to Olympic View Drive a 20' r/w. Mr. Larson commented on the inadequacy of the right-of-way, but concluded that it is a rough area where little traffic is found. After further discussion, it was moved by Mr. Haines, seconded by Mr. Thompson, that the subdivision request of Marie D. Brandt, File No. S-9-65, be,,approved as submitted, subject to the dedication of street right-of-way as proposed in her application o ion carried. Plats File No. P-1-65, "Nelson's Addition ,Division N1", Stuart Nelson (Cont'd from 3/17/65) Letters from the Health Officer and the City Engineer with recommendations for develop- ment of the plat were read. Mr. Haines reported that he had made an inspection of the area. A quit claim deed had been received by the City for the west half of the proposed 82nd Ave. W., shown on the preliminary plat as "To be Deeded". The east half of the road will be in the plat. A recommendation had been received from the City Treasurer's office that the name of the plat be changed, as working with the plats and records becomes confusing with a number of divisions. It was moved by Mr. Payne, seconded by Mr. Sater, that the preliminary plat of "Nelson's Addition, Division N1", File No. P-1-65, be approved subject to the recommendations of the City Engineer and the City Health Officer, and that the name of the plat be changed. The Public Works Department has determined that the electric power lines are located on the opposite side of Olympic View Drive and that, therefore, the Public Utility District is not concerned about the tree impacting electric service. They have also advised me that the telephone and cable TV companies do not have tree trimming/removal programs and that the tree in question is not considered a high risk to fall on the road or disrupt City underground utility lines. Since the tree in question is located on private property, it appears that this is a civil matter between you and the owners of the private property at 18101 Sunset Way. In discussing this matter with your neighbor, please note that, before performing any tree cutting, they should consult with the City Planning Division to determine whether a tree cutting permit is required by Chapter 18.45 of the Edmonds Community Development Code. These procedures shall apply to tree removal and/or trimming within the City right- of -way by any individuals or entities other than the City of Edmonds. These procedures do not apply to tree removal or trimming performed by the City Public Works Department, Parks and Recreation Department, or Fire Department in the course of routine maintenance/repair of public facilities or emergency response situations. Permit Required. A Right -of -Way Construction Permit is required for any party other than the City for any/all removal or trimming of trees located within City right-of-way under any of the following conditions: • Any removal or trimming of a "street tree" asdefined- in the City Street Tree Plan (See Note 1) • Any removal of tree(s) as defined in ECDC 18.45.040Q. (Note 2) •, Any trimming of tree(s) above a height of eight feet above the ground as measured from the downslope side of the tree. • Any trimming of tree(s) requiring or using equipment other than hand held equipment. • Any trimming or removal of trees of any size that will result in any branches or portions of the.tree falling within the traveled way (e.g., street, sidewalk, etc.) of the City right-of- way. A Right -of -Way Construction Permit is also required for any removal or trimming of trees (of any size) on private property if the trees or branches will fall into the traveled way (e.g., street, sidewalk, etc.) of the City right-of-way during the tree removal or trimming, or if any equipment other than hand held equipment will occupy the City right-of-way during the removal or trimming. Criteria for Approval. City policy governing the removal/trimming of trees is contained in City Council Resolution 418, ECDC Chapter 18.45 (Land Clearing and Tree Cutting Code), and ECDC Chapter 18.85 (Street Trees). Copies of these documents are attached. Removal or trimming of trees located in City right-of-way as delineated above will be approved only if one of the following conditions is met: •. Only a licensed and bonded contractor or a utility company may apply for and obtain a right of way permit, with the exception that, if the work will include only trimming of branches using hand equipment and no branches will fall in the traveled way (street, sidewalk, etc.) of the right-of-way, the property owner(s) may apply for the right-of-way permit. Only contractors authorized to represent the owner(s)(or the owner(s) themselves) of the property abutting the City right-of-way upon which the trees are located or a utility company may apply for a right-of-way permit for tree removal or trimming. Such applications shall be reviewed by the Public Works Department, Parks and Recreation Department (for impact on City Parks and the City Urban Design Plan), Planning Division (for critical areas and land clearing permit requirements), and Engineering Division prior to approval or denial by the Engineering Division. Marketable Timber. If the tree removal or trimming involves marketable timber (See Note 4), the owner(s) of the property abutting the right-of-way upon which the trees are located (or the authorized contractor/agent for the owner(s))or the utility company requesting the permit shall be required as a condition of approval to compensate the City for. the market value of the timber as documented by submission of at least three quotes/bids from tree removal contractors experienced in removal and sale of marketable timber. Having lived in this house for half a year we have observed some of the influence that weather patterns have on this subject tree. We are concerned about the stability of this tree for the following reasons: 1. Unmanaged condition: this tree continues to grow in an hazardous state with dangerously overloaded branches overhanging Olympic View Drive, an adjacent telephone pole, and our Property 2. Tree(s) is situated almost over a sanitary sewer line, which runs down the hill to Olympic View Drive. The unstable nature of this tree(s) and its the root structure, can expose this sewer line, (and the adjacent storm and water lines) to dangerous consequences. 3. Tree(s) overhangs Olympic View Drive and due to its unstable, miss managed condition, can easily fall.onto the road. This can especially'be true during stormy conditions such as we experienced earlier this spring. 4. Telephone Pole: this tree is adjacent to a pole that can also be easily impacted by branches and the tree falling in a northward direction. This area of town is constantly impacted by power outages, (we lost power for approximately 22 hours earlier this winter due to weather related conditions), some of which can be attributed to trees such as this one. 5. Our house is situated in such a place that, should this tree fall to the SE, both floors of our house would easily be impacted. Our neighbors, the Shippens refuse to address the condition of this tree and we are therefore appealing to the City to exert some influence on the unsafe condition this tree places our house, the public who use Olympic View Drive, and the City of Edmond's utilities, which share an easement on our common property line.. I have enclosed some photos to better describe these conditions. At your request and with the permission of the Shippens, Thomas Marshall, the Senior Field Technician working at the Shapiro residence, visited the Shippen property to evaluate the reported ground movement along the north edge of their backyard. SITE OBSERVATIONS On October 16, 2002, we visited the site at 12:30 in the afternoon to perform our field reconnaissance. We met with Elana Shippen, who walked us through their backyard and showed us the area in question. We performed an extensive walk through of the backyard and the slope along Olympic View Drive below and made the following observations: 1. Numerous ground cracks up to 2 inches wide and several feet in length were observed running roughly east west along the fence at the north edge of the backyard. The area of cracking extended along the entire east -west fence line and was primarily located within 6 to 8 feet of the fence, inside the property. The area within 4 feet of the fence also exhibited some signs of vertical displacement or "slumping" as much as 6 inches. Several small sinkholes were also observed in a few locations beneath and outside the fence line. 2. Close examination of the cracks and slump scarps showed many to be eroded and have vegetation growth on the failure surfaces indicating that the condition had been occurring for some time and was an ongoing process. We spoke with Mrs. Shippen regarding this and she said that within a year of them moving into the house approximately ten years ago, there was an occurrence of ground movement with cracking and slumping in the same manner as the present condition. She said they simply filled the cracks and lawn back to grade to correct the problem. OFFICES ACROSS ASIA, AUSTRALASIA, EUROPE, NORTH AMERICA, SOUTH AMERICA • f • • Mr. Anthony D. -2- January 17, 2003 013-1685-001.000 We were told that the distressed area was at the northeast cornea- of the site adjacent to the Shapiro property, but we noted that the cracks and slumping extended to the northwest corner of the yard, which is over 100 feet from the closest area of soil compaction with the vibratory roller. It was observed that the entire length of the Shippens back fence and the fence of the neighbor to the west leans downslope at 10 to 20 degrees from vertical, which also indicates an extensive condition of ongoing slope movement or "creep". 4. We observed that approximately 10 feet north of the back fence and extending from the east to the west property line, the yard fill soils are retained by a four to five foot high wood wall which rests on the slope and is constructed of 2x8 planks stacked on edge and supported by a combination of metal fence stakes and 2 inch pipes driven into the slope. It is also braced at intervals by older wooden 2x4 rakers, which are embedded in the slope below the base of the wall. Much of the wall appears bowed and distressed with a 10 to 20 degree lean from vertical similar to the fence above. The wall distress and the varying ages of the supports indicate that movement of the yard fill has been occurring for years. We also observed that considerable quantities of yard waste had been dumped over the fence for some time, which was piled along the top and base of the retaining wall. The slope below the Shippen property is overgrown with blackberries, brush and small trees, many of which lean down slope in a similar manner to the Shippens fence and retaining wall. We walked along the base of the slope and observed that the toe of the slope had been removed by the road cut for Olympic View Drive to a height of at least six feet with a slope of about 1 /2h: l v. Tile removal of this toe without any form of shoring or support, initiated a downslope movement of the soils above at the time of the road construction, as the slope above seeks a new angle of repose. The additional load placed on the slope by the Shippens yard fill simply accelerated this condition. CONCLUSIONS The results of our observations have led to the following conclusions: 1. The observed signs of soil cracking, slumping, and structural distress in the fence and retaining wall indicate that the fill placed north of the Shipper residence has had an ongoing stability problem since the construction of the house. Discussion with Mrs. Shippen confirmed this. 2. The lack of support for the road cut along Olympic View Drive on the slope below the Shippen property only increases the problem, with the placement of additional fill and piles of yard waste increasing the slope loads even further. 3. The Shippen house does not appear to be at risk as it is most likely founded in a out through the surficial slope soils into the underlying dense glacial soils, which are generally very stable. 4. Filling the cracks and regrading the yard would be advisable to prevent rainwater and surface runoff from entering them and exacerbating the condition. However, Golder Associates January 17, 2003 Mr. Anthony D. Shapiro -3- 013-1685-001.000 in view of the extent of the stability problem, it will continue until a more permanent solution is applied. The retaining structure described above is not an engineered structure. It appears that the homeowner constructed it to retain poorly placed fill, as noted by PanGEO. This structure is showing considerable signs of distress and has a limited life. Therefore, it is our opinion that the fill retrained by this wooden structure should be removed along with the structure. SUMMARY While it is possible that vibration from construction equipment at the adjacent site may have initiated another episode, in our opinion, it is very unlikely considering other factors and the age of the movement. The continuing movement of the slope and fill soils on the Shippen property have been moving for at least ten years, and were initiated by any number of actions including heavy rain, earth tremors, the placement of additional material beyond the fence, even vibrations from large vehicles on Olympic View Drive. The continuing nature of the slope creep movement makes it a virtual certainty that some degree of ground movement will continue to occur on the slope until either the slope achieves repose or some form of permanent support measure is taken. Therefore, the uncontrolled and uncompacted fill, and retaining structure should be removed as soon as possible. It has been a pleasure working with you.
