Subject: Permit #970689 Easements I
The Engineering Division does not believe the City needs to require an easement from the
property owner of Lot 2 of Short Plat S- 17-91 for access to Lot 1. A plan was approved for
Lot I by Jamal on June 6, 1997 with no access easements required from Lot 2 to meet City
standards for access width. The only easement referenced on the approved drawing was for a
temporary slope easement on Lot 2.
Grading and Rockery permit number 970689, approved August 21, 1997, allowed Mr. Sand, the
legal owner of Lot 2, to install a rockery and grade Lot 2 adjoining Lot 1. This additional
turnaround for Lot 1 was not needed to meet ECDC standards for development of Lot 1. The
Engineering Division has no reason to prohibit the property owner of Lot 2 from removing the
pavement installed next to Lot 1. Engineering has no requirement for either property owner to
give the other an easement for common use of the asphalt surfaces created outside of the
common property, Tract X.

INTRODUCTION
GENERAL
'Ibis letter providesa supplement to my original report for your planned short plat in the City of
Edmonds. I was not provided a site grading 'Plan at the time the original report was prepared. You
have now provided me with a site grading plan, in addition to a copy of the review comments by the
engineering firm, Landau and Associates, who is reviewing the geotechnical aspects of the project for
the City of Edmonds. My original report for this project was dated June 13, 1991.
The site is currently an empty lot. You plan to parcel the site into 4 lots. A copy of the grading
plan that you have provided to me is attached to this report. A low area exists on the northwest comer
of the site adjacent to Olympic View Drive. The remainder of the site slopes moderately to steeply up
to the south and east from the low area dnd Olympic View Drive. A drainage Swale traverses the site
from the southeast to the low area in the northwest. The low area is also fed by a creek just off site to
the west. The creek is then channeled into a culvert that flows under Olympic View Drive. My
original report discussed various types of fill placement, foundations and wall designs. These were
intended to be preliminary recommendations in order to plan site development. Those
recommendations are still valid and can be used for future site planning.
PLANNED GRADING
I understand that your current plan is to fill the drainage Swale and low area where the culvert is
located. The lots would then be sold and the individual lot owners would be responsible for final
grading. The intent is to use clean (free of organic matter and debris) soil as fill and place it in a
moderately compact form. You do not intend to place. the fill as an engineered compacted fill. We

have discussed that a fill embankment. -slope in the low area near the west property line would not be
suitable if it was constructed with non -compacted fill. The alternative is to use a structural fill berm or
to fill the entire low area level. You have decided to fill the entire low area to level and not create a
fill embankment in this area based on this discussion. You currently have an easement to fill the low
area on the adjacent property. The future structures are expected to be founded on piles or piers that
extend through the fill and into the underlying dense or stiff Whidbey Foundation. The deep
foundations will be designed when the individual lots are developed. The design of measures to
stabilize the upper soils on the steeper portions of the site will also be part of the final plans for
individual lot development.
The steeper portions of the site (in the south) are considered unstable with respect to shallow
failures. Some of these soils appear to be derived from fill that was placed on the top of the slope
when the property to the south was developed. These failures were discussed in the original report and
would need to be stabilized during final site development. The methods used to stabilize these features
should be incorporated into the final site grading.and design. The original report identified methods
for stabilization (slope angles, walls, geogrid walls). You indicate that you do not intend to stabilize
these slopes at this time but to inform potential buyers that this will be a requirement of final grading.
The axis of the swale to be filled slopes at an approximate angle of 12 degrees. The final fill
surface slope is to be inclined at 14 degrees down to an elevation of about 230 where is will be sloped
only to facilitate drainage of the fill surface. The surface soil conditions expected in this area are silty
fine sands. A site grading plan is attached as Figure 1. Figure 2 shows a cross section through the
swale indicating the existing ground surface slope and the expected depth of fill.
REVIEW OF LETTER BY LANDAU AND ASSOCIATES
'Me original report discussed site stability and landslide hazards. These items were further
discussed in the review by Landau and Associates. It is important to note that the report states that it
is my opinion that the fractures observed in the lower portion of the Whidbey formation were tight and
did not exhibit recent (po st glacial) movement. Soils in the upper portion of this unit appears to have
loosened and should be considered unstable. The depth to the intact fracture zones observed in the test
pits was on the order of 2 to 6 feet. These soils can be stabilized with engineered structures. It is my
opinion that the probability portion of City Ordinance 2261 does not apply. My interpretation of that
ordinance is that it was written for areas that have a recent history of deep landslide failures, such as
the Meadowdale complex. This type of failure cannot be economically stabilized to bring to a standard
factor of safety and some type of risk is assumed by the owner.. I have not observed any evidence of
deep, instability, at the site. Providing that the recommendations in my original report are followed, the

stability with respect to deep failures should not be changed. The deep stability would be most
effected by a deep non -shored cut at the base of the slope. Based on the current grading plans this
does not appear likely, however, this is intended to be reviewed at the time the site is developed. 'Me
shallow instability noted on the steeper slopes will have to be addressed and stabilized during final site
development. This is not a probability issue as discussed in the ordinance. Ilese conditions need to
be stabilized to what is considered standard engineering practice for retaining soils.
CONCLUSIONS AND RECOMMENDATIONS
GENERAL
I It is my opinion that the grading planned as proposed is a reasonable approach to site
development. 'Me inclination of the existing ground surface is low with respect to the shear strength
of imported soil. This assumes that the fill surface will be near level through the low area. If a slope
is to be constructed in the northwest comer near the property line, it would have to be evaluated for
stability. Most likely, a fill slope near the property line would have to be properly compacted to
engineering standards with minimum dimensions determined by analysis. I have not provided
recommendations for construction of a structural fill embankment since this option is not intended to be
used. Although the fill is not to be compacted to engineering standards, it should be moderately
compacted using spreading equipment. It should have the ability to withstand truck traffic. 'Mat is,
fill placement should be stopped if trucks cannot cross the fill surface for access.
I expect that fill placed with this type of operation will most likely be fine grained and very
moisture sensitive. Fill placement may be difficult and not appropriate if the site soils are too wet for
nominal compaction. I expect that some weaving and rutting under truck traffic will occur during
placement.
The recommendations provided in the original geotechnical report can still. be used for design of
the development for individual lots. However, once the site grading plans are determined for the
individual lots they should be reviewed by a geotechnical engineer. The engineer should provide
recommendations and perform additional explorations as needed based on his or her review.
A storm drain is to be routed down the center of th e swale. I recommend that a subsurface drain
be incorporated into this storm drain. It is currently difficult to justify a drainage blanket under the
entire fill mass on the upper portion of the swale as it is relatively shallow in depth and slope angle.
However, placing the drain within the storm trench would help if any water does seep toward the
swale. Also, if any future wet areas are observed during site development, drains could be installed in
these areas and routed to the subdrain in the swale.

SITE PREPARATION
The sloped portion of the site to be filled should be stripped of surface vegetation prior to
filling. This material can be placed- within the low area if desired. Any abrupt topography in the low
area should be graded such that there is a transition from the upper to the lower elevation. It may be
necessary to construct a road into the area to be filled if the fill- placement is attempted when the on site
soils are wet. This road should be constructed of 2 to 4 inch rock spalls. The thickness of the road
will be dependent on the condition of the on site soils and the anticipated truck traffic. This should be
evaluated at the time the fill is placed.
FILL PLACEMENT
The fill should be placed by spreading it in uniform lifts and compaction with the placing
equipment. I recommend spreading the fill in minimum I foot thick layers and compaction by moving
equipment over the fill surface. 'Me spreading in lifts is intended to reduce the potential of creating
voids in the fill. The compactive effort can be made by the spreading equipment, truck traffic and
specialized compaction equipment. The fill does not require significant compaction effort to achieve
the necessary strength for -the planned slope. However, the more compactive effort put into the fill the
better it will perform with respect to support of temporary and permanent access ways and concrete
slabs. A well compacted fill surface that is not disturbed when wet can recover for construction
equipment access much faster than a loose fill that has been exposed to rain.
'Me fill surface should be sloped to drain so that it does not pond water. It would be prudent to
compact the fill surface after major spreading is done and fill will not be placed for some time. Ibis is
particularly true at the end of the summer when the fill materials will be most easiest to compact.
FILL PERFORMANCE
The fill placed as described should be expected to settle for several years after placement. It is
not uncommon to observe on going settlements and structural distress of improperly founded structures
on fill 30 years after the structure was completed. Typically, structures on this type of deposit are
founded through the fill into native soils by overexcavation or by drilled piles or piers. Slabs and
walkways not supported on piles should be expected to continue to settle. All concrete slabs placed on
this fill should be reinforced to resist expected differential settlement. The design of individual lots
should allow for the differential settlement between pile supported structures and non -pile supported
walkways. Ile use of "transition" slabs should be used.when necessary. A transition slab is a
suitably reinforced slab that is hinged at the pile supported structure and the other end floated on the
fill. Driveway pavements should be flexible such as asphalt to allow for future settlement. Also, site
drainage grades should be accentuated so that future settlements do not effect surface drainage.

The design of future fill embankments or retaining walls will be influenced by the presence of
the fill. 'Me actual impact cannot b; determined until the final grading foroach lot is determined and
the depth of fill at the embankment location is determined.
DRAINAGE
As discussed in the GENERAL section, I recommend that a subsurface drain be incorporated
into the storm water trench. A typical drain section is shown on the attached Figure 3. The drain
should be routed into the storm system at the base of the slope. The intent of the drain is to allow an
outlet to any subsurface water that is flowing in the swale. This drain could be tied into at the time of
future development if seepage areas are observed on the slope. Ibis drain should be used ONLY for
ground water. Surface water should not be routed into a subsurface drain.
USE OF THIS REPORT
This report has been written for Albert and Norma Sand for their use in obtaining a short Plat
for their site. Ibis report is a supplement to and should be attached to the previous investigation
report, dated June 13, 1991.

9 INTRODUCTION
This report presents the results of my geotechnical engineering investigation for your planned
short plat in the city of Edmonds. The site is located south of Olympic View Drive, just west of 88th
Avenue West. You have retained me to investigate the site and provide recommendations for
development. For use in my study you have provided me with a photocopy of a topography map of
the site showing potential building lot lines and house locations.
The site is currently undeveloped. You plan to parcel the site into 4 lots, as shown on the Site
Plan, Figure 1. Currently you do not have a planned . grading scheme for the site, but you anticipate
filling the lower portion of the site to create the two northernbuilding lots. An access driveway and
potential cuts will be necessary for the southern two lots, particularly the southwest lot. I understand
that you expect some of the grading to be done by the individual home builders as part of their site
development.
SCOPE
The purpose of my services on this project is to explore site surface and subsurface conditions
and to provide you with recommendations for the planned development. Specifically, my services
include:

SITE CONDITIONS
The site slopes moderately to steeply up from Olympic View Drive to the south and east. A
drainage-swale traverses the site from the southeast to the northwest. This swale empties into a low
area just off site created by a creek from the southwest. The creek is then channeled into a culvert that
flows under Olympic View Drive. A single family residence is located on a fairly level bench on the
parcel just northeast of the site. Another residence is located above the steep slope, just south of the
site. The site has been cleared of most of its trees and brush except along the east and west edges
The upper slopes are covered with berry vines and horsetails are scattered over most of the site.
The geology of the Puget Lowland was sculpted by a series of ice ages. Ile last ice advance in
the region is referred to as the Vashon Stade of the Fraser glaciation. Ile ice is thought to have
attained a thickness on the order of 5,000 feet thick and to have retreated from the Puget Sound region
about 10,000 years ago. The weight of the glacial ice compacted previously deposited geologic units
during the occupation. The geologic unit found on site is interpreted to have been deposited prior to
the last glacial advance during a time when the Puget Lowland was impounded with water. Locally,
this unit is termed the Whidbey Formation.
The subsurface conditions were explored by excavating 8 test pits using a track mounted
excavator hoe. The test pits ranged from 3.5 feet to 9 feet in depth below the ground surface. The
test pits were located in the field by hand measurements, using the topography data supplied. The
location of the test pits are shown on the Site Plan, Figure 1. A subcontracted geologist was used to
monitor the excavations and maintain logs of the soils encountered. The soils were visually classified
in general accordance with the Unified Soil Classification System, a copy of which is shown on Figure
2. The logs of. the test pits are presented on Figures 3 through 7. Laboratory testing was not
performed for this project.

The site was found to be underlain by very stiff to hard silt with varying amounts of clay. This
soil deposit is interpreted to be the Whidbey Formation. 'Me upper portion of this deposit was
observed to be fractured and sheared. Most likely these fractures were created during ice movement
through the area as they were tight and appeared glacially consolidated at depth. The upper portion of
this unit appears to have "loosened" and water has infiltrated the fractures. Ibis loosening is most
likely due to rebounding of the soil after removal of the ice load. Some weathering of this material is
also evident. Above the Whidbey Formation in Test Pits 2 and 3 we encountered a dense silty sand
whi I ch is interpreted to be a glacial drift, material that was deposited at -the base of the glacier.
Although the Whidbey was not encountered in these test pits it is expected to also underlie this portion
of the site. The upper soils contain landslide debris and fill. The landslide debris is most likely
associated either.with failures of the upper weathered zone of the Whidbey or with fill slopes. The fill
consists of native soils created by past grading on site, and possibly the site to the south.
As part of the site investigation I walked the fence line at the top of the slope on the south
property line and observed the site conditions. Scarps on the order of 6 to 12 inches in height were
observed along the top of slope. These scarps appeared to be associated with shallow failures of the
upper steep slope. A concave slope feature at Test Pit 4 is interpreted to be a failure that contributed
to the slide mass found in Test Pit S. The growth of the alder trees indicates that this failure is fairly
recent, estimated to be within the last 10 years.
Ground water was observed in some of the test pits within the upper weathered and failed soils.
This water is essentially perched on the underlying silt and is the result of infiltration of surface water
within the drainage basin. It is not inter
.preted to be associated with a regional ground water table. I
would expect this water to vary seasonally, however, the only way to determine if it dries up during
the summer is to explore the ground water conditions at that time. The horsetail plants observed on
site indicate that the site surface soils remain wet most of the year.
CONCLUSIONS AND RECOMMENDATIONS
GENERAL
The project site should be compatible with the planned development provided that site grading
and construction is designed and implemented to maintain and/or increase the existing site stability.
The fractures found in the unweathered lower soils appear to be tight and not to have moved since they
were formed d uring the last glaciation. Therefore it is my opinion that the lower soils are relatively

stable. The movement in the upper soils is interpreted to be due to rebound of the soils, after the ice
unloading, which allowed water to enter the fractured areas. These fractured areas which have
"relaxed" and water been infiltrated by water are considered much weaker than the underlying soils
that have not relaxed. The lower fill that is planned against the roadway embankment should increase
the overall stability of the site because it should buttress the hillside. This fill should be placed and
properly compacted in order to provide the desired hillside support. Grading for residences on the
upper portion of the site should take into account the current instability of the surficial soils. All cuts
should be supported either by a engineered retaining wall or by a properly constructed buttress fill.
Note that the wall pressures provided in this report are substantially larger than those used for standard
retaining wall design. Buttress fills may be constructed of reinforced soil if desired. Soil
r6nforcement is a technique used to provide a structural soil mass with a steep face. This soil mass
has the ability to act as a buttress. Although it is not known at this time if soil reinforcement will be
necessary on site, I have included a general section covering the basics in this report.
SITE PREPARATION AND GRADING
Site grading in the lower portion of the site should, at a minimum, consist of removing the
vegetative layer prior to placing fill. If buildings are expected to be placed on top of the fill, the upper
soft or disturbed soils should be removed prior to placing the fill. I recommend that I be retained to
evaluate the subgrade preparation with respect to the planned future use because the depth of the fill
planned for a specific area, and the type of use (support of structure, yard area, etc.) will influence the
site preparation. Ile fill should be keyed into the slope using a system of benches. These benches
usually have a width dimension that will allow access for earthmoving and compaction equipment. I
recommend that all fill on site be placed ass- structural fill, except that which is specifically identified in -
the design as not influencing slope stability.
STRUCTURAL FILL
All fill placed on site should be structural fill and should be placed to buttress the hillside.
Isolated small fills that may not need to meet this requirement may be identified during design, but
based upon present planning I recommend that all fill meet minimum compaction standards. Structural
fill is fill that is placed and compacted in a uniform manner to a specific compaction standard. The
compaction maximum dry density is determined in the laboratory. In place density tests are taken as
the fill is placed and they are then compared to the maximum. Unless otherwise stated, all reference
to percent compaction in this report is based on the maximum dry density as determined by the ASTM
D-1557 compaction test standard.

Structural fill should be free of debris and organic contaminants. Ile fill should be spread in
uniform.lifts, not exceeding 10 inches in maximum thickness and compacted to a firm non -yielding
condition. Fill in building areas and within two feet of roadway subgrade should be compacted to 95%
of its maximum dry density. All other fill, unless otherwise stated, should be compacted to 90% of its
maximum dry density. Prior to placing fill, the subgrade should be prepared as outlined in the SITE
PREPARATION AND GRADING section of this report.
The onsite soils are extremely moisture sensitive and will disturb easily when wet. This will
influence both site preparation and the use of onsite soils for fill. It would be best to place fill on site
only during the dry portion of the year. Site preparation when the site is wet will requir e additional
expense, such as the use of clean imported sand and gravel, spalls or filter fabric. Since the horsetails
on site indicate year round.moisture, it may not be possible to avoid some use of these materials.
If the onsite soils are observed to be too wet for construction traffic, clearing and site
preparation should be done with a large excavator type hoe using a smooth bucket. Traffic should be
kept off of the stripped surface until the first lift of fill is placed. The thickness of the first lift should
be determined in the field based on the site conditions and the planned use of the area. Ile benches
for keying the fill into the hillside should also be excavated using the excavator.
SHORING AND TEMPORARY CUTS
I expect that cuts will be used, particularly on the south lots, in order to construct the building
and driveway areas. I should be retained to review each of these planned cuts to provide an evaluation
of their potential stability and of the permanent retaining system. Some of the temporary cuts may be
made without support. However, this will not only be site specific, but also time of year specific. All
cuts should be stabilized with a permanent -retention system as soon as possible. Cuts in some areas of
the site should only be attempted during the dry part of the year unless more expensive shoring i s
used. Shoring design should be based on site specific conditions and planned excavation.
Earth movements can be associated with any cut, in almost all soil conditions. The amount and
relative movement is what can cause damage to adjacent properties. I recommend that adjacent
properties be documented for condition prior to excavation so that any future claims that are purported
to have been caused by the excavation have baseline data from which to judge the effect of the
excavation on the structure. I also recommend that survey points be placed upslope of the excavation
and readings be taken daily during the life of the unbraced cut. The readings should be measured to
the nearest 0.01 feet. This data would be used to trigger remedial stabilization measures in the event
that slope movement was noted.

augercast piling. These would have to be designed on a site and structure dependant basis.
RETAINING WALLS
The lateral density of the soil
pressure acting on retaining walls is dependent on the nature and
behind the wall, the amount of lateral wall movement which can occur as backfill is placed, and the
inclination of the backfill. I expect that at least the southern lots will have existing slopes above the
Walls. For walls that are free to yield at the top at least one thousandth of the height of the wall, so"
pressures will be less than if movement is limited by such factors as wall stiffness or bracing. We

for slopes with ' inclinations up to 2.5:1 (Horizontal:Vertical), Non -yielding walls should be designed
using an equivalent fluid density of �5 and 110 pcf respectively. These values do not include
surcharges such as traffic loads or other surface loads. Surcharge effects should be considered, if
appropriate. These values assume a drained condition behind the wall. The drains should be
constructed as outlined in the section below.
The above lateral pressures may be resisted by friction at the base of the wall and passive
pressure against the foundation. A coefficient of friction of 0.3,should be used to determine the base
friction. I recommend using an equivalent fluid pressure of 200 pcf for passive pressure design where
footings bear against fill. An appropriate safety factor should be applied to the above frictional
coefficient and passive pressure values.

All backfill for subgrade walls should be compacted in uniform lifts to between 90 and 92
percent of their maximum dry density. Care should be taken to prevent the buildup of excess lateral
soil pressures due I to overcompaction of the backfill behind the wall. This can be accomplished by
placing the backfill within 18 to 24 inches of the wall in lifts not exceeding 8 inches in loose thickness
and compacting this zone with hand operated vibrating plate compactors.
Permanent drainage systems should be installed for subgrade walls. I recommend that these
drainage systems consist of 18 inches of clean (less than 3 percent fines), free -draining granular
material placed along the back of the wall. A 3/8's inch pea gravel would be suitable for use as drain
material. Slotted rigid PVC drainpipe having a minimum diameter of 4 inches should be embedded
within the granular material at the base of the wall along its entire length and should discharge into
tight lines leading to appropriate collection and disposal systems.
Roof drains should be connected to a tight line system independent from the subgrade wall drain.
These drains should be routed -to an appropriate discharge point down slope.
SLAB ON GRADE
Slabs may be supported on the underlying dense or stiff soils, or on structural fill as outlined in
previous sections. I recommend that the floor slabs be underlain by 6 inches of 'free draining sand or
gravel for use as a capillary break. A suitable vapor barrier such as heavy plastic sheeting should be
placed over the sand or gravel.
GEOGR11D REINFORCED SOIL MASS
The benches that are expected to be needed for some of the lots can be accomplished by using
soil reinforced was, if desired. These walls can be used for retaining and buttressing the existing on
site slopes. The soil is reinforced by a series of geogrid reinforcements. The geogrid acts as
reinforcing within the soil mass and allows the soil to stand at much higher slope angles than normal,
or even near vertical if desired. A slope facing is necessary to prevent erosion or ravelling of the
slope. This facing can consist of wrapping the geogrid up the face with some. sort of soil barrier at the
face, placing some type of erosion fabric on the face of a steep slope, constructing rockeries or using a
product such as Keystone. You may also obtain ideas directly from the geogrid manufacturer. The
key to geogrid design is the desired geometry and the final slope facing that will be used. Once this is
determined, an analysis can be performed and the geogrid spacing can be determined. Due to the
variability of the overlying soils, I recommend that each wall be individually designed for each

a
location. The alternative is to provide a worst case design that would be used at any location on the
site.
For use in preliminary design, I recommend that a depth of embedment of the geogrid be taken
as varying from 0.6H to H, where H is the height of the wall. This will vary with several factors,
including the material behind the wall. If the wall is to retain loose fill or landslide debris, the loads
on the geogrid soil mass are increased and the length of the grids increase accordingly. Traffic loads
should also be considered.
The geogrid wall may be constructed using on site soils, but these soils will have to be
compacted to engineering standards. This could be accomplished by excavating the soils and spreading
them in the building area and allowing them to dry. After they have been dried to the proper moisture
content for compaction they may then be placed in the geogrid fill embankment. The fill should be
placed in uniform lifts not exceeding 8 inches and compacted to 93 percent of its maximum dry density
as determined by the ASTM D-1557 compaction test procedure. The on site soils are moisture
sensitive and will be impossible to compact when wet. They can also be over dried and may required
the addition of moisture. Moisture control will be important for use of the on site soils. An alternative
is to import a clean free draining fill.
The actual geogrid design will be site specific. - Most likely all of the loose surficial soils and
slide debris that may exist should be removed prior to construction of the geogrid. Ibis will be
determined based on slope geometry and expected soil conditions.

drain and a chimney drain up the back of the embankment. The drain design should be finaaed at the
time the embankment design is completed.

Critical Areas Checklist
The Critical Areas Checklist contained on
this form is to be filled out by any person
preparing a Development Permit
Application for the City of Edmonds prior
to his/her submittal of a development permit
to the City.
The purpose of the Checklist is to enable
City staff to determine whether any potential
Critical Areas are or may be present on the
subject property. The information needed to
complete the Checklist should be easily
available from observations of the site or
data available at City Hall (Critical Areas
inventories, maps, or soil surveys).
An applicant, or his/her representative, must

Dear Mr. & Ms. Sand,
The Planning Department received your letter requesting a waiver from the Critical Area
requirements for the construction of a new home one Lot 2 of S-17-91. In it you identify
the various studies and reports that were required as part of the subdivision process. It
should also be noted that a Mitigated Environmental Determination of Nonsignificance
was issued during the short plat review. Based upon the information supplied at the time
of the short plat, and Section 20.15B.040.5. of the Edmonds Community Development
Code (ECDC), additional studies related to the Critical Area requirements are not
necessary.
Section 20.15B.040 lists the exemptions and exceptions from the critical area
requirements that can be waived by staff. Item 5 states, "An application for building
permit for a lot within a development for which critical areas study had previously been
prepared; provided, that the previous study contemplated and evaluated the type of
development proposed on the lot." The survey, geotechnical report, soils test and MDNS
all qualify as elements of a critical area study.
Although the two remaining lots of your subdivision are not subject to additional critical
area study, a letter from Building Official, Jeannine Graf, to you dated October 5, 1993
indicates that portions of the Earth Subsidence Ordinance will be applied to building
permit application for the lots (attached). I strongly recommend you and potential
purchasers of the 2 vacant lots consult with Building Official Graf to obtain the specific
requirements that may be involved in construction on either lot. The properties are also
identified on the City Environmentally Sensitive Area map. Any new building permit
application would have to complete a SEPA checklist and be issued a determination.

The Building Division has concluded the initial review of the subject application. The
subdivision soils report and the Landau Associates analysis have been studied and it has
been determined that portions of the Earth Subsidence Ordinance shall be required for the
development of individual lots within the short plat.
The Landau review indicated that site instability and drainage concerns needed to be
addressed in greater detail in order to determine the type, depth And lateral dimensions of
existing landslides, fill placement and subsurface drainage. An investigation by a licensed
geotechnical engineer shall be conducted and a report prepared which includes measures
for modifying or stabilizing potential landslides and assesses.the risk of future movement.
Additional test borings including piezorneters installations may be necessary.
Subsurface draina,,e considerations and assessments shall also be addressed and called out

in the geotechnical review. All concerns and/or recornmendations shall be, discussed with
the designer and the foundation and drainage plan's shall be altered accordingly.
Other Earth Subsidence requirements that shall be imposed on this project are:
1) Lead Design Professional declaration. 2) Site specific grading plans prepared by a
licensed engineer. 3) Foundation plans prepared and stamped by a licensed engineer with a
professional declaration. 4) An applicant/owner landslide declaration. 5) A Geotechnical
declaration. 6) A Hold Harmless agreement shall be required.

20.15B.050
4. Existing and ongoing agriculture as
defined in ECDC 20.15B.020(R). Such activi-
ties shall not allow critical areas or their buff-
ers which are not currently under agricultural
use to be converted to agricultural use. Normal
and routine maintenance of existing irrigation
and drainage ditches shall be exempt except
for those ditches used by salmonids; or
$^n application for a building permit
for a' lot within a development for which criti-
cal areas study had previously been prepared;
provided, that the previous study contemplated
and evaluated the type of development pro-
posed to occur on the lot. This exemption does
not preclude city staff from conditioning a land
division permit pursuant to the requirements of
this chapter to require subsequent individual
building permit review on specific lots within
a subdivision or short plat.
B. Public Agency or Utility Exception. If
the application of this chapter would prohibit a
development proposal essential to its ability to
provide service by a public agency or public
utility, the agency or utility may apply for an
exception pursuant to this section. After hold-
ing a public hearing pursuant to ECDC
20.100.010, the hearing examiner may
approve the exception if the hearing examiner
finds that there is no other feasible alternative
to the proposed development with less impact
on critical areas, and the proposal minimizes
the impact on critical areas. Any decision of
the hearing examiner is final unless appealed
pursuant to ECDC 20.15B.170(C). Proposals
approved for an exception by this section shall
be constructed using best management prac-
tices as defined within ECDC 20.15B.020(C).
C. Reasonable Use Exception. If the apph-
cation of this chapter would deny all reason-
able use of the property, development may be
allowed which is consistent with the general
purposes of this chapter and the public interest;
provided, that the hearing examiner, after a
public hearing, finds:
1 - This chapter would otherwise deny all
reasonable use of the property;
2. There is no other reasonable use con-
sistent with the underlying zoning with less
impact on the critical area or its buffer;
3. The proposed development does not
pose an unreasonable threat to the public
health, safety or welfare on or off the property;
4. Any proposed alteration of the critical
area or its buffer is minimized to the extent pos-
sible to allow for reasonable use of the prop-
erty;
5. The proposed activity complies with
all state, local, and federal laws including
those related to sediment control, pollution
control, floodplain restrictions, and on -site
wastewater disposal;
6. The inability to derive reasonable
economic use of the property is not the result
of actions by the applicant or a predecessor in
title in segregating or dividing the property and
creating the undevelopable condition after the
effective date of the ordinance codified in this
chapter; and
7. The applicant may only apply for a
reasonable use exception under this subsection
if the applicant has also applied for a variance
pursuant to ECDC 20.15B.170(A).
Any decision of the hearing examiner
regarding this reasonable use exception shall
be final unless appealed to the city council pur-
suant to ECDC 20-15B.170(C). (Ord. 3087 §

20.15B.050 Sequence of actions.
When an application for a development pro-
posal, as defined by this title, is made, the fol-
lowing sequence of actions will be required of
the applicant and city staff prior to issuance of
any development permit. Details of the full
sequence of actions will be contained in the
administrative procedures for this title.
A. Applicant completes and subm * its a crit-
ical areas checklist, as provided in the admin-
istrative procedures for this chapter, to
planning staff,
B. Staff reviews the checklist and deter-
mines any requirement for detailed - critical
area study within' two weeks of receipt of the
