Upon review of the technical reports submitted by Shapiro & Associates regarding the subject
wetland, and comments ieceived on the staffs memorandum of recommendations dated June
10, 1992, the following is the staff decision regarding wetland delineation and mitigation
measures to be applied to the Belt Preliminary Plat and PRD of Admiralty Acres, File Nos. P-
2-90 & PRD-2-90 (see Attachments I through 5).
PAOJECT BACKGROUND INFORMATION
The approval issued by the City Council provided the following direction for review of the
final wetland report and the project design:
"Prior to commencement of any site work or the installation of infrastructure in
contemplation of final plat approval, the applicant shall, at his expense and through a
wetl * ands expert approved by the City's Planning Manager, provide a complete and
accurate delineation of all wetlands within plat boundaries which proposes any and all
mitigation measures necessary to preserve and protect the wetlands, provided, however,
that - it is expressly anticipated that such proposals may include a proposal to replace
small, insignificant and/or isolated impacted wetlands of a minor nature through. the
enhancement of dedicated public areas in the undeveloped portion of the plat. The City
staff shall use the administrative review procedures set forth in City ordinance for
review of SEPA mitigation measures in order to determine the adequacy of the
wetlands report and SEPA mitigation. The staff shall use such administrative
procedures to notify the public, provided, however, that these references to the State
Environmental Policy Act and City ordinance are intended to provide a structure for
review and not to require compliance with full SEPA review at this stage in
development. The staff's decision to approve, disapprove or modify the wetlands
delineation and proposed mitigation measures shall be appealable to the Edmonds City

Council as a staff decision in accordance with the provisions of ECDC 20.105.010 gL

The initial report prepared by Shapiro & Associates and submitted on April 2nd, 1992, clearly
indicates the presence of a wedand on the subject property, the boundaries of said wedand
comprising approximately threeluarters, of the site (see Attachment 1).
Furthermore, the map delineating the boundaries of the wetland indicated that aj)proximately
two-thirds of approved lots 2 and 3 are in fact within the wetland boundaries, with the
majority of the building pads for these two lots located within the wetland boundaries.
To compensate for the proposed elimination of the wetlands on all of the approved lots (lots I
- 4), the applicant is proposing to enhance the vegetation within the remaining wetland area,
and to create a small wetland in the southern portion of the site in an area which is currently
defined as 'uplands".

Upon review of the Council's conditions relating to wetlands review, it is clear that the
proposed lot configuration and future development on each lot would impact the existing
wetland on the subject property. In an effort to mitigate the potential impacts to the wetland it
is appropriate to consider mitigation measures to preserve and enhance the existing wetland
system to the greatest extent feasible.
On June 10, 1992, the Planning Manager issued a memorandum outlining recommended
conditions and mitigation measures which should be applied to the approved Preliminary
Plat/PRD to address the issues related. to wetlands on the subject property (see Attachment 4).
This memorandum was distributed to State agencies and parties of record for review and
comment. All comments regarding the staff recommendations were to be submitted for
consideration by June 22, 1992.
On June 22, 1992, the City received comments from Robert Tjossem, representing the Belts,
regarding the proposed wetland delineation and mitigation requirements (see Attachment 5).
No other comments were submitted.
Based on the discretion provided by the Council for review of all pertinent material and
comments, the following mitigation measures shall be required.
CONDITJONSIMTIGATION REOUBtEMENTS
In addition to the revised mitigation measures proposed by Shapiro & Associates in their report
dated May 26th, 1992 (see Attachments 2 and 3), the following additional mitigation measures
are. recommended by the Edmonds Planning Division staff-
1. Prior to the recording of the final plat documents, the applicant shall:
a. Delineate a "Native Growth Protection Easement" over
the area described as'the that area west of the proposed
eastern edge of the wetland/strearn buffer line. This area
shall also include the proposed "created wetland" at the
southern portion of the site.

Ile "Native Growth Protection Easement" shall be
prepared in a form acceptable to the City Attorney, and
shall be recorded on the face of the plat.
b. As an option to the *Native Growth Protection Easement"
described above, the applicant may choose to either
dedicate the wetland/stream. buffer area to the City; or
identify the wetland/stream, buffer area as a separate
'Tract" on the face of the plat which shall be held in
equal and undivided ownership by owners of the lots in
said plat.
C. Delineate a "Drainage Easement" which shall encompass
the biofiltration swale which is shown on the upland side
of the wetland/strearn buffer area.
The "Drainage Easement." shall be prepared in a form
acceptable to the City Attorney, and shall be recorded on
the fkm of the plat.
0 Complete all wetlands enhancements and creations, unless
bonded for by the applicant. In which case,
enhancements shall be completed within one (1) year of
the acceptance of the bond.
Have a report prepared on the hydrologic, vegetative and
habitat value and functions of wetlands in general, and
specifically, related to the presence of the wetland
adjacent to the proposed development, which shall be
submitted to the planning division for review and
approval. This report shall be recorded with each new lot
in the plat, and a copy shall be provided to the initial
purchasers of each lot.
f. Include a restriction on the face of the plat mylar which
prohibits the construction of any additional fences adjacent
to the wetland/stream buffer other than provided in these
conditions.
2. Prior to the issuance of the first building permit, the applicant shall
design and submit to the Planning Division for approval, a barrier type
fence which shall be located on the upland side of the biofiltration swale.
The barrier fence shall not exceed 6-feet in height, and shall not be in
excess of 50-percent solid. The fence shall be installed prior to issuance
of any occupancy permit for the plat.
APPEAL PROCEDURES
The staff s decision to approve, disapprove or modify the wetland's delineation and proposed
mitigation measures shall be appealable to the Edmonds City Council as a staff decision in
accordance with the provisions of ECDC 20.105.010 et. Kq.

CONDITIONS OF MITIGATION

This determination of nonsignificance is subject to the following
conditions:
I. All excavation and grading shall comply with Chapter 70 of the
Uniform Building Code, 1988 edition. The Applicant shall obtain a
grading permit from the Building Division and comply with all
conditions of permit approval.
2. The Applicant shall submit an erosion control plan for review and
approval by the City Enginieer. All required erosion control
measures shall be installed prior to any site development. The
Applicant shall be responsible to insure that the erosion control
devices are maintained to ensure their proper operation.
3. The Applicant shall submit a proposed truck route to the City
Engineer for approval prior to removal- of any excavated material.
4. The Applicant shall be responsible for keeping all streets clean
and free of debris*at all times.
5. All grading work shall be done during normal working hours of the
City of Edmonds, 8 a.m. to 5 P.m., Monday to Friday.
6. If deemed necessary by the City, the Applicant shall provide
traffic control during removal of the grading material.
7. No work shall be allowed within the stream without a hydraulics
Permit issued by the Washington State Department'of Fisheries.
8. The area designated as Open'Space on the west side of the stream
shall be clearly designated on the face of the recorded final plat
as a natural greenbelt. No clearing shall be allowed within this
area with the exception of the removal of trees that may- pose a
hazard to the public or nearby private proper or improvements.
9. A twenty-five foot buffer shall be maintained from the stream.
This area shall remain in its natural state. The only exception
will be for the removal of dead, dying, or diseased vegetation.
Any plant materials that are removed shall be replaced with This

Critical Areas Checklist
The Critical Areas Checklist contained on
this form is to be filled out by any person
preparing a Development Permit
Application for the City of Edmonds prior
to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).
An applicant, or his/her representative,
must fill out the checklist, sign and date it,
and submit it to the City. The City will
review the checklist, make a precursory site
visit, and make a determination of the
subsequent steps necessary to complete a
development permit application.
With a signed copy of this form, the
applicant should also submit a vicinity map
or plot plan for individual lots of the parcel
with enough detail that City staff can find
and identify the subject parcel(�). In
addition, the applicant shall include
other pertinent information (e.g. site
plan, topography map, etc.) or studies in
conjunction with this Checklist to assist
staff in completing their preliminary
assessment of the site.

1. The subject lot is a part of a 4 lot plat. The plat was reviewed under the
SEPA regulations and a MDNS was issued. The SEPA mitigations took
into account the strearn and wetland protections requirements found in the
Critical Areas Ordinance. Therefore, to avoid adverse impacts to the
critical areas found on site, all development must be completed in
accordance with the plat requirements and the SEPA mitigations.
Based on the above findings and conditions, the requirement for a Critical Areas Study

B. Grantee is constructing a sanitary sewer main and appurtenances on adjacent
property (the "Project") and requires the temporary use of the Burdened Property as depicted
on Exhibit A, which is attached hereto and incorporated herein as though fully set forth.
. C. Grantors are willing to grant an easement to Grantee over the shaded area of the
Burdened Property as indicated in Exhibit A ("Easement Premises") upon the terms and
conditions set forth hereinbelow. Grantee acknowledges the concerns of Grantors regarding
the impacts of the Project on the Easement Premises and adjoining appurtenant properties,
including, but not necessarily limited to, the effect of the construction on the asphalt pavement,
concretedriveways, the supporting soils, and the gravel drainage and drain tiles installed on
and adjacent to the Easement Premises.
WHEREFORE, in view of the foregoing recitals, and for valuable consideration, the
receipt of which is hereby acknowledged, the parties hereto agree as follows:
AGREEMENT
I . Temporary Easement Gra . Grantor hereby grants to Grantee, solely for the
use by Grantee or its authorized representatives and agents, a temporary construction easement
(hereinafter "Easement") to be used only during the construction of a sanitary sewer and
appurtenances on adjacent property. Subject to the terms and exceptions stated hereinbelow,
the Easement includes the right to remove trees, bushes, undergrowth and other obstructions
interfering with the construction of said sanitary sewer main and appurtenances, together with
a right of access to the Easement Premises for the stated purpose.
2. Duratio . The Easement shall be temporary and shall cease upon acceptance of
the sewer main for maintenance and operation by the Grantee.
a. Grantors shall be given a minimum of ten (10) days prior notice before
the Grantee installs equipment on or delivers equipment to the Easement Premises. Grantee
estimates the time necessary for completion of the work for the specific portion of the Project
for which the Easement Premises are required.to be a period of 5 to 7 work days. Once said
equipment has been installed or delivered, Grantee shall expeditiously and diligently pursue the
completion of the specific portion of the Project for which the Easement Premises are required,
the. period of time for which shall not exceed twenty-one (2 1) calendar days. In the event that
the equipment cannot be removed within 21 days of its installation or delivery, Grantee shall
compensate Grantors for all reasonable costs and expenses resulting from the deprivation of

access or inconvenience, including, but not limited to, a per them payment of $50.00 per
Grantor for each day that the equipment remains in place after said 21-day period.
b. Grantee shall exercise its best efforts to protect the asphalt and concrete
surfaces presently on the Easement Premises from settlement, cracks or other deterioration or
damage due to construction of the Project. Grantee shall promptly, upon request of Grantors,
investigate and repair, to industry standards and equal or better quality as presently exists, any
cracks or settlement in the asphalt and concrete surfaces which appear within three (3) years
from the date of substantial completion of construction of the Project. If upon investigation
said cracks or settlement are demonstrated by Grantee to be caused solely by forces unrelated
to the impact or construction of the Project, Grantors shall reimburse the Grantee for the
reasonable cost of such investigation (not to exceed $500) and the performance of such repairs.
C. Grantee shall exercise its best efforts to protect the drainage pipe, gravel
drainage courses and French drains serving the properties of the Grantors from deterioration
or damage due to construction of the Project. Such efforts shall include measures to prevent
and/or control dirt, mud or other oozing which could result from the construction work.
Grantee shall promptly, upon request of Grantors, investigate and repair, to industry standards
and equal or better -quality as presently exists, any deterioration or damage to such which
appears within three (3) years from the date of substantial completion of construction of the
Project. If upon investigation such deterioration or damage is demonstrated by Grantee to be
caused solely by forces unrelated to the impact or construction of the Project, Grantors shall
reimburse the Grantee for the reasonable cost of such investigation (not to exceed $500) and
the performance of such repairs.
d. Grantee shall not harm or damage the ornamental carved owl that is,
presently located on the northern side of the entrance from 76th Avenue West to the Easement
Premises, and should, after exerting its best efforts, any harm or damage occur to said owl,
Grantee shall fully repair and remedy such damage.
e. Grantee shall assure that the sewage pumps serving the Grantors'
properties shall not be stopped for a period of more than thirty (30) minutes during any 24-hour
period. Grantee shall protect from damage the sewer line connection pipes that are in the bank
and immediately repair any damage that may occur.
f. Grantee shall only operate equipment on the Easement Premises during
normal construction hours, not earlier than 7 a.m. and not later than6 p.mi. on weekdays, with
the exception of the pullback of piping being installed by horizontal directional drilling, which
cannot be interrupted, once begun, until it is completed. Grantee shall -provide an access

telephone number of the on -site inspector for the Project in order to address emergency
concerns or problems, with calls to be promptly returned within a reasonable time, but not
more than four (4) hours, or less, depending on the nature of any emergency.
9. Vehicular access to Grantors' homes shall not be interrupted for longer
than thirty (30) minutes at any one time. Should Grantors' vehicular access to their homes be
interrupted or impeded for a period longer than two (2) hours, Grantee shall arrange for secure
parking for Grantors' motor vehicles within easy walking distance and provide, alternative
transportation from such parking to Grantors' homes. . To provide Grantors an opportunity to
move their vehicles, Grantee shall give at least four (4) hours notice to Grantors before any
interruption of vehicular access in excess of ten (10) minutes.
h. Grantee agrees to and shall restore to substantially the original condition
(which shall be to Grantors' reasonable satisfaction) such improvements as are disturbed during
the Project, provided the Grantors shall not construct any new permanent structure over, upon,
or within the Easement Premises during the existence of the Easement. The restoration shall
be completed within thirty (30) days after removal of the equipment for the specific portion of
the Project for which the Easement Premises are required. Such restoration shall include, but
not necessarily be limited to, (1) replacement with plants and shrubs of suitable and similar size
and quality as are presently located on the bank adjacent and to the east of the Easement
Premises, and (2) appropriate and necessary hillside stabilization measures to stabilize the slope
where the work on the Project is performed. Any replacement plants or shrubs shall be
guaranteed by Grantee for a period of two (2) years from date of planting and replaced by
Grantee with like and like -quality plants or shrubs if they die during the guarantee period. In
the event that there is slope failure on said bank where the work on the Project is performed
which occurs within two (2) years of substantial completion of the Project, Grantee agrees to
install a suitable and acceptable retaining wall (to proper engineering standards) if needed to
prevent erosion and deterioration of the said bank.
i. Any release which Grantors are requested to execute regarding
completion of restoration of the Easement Premises shall only operate to indicate satisfaction
with such restoration as is easily visible and such shall not operate as a release of any
obligations of Grantee stated herein.
j . The Grantee agrees to save, indemnify, defend and hold harmless
Grantors from and against any and all liability, loss, damage, expense, actions and claims,
including costs and reasonable attorneys' fees incurred by Grantors in defense thereof, asserted
or arising directly or indirectly on account of or out of acts or omissions of Grantee and/or
Grantee's tenants, occupants, visitors, business invitee8, guests, agents, representatives, or

employees in the exercise of the rights granted in this Agreement, Provided, however, that
Grantors shall not be indemnified against liability for damages arising out of bodily injury to
persons or damaged property caused by or resulting from the sole negligence of Grantors. This
indemnity and hold harmless shall include, but not be. limited to, any damages resulting from
sewage overflows should such occur.
k. All manhole covers for the Project shall be of the sealed type and shall
be sealed so as to prevent the escape of effluent.
4. Binding Effec . The rights and obligations of the Grantor and Grantee hereunder
shall inure to the benefit of and be b4nding upon their respective successors and assigns . The
benefits and burdens created by this Easement Agreement shall b�6 appurtenant to and a
covenant running with the lands for the duration of the Easement as set forth above. *

This Temporary Construction Easement Agreement (hereinafter "Agreement") is made
