Dear Mr. Scalf-
This is in response to your letter to Mayor Haakenson dated August 26, 2002.

MAYOR
Pam Lemcke, Engineering Specialist, and I have met with you at your house to look at
and discuss your ' concerns regarding the fence and lawn restoration and the placement of
dirt in your back yard. In addition, we have contacted the construction contractor in an
effort to resolve your concerns, and understand that he has also met with you.
Your letter mentions that you called City offices no less than 5 times during the six
months prior to your August 26 letter. We have been unable to determine who received
your calls to the City offices. It appears that none of your calls were received by ' the
City's Engineering Division or the Project Manager for the sewer installation contract.
Unfortunately, when we received your letter and, soon thereafter, contacted the
contractor, it was well beyond the contract warranty period.
The contractor will not agree to perform any more work on your property. We agree with
the contractor's position regarding further restoration of the lawn in your back yard. It ,
has been farloo long since the lawn restoration work was completed to ascertain whether
the conditions you consider unsatisfactory are a result of the contractor's work or lack of
maintenance on your part. With regard to the placement of dirt in your yard that you
consider unsatisfactory, this was done pursuant to a separate arrangement between you
and the construction contractor. Since the City was not a party to that agreement, we are
unable to enforce whatever your agreement was and, therefore, cannot require the
contractor to do any more work on this issue.
However, we do agree with you that the quality of the installation of the two fence post
base plates is not acceptable. Unfortunately, at, this late stage, we have no contractual
remedies available to require the sewer construction contractor to correct these
deficiencies. However, we will agree to reimburse you for the reasonable cost to reinstall
thetwo fence post base plates.

To receive reimbursement from the City, please complete the following steps:
• Prior to beginning work, obtain and submit to the City Engineer three written
quotes from contractors to do the work. If we consider the quotes reasonable, we
will authorize you to proceed with the work.
• Have your selected contractor complete the work.
• Upon completion of the work, submit to the City Engineer a copy of the
contractor's bill for the completed work.
Upon completion of the above, the City will reimburse you the amount of the contractor's
bill for the repairs to the two fence posts up to a maximum not to exceed the amount of
the'lowest of the quotes received. While the City will reimburse you as indicated above,
we will not construct, supervise, or guarantee the repairs to the fence posts. It will be
your responsibility to deal directly with your selected contractor to ensure that all work is
performed to your satisfaction.
Your letter also states that you "will not pay any assessment or interest or penalties or any
other form of payment or penalty or tax...." until the City has addressed these issues with
you and come up with an agreement to resolve them. I must advise you that you are
required to pay the LID assessment, interest and any penalties charged by the City. I
strongly encourage you to make prompt payment to avoid requiring the City to pursue
collection actions through whatever remedies are available to the City as prescribed by
statute and ordinance in accordance with the Edmonds City Code.
