The hook-up was completed after the formation of and preliminary assessment for the proposed Local Improvement District (LID) in your area. However, we recognize that you would receive a limited benefit from the proposed sewer extension project associated with the LID. We will, therefore, recommend to the City Councilthat your property be removed from the final assessment roll. If the Council approves the recommendation, you will not be assessed for the LID. The final assessment hearing will take place after completion of the construction of the sewers. You will remain on our mailing list for all correspondence sent to the LID owners, including the letter regarding the final assessment hearing. Butler 19119 North Creek Parkway, Suite 113 Bothell, Washington 98011 RE: Property @, 18410 Homeview Drive, Edmonds, WA Dear Mr. Butler: GARY HAAKENSON MAYOR As a follow-up to City letter dated November 19, 2001, and my telephone conversations with you (the last on December 13, 2001) you indicated to me that you have had your geotechnical engineer look at the property but in the meantime you had found out that the 'hill is on your neighbor's property'. I informed you that the City was not in receipt of a conclusive survey from you or from the Lee's that proved this point. Therefore, the City position with regard to your property requirements for the landslide has not changed. As required by City letter dated November 19, 2001 a geotechnical report is required to be submitted for your property that discusses the landslide that occurred on or around November 15, 2001. The report must include a detailed site investigation of the slope failure and must include a plan that includes temporary and permanent erosion control, slope protection or mitigation measures, and subsurface drainage recommendations, etc. If you have a copy of a stamped survey that proves your position, I suggest that you immediately submit a copy to the City for review. Without a confirming survey the City has no knowledge of the location of the common property line and therefore is requiring identical information to be submitted from both parties of record. Enclosed is an'Order to Correct Violation Notice that requires your attention. Be advised this is the first step in the City's civil penalties process whereby fines may be levied in order to secure code compliance. The Order requires a geotechnical report and/or survey be submitted by February 4, 2002. Failure to submit by this deadline shall result in the City issuing a Notice of Civil Violation whereby fines of $100.00 per day, or portion of day, shall be assessed until this matter is resolved. It is not the City's intent to cause you undue hardship, however, compliance to the Code is mandatory for the fair and equal treatment of all citizens. Butler 19119 North Crekk Parkway, Suite 113 Bothell, Washington 98011 RE: 18410 Horneview Drive Dear Mr. Butler: The purpose of this letter is to inform yQ ' u that in response. to your tenant's inquiry on a possible slope failure and dangerous condition to the residence at 18410 Homeview Drive, City officials conducted a site inspection on November 15, 2001 and observed a surface slide of the exposed slope on your property. Accompanying City officials were representatives of Landau Associates, professional geotechnical consultants for the City. Landau Associates prepared a report on behalf of the City, and a copy is enclosed. Please note that the primary purpose of the investigation was to determine if the slope erosion created a danger to the inhabitants of your residence. According to our geotechnical engineer, there is no immediate danger to your residence or to the improvements on the upper (western) property. However, as the owner of the property you are responsible for slope protection and/or mitigation of damage suffered on your property. Pursuant to Uniform Building Code Section 3307, Excavation and Grading, the City shall require that you enlist the services of a State licensed Geotechnical Engineer to monitor the site and conduct a detailed site investigation of the slope failure. By December 14, 2001 a plan must be provided that includes temporary and permanent erosion control, necessary slope protection or slope mitigation measures and subsurface or surface drainage improvements, as applicable. Any work deemed "emergency" by the geotechnical engineer in the report, shall be immediately installed (provided no City permits or discretionary approvals are required).
