Dear Mr. Hengigen,
We have reviewed your as -built drawing of the Storm force main along with the sump
pump specs for the subject house; however, we cannot approve it as submitted. In earlier
conversations Lyle Chrisman had with you, he explained the drawings needed to be
stamped by an engineer so we could be sure the system, when installed, could handle the
impervious surface runoff. You assured Lyle that an engineer was working on it, but the
drawings submitted did not -have the required stamp on them. The engineer needs to
provide calculations that show the system can handle the runoff and maintain the required
head without burning out the motor.
Before we can final the building permit, we need the information submitted and stamped
by an engineer. If you have any questions, please call Lyle Chrisman at 425-771-0220,

Dear Superintendent of Water,
The purpose of this letter is to request a consideration for
an adjustment to my water bills over the last 6 months. During
that period of time a series of water leaks in the water line from
the meter to my house created a sizeable impact on the
apparent water use for my residence. During the summer
months I was under the impression the excessive water use was
a result of landscape watering, but by late fall it was obvious
that it was something more involved.
My plumber was contacted in late November but could not
arrange to do the investigation and work until December.
During his work he discovered and corrected leaks at each end
of the line plus additional leaks at the junction of the sprinkler
system. A copy of his bill with an explanation is enclosed,
along with copies of the last year's billing statements.
My residence has only two adults living here with both of
us working outside the home. Our normal water consumption is
little. The dishwasher and the clothes washer each are rarely
utilized more than twice a week. Daffy showering by both of us
is our main use of water. Water statements up through April,
1994, reflect an additional two adults and a baby living within
the residence.
I would appreciate any consideration concerning an
adjustment. I am aware that even with an ad ustment the
customer is responsible for the basic fee. I was told that the fee
is the amount charged to the City of Edmonds from the water

I write to you on behalf of my client, Marilyn Griffin. Based upon the
records I have reviewed and my conversations with my client,' it is my
understanding that you have been assisting her in her efforts to bring the
residence into conformance with the requirements of the uniform building
code, uniform mechanical code and uniform electrical code. As I am sure
Marilyn has made you aware, she is currently in litigation with her former
husband. The thrust of that litigation is that he either concealed known
material defects in the residence from my client and the appraiser that was
used during their dissolution proceeding, and/or there was a mutual mistake
of fact that served as a basis for the settlement agreement between
-Marilyn Griffin and her former husband. This matter is set for trial in the
Superior Court of the State of Washington for King County on December 8,
1988. However, because of current backlog in trial assignment, we cannot
be assured that we will be assigned to a court on that date.
I anticipate that it may be necessary to call you as a witness in this
matter. To ascertain whether that will be necessary, I would like to meet
with you at your office if possible, sometime within the next several weeks.
Upon receipt, I ask that you contact my office so that we may discuss this

Engineer's Inspection of the Residence Located at 18410 84th Ave.
W., Edmonds, WA.

On July 25, 1988, 1 inspected the single-family residence located
at 18410 84th Ave. W., in Edmonds, Washington. The purpose of
this inspection was to identify any significant deficiencies
which could contribute to long-term deterioration in the premises
and/or which would be beyond the capabilities of the average
homeowner to easily correct. The deficiencies have been
identified and the corrections listed below are recommended.
When pertinent corrections have been made, it will be ' the opinion
of the inspecting engineer that the integrity of all structures
of the premises is reasonably adequate, that no 6ignificant
infestation or damage by wood -destroying organisms and no
c . onditions likely to contribute to such infestation or damage
exist, and that the plumbing, electrical, and heating systems are
adequate to meet the requirements ofthe local housing code.
All recommended work must be done in compliance with all
applicable codes. References to Uniform Building Code in this
report are to the 1970 edition. The recommended corrections are
as follows:
Building Exterior
1. Finish installing exterior siding. This is required for
weatherproofing by Uniform Building Code (UBC) section
2516(g). See photos no. 1, 2, 3, 4, and 5.
2. Replace decayed structure under front entry steps. Provide
six inches clearance above ground, or decay -resistant wood,
asrequired by UBC 2516(c).

3. Finish installing gutters, downspouts, and soffits in
accordance with normal construction practice. When not led
away from the house, roof water will. increase tendencies
toward dampness in the basement and subsequent deterioration
of finish coverings and structure. See photo no. 6.
4. Replace a decayed fly rafter at the southwest corner of'the
house behind th ' e garage, and two decayed joists under the
narrow deck on the east side of the northeast corner. Used
lumber, painted green, was installed in these locations and
in other parts.of the house. The used lumber has deter-
iorated earlier than other -members exposed to weather. See
photos no. 6 and 7.
5. Replace a decayed beam and post under the north deck and a
decayed beam under the east deck. These members were also
used before installation. See photos no. 8, 9, and 10.
6. Provide proper flashing for windows as required by UBC
1707(b)., The installation of windows is not weatherproof,
and in some places is unfinished. Interior surfaces in
several parts of the house show stains from window leaks.
See photos no. 11, 12., 13, 14, 15, and 18.
7. Finish installing the kitchen door.to the deck as required
by UBC 1707(b). The lack of a proper sill is allowing leaks
into the wall. See photo no. 16.
8. Provide flashing where deck members penetrate siding. This
is required by UBC 1707(b).
9. Rebuild the railing for the north deck. Connections at the
deck have deteriorated such that the railing no longer
provides adequate safety. This is required by Uniform
Housing Code (UHC) section 601(a).
10. Repair the roof covering along edges above clerestory
windows to exclude dampness as required by UHC 601(b).,
Shakes are out of position over the master bedroom and
deteriorated over the garage. over the bedroom, felt is not
properly installed per UBC 3203(d). See photo no. 17.
11. Install flashing at junctions of roof and clerestory walls
as required by UBC 3208. See photo no. 5.
12. Provide six inches clearance between soil and siding in all
areas as required by UBC 2516(c).

Building Interior
13. Professionally exterminate carpenter ants. Evidence of
carpenter ant infestationvas observed in the garage and in
a railroad tie retaining wall. Insect infestation is
inadequate sanitation per UHC 1001(b), and will eventually
lead to structural damage.
14. Install windows suitable for emergency egress in two lower
bedrooms per UBC 1404.
15. Revise window installations less than 18 inches above the
floor to meet requirements in UBC 5406. Temporary boards
have been installed to satisfy the requirement. See photos
no. 18 and 19.
16. Rebuild decayed structure surrounding the hot tub. See
photo no. 20.
17. Replace a post in the hot tub room which has an infestation
of powder post beetles. Insect infestation is inadequate
sanitation per UHC 1001(b), and will eventually lead to
structural damage. See photo no. 21.
18. Reinstall structure on the north wall of the hot tub room
whi ' ch is leaning. Structurels required to be installed
true and plumb by UBC 2312(a).
19. Provide humidity control forthe hot tub room. This is
necessary to prevent decay and insect infestation as have
occurred in structure surrounding the hot tub and in a
nearby post as noted above. Humidity can be controlled in
several ways. The simplest and most effective is an exhaust
fan controlled by a humidistat and a spring -loaded vent to
admit outside air.
Electrical System
20. Finish installing electrical wiring in accordance with the
state electrical code. Unfinished wiring is shown in photos
no. 22, 23, 24, 25, and 26. If the electrical system,was
not inspected prior to covering, a governmental inspector
could require removal of coverings to prove code compliance.

Heating System
21. Finish assembling furnaces, and provide return air ducting
as required by Uniform Mechanical Code (UMC) section 706.
See photos no. 29 and 30.
22. Provide a return air duct-1 or other provisions for heat, in
the north basement bedroom. This room will not be heated
sufficiently for requirements in UBC 1410 with warm air
registers on the inner wall and no return duct.
23. Furnaces should be checked for proper operation and adjust-
ment by qualified service personnel. Both furnaces are slow
to respond to thermostat control, which is unusual for this
type of furnace.
Plumbing System
24. Finish installing plumbing and fixtures in accordance with
Uniform Plumbing Code and normal construction practice.
Unfinished plumbing is shown in photos no. 26, 27, and 28.
If the plumbing system was not inspected prior to covering,
a governmental inspector could require removal of coverings
to prove code compliance.
Limitations on Inspections
This is a special report format not intended to be fully informa-
tive as to all aspects and deficiencies of the premises.
Certain limitations apply to any inspection, including those
diligently performed by a qualified expert. The limitations on
this inspection include, but are not limited to, the following:
This inspection does not include an inspection for construction
or other materials which might be hazardous to health; such
materials may be present and not noted in this report. In some
cases, the presence of hazardous materials may.be noted in the
report, but this should never be interpreted as a complete list

of hazardous materials or their locations. This inspection does
not include any evaluation of air or water quality. Radon,
ozone, formaldehyde, or other hazardous substances may be present
and not noted in this report.
Mechanical equipment is inspected for operability only and may
contain undisclosed defects which may significantly impair its
usefulness. No inspection is made of furnace heat exchangers or
other such mechanical parts of equipment for their condition.
Hot tub equipment was not inspected.
We carefully inspect for evidence of water leakage into basements
and underfloor crawl spaces. However, the lack of evidence of
past leakage does not guarantee that there will be no leakage in
the future. We cannot reliably predict amounts of water which
may appear in damp areas, and we cannot guarantee that any
basement, underfloor crawl.space or other subgrade area will
remain dry.
This report includes references to building and housing codes.
These are ambiguous documents that leave many details to the
discretion of the inspector. It is not possible to predict how a
given representative of a governmental building or housing agency
will apply the code to each specific condition. We do not
guarantee that a.government inspector would not list some
additional violations or that a government inspector would list
all deficiencies that appear in our report.

examination of the exposed areas of the structure inspected.

described problems with sewer gas emanating from the kitchen sink
when the future bathtub drain was uncapped.
I made my best effort to evaluate the situation, but could only
speculate on the actual cause of the problem(s) because not all
of the drain and vent lines were exposed.
In order for me to determine exactly what plumbing code provisions
are in violation, it would be necessary for you to have all the
lines exposed, or provide me with an as -built schematic of the
piping prepared by a licensed plumber or mechanical engineer.

Based on your statements in that letter, and the numerous
phone conversations I have had with you and your father,
Mr. Charles David,*the City is defering enforcement of the
dangerous building abatement procedures at this time.
I would expect that you keep in close contact with the
Building Division regar ' ding the status of the repairs, and
notify us for a final inspection as.soon as the work
outlined in my letter*of January 30, 1987 is complete.

Dear Mr. Reeves:
This is written to acknowledge receipt of the above
referred letters regarding the subject address above. Tt is
to be noted that the subject permits were issued to Jim
Griffin as owner builder.
Reference "2" details Mr. Griffin's denial of
responsibility. I do not necessarily concur with details of
his letter. I am presently living at the subject address and
desire to continue to do so safely.
Reference "l" details the discrepancies remaining under
permits above issued to Mr. Griffin. I intend to correct
these discrepancies. I expect that my father, a retired
building contractor, will assist as soon as he sufficiently
recovers from a recent stroke. His present prognosis is for
an early recovery.
I have reviewed the discreoancies noted in Reference "1"
with my father. we will detail our interim and final
corrections:

1. We will cease use of this room until a second means
of egress can be effected.
2.. We elect to install safety bar.
3. The fireplace will not be used until reconstruction
to code is completed.
4. We are in the process of contracting a licensed
contractor to obtain a repair order. This will
require the attention of my father and his
experience.
5. This was in the process of correction by my father
prior to his stroke. This work will soon continue.
No cars will be parked in the garage in the interim.
6. An electrical contractor, Terry Hoyt, has been
contracted. He will request the electrical inspec-
tor to conduct an on -site inspection with intent of
implementing necessary corrections.
7. Electrical contractor will include smoke detectors
as part of his work.
8. Handrails will be installed by my father.
The above corrections will be completed as quickly as
possible. I request your forbearance to permit as timely as
possible completion. This is the only residence presently
available to my daughter and myself.

life safety code violations that must be corrected to avoid a serious
problem.
Ed, she will need financial help. She says she can't afford to make
these corrections, but we (City) can't afford legally to .,,l ' et them go
uncorrected. Can she refinance the loan? - This is not an "easy "fix"
and we can't disregard some of these code violations.

It has come to the attention of the City Building Division that work
performed under permit number 720466 &.730300 has not been completed,
and further, that serious violations of Sta-te Building and Electrical
codes exist at the residence at 18410 84th Avenue West.
A site,inspection was performed on January 22, 1987 by the City
Building Division. The following items were noted:
1. A second means of -.bedroom egress as required by UBC 1204 has not
been provided. You should cease use of these rooms as
sleeping rooms until such time as this code violation is repaired.
2. There are a number of windows adjacent to walking surfaces and less
than 18 inches above the walking surface which are not protected as
required by UBC Section 5406. These windows must be
protected by safety glazing, a safety bar 36 inches above the finish
floor, or discontinue use of the rooms or areas until the code
violation is repaired.
3. The living room fireplace is in violation of the manufacturer's
specifications for clearances to combustibles. The fireplace shoul'd
not to be used until the code violations are repaired.
4. It appears that the electrical warm air furnace is installed in
violation of the State Uniform Mechanical Code Section 706 with
regard to circulating air. Please provide the Building Division
with a repair order from a licensed contractor. (Section 1211 of
the UBC requires legal heating facilities for every dwelling unit.)

5. . There is no fire resistive occupancy separation between the garage
and the living areas as required by UBC Table 5-B, and Section 503.
You should cease use of the garage area for storage of
motor vehicles until such time that the garage/dwelling occupancy
separation is constructed and approved by the Building Division.
6. During the site inspections, no evidence of complete approval of the
electrical wiring by the State Electrical Inspector was noted.
Exposed 120 volt wire ends were observed and other hazards are
suspected. You should contact the State Electrical Inspector for
inspection and then furnish a schedule for repairs of
the electrical wiring system to the Building Division.
7. Provide smoke detectors as required by UBC Section 1210.
8. Provide handrails for stairway to lower area per UBC Section 3306.
Please contact the Building Division in writing within 5 days date of
this letter regarding your intentions.

West, Edmonds, Washington, I am hereby requesting on behalf of Jim G.
Griffin, the owner/bui lder/ contractor of record at that time, that
you will please grant an extension of those permit numbers for an
additional thirty days or longer as is deemed necessary to complete
and/or bring up to code requirements those items specified in your
letter to Jim Griffin dated January 30, 1987.
Please inform me of the necessary steps needed to be takes to obtain

The attached letter was drafted under the advice of city
attorney Scott Synder. He and I felt that the violations
listed were serious enough, and the elapsed time long enough
that drastic action should be taken.
The letter was reviewed by Community Services Director Peter Hahn
who consulted Mayor Naughten regarding the matter.
I was ordered to revise the letter eliminating the references
to the Dangerous Building Code, and to give the Griffins another
chance. Letter revised 2-2-87.

The City of Edmonds has adopted the 1985..Edition of the Uniform Code
for the Abatement of Dangerous Buildings. This code provides for a
specific process to either repair or vacate premises which are deemed
unsafe by the building official as defined in this code.
You should be aware that one provision of the Dangerous Building Code
requires that notice also be served on the holder of any mortgage or
deed of trust as disclosed by public record.
One proceedings are commenced, strict time limits are imposed. Due to
the serious nature of the code violations, it is the City's intention
to proceed with abatement procedures in accordance with State Law
unless the directives outlined in this letter are followed.
Please contact the Building Division in writing within 5 days date of
this letter regarding your intentions.

HAROLD REEVES, being first duly sworn upon oath, deposes and says:
1. 1 am a building inspector with the City of Edmonds and make
this affidavit upon personal knowledge and records maintained by the
City of Edmonds. I am competent to testify in this action. .
2. On 10-2-- 72- _1 Jim Griffin applied for and was
issued a building permit for the purposes of remodeling portions of a
house located at 18410 - 84th Avenue West, Edmonds, Washington 98020.
3. For several years thereafter, Mr. Griffin continued to renew
the license on the grounds that the remodeling had not been completed.
4. In January of 1987, it came to the City's attention that the
permit had been renewed year after year but there had been no evidence

that the remodeling project was nearing completion, nor had Mr. Griffin
in recent years requested progress inspections as required by the
building code. I therefore decided to inspect the premises to determine
to what extent the remodeling had been completed.
5. An inspector was sent out to inspect and prepare a punch list
of items that had yet to be completed before the necessary final
approval could be given.
6. The inspector found several life safety code violations which
had to be remedied immediately, including defective electrical wiring
and furnace installation, failure to install handrails and to provide
adequate exits, improper spacing between the windows and the floors,
and improperly installed fact ory built fireplace.
7. 1 informed Mrs. Griffin that the defects had to be remedied
immediately or I would have to, upon the advice of the City Attorney,
begin dangerous building abatement proceedings.
8. 1 was subsequently contacted by Mrs. Griffin's father who
promised to immediately begin repairing the defects to bring the
premises up to code if I would postpone the proceedings.
9. Mr. David was apparently able to remedy many of the minor code
violations, and because it was obvious that he was working in good
faith, we decided to temporarily postpone the abatement proceedings.
10. 1 have been to the house several times to review the work in
progress. Two major problems which have not been remedied have to do
with the plumbing and the electrical wiring. With respect to the
electrical wiring, much of' the work has been concealed behind

1 plasterboard and is not visible for inspection. I must be provided
2 with a Certificate of Inspection and approval by the State.
3 11. With respect to the plumbing, I was unable to tell exactly
4 which code provisions are in violation because it too is concealed and
5 partially encased in cement. However, it is apparent that the toilet
6 plumbing is not functioning and Mrs. Griffin is experiencing problems
7 with sewer gas escaping out of the kitchen sink.
8 12. 1 cannot give a final approval or completely alleviate the
9 threat of abatement proceedings until I receive a Certificate of
10 Approval from the state electrical inspector and the defective portions
11 of the plumbing are completely repaired and inspected, to assure that
12 the repairs meet code requir ements. Alternatively, if Mrs. Griffin
13 chooses not to use the bathroom, I must receive a certificate from a
14 certified plumber stating that the defect in the remodelled work does
15 not affect the safety and sanitation of the remainder of the plumbing
16 system. This may or may not require some demolition to expose pipes
17 for inspection.

Please provide the building division with a repair order from
a licensed contractor within 5 days date of this letter.
(Sect 1211 of the UBC requires legal heating facilities f6r

The City of Edmonds has adopted the 1985 Edition of the Uniform
Code for the Abatement of Dangerous Buildings. This code provides
for a specific process to either repair or vacate premesis which
are deemed unsafe by the building official. Unless the directives
outlined in this letter are followed, it is the city's intention
to proceed with abatement proceedures in accordance.with State law.
7. Provide smoke detectors as required by UBC Sect 1210.

Dear Mr. Walker:
As of my conversation with Don Fiene and Lyle (the building inspector) in the Edmonds City.
offices on 2/4/00, no drainage system had been submitted for approval for the subject
development. Yet the developer proceeded to install a drainage system anyway without any
approval, contrary to the requirements of Sec. 18.30 of the ECDC.
I am concerned that the unapproved drainage system has not been properly designed. The
installed system directs all tight line flow to a small concrete box about 2'x 2' which will.have
inadequate storage to:
(1) prevent the pump from "short cycling" during operation,, thus causing it to bum out
prematurely, and
(2) allow for emergency storage for maintenance or replacement of the pump under rainy
conditions.
I am requesting that no drainage system be approved unless properlysized and designed by a
Professional Engineer to take into account the above factors. Allow me call. to your attention that
the City of Edmonds "Drainage System Standards" on p. I state: "Any other type of plan [other
than the standard detention approach] must be prepared by a licensed engineer."
If this requirement is not followed, I am concerned that the existing flooding problems for our
property and other properties on 90th Ave West will be worsened over time due to inadequate
performance of the system. This is a matter to which I have called to the attention of the City of
Edmonds several times in my previous correspondence of 9/8/98, 2/9/99, and 1/24/00.
I am also requesting that you reply to me to advise the status of the above drainage system
approval, and how my concerns will be addressed.
