Background Information
In response to a citizen complaint the City investigated the subject property and found an
attached covered porch constructed without a permit. The covered porch also encroached into
the side yard setback. Ms. Vigil wanted to retain the structure as -is and requested Reasonable
Accommodation to allow the covered porch to remain in the setbacks due to her debilitating
health issues; the request was granted. A condition of approval included a clarifying Covenant to
be recorded against the property explaining the Accommodation and dispensation of property
upon her death or sale of the property. Ms. Vigil then applied for the required building permit;
however during the plan review process she chose on her own volition to demolish the covered
porch (demolition work performed without first obtaining a permit). The City converted the
covered porch permit application into a demolition permit and issued the permit on May 30,
2007. No Covenant was ever provided by the attorney who represented Ms. Vigil.
Outcome
Because Ms. Vigil demolished the covered porch the Reasonable Accommodation approval
granted by the Development Services Director on October 31, 3006 is void.
