The first point I want to address is the exclusive easement rights issue. We are not requesting exclusive easement rights from anyone. This will permit utilizatiowof space within the easement by others, providing that their activities don't interfere with the operation and maintenance of our system. The second point I want to emphasize is flexibility by the City. If you need to work around our system in order to install a private utility, the City would be willing to permit a temporary disruption of our system (provided it is restored to the original condition). Would you please contact Mr. Powell about the easement we have been discussing. If either of you have any additional concerns, please let me know so that we can discuss them. I want to get this.easement taken care of at the first opportunity, so that we can install the drainage system prior to the rainy season. WILSON, AICP, CURRENT PLANNING SUPERVISOR FROM: ED SOMERS, ASSOCIATE CITY PLANNER SUBJECT: CRITICAL AREAS STUDY FACTS AND CONDITIONS FOR FUTURE SUBDIVISION OR DEVELOPMENT CA-92-4 Lot located at 18500 High St.. Dr. and Mrs. Olav Sola have submitted a critical areas checklist for a property located adjacent to Hutt Park and addressed at 18500 High St. During my site inspection of the site, I observed a stream that flows through the southwest side of the subject property. The stream is not mapped on the Critical Areas Map and would be considered a class 3 stream. A class 3 stream designation requires a ten foot buffer from the top of the bank of the stream and a 15 foot building setback from the edge of the buffer. Therefore the Planning division required that the applicant provide the City with a critical area study which delineated the edge of the bank of the stream and showed that the proposed construction would meet the required stream setbacks. The site also contains wooded areas and areas of steep topography. The applicant has provided the City with a plan which delineates the location of the stream. The applicant has also submitted plans showing the topography of the site and wooded areas (see Attachments 1, 2, and 3). I recommend that the following conditions be required with the approval of any building permit or subdivision of the subject site: 1 . The applicant provide the City with a Native Vegetation Greenbelt Easement for the portion of the property within 10 feet of the stream bank. This easement must state that no construction of structures or driveways is allowed in the easement. Furthermore, no,alteration of the stream is allowed, and no grading, tree or vegetation removal shall be permitted in the Greenbelt Easement without prior written approval from the City of Edmonds Planning Division. 2. The applicant shall provide a 15 ft. wide Building Setback Easement from the buffer. No structures or driveways shall be permitted within the 15 ft. wide Building Setback Easement. 1; 1 3. The easements described in 1 and 2 above must be recorded with the Snohomish County Recorder's office prior to the issuance of a building permit or along with any subdivision of the property. 4. A tree clearing plan shall be submitted prior to any removal of ' existing trees on the remainder of the site. Tree removal shall be limited to driveways and building pads, and a construction fence shall be installed around trees during construction to protect the trees from construction damage.
