SUMMARY OF RECOMMENDATION AND DECISION: Staff Recommendation: Hearing Examiner Decision: PUBLIC HEARING: Approve with conditions Approve with conditions After reviewing the official file which included the Planning Division Staff Advisory Report; and after visiting the site, the Hearing Examiner conducted a public hearing on the application. The hearing on the application was opened at 11:00 a.m. December 19, 1996, in the Plaza Room, Edmonds Library, Edmonds, Washington, and closed at 11: 15 a.m. Participants at the public hearing and the exhibits offered and entered are listed in this report. A verbatim recording of the hearing is available in the Planning Division. I-- — U- 8 Z LU (n 0 Z 0 to HEARING COMMENTS: The following is a summary of the comments offered at the public hearing. From the City: Stephen F. Bullock, Project Planner, presented the staff report which recommended approval with conditions. He noted that the property is triangular in shape and has an existing right-of-way adjacent which requires a 25 foot setback. He indicated that this right-of-way will never be used as a public street. From the Applicant: Pat McDonald indicated that due to the shape of the property and the setback requirements, that without a variance the lot is essentially unbuildable. John Gamlam, representing the seller of the property (Gary & Susie DeRosa), ndicated he had talked to neighbors and that they were generally favorable. The intent is to build a home comparable to the neighborhood. From the Community: No one testified and no letters from surrounding property owners were received. FINDINGS OF FACT AND CONCLUSIONS A. SITE DESCRIPTION 1. Site Development And Zoning: a. Facts: 1) Size: The subject property is approximately 6,400 square feet in area, and is irregular in shape with 120-feet of frontage along 79th Place W. to the south and 105-feet of frontage along the undeveloped right-of- way to the east (see Exhibit A, Attachment 4). 2) Land Use: The subject property is currently undeveloped. 3) Zoning: The zoning of the subject property is Residential Single - Family - 8,000 sq. ft. lots (RS-8) (see Exhibit A, Attachment 1). Single -Family homes are a permitted primary use in this zone. t 4) Terrain and Vegetation: The subject property is generally fla to rolling and vegetated with lawn. 2. Neighboring Development And Zoning: a. Fact: The adjacent properties on all sides are cur ' rently zoned under, the, same RS-8 zone (see Exhibit A, Attachment 1). Compliance with requirement for a Variance 0 ECDC Chapter 20.15B. 180.A, states an applicant may request a variance from the standards of this Chapter pursuant to the procedures set forth in ECDC Chapter 20.8S (Variances). Chapter 20.85 of the ECDC sets forth L the mechanism whereby a provision of the Code may be varied on a case -by -case basis if the application of the provision would result in an unusual and unreasonable hardship (see Exhibit A, Attachments 3). t a. Facts: 1) ECDC Section 20.85.010 establishes the decisional criteria with which a variance request must comply in order to be granted by the Hearing Examiner. These criteria include: a Special Circumstance must exist; no Special Privilege is granted; the proposal is consistent with the Comprehensive Plan; the proposal is consistent with the Zoning Code.-L 7,71, 0! place, the lot is not large enough to put a house on (see Exhibit A, Attachment 3). • Special Privilege - This is not a special privilege in that other property owners with the circumstances would have the same opportunity to meet the variance criteria. • Comprehensive Plan - The proposal is consistent with the Comprehensive Plan in that it does not create a greater density or change the residential character of the neighborhood. • Zoning Ordinance - The proposal is consistent with the Zoning Ordinance in that it does not create a greater density or ask for any increase in lot coverage or additional height. • Not Detrimental - The granting of this variance does not appear to be detrimental to the public health, safety and welfare or injurious to adjacent properties or improvements in the vicinity and with the same zone. Minimum Variance - The granting of this variance appears to be the minimum necessary to grant the applicants the rights enjoyed by the other properties in the vicinity with the same zoning and allow for the reasonable. b. Conclusions: 1) City staff agrees that Special Circumstances exist in regards to this lot's size, shape, and location adjacent to two separate right-of-ways. The pie shape of the lot with streets on two of the three side and the associated street setbacks seriously reduces the buildable area of the lot to a size and shape that a house can not be built on (see Exhibit A, Attachment 3). 2) No special privilege will be demonstrated in granting this variance in that other variances have been granted in situations like these (see t 0 Exhibit A, Attachment 3). 3) Approval of the proposed variance would allow for the continued development of the site in a manner consisten t with the intent of the Zoning Code and the Comprehensive Plan designation of the site. 4) Approval of a setback variance on the east side of the lot will not be detrimental to adjacent property owners in that the property impacted 71 Hearing Exammer Decision Case No. V 96-135 Page 5 is the right-of-way to the east. Also, since the eastern right-of-way will never, be developed as a street because of its reduced size a street setback will never an issue for neighborhood continuity. 5) Approval of the requested variance appears to be the minimum required to allow for construction of a reasonable new single family home (see Exhibit A, Attachment 3). 6) As conditioned, the requested variance would be consistent with these review criteria. .C. TECHNICAL COMMITTEE 1. Review by City Departments a. Fact: No comments were made by other City departments. b. Conclusion: Other City departments have no initial concerns. D. COMPREHENSIVE PLAN (ECDC) 1 . Comprehensive Plan Designation a. Fact: The Comprehensive Plan designates the subject property as LOW Density Residential. b. Conclusion: The proposed project is consistent with the Low Density Residential designation in the Comprehensive Plan. DECISION Based upon the foregoing findings and conclusions, the request for a variance is approved, subject to the following conditions: 1. Reduce the east street setback 171h-feet as depicted in the submitted'site plan to provide a 7.5-foot setback from the east property line (see Exhibit A, Attachment 4). 2. This application is subject to the applicable requirements contained in the Edmonds Community Development Code. It is the responsibility of the applicant to ensure compliance with the various provisions contained in these ordinances. 3. The applicant must obtain a building permit prior to any construction. 4. The permit should be transferable. Description of Proposal As inuicateG Dy figure 1, the subject property is pie shaped with two of the three sides adjacent to a public right-of-way. However, the right-of-way to the east of the property is undersized and undeveloped, but because it is a pubic right-of-way a 25- foot street setback is required. The applicant submits that providing 25- foot street setbacks from two of the three property lines on this property creates a hardship from which they request the following variance. Reducing the required setback from 25-feet to 7.5-feet (a typical side setback) the applicant states, would resolve their problem (see figure 2). For more detail see the attached vicinity map, attachment 1, and site plan, attachment 4. C.
