Mr. John Wallace, city attorney for Edmonds, called me
the other day about your refusal to grant an easement for the
pipeline -which the city put on your property. It might be
necessary for them to bring an action of eminent domain to
condemn the property insofar as the easement is concerned.
This will be expensive to the city of Edmonds.
You also can crosscompla ' in or you can bring an action
against the city of Edmonds,for wrongfully placing the pipeline
upon your property. However, as I explained.to you over the
telephone, it is going to be difficult for you to establish
damages. In other words, you can pay $500 to an a--torney to
bring an action against the city and have the couri c or a jpry
award you $1. 1 wish you would -give me a call on this matter,
because inasmuch as you are in business in Edmonds and own
property there, I think you should cooperate with the city even
though they did make a mistake.

In reference to your letter of January 17 on the subject matter,
the following information Is supplied relative to the *war situation.
When 76th Avenue was constructed approximately two years ago,
extensions to the sanitary sewer were made at various points by constructing
laterals to adjoining properties and ending at the back of the sidewalk.
This work was done in order that sewer connections could be made without
cutting the now street improvement.
The only available connection for the Scuba Shop was located
approximately 60 feet north of the property line which would place it
adjacent to Mrs. Reynolds' property. During December, the City used a back-
boe to excavate a trench behind the sidewalk in order to locate the connection
point. This necessitated a trench construction approximately 6 feet deep and
the placement of the machinery within Mrs. Reynolds' property. After finding
the lateral, the City constructed an extension paralleling the sidewalk on4
running south to the Scuba Shop property. The trench was backfilled and the
ground woo leveled and restored to its original grade. Since the Reynolds'
property Is vacant, there was no damage 4=9 to the property. Due to the
location of a water service line and a fire hydrant, it was necessary to
construct the sewer extension westerly of the sidewalk with a slight encroach-
ment on Mrs. Reynolds' property.
We feel that this extension of the sewer, done at City expense and
without cost to Mrs. Reynolds, provides no obstruction to the development of
her property. The property -in xoned BM (Neighborhood Business) which requires
a 30-foot building setback from the rlghi�-of-wsy lint. The right-of-way line
is approximately 2h feet behind the sidewalk. We also believe that this
construction will be of benefit to the Reynolds' property as the sewer extension
from the main sewer has been located and modified to provide an easier connection
for any future buildings.

Enclosed is a sketch depicting the sever situation. Also enclosed
is a proposed utility easement which would resolve any future questions as
to the maintenance responsibility of the sewer. Would you please forward
this information to Mrs. Reynolds for resolution.
In summary, we in no way planned to 4ppropriate property from
Mrs. Reynolds and feel that our actions were necessary to provide essential
sever services and protect the street construction. If after review of this
information you feel that further action is necessary, you are requested to
direct future correspondence on this matter to the City Attorney.

Gentlemen:
We ' represent Helen Reynolds, who owns property on 76th
West in theidevelopment called Perrinville. The legal des-
cription ' of"thb property is Edmonds Sea View Tracts, Block
000 D-04, the north 100 feet of the south 152 feet of the east
125 feet of TR 107, less east 10 feet S. C. No. 106013 to the
City of Edmonds, Snohomish County, Washington.
The legal description might possibly be a little dif-
ferent that I have described herein. Mrs. Reynolds gave me
the information over the telephone, and I have not seen her
deed or real estate contract. However, there is no question
that your department and the City of -Edmonds know where the
property is.
-1 Mrs. Reynolds complained that around Christmas time,
personnel from the City of Edmonds went upon her property
on several different occasions, dug it up in attempting to
find a sewer line to service an adjoining property owner,
Richard Cline, who operates a scuba supply shop. Mrs. Reynolds
advises us that the city or its agents or someone acting under
authority of the City of Edmonds constructed a "Y" and that
Mr. Cline is to connect on the "Y" and a request was made to
Mrs. Reynolds for her to hook up to the "Y".
If the facts are as represented, the City of Edmonds
has, without permission, trespassed on Mrs. Reynolds' property,
and the City of Edmonds will be held accountable for the same.
We will appreciate your contacting us at once to -discuss this
matter with us. As an attorney who has handled a number of

matters for water districts and sewer districts, I cannot con-
ceive of the City of Edmonds or its agents or representatives
putting a sewer line on someone else's property without the
property owner's -permission. Is there something in the deeds
which provides a utility.easement of which Mrs. Reynolds is not
aware? I will appreciate your explaining the situation to me.
