When 76th Avenue was constructed approximately two years ago, extensions to the sanitary sewer were made at various points by constructing laterals to adjoining properties and ending at the back of the sidewalk. This work was done in order that sewer connections could be made without cutting the now street improvement. The only available connection for the Scuba Shop was located approximately 60 feet north of the property line which would place it adjacent to Mrs. Reynolds' property. During December, the City used a back- boe to excavate a trench behind the sidewalk in order to locate the connection point. This necessitated a trench construction approximately 6 feet deep and the placement of the machinery within Mrs. Reynolds' property. After finding the lateral, the City constructed an extension paralleling the sidewalk on4 running south to the Scuba Shop property. The trench was backfilled and the ground woo leveled and restored to its original grade. Since the Reynolds' property Is vacant, there was no damage 4=9 to the property. Due to the location of a water service line and a fire hydrant, it was necessary to construct the sewer extension westerly of the sidewalk with a slight encroach- ment on Mrs. Reynolds' property. We feel that this extension of the sewer, done at City expense and without cost to Mrs. Reynolds, provides no obstruction to the development of her property. The property -in xoned BM (Neighborhood Business) which requires a 30-foot building setback from the rlghi�-of-wsy lint. The right-of-way line is approximately 2h feet behind the sidewalk. We also believe that this construction will be of benefit to the Reynolds' property as the sewer extension from the main sewer has been located and modified to provide an easier connection for any future buildings. However, there is no question that your department and the City of -Edmonds know where the property is. -1 Mrs. Reynolds complained that around Christmas time, personnel from the City of Edmonds went upon her property on several different occasions, dug it up in attempting to find a sewer line to service an adjoining property owner, Richard Cline, who operates a scuba supply shop. Mrs. Reynolds advises us that the city or its agents or someone acting under authority of the City of Edmonds constructed a "Y" and that Mr. Cline is to connect on the "Y" and a request was made to Mrs. Reynolds for her to hook up to the "Y". If the facts are as represented, the City of Edmonds has, without permission, trespassed on Mrs. Reynolds' property, and the City of Edmonds will be held accountable for the same.
