RE: FOLLOW-UP ON TREE CUTTING QUESTIONS
Dear Ms. Pulfer:
We spoke on the phone yesterday about potential tree cutting on your parcel, particularly the
removal of one or more hazard trees. Since your property is located immediately east of Hutt
Park, I wanted to briefly outline the requirements for tree cutting in Edmonds and near Hutt Park
in particular. Hutt Park is an identified bald eagle nesting site and, as a result, the Department of
Fish and Wildlife will need to be involved with your tree removal decision.
Before reviewing the permitting process, I would like to describe the critical areas that are on or
near your parcel. A critical areas checklist was submitted in September 2004 which identified
the presence of a small stream and associated wetlands on the parcel in addition to being adjacent
to Hutt Park. Varied slopes are also present which appear to range from about 20% on the
southern portion of the parcel (which qualifies as an erosion hazard) to slopes in excess of 40%
toward the northeastern comer of the. parcel (which qualifies as a landslide hazard). Enclosed are
both the original critical areas checklist and the wetland determination from 2004. Because the
City's critical areas code was updated after these documents were submitted, the checklist and
wetland report will eventually need to be updated to make specific reference to the requirements
of the new code. I will update your critical area checklist as part of this background research; the
wetland report does not need to be updated at this time but will if future development is
anticipated on the parcel.
In addition to updating the critical areas information, you will need to contact the Department of
Fish and Wildlife to begin the process of creating a management plan for your site. DFW staff
will work with you to do that at no cost to you. The contact for DFW is Jay Shepard and I have
copied him on this letter. Please contact Mr. Shepard at your convenience and he can work with
you to get the process started. More information is available at:

As far as City permitting, there are two portions of code that could drive the process: ECDC
18.45 (tree cutting) and ECDC 23.40 (critical areas). Both sections are available at:
http://www.mrsc.org/mc/edmonds/Edmondsnt.html. The first step in the process is to have an
arborist produce a report describing the health of the tree(s) in question and locate them on a site
plan. If the tree(s) are hazardous, they may be removed per ECDC 23.40.220.C.7. They must be
replanted at a 2:1 ratio and a replanting plan must be submitted (DFW may have suggestions for
appropriate replacement species and replacement locations so that is why it is good to contact
them first).
While the City does not encourage it, if you want to remove trees that are otherwise healthy, you
can apply for a tree cutting permit as described in ECDC 18.45. Such a permit is an
administrative conditional use permit that requires SEPA review. The cost for this permit is
$1,070. Handout P46 (http://www.ci.edmonds.wa.us/bldg permits forms.stm) describes the
submittal requirements for a complete application.

SITE DESCRIPTION
Wetland Resources, Inc. conducted a wetland delineation in November of 2004 to
locate jurisdictional wetlands and streams on the approximate 0.76 acre site
located at 18610 92 ND Avenue W in the city of Edmonds, Washington. The site is
located as a portion of Section 13, Township 27N, Range 3E, W.M.
This property is bounded by 92nd Avenue W in the east and is surrounded by single-
family residences to the north, south, and east. Hutt Park borders this property ' �to
the west. This site has a western aspect, the northern portion of the property
slopes steeply from 92nd Avenue W to a Category 2 wetland and associated Category
3 stream. The southern part of this site is occupied by a single-family residence and
maintained lawn on fill soil. The fill soil appears to be as much as 10 to 12 feet deep
in places and slopes steeply at the edges. At the northern edge of the fill soil,
stormwater from 92rd Avenue W outfalls on to the subject property via a 12 inch
culvert. The stormwater drains northwest through an on -site ditch to the Category
2 Wetland. Hydrology from this culvert appears to come exclusively from the
municipal stormwater system and no wetlands or streams were located upstream.
As a result, this ditch was not flagged as a stream. Although hydrology from this
ditch drains to the on -site wetland, it does not appear that the ditch functions as
a part of this wetland due to the vertical separation caused by the fill soils
(approximately 8 feet). Category 2 wetlands in the city of Edmonds typically receive
50-foot protective buffers while Category 3 streams receive 10-foot protective
buffers from their delineated wetland edge or ordinary high water mark.
WETLAND AND STREAM CLASSIFICATIONS - COWARDIN SYSTEM
According to the Cowardin System, as described in Classification of Wetlands and
Deepwater Habitats of the United States, the on -site wetland and stream are
classified as follows:
Wetland: Palustrine, Forested Wetland, Broad leaved deciduous, Seasonally flooded.
Stream: Riverine, Intermittent, Streambed.
WETLAND AND STREAM CLASSIFICATIONS - CITY OF EDMONDS
Under ECDC, chapter 20.1513 (Critical Areas), the on -site wetland and stream are
classified as follows:
Category 2 Wetland: This wetland is less than one acre in size but greater than
2,500 square feet and has a forested wetland class. Category 2 wetlands in the city
of Edmonds typically receive 50-foot protective buffers.

Category 3 Stream: This Category 3 stream is intermittent, approximately one foot
wide, and is not used by salmonids. Category 3 streams in the city of Edmonds
typically receive 10-foot protective buffers.
In the city of Edmonds, critical areas and their buffers may be required to be
placed in a separate critical area tract or easement. The City may also require the
critical area tract to be designated "native growth protection easement". In this
case, appropriate survey markers and permanent signage shall be installed o.n the
property at the boundary of the critical areas andlor their buffers (20.15 B. 160).
BUILDING SETBACK LINE
Pursuant to ECDC chapter 20.15B a building setback line (BSBL) of 15-feet is
required from the edge of any buffer to prevent construction intrusions into the
buffer. The BSBL shall be identified on the site plan, which is filed as an
attachment to the notice on title required by ECDC 20.15B.160(B)
WETLAND DETERMINATION REPORT
Methodology
On -site, routine methodology as described in the Washington State Wetlands
Identification and Delineation Manual (Washington State Department of Ecology
Publication #96-94, March 1997), was used for this determination, as required by
the City of Edmonds during the permitting process. Under this method, the
process for making a 'Wetland determination is based on three sequential steps: '
1) Examination of the site for hydrophytic vegetation (species present and
percentage cover).
2) If hydrophytic vegetation is found, then the presence of hydric soils is
determined.
3) Determination of the presence of wetland hydrology in the area examined
under the first two steps.
Vegetation Criteria
The Washington State Wetlands Identification and Delineation Manual, 1997 edition,
defines hydrophytic vegetation as the sum total of macrophytic plant life that
occurs in areas where the frequency and duration of inundation or soil saturation
produce permanently or periodically saturated soils of sufficient duration to exert
a controlling influence on the plant species present. One of the most common
indicators for hydrophytic vegetation is when more than 50 percent of a plant
community consists of species rated "Facultative" and wetter on lists of plant
species that occur in wetlands.
Soil Criteria and Mapped Description
The Washing
,ton State Wetlands Identification and Delineation Manual, 1997 edition,
defines hydric soils as those that formed under conditions of saturation, flooding,

or ponding long enough during the growing season to develop anaerobic conditions
in the upper part. Field indicators are used for determining whether a given soil
meets the definition and criteria for hydric soils.
The soils underlying the site are mapped in the Soil Survey of Snohomish Count
Area Washington as A[derwood-Urban land complex, 8-15 percent slopes.
Alderwood-Urban land complex, 8-15 percent slopes on till plains. This unit is, about
60 percent Alderwood gravelly sandy loam and about 25 percent urban ta'nd.
Included in this unit are small areas of Everett and Indianola soils on terraces and
outwash plains, Kitsap soils on terraces and terrace ' escarpments, and Ragnar soils
on outwash plains. Included areas make up about 15 percent of the total acreage.
The Alderwood soil is moderately deep and is moderately well drained. It formed in
glacial till. Typically, the surface layer is very dark grayish brown gravelly sandy loam
about 7 inches thick. The upper part of the subsoil is dark yellowish brown and
dark brown very gravelly sandy loam about 23 inches thick. The lower part is olive
brown very gravelly sandy loam about 5 inches thick. A weakly cemented hardpan
is at a depth of about 35 inches. Depth to the hardpan ranges from 20 to 40
inches. Permeability of the Alderwood soil is moderately rapid above the hardpan
and very slow through it. Available water capacity is low. A seasonal perched water
table is at a depth of 18 to 36 inches from January to March.
Urban land consists of areas that are covered by streets, buildings, parking lots,
and other structures that obscure or alter the soils so that identification is not
possible.
Hydrology Criteria
The Washington State Wetlands Identification and Delineation Manual, 1997 edition,
states that "areas which are seasonally inundated and/or saturated to the surface
for a consecutive number of days greater than or equal to 12.5% of the growing
season are wetlands, provided the soil and vegetation parameters are met. Areas
inundated or saturated between 5 and 12.5% of the growing season in most years
may or may not be wetlands. Areas saturated to the surface for less than 5% of the
growing season are non -wetlands." Field indicators are used for determining
whether wettand hydrology parameters are met.
BOUNDARY DETERMINATION FINDINGS
Wetland Areas Wetland: This forested wetland occupies the central and
northwestern part of this site and extends off -site to the north and west.
Vegetation in this wettand is represented by a canopy that is dominated by red
alder (Alnus rubra, Fac). Understory vegetation is comprised of salmonberry (Rubus
spectabilis, Fac+), pacific water parsley (Oenanthe sarmentosa, ON), and lady fern
(Athyrium filix-femina, Fac).

Typical soils in this wetland have a Munsell color of very dark grey (10 YR 3/1) and a
texture of sandy loam from 0 to 18 inches below the surface. Soils were saturated
to the surface during our November 2004 site investigation.
Non -Wetland Areas: Upland vegetation in the northern portion of this site is
represented by a canopy of red alder and western hemlock (Tsuga heterophylla,
FacU-). Understory vegetation is comprised of red elderberry (Sambucus racemosa,
FacU, Himalayan blackberry (Rubus discolor, FacU), and sword fern (Poly4�ichum
munitum, FacU). The southern portion of this property is represented�'by
maintained lawn.
Typical soils in the portions of the property mapped as non -wet have a Munsell
color of dark yellowish brown (10 YR 4/4) and a texture of gravelly sandy loam from
0 to 18 inches below the surface. Soils sampled in the upland areas of the site were
dry during our November 2004 site investigation.
WETLAND FUNCTIONS AND VALUES ASSESSMENT
Methodology
The methodology for this functions and values assessment is based on professional
opinion developed through past field analyses and. interpretation. This assessment
pertains specifically to this, site, but is typical for assessments of similar systems
common to western Washington.
Functions and Values Components
Wetlands in western Washington perform a variety of ecosystem functions.
Included among the most important functions provided by wetlands are stormwater
control, water quality improvement, fish and wildlife habitat, aesthetic value,
recreational opportunities, and education. The most commonly assessed functions
are discussed. Assessments of these functions for the project site are provided
below.
Existing Conditions
The on -site wetland is a portion of a Category 2 wetland that extends off -site to
the north, south and west, and is associated with an intermittent Category 3
stream. This wetland stores water during periods of high precipitation and releases
it during times of low flow, helping to maintain consistent stream flows. This
wetland also serves to filter runoff from 92nd Avenue W, thus improving water
quality. Because this wetland is adjacent to and contiguous with Hutt Park in the
west, it adds to valuable open space and provides habitat for a variety of wildlife.
Functions and value of this wetland are limited by its small size, proximity to
developed areas, and the presence of trash in the wetland and buffer in the
northern portion of this property. Overall, this wetland provides a moderate level
of functions and values.

WILDLIFE
During our site investigation several species of birds were noted: American robin
(Turdus migratorius), black -capped chickadee (Poecile atricapillus), dark -eyed
junco (Junco hyemalis), song sparrow (Melospiza melodia), steller's jay (Cyanocitta
stelleri), and winter wren (Troglodytes troglodytes).
USE OF THIS REPORT
This Critical Area Study is supplied to the City of Edmonds as a means of describing
jurisdictional wettand conditions, as required by the City of Edmonds during the
permitting process. This report is based largely on readily observable conditions
and to a lesser extent, on readily ascertainable conditions. No attempt has been
made to determine hidden or concealed conditions. Reports may be adversely
affected due to the physical condition of the site and the difficulty of access
which may lead to observation or probing difficulties.
The laws applicable to wetlands are subject to varying interpretations and may be
changed at any time by the courts or legislative bodies. This report is intended to
provide information deemed relevant in the applicant's attempt to comply with the
laws now in effect.
The work for this report has conformed to the standard of care employed by
wetland ecologists. No other representation or warranty is made concerning the

CRITICAL AREAS DETERMINATION: STUDY REQUIRED (CA-04-115)
During review and inspection of the subject site, it was found that the site may contain critical
areas, including a Wetland and Wildlife Habitat pursuant to Chapter 20.15B of the Edmonds
Community Development Code (ECDC). The site also had some very steep portions, but the
survey submitted, which was done by Jeffrey Treiber of Lovell-Sauerland & Associates, dated
July 9, 2004, showed that the site did not meet the definition of steep slope in the Edmonds
Community Development Code.
STUDY REQUIREMENT — WETLAND
The site investigation has shown that the site may contain a wetland at the low portion of the
lot. Based on the above finding, a Critical Areas Study is required to determine the class of the
wetland and locate the wetland on the property.
Wetland Classification and Delineation: A critical areas consultant shall perform the
following:
o Classification of the wetland pursuant to the criteria established in ECDC Section
20.15B.060.A.5.
o Delineate the boundaries of the wetland on the site.
o State any mitigating measures appropriate to preserving and protecting the
wetland.
This part of the study shall be performed as a three -party contract with the city selecting
the consultant -and the property owner or applicant paying the fees. When you are
ready to proceed, please contact a Planner.
Wetland Mapping: After the critical areas consultant has classified the wetland and
delineated the wetland boundary, a surveyor licensed by the State of Washington must
perform the following:
o Survey and map the wetland, the buffer and the fifteen -foot building setback
(refer to ECDC 20.15B. 1 30.0 for the required buffer widths).
In order to complete this Study Requirement, this map must be submitted to the
Planning Division for review and approval.
DEVELOPMENT PROPOSALS ON A SITE WITH A WETLAND
Development proposals that encroach into the wetland buffers or building setbacks may be
allowed through the approval of certain processes. The specific process depends on the
individual site and development proposal but may include Buffer Averaging, Wetland
Replacement Ratios, a Critical Areas Variance, and/or a Critical Areas Variance or Reasonable
Use Exception. If you think that you have a proposal that may require one of these processes,
please contact a Planner for more information.
STUDY REQUIREMENT — WILDLIFE HABITAT
Since the sight is within a mapped eagle habitat area, this portion of the critical areas
study requires you to contact the State Department of Fisheries and Wildlife. The
Washington State Department of Fish and Wildlife has strict regulations for the
development of properties within 800 feet of an active and/or recent eagle nest site.
Therefore the approval of any building permits for this site shall be subject to the
requirements of the State Department of Fish and Wildlife.

Washington State Department of Fish and Wildlife prior to or with the submittal of any

to the Planning Department for review. If the Planning Department finds that the
proposed development permit will not adversely impact a Critical Area or its buffers, a
conditional waiver may be issued on a project by project basis.

SITE DESCRIPTION
Wettand Resources, Inc. conducted a wettand delineation in November of 2004 to
locate jurisdictional wetlands and streams on the approximate 0.76 acre site
located at 18610 92 ND Avenue W in the city of Edmonds, Washington. The site is
located as a portion of Section 13, Township 27N, Range 3E, W.M.
This property is bounded by 92rd Avenue W in the east and is surrounded by single-
family residences to the north, south, and east. Hutt Park borders this property,�to
the west. This site has a western aspect, the northern portion of the property
slopes steeply from 92rd Avenue W to a Category 2 wettand and associated Category
3 stream. The southern part of this site is occupied by a single-family residence and
maintained lawn on fill soil. The fill soil appears to be as much as 10 to 12 feet deep
in places and slopes steeply at the edges. At the northern edge of the fill soil,
stormwater from 92rd Avenue W outfalls on to the subject property via a 12 inch
culvert. The stormwater drains northwest through an on -site ditch to the Category
2 Wettand. Hydrology from this culvert appears to come exclusively from the
municipal stormwater system and no wetlands or streams were located upstream.
As a result, this ditch was not flagged as a stream. Although hydrology from this
ditch drains to the on -site wettand, it does not appear that the ditch functions as
a part of this wettand due to the vertical separation caused by the fiR soils
(approximately 8 feet). Category 2 wetlands in the city of Edmonds typically receive
50-foot protective buffers white Category 3 streams receive 10-foot protective
buffers from their delineated wettand edge or ordinary high water mark.
WETLAND AND STREAM CLASSIFICATIONS - COWARDIN SYSTEM
According to the Cowardin System, as described in Classification of Wetlands and
Deepwater Habitats of the United States, the on -site wettand and stream are
classified as follows:
Wettand: Palustrine, Forested Wettand, Broad leaved deciduous, Seasonally flooded.
Stream: Riverine, Intermittent, Streambed.
WETLAND AND STREAM CLASSIFICATIONS - CITY OF EDMONDS
Under ECDC, chapter 20.1513 (Critical Areas), the on -site wettand and stream are
classified as follows:
Category 2 Wettand: This wettand is less than one acre in size but greater than
2,500 square feet and has a forested wettand class. Category 2 wetlands in the city
of Edmonds typically receive 50-foot protective buffers.

,ory 3 Stream: This Category 3 stream is intermittent, approximately one foot
wide, and is not used by salmonids. Category 3 streams in the city of Edmonds
typically receive 10-foot protective buffers.
In the city of Edmonds, critical areas and their buffers may be required to be
placed in a separate critical area tract or easement. The City may also require the
critical area tract to be designated "native growth protection easement". In this
case, appropriate survey markers and permanent signage shall be installed p.n the
property at the boundary of the critical areas andlor their buffers (20.1513. 160).
BuILDING SETBACK LINE
Pursuant to ECDC chapter 20.1513 a building setback line (BSBL) of 15-feet is
required from the edge of any buffer to prevent construction intrusions into the
buffer. The BSBL shall be identified on the site plan, which is filed as an
attachment to the notice on title required by ECDC 20.15B.160(B)
WETLAND DETERMINATION REPORT
Methodology
On -site, routine methodology as described in the Washington State Wetlands
Identification and Delineation Manual (Washington State Department of Ecology
Publication #96-94, March 1997), was used for this determination, as required by
the City of Edmonds during the permitting process. Under this method, the
process for making a wetland determination is based on three sequential steps:
1) Examination of the site for hydrophytic vegetation (species present and
percentage cover).
2) If hydrophytic vegetation is found, then the presence of hydric soils is
determined.
3) Determination of the presence of wettand hydrology in the area examined
under the first two steps.
Vegetation Criteria
The Washing
,ton State Wetlands Identification and Delineation Manual, 1997 edition,
defines hydrophytic vegetation as the sum total of macrophytic plant life that
occurs in areas where the frequency and duration of inundation or soil saturation
produce permanently or periodically saturated soils of sufficient duration to exert
a controlling influence on the plant species present. One of the most common
indicators for hydrophytic vegetation is when more than 50 percent of,a plant
community consists of species rated "Facultative" and wetter on lists of plant
species that occur in wetlands.
Soil Criteria and Mapped Description
The Washinp
,ton State Wetlands Identification and Delineation Manual, 1997 edition,
defines hydric soils as those that formed under conditions of saturation, flooding,

or ponding long enough during the growing season to develop anaerobic conditions
in the upper part. Field indicators are used for determining whether a given soil
meets the definition and criteria for hydric soils.
The soils underlying the site are mapped in the Soil Survey of Snohomish Count
Area Washinpaton as Alderwood-Urban land complex, 8-15 percent slopes.
Alderwood-Urban land complex, 8-15 percent slopes on tit[ plains. This unit is. about
60 percent Alderwood gravelly sandy loam and about 25 percent urban La'nd.
Included in this unit are small areas of Everett and Indianola soils on terraces and
outwash plains, Kitsap soils on terraces and terrace escarpments, and Ragnar soils
on outwash plains. Included areas make up about 15 percent of the total acreage.
The Alderwood soil is moderately deep and is moderately weR drained. It formed in
glacial titL Typically, the surface layer is very dark grayish brown gravelly sandy loam
about 7 inches thick. The upper part of the subsoil is dark yellowish brown and
dark brown very gravelly sandy loam about 23 inches thick. The lower part is olive
brown very gravelly sandy loam about 5 inches thick. A weakly cemented hardpan
is at a depth of about 35 inches. Depth to the hardpan ranges from 20 to 40
inches. Permeability of the Alderwood soil is moderately rapid above the hardpan
and very slow through it. Available water capacity is low. A seasonal perched water
table is at a depth of 18 to 36 inches from January to March.
Urban land consists of areas that are covered by streets, buildings, parking tots,
and other structures that obscure or alter the soils so that identification is not
possible.
Hydrology Criteria
The Washington State Wetlands Identification and Delineation Manual, 1997 edition,
states that "areas which are seasonally inundated and/or saturated to the surface
for a consecutive number of days greater than or equal to 12.5% of the growing
season are wetlands, provided the soil and vegetation parameters are met. Areas
inundated or saturated between 5 and 12.5% of the growing season in most years
may or may not be wetlands. Areas saturated to the surface for less than 5% of the
growing season are non -wetlands." Field indicators are used for determining
whether wettand hydrology parameters are met.
BOUNDARY DETERMINATION FINDINGS
Wettand Areas Wetland: This forested wettand occupies the central and
northwestern part of this site and extends off -site to the north and west.
Vegetation in this wetiand is represented by a canopy that is dominated by red
alder (Alnus rubra, Fac). Understory vegetation is comprised of salmonberry (Rubus
spectabilis, Fac+), pacific water parsley (Oenanthe sarmentosa, Obt), and lady fern
(Athyrium filix-femina, Fac).

Typical soils in this wetland have a Munsell color of very dark grey (10 YR 3/1) and a
texture of sandy loam from 0 to 18 inches below the surface. Soils were saturated
to the surface during our November 2004 site investigation.
Non -Wetland Areas: Upland vegetation in the northern portion of this site is
represented by a canopy of red alder and western hemlock (Tsuga heterophylla,
FacU-). Understory vegetation is comprised of red elderberry (Sambucus racemosa,
FacU, Himalayan blackberry (Rubus discolor, FacU), and sword fern (Poly�tichum
munitum, FacU). The southern portion of this property is represented� by
maintained lawn.
Typical soils in the portions of the property mapped as non -wet have a Munsell
color of dark yellowish brown (10 YR 4/4) and a texture of gravelly sandy loam from
0 to 18 inches below the surface. Soils sampled in the upland areas of the site were
d ry during our November 2004 site investigation.
WETLAND FUNCTIONS AND VALUES ASSESSMENT
Methodology
The methodology for this functions and values assessment is based on professional
opinion developed through past field analyses and interpretation. This assessment
pertains specifically to this site, but is typical for assessments of similar systems
common to western Washington.
Functions and Values Components
Wetlands in western Washington perform a variety of ecosystem functions.
Included among the most important functions provided by wetlands are stormwater
control, water quality improvement, fish and wildlife habitat, aesthetic value,
recreational opportunities, and education. The most commonly assessed functions
are discussed. Assessments of these functions for the project site are provided
below.
Existing Conditions
The on -site wetland is a portion of a Category 2 wetland that extends off -site to
the north, south and west, and is associated with an intermittent Category 3
stream. This wetland stores water during periods of high precipitation and releases
it during times of low flow, helping to maintain consistent stream flows. This
wetland also serves to filter runoff from 921 Avenue W, thus i * mproving water
quality. Because this wetland is adjacent to and contiguous with Hutt Park in the
west, it adds to valuable open space and provides habitat for a variety of wildlife.
Functions and value of this wetLand are limited by its small size, proximity to
developed areas, and the presence of trash in the wetland and buffer in the
northern portion of this property. Overall, this wetland provides a moderate level
of functions and values.

WILDLIFE
During our site investigation several species of birds were noted: American robin
(Turdus migratorius), black -capped chickadee (Poecile atricapillus), dark -eyed
junco (Junco hyemalis), song sparrow (Melospiza melodia), steller's jay (Cyanocitta
stelleri), and winter wren (Troglodytes trogiodytes).
USE OF THIS REPORT
This Critical Area Study is supplied to the City of Edmonds as a means of describing
jurisdictional wettan - d conditions, as required by the City of Edmonds during the
permitting process. This report is based largely on readily observable conditions
and to a lesser extent, on readily ascertainable conditions. No attempt has been
made to determine hidden or concealed conditions. Reports may be adversely
affected due to the physical condition of the site and the difficulty of access
which may lead to observation or probing difficulties.
The taws applicable to wetlands are subject to varying interpretations and may be.
changed at any time by the courts or legislative bodies. This report is intended to
provide information deemed relevant in the applicant's attempt to comply with the
laws now in effect.
The work for this report has conformed to the standard of care employed by
wettand ecologists. No other representation or warranty is made concerning the
