Dear Mr. Ferran:
This is in response to your letter of July 16, 2012, requesting "approval of a non-
conforming building located at 18710 94 1h Avenue West in Edmonds." As a point of
infori-nation, the address for this property was changed in city records some years ago and
is now listed as 18626 94th Avenue West.
We have researched our records and have compiled the following chronology related to
this pro�erty:
3/13/1978 BLD 1978-019 1. Original building permit issued for new SFR.
Note on permit: "Height controlled by Ord. 1806." Foundation and shell
constructed within I st year
11/6/1978 Letter from Harry Whitcutt, Building Official, stating the elevation of the
highest ridge complies with height regulations, by inspection.
1/3/1979 'Inspector note on permit. verified house is in conformance.
1980 to 1994 At least 10 subsequent permits taken out as renewals (of previous permit)
or new permits for completion of house. No documented inspections for
these permits.
9/21/1995 Letter from J Graf, Building Official, advising latest permit has expired
and future permits will be subject to current adopted codes.
2/24/1999 Letter from J Graf advising owner of inspection status, and that height
requirements have changed. Roof will need to be lowered, or apply for
variance.

The current rules for nonconforming structures are relatively strict in Edmonds.
Specifically, Chapter 17.40.020 of the Edmonds Community Development Code defines
a nonconforming building as:
"A nonconforming building is one which once met bulk zoning standards and the site
development standards applicable to its construction, but which no longer conforms to such
standards due to the enactment or amendment of the zoning ordinance of the city of Edmonds or
the application of such ordinance in the case of a structure annexed to the city. Subject to the other
provisions of this section, an accessory building that is not an accessory dwelling unit shall be
presumptively nonconforming if photographic or other substantial evidence conclusively
demonstrates that the accessory building existed on or before January 1, 1981. In the case of a
property that was annexed after January 1, 1981, then the date shall be that of the effective date of
the annexation of the city of Edmonds. Such presumption may be overcome only by clear and
convincing evidence."
We provide the above chronology and code references for informational purposes only.
Your July 16, 2012 letter states that you are "seeking approval of a non -conforming
building," but the only way we could make such a f6rmal deten-nination is in conjunction
with a development application; in your case, that would normally mean applying for a
building permit. Although your letter does not qualif� as an application, what we can do
is provide you with an assessment of the status of the building which currently exists on
the property.
Given the history on this site, and the direction provided by the city in 1995/1999, it
appears that the current building on the site cannot be determined to be 'nonconforming.'
It doesn't appear that your letter offers any information that would contradict that
assessment. The assessment we are providing in this letter is a simple statement of how
we view the situation on the property at the present time.
/ You appear to have three avenues available to you.
If you wish to challenge bow the city is applying the nonconforming code in your case,
you could ask for a formal administrative interpretation of how the nonconforming
provisions apply to the building on the property. This interpretation would be a staff
decision appealable to the City's Hearing Examiner. You would basically attempt to
demonstrate to the Hearing Examiner bow the City is in error in interpreting and/or
applying its nonconforming rules in your case.
Given that you raise issues of 'hardship' in your letter, another option would be to seek a
variance from the City's Hearing Examiner. We cannot predict what the Hearing
Examiner's decision would be on a variance application in this case. Our own staff
recommendation on such an application would need to await the submittal of an
application, but we would point out that, in general, the criteria for approval of a variance
are not easily met. If you are interested in pursuing this option, you might want to
research other variances that the Hearing Examiner has ruled on in the past.

Of course, the most certain way to assure approval of a building permit to complete the
house would be to submit an application that complies with all current building and
zoning codes. We recognize that this would require substantial modifications to the
building envelope, but this would be the best way to eliminate the additional process and
uncertainty that would be involved in any of the other options.

I am seeking approval of a non -conforming building located at 18710 94h Avenue West in
Edmonds. When I began construction of the residence at this location the zoning code for
maximum roof height was twenty-five plus five feet. The building met code and was approved
by the Building Inspector for City of Edmonds, Harry Whicutt. To date the structure has not
been completed for occupancy, and, due to a subsequent amendment by the City of Edmonds no
longer meets current zoning standards.
The property where the home is located is steep and two of the four comers used for
rn easurement are located downhill a great distance from the two that are also below street level.
Because of this, the additional height of the building does exceed that of adjacent homes- and
does not therefore visually impact the neighborhood negatively. In addition, to bring the
building into compliance would create an undue hard�hip since an entire floor would need to be
removed, thus eliminating all of the bedrooms, compromising the homes livability and value
upon completion.
Having to alter the entire roofline of the home would also create such a huge financial burden it
would put finishing the home, which is lacking only insulation, sheetrock and fixtures and is
therefore quite near completion, in jeopardy. Over the past six months I have been taking
positive steps that would make it possible to complete this project if the City grants me a
nonconforming building permit. Your consideration in this matter is greatly appreciated.

The purpose of this letter is to recall to your attention the City letter dated September 21, 1995 (copy
enclosed) informing you of your responsibility to apply for a new building permit when you again
started work on the subject residence. Be advised in order for the City to grant a new building permit
the following is required:
1 . According to City records the framing has never been app rioved on the residence. Framing must be
approved under a new permit prior to insulation or slieetrock installation.
2. According to City records the plumbing, mechanic * al and gas systems have not been approved.
This work must be inspected and approved prior to cover underthe new permit.
3. According to City records the insulation has never been approved. This work must beapproved
prior to cover under the new permit.
4. As stated in the 9/21/95 letter, issuance of a now building permit shall require upgrade to current
building, energy'and zoning codes. Therefore, a copy of the plans conforming to current 1997
Utifform and State Building Codes shall be submitted for review and approval. A plan review fee
shall be assessed for review of compliance to the Codes based on the value of the rem'amm'g -work.
Be advised,' since th e City's height ordinance has changed to 25 feet and your building was measured
at 20 feet 8 inches the City shall require that the building height be -reduced to meet the 25 foot
maximum height limit for single family residences. However, if you desire to keep the building at the
existing height you must apply for a variance. I have included the applicable City handout for your
information, the filing fee $350.00. Please note, the City has also enacted a Civil Penalties Ordinance
whereby compliance to the Codes is enforced, a $100.00 per day penalty fine can be assessed until
'ffatters affr�solved to the satisfaction of the City. If you start your work prior to issuance of a new
permit the City shall utilize the Civil Penalties Ordinance for compliance as well as'assess double
permit fees.

According to building division records the subject permit is due to
expire on May 6, 1993. If the work is complete and ready for a final
inspection please contact the Building inspector in the Building
Division (771-0220) to schedule for an appointment.
If the work is not finished and more time is needed to complete the
project, the Permit must be renewed prior to the expiration date. A
new application form is required and a renewal fee of 112 the original
permit.fee will be charged. Failure to renew the permit or call for
inspection is a violation of Section 303 of the Uniform Building Code
and subject to penalties as outlined in Chapter 19 of the Edmonds
Community Development Code.
Please contact the building division PRIOR to the permit expiration
date at 771-0220 with regard to your intentions.

valid from one year from the date of permit issuance. Section 305 of
the 1985 edition of the Uniform Building Code, as adopted by the City,
states, "it shall be the duty of the person doing the work authorized

be doubled.
50. 07/15/99 Graf received call from Rick Wurdeman, attorney for Ferran wants to meet
tomorrow.
51. 07/16/99 Wurdeman meets with Miller and Graf says no work being done and agrees to
have Ferran contact City to schedule for an interior inspection next week
52. 07/22/99 Saterlie inspection with Ferran, verifies no work being done Stop Work Order
pulled
53. 07/22/99 Ray Martin in to see Walker (out at computer seminar) regarding an answer to his
complaint regarding the retaining wall in the easement and storm drainage on the Ferran
property Graf listened to Martins' complaints and wrote up the questions that he wanted
answered. Jana said she would make sure that Walker got the note since Martin was very
demanding in wanting an answer from the City Engineer. Jana informed Ray Miller of the
situation.

Work is rescinded
55. 07/28/99 Graf letter to Wurdeman Saterlie inspection on 7/22 confirmed no work taking
place Stop Work pulled
56. 09/03/99 Martin calls Graf says there is no plumbing facilities in the building; states Ferran
has been working steadily for the last 4 months on the residence. Still waiting for Walker to
respond to him regarding the retaining wall. Martin next calls the Mayor's office to
complain.
57. 10/11/99 Mayor's office provides letter dated 5/4/99 to Mayor Fahey from Martin, Pierce
and Strong NOT FOR PUBLIC
INFORMATION
Note, the City policy for renewing building permits up until 1990 was to allow people to renew
regardless of how many years it took to complete the work. Also, the renewal fees were very
minimal at that time. A new Building Official in 1990 created the policy that permits could only
be renewed once and the cost would be for one-half the fees. If there was additional work that
needed to be completed after the renewed permit expired the person had to get a brand new
permit and pay full fees instead of half fees. Even if a person was required to obtain a new
permit the City has never required code updates on the new permit either for zoning or building
code issues.
Regarding the complaint received by the Mayor's office:
1) 1 am unaware of the Stop Work order issued on March 8, 1978.
2) 1 checked with Planning and there is no evidence of complaints being filed for the junk
-vehicles. Jason did a site inspection and determined that there is one junk vehicle.
3) The retaining wall appears to be permitted under building permit #920538 with a
variance granted by the Hearing Exammer on 7/9/92.
4) Mr. Ferran was notified by City letter on 9/21/95 that the house had to be secured, no
occupancy was permitted and in the future when he started to work again he was required
to obtain a new permit.
5) It appears that Engineering has never responded to Martin's complaint regarding the
retaining wall in the easement.
I have been instructed by Ray Miller, Development Services Director to write Mr. Ferran a letter
informing him of the permit requirements and that his plans must meet the current zoning and
building code requirements including meeting the City's 25 foot height requirement. A copy of
the letter is attached, Mr. Miller approved the draft version.

Subsequent to the hearing pursuant to an order of the Hearing
Examiner the following exhibits were submitted subsequent to the

After due consideration of the evidence presented by the Applicant,
and evidence elicited during the public hearing, the following
Findings Of Fact and Conclusions constitute the basis of the
decision of the Hearing Examiner.
FINDINGS OF FACTS
I. The Applicant requested approval of a variance to locate a
retaining wall within the required rear yard setbacks at 18626 94th
Ave. W.1 Edmonds, Washington. The retaining wall has been
constructed and exceeds the three foot requirement. The Applicant
seeks a variance.
2. The Applicant's property is approximately twelve thousand
square feet and is developed with a large single family dwelling
unit.
3. The subject property is zoned residential single family (RS-
12). The comprehensive plan designation for the subject property
is low -density residential.
4. The property has a steep slope from the southeastern property
line to the northwestern property line. The slope is an
approximate twenty-five percent grade. It is the intent of the
Applicant to terrace the backyard to allow use of this property.
As part of the terrace the Applicant has constructed a retaining
wall that has been built within the rear yard setback.
5. ECDC 21.9o.150 defines structure as "a combination of
materials constructed and erected permanently underground or
attached to something having a permanent location on the ground.

Not included are residential fences less than six feet in height
retaining walls, rockeriest and similar improvements of a mino�
character less than three feet in height". The City determined
that the Applicant's retaining wall is a structure and must satisfy
the setback standards for RS 12 zones. ECDC 16.20.030 establishes
a twenty-five foot minimum rear yard setback for structures. The
Applicant seeks a variance from this standard.
6. In order for a variance to be granted within the City of
Edmonds a criteria of ECDC 20.85.010 must be satisfied. Those
criteria include:
A. Because of the special circumstances relating to the
Property, the strict enforcement of the zoning ordinance would
deprive the owner of use rights and privileges permitted to
other properties in the vicinity with the same zoning.

F. The requested variance is the minimum necessary to allow
the owner the rights enjoyed by other properties in the
vicinity with the same zoning.

7. The Applicant purchased the property in 1977 and construction
has occurred on site periodically since that time. At times the
Applicant has developed the property without permits. The
retaining wall was constructed without the benefit of a building
permit and its existence was brought to the attention of the
Planning Department.
8. The type of construction on the retaining wall indicates that
there is an intent to develop a fence. The request of variance is

for the retaining wall. Permits for the fence will be required
under a separate process.
9. The use of the retaining wall appears to be reasonable to
preserve privacy for the Applicant and the adjoining property
owners. It also maximizes the use of the rear yard which is the
steep sloped area. The severe slopes are special circumstances
that warrant a variance.
10. The variance would not be a special privilege to the
Applicant. It will allow the property to be used in a manner
similar to other properties in the vicinity. It will further
provide a means of providing privacy for adjoining property owners.
11. The requested variance is in conflict with the purposes of the
RS-12 zoning. It is consistent with the purposes of the RS-12 zone
as set forth in ECDC 16.20.000 because it reserves or regulates an
area primarily for family living that compliments the single family
dwelling on site.
12. The request of variance is consistent with the Comprehensive
Plan of the City of Edmonds. It provides complimentary use to the
low -density residential designation of the subject property.
13. The request variance will not detrimental to the public
health, safety and welfare. The Applicant submitted a structural
report of the existing concrete wall which indicates that the wall
has the proper footings, drainage and construction to be
structually safe. A copy of the structural report is attached
hereto and by this reference is hereby incorporated as part of
these findings.
14. The requested variance appears to be a minimum variance
request.
15. At the public hearing testimony was received. The testimony
received indicated that in the past the Applicant has been
uncooperative with the neighborhood and neighborhood disputes have
resulted. Opposition to the variance was not voiced as much as the
attitudes of the Applicant.
16. The Applicant responded that it is his intent to secure the
variance and eventually construct a fence in order to secure
privacy and to complete the construction on site.
CONCLUSIONS
1. The application is for the approval of a variance from the
setback standards for RS-12 zoned property. The Applicant has

constructed a concrete retaining wall within the twenty-five foot
rear yard setback for the RS-12 property at 18626 94th Ave. W.,
Edmonds, Washington. Because the retaining wall is considered a
structure pursuant to ECDC 21.90.150 a variance is required. As a
result it must satisfy the setback standards.
2. In order for a variance to be granted the criteria of ECDC
20.85.010 must be satisfied. Those criteria have been satisfied in
the manner addressed in the Findings in this document.
3. The requested variance this will not be detrimental to the
health, safety,or welfare of the public.
4. Pursuant to ECDC 20-100.010(b), the Hearing Examiner has
jurisdictional authority to issue the decision.
DECISION
Based upon the preceding Findings of Facts and Conclusions, the
testimony and evidence submitted at the public hearing, and upon
the inspection of the subject property by the Hearing Examiner, it
is hereby ordered that the requested.variance to allow a retaining
wall within the required rear yard setback on property located at
18626 94th Ave. W., Edmonds, Washington is granted subject to the
following conditions:
1. This application is subject to the applicable
requirements contained in. the Edmonds Community Development
Code. It is the responsibility of the applicant to ensure
compliance with the various provisions contained in these
ordinances. Attachments 7 through 10 of the Planning Staff
Report are provided to familiarize the applicant with some of
the additional development regulations. These attachments do
not include all of the additional regulations.
2. This variance applies only to the retaining wall. Any
other development, e.g., a fence on the retaining wall, will
require a separate permitting process.
3. Within 30 days of the date of the Hearing Examiner
Decision, the applicant shall complete the following:
a) Together with the adjacent property owner to the
northwest, reach a mutually agreed upon means of reducing
the negative visable impact of the retaining wall.
Alternatives might include covering the wall with paint
or stucco, screening the wall with vegetation, building
a fence, or any combination of these. If a mutually
agreed upon solution is not reached within this 30 day

period, the Planning Division reserves the right to
determine the means by which the negative visual impacts

I am writing to follow-up on our meeting of Monday, July 19, 1999. As you will recall,
we met regarding the Stop Work Order that was issued on the Ferrans' property located at 18626
- 94th Avenue West onjuly 1, 1999, and determined that the order had been issued solely as a
result of a neighbor's. report that sheet rock wasbeing hung'in the premise's without a permit.
When.l. assured you tli.at.n.00such -work was taking place, you indicated that- the -appropriate thing

rescind - the order, upon his veirification that no such work was being done. Within a day or so,
I was able to contact Jerry Saterlie*, relay our Ian to him and he agreed to' ins p*ec't the property.

(He also indicated that 'when he posted the notice it . did not appear that construction was taking
place.) I am writing you at this point to request your confirmation that the inspection has taken
place, and that you will be withdrawmig or rescinding the order as agreed. Of course, if Jerry
Saterlie discovered that work was taking place without a permit, I am equally interested in
learning about that. Hopeftilly, this was not the case.
On another note, I want to tell you how disappointed I am in,the manner in which your
office has handled the Marquis Mortgage/506 Bell Street matter. Although you may not be aware
of it, after our meeting on the Feffan project, I went upstairs to speak to Paul Mar about the 506
Bell Street matter. He and I discussed the fact that the project had not progressed as quickly as
originally anticipated, (due to delays on both ends), and agreed that we needed to establish a new
projected date for compliance and/or explore the possibility of some type of temporary
compliance measures. I left his office that morning with an agreement that the City would take
no action until we had an opportunity to propose a new compliance date or interim compliance
measures. Thereafter, I began the process of p*utting together a new compliance proposal by
contacting the arch
proj ec,t itect. for a new time. line. To have the City then turn around and issue
an Order. to Correct Violations less than 48 hours later was .. q . uite a shock. While I can certainhi
understand that, some peo le think Paul Mar should not have agreed to handle the matter the' way

Edmonds, and I should have been able to believe what he said on behalf of the City. If the City
could not abide by his agreement, it seems that someone at the City could have at least contacted
me, explained the situation, and discussed the alternatives prior to issuing an order. Although
I am certain we will still be able to resolve these problems in an amicable fashion, I remain
concerned about the manner in which the City tends to deal with certain issues. The City's
issuance of a Stop Work Order on the basis of an unverified report by a protagonistic neighbor,
and the City's cornmencement of administrative action against a landowner within 48 hours of
agreeing to resolve the problem by other means, are difficult forms of conduct for most
landowners to understand.
If you have any questions regarding this letter or would like to discuss either of these
matters with me, please do not hesitate to contact me. Otherwise, it was a pleasure meeting you
last week, and I look forward to working with you to resolve all of the issues present in each
case.

The purpose of this letter is to outline the corrective action required to resolve the STOP
WORK order issued on the subject property on 7/l/99. Pursuant to Uniform Building
Code Section 104.2.4 all work requiring a permit shall forthwith stop until authorized by
the building official through the granting of a building permit. It is a violation of State
and local laws to continue to work after a Stop Work order has been posted.
In order for a building permit to be issued a permit application and complete building
plans (including pen -nit fees) must be submitted to the City for review. Since you have
started the work prior to issuance of a building permit the permit fees shall be doubled.
Please refer to the enclosed single family handout for minimum submittal requirements.
As you were previously informed by City letter dated 2/24/99 the plans must comply to
the current Edmonds Community Development Code and 1997 Uniform Building Codes.
Technicians in Development Services are available at City Hall from 9:00am to 5:00pm

Thank you for responding to our letter of February 22"d. Ms. Graf responded on April 12'h. The response
from Ms. Graf is in general unsatisfactory. It contained several inaccurate or incomplete statements. It
would appear dot only a superficial investigation has taken place. Please note the 7 letters, maps, etc.
attached that support the contentions made herein. Also please note the addition of the Strongs, which
now brings together all of the view diminished neighbors together in seeking a reasonable resolution.
The response from Ms. Graf is dated April 12, and postmarked Agril 13. This is interesting as the
inspector, observed by Mr. Martin, arrived at 2:30PM on April 13 . And even more interesting, he
completed his inspection in two and one half minutes and left! Now -we wonder how much (or little) time
was spent at the office on the work reviewing and preparing their response.
Lets begin with the concrete wall by first dismissing your responses as being just simply totally incorrect.
The concrete wall in question is on the EAST side(Front yard setback) of the lot not the West side (Rear
yard setback) that the variance covered. Mr. Martin attended the formal part of the Hearing Examiner's
open V-102-99 session in 1992 and reported many of the same problems stated herein. This WEST wall
decision was a bad one in his opinion, but its over and done. Building permit #920538 has not been
available to the public. But the EAST wall remains still awaiting your reasonable response. Again Us is
an unsafe wall as it stands, and was built without permit or variance, arid was built within the 20' easemen�
and not just within, but way within as you will see in the next paragraph.
It was understood that a minimum of twelve feet of the easement would be paved, that construction debris
would be cleaned up, that drainage would be contained on site, and that a "Right of way construction
pertnit" from Public Works would be required for any work in the easement The actual construction
included ONLY a paved driveway 9' 3" which is 3 feet short of the required width; no "right of way
construction permir was obtained from Public Works for either the driveway or wall built 10' 3" into the
easement (2 permits being required); drainage has not been contained on site as required; (2) 2 1" holes
have been introduced in the easement at 9' 10.5" in the agreed upon 12'. There are 15 dangerously
protruding steel rods (rebar) sticking out of this uncompleted ugly wall; part which includes an 8" high
concrete obstruction 9' 15.5" into the required 12' pavement area. No permit whatsoever exists for the
wall even though required. Again I have included a photograph previously provided. Whatever happened
to city inspection?
Now to the iunk vehicles: The " 1970s" truck reported by the inspector is a 1963 moss covered
International pick-up, apparently last registered in 1994. It has not been moved or even started since at
least that date. It is mildly encouraging to at last see action on this single item. Now, for the Concrete
mixer; it is a two wheeled trader "vehicle" and it is "junk", no reasonable person can dispute that It was
not properly cleaned up, has been totally stationary and neglected for about 10 years, arid is apparently
inoperable. It is without displayed registration of any kind and its market value is its scrap value. It is
parked on a slope and secured by only a block of wood. It is parked on the portion of the easement that is
supposed to be paved. It is most certainly an attractive nuisance. Again it is a utility trailer with wheels
and as suck according to the Dept of Motor Vehicles, is M to be properly licensed. And it is very,
very ugly. Please review Chapter 20. 110. This concrete mixer is clearly regulated by the City code. The
"camper"referred to by the inspector is located immediately next to and behind the pick-up truck ne

inspector was within 2 feet of it, and apparently didn't notice it in his haste. It also is moss covered and
hasn't moved for years. It would perhaps be more accurately described as a pick-up canopy so therefore is
a vehicle that has been discarded for years now. It is ugly.
The unfinished non -conforming deteriorating building has existed now unoccupied for 21 years seriously
blocking three property owner's view, and for what purpose, to keep property taxes down? It is nearly 5
feet in excess of the allowed building heights, and serves no useful purpose. And what we are hearing from
the City of Edmonds is that you never in a hundred years will do anything to correct this non -conforming
structure other than to require a height variance for the 21 year old leaking rotting hulk if and when the
owner ever requests another building permit And when the variance is rejected will you continue even
then to allow the blockage? Is there nothing more positive you will do? Is this a correct assessment of
your position? Please respond. It would seem that this situation must have happened before in Edmonds or
the County and that a just reasonable solution was pursued by our elected officials.
Also is it true that a Public Notice of 7/l/98 requires strict adherence to the 1997 Uniform Building,
Plumbing, Mechanical, Fire, and Supplemental Codes, many of which 18626 can never be in compliance?
Mr. Martin will be most happy to point out the problems, or whatever else it will take to get the City to
fully respond in a genuine manner to the concerns voiced in this letter. His phone number is 774-6092, and
he will make himself reasonably available. We don't have a complete file on 18626, as it seems to be
scattered all over the Building Dept or in some "archives" somewhere; and as such has not always been
available (other than in a piecemeal manner) to the public. We would appreciate a complete copy of
Building Permit #920538 and any attachments if that would be possible.
The City of Edmonds should fully inspect the property. Any discrepancies noted in the current Code
and/or required by previously issued permits must be first brought into compliance and re -inspected prior to
a new permit to continue the general construction. Failing compliance with past permits a future permit
should be denied, and abatement proceeding coninienced.

retaining wall adjoining our properties, we need to reach a
mutually acceptable means of reducing the negative.visual impact of
the wall itself. In an effort to reach this goal, I would like to
propose that the wall be painted a soft beige as you suggested in

also like to suggest that you provide for discussion, a list of
the type of shrubbery you would like to have as wall coverage,
along with the price. This way, we may be able to' come to a

junk vehicles or parts thereof; to provide
opportunity for a prompt hearing and decision
of alleged violations; to establish monetary
penalties for these violations of the Edmonds
Community Development Code; and, to abate
such violations. This chapter shall coordinate
with Chapter 8.50 ECC, on abandoned vehi-
cles. (Ord. 2934 § 1, 1993].
20.110.020 Definition section.
A. "City" means the city of Edmonds,
Washington.
B. "Civil violation" means a violation of a
provision of the Edmonds Community Devel-
opment Code for which a monetary penalty
may be imposed under this chapter. Each day
or portion of a day during which a violation
occurs or exists is a separate violation.
C. "Junk vehicle" shall be defined as a
vehicle meeting any two of the following
requirements:
1. Is three years old or older;
2. Is extensively damaged, such damage
including but not limited to any of the follow-
ing: a broken or missing window or windshield
or missing wheels, tires, motor, drive train,
brakes or transmission;
3. Is apparently inoperable;

4. liaithout valid current registration
plates;
5. Has a fair market value equal to the
value of the scrap in it.
Said vehicle shall be abated as described in
ECDC 20.110.050.
D. "Emergency" means a situation in
which the community services director or
his/her designee determines immediate action
is required to prevent or eliminate threat to
health or safety of persons or property.
E. "JunlC' means discarded, broken or dis-
abled material including but not limited to: fur-
niture; appliances; toys; or other items that are
not in functioning condition.
F. "Litter" means discarded waste materi-
als, including but not limited to: paper wrap-
pings; packaging material; discarded or used
bottles; and discarded or used cans.
G. "Person" means any natural person, any
corporation, or any unincorporated association
or partnership.
H. "Trash" means waste food products and
other household garbage. [Ord. 2934 § 1,
19931.
20.110.030 Nuisance section.
No person owning, leasing, renting, occupy-
ing or having charge or possession of any
property in the city, including vacant lots, shall
maintain or allow to be maintained on any such
property, except as may be allowed by any
other city ordinance any of the following:
A. Junk, trash, litter, boxes, discarded lum-
ber, salvage materials in front yard, side yard,
rear yard or vacant lot;
B. Attractive nuisances dangerous to chil-
dren including but not limited to the following
items when located in any front yard, side
yard, rear yard or vacant lot: —
1. Abandoned, broken or neglected
equipment;
2. Potentially dangerous machinery;,
3. Refrigerators and freezers unless the
door has been removed therefrom or it is
equipped with a magnetic catch which does
not pose a hazard;
5. Wells or shafts;
C. Broken furniture or disoed furniture,
household equipment and furnishings in any
front yard, side yard or vacant lot;
D. Graffiti on the exterior of any building,
fence or other structure in any front yard, side
yard, rear yard or on any object in a vacant lot;
E. Utility trailers or unmounted camper
tops located in any front yard, except the drive-
way, or located inany vacant lot;
F. Vehicle parts or other articles of personal
property which are discarded or left in a state
of partial construction or repair in any front
yard, side yard, rear yard or vacant lot;
G. Hazardous trees, or any other vegetation
which is dangerous to the public health, safety
and welfare, located in any front yard, side
yard, rear yard, or vacant lot;
H. One or more junk vehicles or abandoned
vehicles in any front, rear or side yard setback
areas, driveways, or vacant lots. (Ord. 3130 §
1, 1997; Ord. 2934 § 1, 1993; Ord. 2913 § 2,
19931.
20.110.040 Enforcement procedures.
A. Order to Correct Violation.
1. Issuance. Whenever the community
services director or his/her designee becomes
aware that a violation has occurred or is occur-
ring, he/she may issue an order to correct vio-
lation to the property owner or to any person
causing, allowing or participating in the viola-
tion.
2. Content. The community services
director or his/her designee shall include the
following in the order to correct violation:
a. Name and address of the property
owner or other person to whom the order to
correct violation is directed; and
b. The location of the subject prop-
erty by address or other description sufficient
for identification of the building, structure,
premises or land upon or within which the vio-
lation has occurred or is occurring; and
c. The code section that has been vio-
lated; and

e. A stagent. of action required to
be taken to co e violation; and
f. Date by which compliance is
required to avoid monetary penalties. This date
will be no less than 24 hours from the date and
time that the notice is posed on the property or
no less than three days from the date that the
letter is placed in U.S. Mail; and
g. Statement that a monetary penalty
in an amount per day for each violation shall
be assessed against the person to whom ' the
order to correct violation is directed for each
and every day or portion of a day on which the
violation continues following the administra-
tive hearing.
3. Service of Order. The community ser-
vices director or his/her designee shall serve
the order to correct violation. upon the person
to whom it is directed, either by sending a copy
by U.S. Mail to the last known address of the
person responsible for the violation, or by
posting a copy conspicuously on the site or by
serving a copy of the notice personally on the
person responsible for the violation.
B. Notice of Civil Violation.
1. Issuance. If the person responsible for
the violation fails to correct or cauge the cor-
rection of the violation within the time given
by the order to correct the violation, a notice of
civil violation will be issued to each person to
whom the order to correct violation directed.
2. Issuance in an Emergency or for
Repeat Violations. The community services
director or his/her designee may issue a notice
of civil violation without having issued an
order to correct where an emergency exist§ or
a repeated violation occurs.
3. Content. The applicable department
director or his/her designee shall include'the
following in the notice of civil violationct—
a. The name and address of the prop-
erty owner or the person to whom the notice is
directed; and
b. The location of the subject prop-
erty by address or other description sufficient
(3) If such building, structu rty
tion thereof is unoccupied, the: iri�jr, shall 'fir'st
make a reasonable effort to locate the owner or
other persons having charge or control of the build-
ing, structure, property or portion thereof and
demand entry. If the inspector is unable to locate
the owner or such other persons, and he has reason
to believe that conditions therein create an immedi-
ate and irreparable land use or safety hazard, he
shall make entry.
(4) It is unlawful for any owner or occupant or
any other person havfhg charge, care or control of
any building, structure, property or portion thereof
to fail or neglect after proper demand has been
given to permit prompt entry thereon where the
inspector has reason to believe that conditions
therein create an immediate and irreparable land
use or safety hazard.
(5) Unless entry is consented to by the owner or
person in control of any building, structure, prop-
erty or portion thereof or conditions are believed to
exist which create an immediate and irreparable
land use or safety hazard, the inspector, prior to
entry, shall obtain a search warrant as authorized
by applicable law. (Added Ord. 85-017, § 2, May
1,1985).
28.08.050 Abatement proceedings —
Authorized.
In addition to or as an alternative to any other
judicial or adn-dnistrative remedy provided in this
title or by law or other ordinance, a director may
order a land use ordinance violation to be abated. A
director may order any person who creates or
maintains a violation of any land use ordinance, or
rules and regulations adopted thereunder, to com-
mence corrective work and to complete the work
within such time as a director determines reason-
able under the circumstances. If the required cor-
rective work is not commenced or completed
within the time specified, a director may proceed to
abate the violation and cause the work to be done.
He will charge the costs thereof as a lien against the
property and as both a joint and separate personal
obligation of any person who is in violation.

28.08.060 Abatement proceedings — Legal
relief.
Notwithstanding the existence or use of any
other remedy, a director may seek legal or equita-
ble relief to enjoin any acts or practices or abate
any conditions which constitute or will constitute a
violation of any land use ordinance or rules and

28.08.070 Technical review committee.
(1) There is established the enforcement techni-
cal review committee, consisting of one designated
representative from each of the following depart-
ments or offices: the department of planning and
development services, the department of public
works, and the office of the prosecuting attorney.
The committee shall select one member as its
chairperson. The committee shall meet periodi-
cally and at such times as it deems necessary to
carry out the functions specified in this title.
(2) The functions of the committee include the
following:
(a) Assure coordinated enforcement in cases
involving multiple violations;
(b) Review and recommend appropriate
enforcement actions in the case of complex or pro-
tracted violations or in any other case requested by
a director;
(c) Develop efficient methods of identifying
and enforcing violations and avoiding duplication
of,enforcement functions among county and other
agencies. (Added Ord. 85-017, § 2, May 1, 1985;
Ord. 95-004, § 152, Feb. 15, 1995, Eff date Feb.
27,1995).
28.08.080 Nfisdemeanor.
As an alternative to any other judicial or admin-
istrative remedy provided in this title or by law or
other ordinance, any person who willfully or
knowingly violates any land use ordinance, or rules
and regulations adopted thereunder, or any order
issued pursuant to this title, or by each act of com-
mission or omission procures, aids or abets such
violation, is guilty of a misdemeanor and upon con-
viction shall be punished as provided in SCC
1.01.100. Each day such violation continues shall
be considered an additional misdemeanor offense.

28.08.090 Civil penalties — Procedures.
(1) Any person or organization who violates
any land use ordinance, or rules and regulations
adopted thereunder, or the conditions of any 'penni't
issued pursuant to such ordinance, rule or regula-
tion, or who, by any act of commission or omission
procures, aids or abets such violation shall be sub-
ject to civil penalties as provided in this chapter.
(2) Civil penalties may be directly assessed by
the appropriate director by means of a notice and
order issued pursuant to chapter 28.12 SCC or may
be recovered by legal action filed in Snohomish

In response to your letter dated 2/22/99 1 have the following information for you.

Regarding the junk vehicles, the City's Construction Compliance Inspector has
investigated the junk vehicle situation and found one early 1970's International vehicle
that meets two of the five criteria for junk vehicles. The inspector will notify the
registered owner of the vehicle and outline the process for compliance or abatement. The
concrete mixer is not regulated by City code since it is not used in conjunction with a
business and no camper was observed on site.
Regarding the partially built concrete wall, according to City records the retaining wall
that you are referring to is the wall that was approved by the Hearing Examiner in 1992
under Variance #92-109. City staff does not have the ability to re -open the hearing or
alter the final determination of the Hearing Examiner. The City Engineer has not
determined that a road hazard exists but I will certainly forward a copy of your letter to
him for review. Regarding the exposed rebar, a site inspection by the City Building
Inspector determined that no safety hazard exists.
The storage of drywall in the garage does not constitute a violation, although it may
indicate your neighbor's intent to start working on the house. No violation exists unless
he starts work without first obtaining a building permit. The City sent a letter dated
9/21/95 to Mr. Ferran informing him that in the future when he applied for a building
permit to complete the house that the construction must meet applicable building and
zoning standards of the current code. To reiterate this requirement the City sent a letter
recently by certified and first class mail informing him again of this requirement.

Mr. Ferran has been properly notified of his responsibility to obtain the proper permit(s)
to complete the work to the current code. The City Building Inspector has verified that
the existing condition of the house does not constitute a public nuisance or a fire hazard.
The City cannot "make" Mr. Ferran finish the work on the house since no violations or
life -safety hazards exist. Even if a building code violation existed the City could only
force him to correct the violation --not finish the house.

The purpose of this letter is to recall to your attention the City letter dated September 21, 1995 (copy
enclosed) informing you of your responsibility to apply for a new building permit when you again
started work on the subject residence. Be advised in order for the City to grant a new building permit
the following is required:
I . According to City records the framing has never been approved on the residence. Framing must be
approved under a new permit prior to insulation or sheetrock installation.
2. According to City records the plumbing, mechanical and gas systems have not been approved.
This work must be inspected and approved prior to cover under the new permit.
3. According to City records the insulation has never been approved. This work must be'approved
prior to cover under the new permit.
4. As stated in the 9/21/95 letter, issuance of a new building permit shall require upgrade to current
building, energy and zoning codes. Therefore, a copy of the plans conforming to current 1997
Uniform and State Building Codes shall be submitted for review and approval. A plan review fee
shall be assessed for review of compliance to the Codes based on the value of the remaining work.
Be advised, since the City's height ordinance has changed to 25 feet and your building was measured
at 29 feet 8 inches the City shall require that the building height be reduced to meet the 25 foot
maximum height limit for single family residences. However, if you desire to keep the building at the
existing height you must apply for a variance. I have included the applicable City handout for your
information, the filing fee $350.00. Please note, the City has also enacted a Civil Penalties Ordinance
whereby compliance to the Codes is enforced, a $100.00 per day penalty fine can be assessed until
matters are resolved to the satisfaction of the City. If you start your work prior to issuance of a new
permit the City shall utilize the Civil Penalties Ordinance for compliance as well as assess double
permit fees.

Dear Mayor Fahey:
The subject is the construction of 18626 9e AV West. Construction on this unfinished building and lot
began in 1978 and remains half finished. It appears that yet another building permit application may or
may not be made sometime soon, though additional construction activity may have all ready began. There
are three major continuing problems with this project, in addition to its snail like progress. Many
communications to the Building Dept and other City officials over the years have been ignored; and that
seems to certainly be the current mode, judging by the incredibly incomplete file available to the public.
The method of building on this property seems to be; 1. Begin construction, 2. Wait for a complaint, 3. If
no complaint, then do not worry about possible required permits, and 4. In the event of complaint ask for
and automatically receive with little delay a permit or variance regardless of inconvenience or cost to the
neighbors. The Building Department aids these tactics by ignoring complaints. This letter is an attempt to
enlist your efforts in a effort to change this unique process by utilizing the Community Development Code
as it was intended to be used. It is high time to cease granting special building rights in this situation.
The sad history of 18626 began on Mar 8, 1978 when Mr. Harry Whitcutt issued a Stop Work Order upon
cOmPhlint after the house construction process had initially began without a permit. After a brief delay a
permit ivas obtained and construction continued erratically. The foundation and rough framing were
quickly completed, yet it wasn't until about 1987 or 1988 that the bisqueen (plastic) roof was replaced by
the permanent one. Since that time construction has basically stopped. 'the house has remained at an
approximately 50% completion. The interior other than perhaps rough electric remains incomplete.
Permits were issued erratically often due to continuing complaint after expiration during this 21 year
period, without any real construction effort being made, other than to pour concrete all over the property
without all of the required permits and/or variances. The building and property has been used as a junk
yard storage facility and is an eyesore, and a dangerous attractive nuisance. There was a serious problem in
1992 with the owners of 18625 Olympic View Dr. over a huge retaining wall built on the west side within
the 25' setback of 18626 without the required variance and permit. I believe that to this day the'Hearing
Examiner's decision to allow the ugly invasive wall to remain has adversely affected the value of the 18625
property. No certificate of occupancy for 18626 has ever been issued. There are three major concerns
remair"g that have yet to be addressed by the City, that pose a significant threat to the quality of life,
safety, and valuations of the properties on 18624, 18626, 18628, 18702, and 18704 94" AV W.
The first concern is simple and very easy to correct. There is a very old pickup truck, old ugly concrete
mixer trailer, and an old junky Camper top on the east side of the premises (see photos) making for a very,
very ugly junk yard appearance. These vehicles have no current registration and have not been operated for
years. Until recently two other oldjunky vehicles were also stored in the garage. However with the
building process beginning again, they have been removed and drywall materials have started to be stored
inthere. Perhaps an appropriate City official could be directed to find time to read Chapter 20.110 of the
Community Development Code and quickly eliminate this unlawful irritation of 20 years. The code
appears to have been written using this specific long-lasting situation as a model example for itself.
The second concern is intrusion of a partially built concrete wall reducing the 20 foot dedicated easement
(again without permit or variance) on the eastern side of the property to about 12 feet. Additionally, this
unfinished mess is a classic example of a safety hazard if I have ever seen one. I have watched it least two
vehicles fall in the hole created by this unfinished mess. Several others including an Aid vehicle with the
owner of 18628 aboard apparently in transit to the hospital have had some difficulty. Just how a fire truck
is going to negotiate die narrow approach to 18628, 18626 or the western side of 18704 is questionable in

my mind, for which my logic tells me why the 20 feet width easement was dedicated! And of course the
metal rebar protruding vertically every eight feet patiently awaits someone to be impaled on it. This is a
dangerous attractive nuisance and should be cleaned up, with the easement restored to required dimensions
immediately. Certainly no budding permit should be issued until this negligence has been corrected and
inspected.
Finally, the house was partially constructed when a thirty feet height was permitted. This was changed a
feWshbrt months after construction began to a maximum of twenty-five feet. On September 21,1995 the
owner of 18626 was notified by the City that the building permit had expired and that any new permit
issued would subject the property "to all Mlicable zoning and building es as adopj�d by the Cit_v a
that time." meaning the date of any new permit. In addition to the height there are many other various code
changes that are now required. Plumbing using lead solder must be replaced, changes and improvements
in the electrical system have to be made, earthquake straps need to be added, drainage updated, and a
zillion other items made current, including lowering the height of the building five feet to restore the views
of 18624, 1870 1, and 18704 in order compliance with the Code. For twenty one years diis empty partially
completed hulk has diminished the views of 18624, 1870 1, and 18704, to oar detriment Construction has
been initiated on occasion without permits or required variances until after there is a complaint. The height
problem needs to first be addressed and corrected or risk establishing an undesired precedent of raising
building heights through unintended default. The Mgfitv of life and safety of the neighborhood Mquires
strict adherence to current code. The practice of no enforcement needs to change quickly.
In conclusion a responsible City official should make himself aware of these ongoing problems and correct
them with due diligence and speed. The junk should be removed, the easement restored, and the building
made to conform to existing standards as basic prerequisites to an issuance of a Building Permit, .
resumption of construction, and absolutely prior to an issuance of a Certifical " e of Occupancy. A reply from
you, which would include the intended City actions/solutions to these long lasting violations, would be
appreciated. Photos are included showing the junk and easement incursiorylkazard. Some straightforward
answers would be greatly appreciated by all concerned in the neighborhood. Without professional
supervision by the City, this situation may become even worse.

I apologize for not communicating better with you in regard to the structural integrity of the retaining wall
on Mr. Ferran property. Mr. Ferran did submit a letter and calculations signed by John C. Raby, a
registered Professional Engineer, confirming the structural integrity of tile wall. This letter was included
with the information the Hearing Examiner used in making a decision.
I inspected the site November 23, 1992 and have released Mr. Ferran's performance bond which was lield
to ensure prompt installation of tile trees and painting of the wall. At the present time Mr. Ferran is in the
process of applying for a permit to allow hirn to build a six (6) foot high fence on the retaining wall. If

vith us in any way to satisfy our requests (referenced letters) for
assurance that the wall meets the enaineering criteria of the city. A
copy of this letter is being mailed separately to the Edmonds Planning
