History And Summary Statement:
The applicant has submitted the 10 lot plat of "Helleren Lane' for final plat approval (see Exhibit 1). The subject
property is located on the north side of 188th Street Southwest at the 8500 block (see Exhibit 2). Preliminary Plat
approval was granted by the City Council 11/1/94 (see Ex*hibit 3).
The draft final plat materials have been reviewed by the Community Services Department staff, and appear to
comply with the requirements of ECDC Chapter 20.75 and the conditions which wre placed on the approved
preliminary plat (Exhibit 4).
Recommended Action:
Approve the final plat of -Hcllcren Lane- (File No. P-94-55) and atithorize the Mayor to sign the final plat
documents.

City Attorneys previous reference to additional city benefit being obtained by virtue of the wall-
Councilmember Kasper indicated he would have to vote against the motion on the basis of his
understanding that the city has a liability at this point if the land slides, and that the Council should go
along the lines of what the City Attorney said and get the wall in there up to the amount it would cost
the applicant. We should be willing to follow the posture of setting our portion of the benefits of
putting a wall in but not the full c, =' if it exceeds that arnounL In his observation the wall needs to be
there. Councilmember Tom Petruzzi said the City Attorney requested of both parties whether or not
that was part of what they were seeking and asked if the Council was looking to impose something
upon them. Councilmember Barbara Fahey concurs with Councilmember Kasper from the standpoint
that the city is going to derive a Ognificant benefit and she didn't think it fair to impose that kind of cost
factor for vacation of this alleyway when something positive will result. Her concern was whether it
was acceptable to Mr. Frazer to actually have an easement placed on the property as had been
suggested by City Attorney Snyder. She wonders if it might be a better solution for Mr. Frazer to have
an easement placed on the property and not have to pay such a high price for the vacation of the alley.
City Attorney Scott Snyder indicated one reason they didnk come forward with fiuther dis;azsions of
the easement was that by retaining the eam'nent the city would have an ownership inWest in what
could potentially be an unstable slope. The city is best off being divested of the slope. In. ter= of
Messrs. Kasper and Halls points, he explained how to amend the motion.

approximately 3.2 acres into 10 single-finidy lots in an area zoned RS-12 and located at 8511 188th
Street S.W. Included in the proposal was a request to modify the setback on the east side of Lot 2
from 10 ft. to 8 ft. in order to accommodate the exi�g residence.

The Hearing Examiner issued his report recommending approval of the application subject to
recommendations which he outlined in his report (copy of which is induded in Councils packet). 11iis
hearing process is subsequent to the environmental appeal decision.
It is Staffs reconiniendation that the Council approve the proposed Preliminary Subdivision application
subject to the recommendations of the Hearing Examiner as shown on ExtWit 4 to the packets.
Council President John Nordquist asked Mr. Wilson if he had received or reviewed the letter from
Victoria Rondel regarding the fence. Mr. Wilson indicated he had talked to 1&. Rondel this afterrioon
*but had not read todays letter yet. He provided the Council with details as to how this project wiU
effect Ms. Ronders property� where the roads were and where landscaping would be used.
City Attorney Snyder asked if Mr. Wilson was aware of any developmentcodes to require a fence at
that location, and Mr. Wilson said there were none.
Jim Miler, Lovell-Sauerland & Assoc., 19400 - 33rd Avenue West, Suite 200, Lynnwood, spoke on
behalf of Helleren Development Company. His company also represented the Hellerans before the
Hearing Examiner His expressed their agreement with the recornmendations; of the Hearing Examiner
relative to the preliminary plat and also agree widi record in tam of the findings and conclusions that
it does conform to all of the requirements of the Edmonds Community Development Code as well as
the Comprehensive Plan and the Zoning Code. He stated his primary purpose tonight was to answer
any questions there may be on the plat design or the review process. They have moved ahead 'with
engineering plans and have reviewed them with Staff in order to implement some of the conditions of
approval.
Councilmenber Bill Kasper asked about the feeling of the applicant with regard to the issue of a fence.
Mr. Miller responded that when the adjacent property owner was uninterested in being deeded this
property to the owner, the plan that was developed to create a transition between the street and the
adjoining residential property was to landscape the area. The pattern for the tree planting would
continue on into the subdivision, so that foram a landscape theme for the entire development. A fence
that close to the entiyway-could provide a visual hazard and would not have the soft appearance of the
discussed landscape which would provide both a physical and visuW barrier They feel a fence may be
more of a liability than an asset.
The public portion of the. hearing was dosed when no one wished to speak, and the matter was
remanded to the Council for acfion.

Councilmember Tom Petruzzi stated that on October 16 there was a SEPA hearing in Council
Chambers, and at that time he voted against the motion to approve proceeding with this development
He thinks the development is good for the community, but he feels the Hearing Examiner erred in
overruling staff regarding Section 18.80.0100. He believes staff was correct, and for that reason he
will vote against the motion.

SECOND HEARING ON DOWNTOWN/WATERFRONT PLAN
Rob Chave, Planning Manager, indicated this was a second hearpg and that he did not have many
specific opening comments to make. He commented review had begun of the suggestions contributed
at the last hearing by Mr. Rob Morrison of the Chambees 3M-T Task force. He said there were some
good ideas contained therein and it gives them a good idea of how much work is -yet to do to
implement a plan.
Rob Morrison, 250 Beach Place, # 102, spoke on three elements of access to and from the waterfront.
FuA,with the increase of commuter trains, pedestrian access to the railroad terminal and buses and the
parking lots fi7om Bracketts Landing and other beaches and parks, the Senior Center, and the interim
ferry dock at Main Street will become a major safi:ty matter. Second, travel to and from the railroad
terminals, parking lots, etc., could be accessed safely through pedestrian underpasses at both the
Dayton Street and Main Street crossings. Third, a water1ront walkway/esplanade will obstruct access
to the beaches. He directed the majority of his comment to the third item. There is a significant
number of people who have signed petitions against a walkway because of the obstruction factor. He
feels that plan should be made separate from the waterfront plan. He suggested the City consider a
paved walkway along the West bank of Sunset Avenue from Main Street to Caspers Street to replace
the dirt pathway now in odstence. - This would give walkers a clear and unobstructed view saf* away
from railroad tracks and not subject to destruction from wind, waves and high tides. They fixther
requested that the Save Our Beaches be included in any planned discussions of these three elements
effecting the access to and fiom the waterfiont parks and beaches.
Loreena Strickland, 200 Beach Place, #304 feels we have a boardwalk on Pon property� a park for
skindivers, but we need to preserve our only sandy beach. She finds the flow of people from early
morning throughout the day interesting. She thinks a walkway would cut off the beach and that what
is really needed is for the Anderson property to become a parking lot for the people.

Based on the testimony and evidence submitted at the public hearing, the following constitutes the
Findings of Fact in this matter.
FINDINGS OF FACT
I The applicant requested approval of a preliminary plat for the subdivision of
approximately 3.2 acres of property located at 8511 - 188th Street SW, Edmonds,
Washington. As part of the proposed development, the applicant also requested a
modification of the side setback requirements for the east property line of proposed Lot
#2 from a 10 foot setback in order to a 8 foot setback to accommodate an existing single
family residence on the lot.
2. Admitted at the public hearing as Attachment 4 to Exhibit A was a reduced copy
of the preliminary plat map. A copy of this plat map is attached hereto and by this
reference is hereby incorporated as part of these findings.
3. The subject property is zoned RS-12 and has a comprehensive plan designation of
Low Density Residential.
4. The property is 3.2 acres in size and is rectangular in shape. It fronts 188th Street
SW and is developed with a detached single family residence of 3 outbuildings. It is the
intent of the applicant to retain the detached single family residence on Lot #2 but to
remove the other outbuildings.
5. The subject property has a gentle slope that extends from the south southeast comer
to the north northwest comer. There are several depressed areas in the middle. The site
is heavily forested with over 200 trees, bushes and other vegetation. An arborist's report
has been prepared and was submitted as part of the environmental review process.
6. The properties to the north, east and west are all. z * oned RS-12 and developed with
single family residences. The properties to the south are developed with single family
residences and an elementary school. There is a mixture of RS-12 zoned property and
Public Use zoned property south of the subject property.
7. Pursuant to the State Environmental Policy Act the City of Edmonds was
designated as the lead agency for the environmental review. Subsequent to the submittal
of an environmental checklist, an arborist's report and other environmental documentation,
the City issued a Mitigated Determination of Nonsignificance (MDNS). An appeal of the
MDNS was filed and the appeal was heard and by the Hearing Examiner of the Hearing
Examiner of. the City of Edmonds. The City Council upheld the Hearing Examiner's

recommendation on the MDNS appeal.
8. In order for a preliminary plat to be granted within the City of Edmonds, the
criteria Of ECDC 20.75 must be satisfied. These criteria include review of environmental
isslim, lot and sftd layouts, dedications, improVements, and flood plan . In addition, the
subdivision ordinance of the City (ECDC Chapter 20.75), the Comprehensive Plan of the
City, the Zoning Ordinance and the Flood Plan Management Ordinance must all be
considered.
1. Subdivision Ordinance. The proposal must be consistent with the purposes
of this chapter (ECDC 20.75) and must meet all requirements of this
chapter.
2. Commehensive —Plan. The proposal is consistent with the provisions of the
Edmonds Comprehensive Development Plan (ECDC Chapter 15) and other
adopted city policies, and is in the public interest.
3. Zoning Ordinance. The proposal must satisfy all requirements of the
zoning ordinance, or a modification must be approved.
4. Flood Plan Manaement. The proposal must satisfy all requirements of the
Edmonds Community Development Code relating to flood plan
management.
0. Tie d—eirelopment standards for RS-12 zones are set fcrffi in ECDC 16.20.030. '-Me
proposed subdivision, with the exception of proposed Lot #2, satisfy these requirements.
10. The applicant has requested a modification of the minimum side setback for the east
boundary line of proposed Lot #2. ECDC 16.20.030 establishes a 10-foot minimum site
setback. The applicant requests an 8-foot side setback in order to accommodate an existing
residence on site. Ile side setback for the west property line of proposed Lot #1 will be
12 feet, as agreed to by the applicant. 7hus the separation of the residences on the two
lots will be a as required by ordinance for RS-12 IoM The modification appears to be
reasonable.
11. All utilities will be available to the site and all utility lines will be placed
unda-ground. Access to the site will be off 188th Street SW. The internal access will be
85th Place and will be a cul-de-sac which will have a turnaround near the northern
boundary of the subject property. All of the lots within the proposed subdivision with the
exception of Lots #1 and #2 will access directly off the internal cul-de-sac. This internal

street within the proposed subdivision will. be developed to -City standards.
12. ' The applicant, as part of the proposed development submitted to the City of
Edmonds Engineering Dqpartnient a preliminary civil engineering plan for improvements
to -188th Street SW. The engineering plans address the access to Uts #1 and #2. As a
part of the engineering requirements of this plan, the City onginally required that Lots #1
and 922 sham a single driveway and curb -cut on 188th Street SW and dw it not exceed 30
feet in width. The applicant objected to this requirement based on the fact that Lot #2 is
developed and the shared accessway could create difficult= in the development of Lot #1.
As part of the solution to this problem and disagreement, the Hearing Examiner instructed
the City and the applicant to provide additional information with regard to this issue
13 The proposed plat has been designed to minimize potential adverse impacts to the
natural environmenL These unpacts have been addressed in the MDNS. included in the
impacts will be reduction of a number of existing trees on site for the development of the
plaL The trees which will be eliminated have been identified in the arborist's report and
include hazardous trees. Plans call. for the retention of healthy trees and provide for
additional planting of trees in area that will be cleared.
14. The lot layout design has been done. pursuant to the requirements and
considerations as dictated by the ECDC.
15. The applicant has entered into an agreement with the Public Works Department of
the City of Edmonds with regard to a time schedule for installation of improvements.
Inspection fees have also been paid pursuant to the requirements of the ECDC.
16. The performance bonds in lieu of completing required improvements are the
discretion of the City.
17. The proposal is consistent with the Comprehensive Plan Designation of Low
Density Residential. It will result in lugh quality residential development while providing
low density improvements to the area.
18. The Planning Department of the City of Edmonds recommended approval of the
proposed project subject to conditions as set forth in the Staff Report (Exhibit A).
19. The applicant indicated that there are impacts that will result in the development
of the subject property. He further agreed that the conditions as imposed by the City in

its recommendation and the conditions of the Engineering Department adequately address
those impacts.
20. The applicant indicated that there may not be a need for a homeowners association
if there is not scperate ownership of the lots within the plaL He indicated that if the
ownership remains in the Developer, a maintenance covenant recorded with the property
would be filed.
21. A storm drainage system plan will be submitted by the applicant. It will include
an enclosed drainage system on 85th Place with a detention system. All structures within
the property will be tightlined to the storm drainage. The City indicated there would be
no problem with the storm drainage as proposed by the applicanL
CONCLUSION
1. 'Me application is for approval of a preliminary plat for the subdivision of
approximately 3.2 acres of property located at 8511 - 188th Street SW, Edmonds,
Washington. As part of the proposed development, the applicant requested a modification
of the side setback requirements for the east property line of proposed Loot #2 from a 10
foot setback to a 8 foot setback to accommodate an existing single family residence on that
lot.
2. The proposal has been reviewed pursuant to the requirements and criteria of ECDC
Chapter 20.75. With conditions, these are satisfied.
3. The proposal is consistent with the purposes of ECDC Chapter 20.75. It regulates
subdivision of land and promotes the public health, safety and general welfare in
accordance with State standards to prevent overcrowding of land. Further, it provides
adequate provisions of water, utilities, sewage, storm drainage, parks and recreation
spaces, and other public requirements. The proposed subdivision provides proper ingress
and egress. It also allows for the uniform monumenting of subdivisions and accurate legal
descriptions of the subdivided lots.
4. The proposal is consistent with the provisions of the Edmonds Comprehensive
Plan. It provides high quality residential development which is appropriate to the diverse
lifestyles of the Edmonds residents [ECDC 15.20.005(B)].
5. The proposal is consistent with the RS-12 zoning standards and requirements as set
forth in ECDC 16.20.030. '

6. Floodplain management issues are not applicable in this matter.
7. Ile . environmental impacts resulting from the proposed development were
adequately addressed in the SEPA deterininadon of this proposal. Ile MDNS is applicable
in this matter.
8. There is adequate lot and strwi layouts that identifies the st=ts within the proposed
subdivision.
9. Adequate sewage, water and other utilities are available to the site.
10. The proposed development will not be detrimental to the other properties in the
general vicinity.
11. The modification of the east property line to allow for an 8-foot setback instead of
a 10-foot site setback for Lot #2 is consistent with the criteria as set forth in ECDC 20.85.010.
Special circumstances exist for the allowance of this modification because of the existing structure
on Lot #2. In addition, this modification will not result in a qxxial. benefit to the applicant but
will allow for development of the site in a manner consistent with other properties in the area.
RECOMMENDATION
Based upon the preceding Findings of Facts and Conclusions of Law, and the testimony and
evidence submitted at the public hearing, and upon impressions of the Hearing Examiner's site
view, it is hereby recommended to the City Council of the City of Edmonds that the proposed
preliminary plat for the subdivision of the property at 8511 - 188th Street SW, Edmonds,
Washington into 10 single family building lots be approved, and that the modification of the
east property line from a minimum of a 10-foot setback to an 8-foot setback be approved. The
preliminary plat should be approved subject to the following conditions:
1 Ibis application is subject to the applicable requirements contained in the Edmonds
Community Development Code (EMC). It is the responsibility of the applicant to ensure
compliance with the various provisions contained in these ordinances.
2. The applicant shall comply with the "tree retention plan" as shown on Attachment
5 of the Staff Report.
